Abstract

One of the efforts made to prevent Kamtibmas disturbances by the Police is to conduct patrols, which are regulated in the Regulation of the Head of the Security Maintenance Agency of the National Police of the Republic of Indonesia Number 1 of 2017 concerning Patrols. This is important because it is an essential need for everyone in various aspects of life, and is free from all worries, threats, disturbances of kamtibmas. One of the triggers for kamtibmas disturbances is the wild racing action that occurred in Padang City. Research is descriptive analytical with a normative juridical approach supported by an empirical juridical approach. Based on the results of research and analysis obtained first, the effectiveness of the implementation of patrols by the Padang Police Traffic Unit in tackling wild racing has not been maximally proven until now there are still wild racing actions at several road points in Padang City. In addition, the actions of the Police only use repressive measures, namely fines based on traffic violations. Second, the obstacles encountered in the implementation of patrols by the Padang Police Traffic Unit in tackling wild racing include internal obstacles , namely the absence of a Special Unit that handles wild racing actions so that it is limited to control and disbandment, as well as the lack of personnel of the Padang Police Station considering the large number of illegal racing actors who often move around in holding wild racing actions. External constraints are the absence of integrated cameras with traffic units at road points that are used as wild racing actions so that patrols must still be carried out directly to areas prone to wild racing and betting culture among people who love speed racing and the absence of special facilities and places or racing arenas in Padang City.

Abstract

Pasal 5 ayat (1) Undang-Undang Nomor 11 Tahun 2011 tentang Sistem Peradilan Pidana Anak (UU SPPA), menentukan bahwa “Sistem Peradilan Pidana Anak wajib mengutamakan pendekatan keadilan Restoratif. Anak merupakan aset bangsa sebagai bagian dari generasi muda yang berperan strategis dalam kemajuan suatu bangsa. Pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif, dengan melakukan penelitian terhadap aturan-aturan hukum tentang devrsi. Didukung pendekatan yuridis empiris, dengan melakukan penelitian untuk melihat bekerjanya aturan-aturan hukum tersebut dalam prakteknya di Kejaksaan Negeri Sawahlunto. Berdasarkan hasil penelitian dan pembahasan diperoleh bahwa pelaksanaan diversi terhadap anak yang berkonflik dengan hukum oleh Kejaksaan Negeri Sawahlunto mempengaruhi implementasi Peraturan Jaksa Agung RI No. 006/A/J.A/2015 tentang Pedoman Pelaksanaan Diversi Terhadap Anak Pada Tingkat Penuntutan yaitu : 1) Jaksa Anak tidak bisa bertindak sendiri karena dalam Undang-Undang Sistem Peradilan Pidana Anak mewajibkan melibatkan banyak pihak, 2) Tidak semua kejaksaan negeri, dan cabang kejaksaan negeri yang memiliki Jaksa yang memiliki Pendidikan dan pelatihan dalam penyelesaian perkara anak, 3. Tidak semua kejaksaan negeri, dan cabang kejaksaan negeri memiliki RKA untuk musyawarah diversi perkara anak, 4) Pihak yang hadir ada yang belum  paham mengenai ketentuan UU SPPA, 5)  Masih banyak Masyarakat berpendapat bahwa terhadap anak yang berhasil dilakukan diversi berdampak buruk bagi lingkungan masyarakat. Pertimbangan jaksa dalam putusan diversi terhadap anak yang berkonflik dengan hukum  Diversi terhadap anak yang berkonflik dengan hukum di masa mendatang bekerja secara efektif maka harus berpedoman pada petunjuk teknis pelaksanaan diversi pada tingkat penuntutan yang mengacu pada 9 (sembilan) tahapan proses palaksanaan Diversi sesuai dengan Peraturan Jaksa Agung Republik Indonesia Nomor : PER-006/A/J.A/04/2015 tentang Pedoman Pelaksanaan Diversi pada Tingkat Penuntutan, yaitu:1) Penunjukan Penuritut Umum, 2) Koordinasi, 3) Upaya Diversi, 4) Musyawarah Diversi, 5) Kesepakatan Diversi, 6) Pelaksanaan Kesepakatan Diversi, 7) Pengawasan dan Pelaporan Kesepakatan Diversi, 8) Penerbitan Surat Ketetapan  Penghentian Penuntutan, 9) Registrasi Diversi.

Abstract

Pasal 2 Peraturan Kapolri No 8 Tahun 2021, tentang Penanganan Tindak Pidana Berdasarkan Restorative Justice. Penelitian ini merupakan penelitian hukum dengan spesifikasi yang bersifat deskriptif analitis. Penyelesaian tindak pidana penipuan dengan mediasi penal pada tahap penyidikan oleh Satreskrim Polresta Padang adalah dengan cara adanya penyesalan serta itikat baik tersangka untuk menyelesaikan hal ini secara kekeluargaan dimana penyidik Polresta Padang selaku penengah. Tersangka menyanggupi untuk mengembalikan kerugian korban dalam waktu tertentu. Ketika sudah ditunaikan tersangka maka korban bersedia mencabut laporan polisi atas kasus tersebut. Efisiensi penyelesaian tindak pidana penipuan pada tahap penyidikan dengan mediasi penal oleh Satreskrim Polresta Padang terhadap pengulangan tindak pidana adalah tidak efesien. Hal ini terlihat dari tingkat pengulangan Tindak pidana penipuan yang terjadi di wilayah hukum Satreskrim Polresta Padang.

Abstract

Petugas Humas Polri dalam menjalankan kewajiban memberikan informasi secara transparan, dengan mengacu pada Pasal 7 Undang-undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik (KIP), dan Pasal 4 Peraturan Komisi Informasi Nomor 1 Tahun 2010 tentang Standar Layanan Informasi Publik. Penelitian  ini merupakan penelitian hukum dengan spesifikasi yang bersifat deskriptif analitis. Bentuk penggunaan media sosial oleh Bidang Hubungan Masyarakat Polda Sumbar dalam upaya penanggulangan kejahatan  berupa Kerja sama dengan berbagai media masa, sosialisasi. Mengadakan program memberikan akses informasi kepada masyarakat dengan cara memberikan himbauan fakta/informasi yang benar melalui media sosial seperti instagram, youtube, twitter, facebook, dan website. Humas Polda Sumbar memiliki media sosial khusus berupa instagram dengan nama akun @humaspoldasumbar hal ini karena banyaknya masyarakat yang mempunyai akun instagram, sehingga masyarakat tahu informasi dan himbauan apa saja yang selalu diberikan melalui instagram. Selain instagram, Humas Polda Sumbar juga memliki akun Twitter/X yakni Humas Polda Sumbar@SumbarHumas, akun Facebook dengan nama Humas Polda Sumbar, dan akun TikTok yakni humas polda sumbar. Kendala dalam penggunaan media sosial oleh Bidang Hubungan Masyarakat Polda Sumbar dalam upaya penanggulangan kejahatan adalah Penggunaan Terminologi, dalam redaksional suatu berita tentang kejahatan yang kurang pantas untuk dimuat. Pemberitaan yang sering tidak berimbang atau dalam istilah jurnalistik dikenal dengan cover both side Pemberitaan yang menghakimi. Kurangnya sarana liputan. Media dalam peliputan tugas kehumasan di Polda Sumbar disebut-sebut masih rendah, semisal camera, video trone dan link. Personel ahli dalam bidang humas. Secara umum, bidang humas Polda sumbar memiliki tenaga yang terampil dan berkualitas, namun tidak semua bagian dapat dianggap memiliki kualitas yang sama.

Abstract

Tindak pidana poliandri diatur dalam Pasal KUHP. Penelitian ini merupakan penelitian hukum dengan spesifikasi yang bersifat deskriptif analitis. Penerapan Pidana Terhadap Pelaku Poliandri Pada Putusan Nomor 3/Pid.B/2021/PN Cag hakim memutuskan bahwa terdakwa dinyatakan tidak bersalah, hal ini disebabkan karena tidak terpenuhinya salah satu unsur dari Pasal 279 ayat (1) KUHP Yakni pada unsur mengadakan perkawinan. Sementara pada perkara dengan putusan nomor 45/Pid.B/2022/Pn Pol majelis kahim mengeluarkan putusan Terdakwa terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana “Melangsungkan perkawinan yang diketahuinya perkawinan tersebut menjadi penghalang yang sah” Menjatuhkan pidana kepada Terdakwa dengan pidana penjara selama 4 (empat) bulan. Pertimbangan Hakim Dalam Menjatuhkan Pidana Terhadap Pelaku Poliandri Pada Putusan Nomor 3/Pid.B/2021/PN Cag secara subyektif tidak diketemukan hal-hal yang membuat Terdakwa lepas dari tanggung jawab apabila terbukti dalam persidangan. Kemudian pada perkara putusan nomor 45/Pid.B/2022/Pn Pol, yang menjadi subjek hukum in casu adalah seorang Perempuan berusia 23 tahun di mana merupakan usia sudah dianggap cakap hukum. Unsur Obyektif, yakni unsur mengadakan perkawinan. Maksud dari “mengadakan perkawinan” pada perkara nomor putusan 3/Pid.B/2021/Pn Cag pada unsur “mengadakan perkawinan” dinyatakan tidak terpenuhi, majelis hakim menimbang bahwa sahnya perkawinan ditentukan oleh hukum agama dan kepercayaan masing-masing. Pada perkara putusan nomor 45/Pid.B/2022/Pn Pol, sebelum Terdakwa melangsungkan pernikahan tersebut dengan Saksi Ahmad Yusuf Alias Yusuf Bin Mansur, Terdakwa mengetahui bahwa Terdakwa masih terikat hubungan suami istri yang sah dengan Saksi Sudirman Alias Dirman Bin Husain dan masih dalam proses perceraian di Pengadilan Agama Polewali, dengan demikian unsur “mengadakan perkawinan padahal mengetahui bahwa perkawinan atau perkawinan-perkawinannya yang telah ada menjadi penghalang yang sah untuk itu” menurut Majelis Hakim telah terpenuhi.

Abstract

Prostitution has been an enduring phenomenon in Indonesia for an extended period of time. Prostitution is the sale of human beings for financial gain, among other motives. The jurisdiction over prostitution in Padang is transferred to the Padang City Satpol PP, as stipulated in Chapter 1, Article 1 of the Regional Regulation of the City of Padang Number 11 of 2005 pertaining to General Provisions. Several issues can be deduced from the preceding description, including the following: What is the function of the Satpol PP in overseeing clandestine prostitution at karaoke establishments in Padang City? Furthermore, what challenges does Satpol PP face when attempting to regulate clandestine prostitution in Padang City's karaoke establishments? The study employs a sociological juridical methodology. Both primary and secondary data are utilised. Methods of data collection include document analysis and interviews. The data underwent qualitative analysis. The findings of the study indicate that effective control by Satpol PP is contingent upon the proper operation of nightly patrols, regulations, and stringent measures implemented by Satpol PP. Two factors impeded the Padang City Satpol PP's ability to control karaoke: internal constraints, such as raid information leaks, and external obstacles, such as the large number of TNI personnel who own karaoke and the protection it receives from other officials, which prevented the Satpol PP from conducting policing.

Abstract

Rape is a crime that causes trauma to the victim, besides the trauma of rape can also cause pregnancy in the victim. Pregnancy from rape behavior is certainly a pregnancy that the victim did not expect, so that not a few have abortions for their pregnancies. This study aims to determine the legal protection for abortion perpetrators who are rape victims. This study uses a normative legal research method with a normative juridical approach, while data collection techniques are carried out by exploring journals, books and applicable laws and regulations. The results of the study show that legal protection for abortion victims of rape is with the policy of Article 76 of the Health Law which considers the condition of rape victims so as to allow abortion with certain conditions stated in the law in it.

Abstract

The implementation of medical rehabilitation and social rehabilitation for addicts and victims of drug abuse by the National Narcotics Agency of Payakumbuh City is for drug addicts who are undergoing judicial proceedings can be placed in medical rehabilitation institutions and / or social rehabilitation. For addicts, both those caught and those through the IPWL program, before rehabilitation is carried out, they will first go through an assessment carried out by an integrated assessment team.  In addition to medical treatment and/or rehabilitation, healing of drug addicts can be organized by government agencies or the community through religious and traditional approaches. The obstacle faced by the Payakumbuh City National Narcotics Agency in the implementation of medical rehabilitation and social rehabilitation of addicts and victims of drug abuse is that the recommendation letter of the integrated assessment team consisting of the medical team and the legal team is only a recommendation. Rehabilitation places in each area have not been fulfilled (none). Weak coordination between law enforcement, health services and social services. Optimization of the implementation of medical rehabilitation and social rehabilitation for addicts and victims of drug abuse at the National Narcotics Agency Payakumbuh City is carried out with counseling, supervision and monitoring, carried out so that victims of narcotics abuse do not return to using narcotics under any conditions by checking periodically for 4 months after completing rehabilitation at BNNK Payakumbuh. Optimization is measured from the results of the rehabilitation and the number of people who participate in rehabilitationRehabilitation participants then no one repeats. This shows that the implementation of rehabilitation has been optimal.

Abstract

The South Coast Police Crime Squad conducted an investigation into the crime of carrying out plantation activities without ministerial permission in forest areas. The difficulty of the South Coast Police Detective Investigator is to implement 'Elements in forest areas'. This happened because of the unclear boundaries of the National Park forest area. In the investigation process, the Investigator applied the provisions of Article 17 paragraph (2) letter b Juncto Article 92 paragraph (1) letter a of Law Number 18 of 2013 concerning the Prevention and Eradication of Forest Destruction as Police Report Number:  LP/25/A/II/2019/ Res-Pessel dated February 12, 2019. The application of the elements of the criminal act of clearing plantation land in the National Park area consists of subjective elements and objective elements. The subjective element is a person, then what is meant by everyone in this article is the perpetrator as a person who can account  for his actions and the objective element is that his actions are unlawful, namely: "Elements intentionally, elements carrying out plantation activities,  elements without the permission of the Minister and elements dnature forest area". According to investigators, the suspect's actions have fulfilled the formulation and elements of Article 17 paragraph (2) letter b Juncto Article 92 paragraph (1) letter a of Law Number 18 of 2013.
