Abstract

Gender discrimination against women remains a serious issue in Indonesia, both in public and domestic spheres. Although various legal instruments guarantee equality, social practices still reflect unequal treatment, marginalization, and gender-based violence. This study aims to analyze the forms of discrimination experienced by women and to evaluate the effectiveness of legal protection provided by the state. The research applies a normative juridical method with statutory and conceptual approaches. Primary legal materials include the 1945 Constitution, Law No. 7 of 1984 on the Ratification of CEDAW, and Law No. 23 of 2004 on the Elimination of Domestic Violence, while secondary materials are obtained from legal literature and academic journals related to gender equality. The findings show that although Indonesia’s legal framework recognizes the principle of equality, its implementation is still hindered by patriarchal culture, low legal awareness, and weak law enforcement. Affirmative policies, improved capacity of law enforcers, and active community participation are needed to create effective and fair legal protection for women.

Abstract

Penelitian ini mengkaji pengaruh penerapan sistem e-court terhadap percepatan proses hukum acara pidana di Indonesia. Isu hukum yang menjadi fokus dari penelitian ini adalah lambatnya penyelesaian perkara pidana dalam sistem peradilan hukum acara pidana, yang menyebabkan terhambatnya penegakan keadilan dan berdampak negatif terhadap kepercayaan masyarakat pada lembaga peradilan. Permasalahan yang dikaji adalah bagaimana e-court dapat meningkatkan kecepatan proses hukum acara pidana dan mengapa sistem digital ini penting untuk diimplementasikan dalam konteks peradilan pidana di Indonesia yang masih menghadapi berbagai keterbatasan administrasi manual. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan yuridis normatif, menggabungkan studi dokumen yang meliputi peraturan perundang-undangan terkait e-court dan hukum acara pidana. Hasil penelitian menunjukkan bahwa penerapan e-court secara signifikan mempercepat tahapan proses hukum acara pidana, terutama dalam hal pengajuan permohonan, penyampaian dokumen, dan pemberitahuan sidang secara elektronik. Selain meningkatkan efisiensi administrasi, e-court juga memberikan transparansi lebih besar, meminimalkan potensi penyalahgunaan waktu, dan memudahkan akses para pihak yang terlibat dalam perkara.

Abstract

A considerable number of Indonesians are encountering challenges within their households. In 2023, 6,480 (or 79%) of the 8,234 reported KDRT cases to Komnas Perempuan and its affiliates occurred within the premises of the tangga house. As of 3.221 inside, the kerasan in the staircase of the house has attained its maximum capacity. This research aims to elucidate the origins and impacts of violence within Indonesian households, specifically focusing on the behaviors of the perpetrator and their family members, interpreting the underlying causes of the issue, and examining the perceptions shaped by the relevant perspective, along with the perpetrator's insights regarding the repercussions of the problem. The present study employs both conceptual and normative-legal sources of information. The study's findings indicate that the violence occurring within the household staircase can consist of various sources. The theoretical framework concerning social isolation, control, resources, and ecosystems is readily comprehensible due to several reasons discussed herein. The use of violence by perpetrators, whether through bare hands or other instruments, has the potential to be exacerbated by physical aggression occurring in proximity to the residence, potentially surpassing the severity of the violence within the home itself. Injury or even death may result from the occurrence of violence within the staircase house.

Abstract

As time goes on, the conditions and lifestyle of children deteriorate because, as far as they can tell, the world and society are causing problems for children. In 2021, 8.43% of children and adults reported sexual dysfunction, and by 2024, that number had risen to 8.82%. This research aims to analyze, describe, and illustrate the legal protections afforded to parents and children who become victims of sexual abuse and other forms of violence. This type of research is normative, employing conceptual frameworks and principles. The results of this study indicate that legal protection against women and children who are victims of sexual violence is regulated in the 1945 Constitution, Criminal Code, Law 39/1999, Law 35/2014, Law 11/2012, Perppu 17/2016, Law 12/2022, Law 23/2004, Law 16/2011, Law 13/2006, Law 26/2000 and in the implementation of legal protection against women and children who are victims of sexual violence there are several obstacles faced, these obstacles come from law enforcement factors that do not carry out their obligations according to existing regulations, lack of facilities for victims, factors from the victims themselves who have a fear of reporting, and lack of attention from the community.

Abstract

The power of social media lies in its ability to harness the collective intelligence of its users by actively involving them and soliciting their input from diverse groups. The use of social media for public relations purposes can have unintended consequences if not handled with care. Analysing, describing, and illustrating the negative effects of social media on minors as well as efforts to counteract these effects are the primary goals of this research. This study takes a conceptual approach to research, making it normative. First, the negative effects of social media on children include stunted development, health problems, increased risk of criminal behaviour and cyberbullying, impaired language skills, and unhealthy comparisons with others. Second, teacher educators can do their part to mitigate the negative effects of social media on youth by banning smartphone use in the classroom, parents can set limits on when and how much time their children can spend on social media, policymakers can take action through legislation and outreach, and members of the community can work together to make their neighbourhoods safer and healthier for teens.

Abstract

This article examines the factors causing children to become victims of domestic violence (DV) and the state's responsibility in protecting children's rights. The legal issue raised is the lack of legal protection for child victims of domestic violence and how law enforcement and state policies are not yet optimal in preventing and addressing these cases. The aim of this study is to identify the factors contributing to violence against children within households and evaluate the role of the state in prevention and child protection efforts. The methodology used is literature review with a normative juridical approach by analyzing relevant laws and case studies from official reports. The results show that economic factors, low parental education, and patriarchal culture are the main causes, while the state's efforts remain insufficient to comprehensively tackle this issue.

Abstract

Violence against women and children is a serious problem that still occurs in Indonesia, despite regulations designed to protect these vulnerable groups. Law No. 23/2004 on the Elimination of Domestic Violence (PKDRT) and Law No. 35/2014 on Child Protection provide a strong legal foundation, but their implementation often faces challenges. The main legal issue in this study is how the implementation of laws on the protection of women and children can be effective in preventing violence, and what factors influence this effectiveness. This paper aims to analyze the application of the law and identify obstacles in its implementation. The method used in this research is the normative juridical method, by analyzing relevant legislation. The results show that although the law on the protection of women and children is available, its implementation is still constrained by a lack of socialization, low law enforcement, and cultural barriers that prevent victims from reporting. Therefore, improvements are needed in the implementation of the law to make it more responsive and effective in protecting women and children from violence.

Abstract

Violence is an act against someone, especially women, which results in physical, sexual, psychological misery or suffering and domestic neglect. Domestic violence is a social phenomenon that has been going on for a long time in some households in Indonesia. The impacts resulting from these acts of violence produce psychological impacts on women who are victims of domestic violence, for example victims feel anxious, afraid, depressed, always alert, constantly imagine seeing similar cases, often daydreaming, moody, crying easily, having difficulty sleeping, and even having nightmares. . Victims lose confidence to act because they feel helpless, lose interest in taking care of themselves, and lose courage in expressing opinions and acting. The aim of this research is to find out how effective legal protection is for women who are victims of domestic violence, and what the obstacles are. The analysis of legal materials used in this research is an analytical perspective which is a type of normative research, by finding legal rules, legal principles and legal doctrines by examining library materials or secondary data.

Abstract

This article analyzes the influence of patriarchal culture on domestic violence (KDRT) against women in Indonesia, particularly in the economic context. The study argues that patriarchal culture creates gender inequality that disadvantages women, limiting their access to education, employment, and economic resources, making them vulnerable to exploitation and violence. Women’s economic dependence on men, coupled with social norms that demand women’s obedience and acceptance of mistreatment, creates a vicious cycle that is difficult to break. The article also discusses the economic impact of KDRT on women, as well as the difficulties in accessing justice for victims of KDRT, which are influenced by patriarchal culture.

Abstract

The problem of abandoned children has become problem that never ends. A neglected child is a child who does not receive proper care, protection and nurturing, both physically, mentally and socially. Child neglect occurs due to the inability of family or guardians carry out their obligations in the process of fulfilling children's rights. The impact of child neglect is that children often drop out of school, get involved in child labor, and end up in situations of neglect. in child labor, and end up in dangerous situations such as violence and exploitation. This research aims to find out, analyze, and describe the legal protection of neglected children in terms of Law No. 35 of 2014 concerning Amendments to Law No. 23 of 2002 concerning Child Protection and government efforts to fulfill the rights of neglected children. The research method uses juridical law normative and using a statutory approach. Research results The results show that the state guarantees and provides legal protection related to the rights of neglected children through Law Number 35 Year 2014 Regarding the Amendment to Law Number 23 Year 2002 Regarding Child Protection and the government make various efforts to ensure the fulfillment of children's rights, including neglected children.
