Abstract

The main objective of this research is to examine the concept of justice in labor law which has developed in the context of the post-modern era as marked by rapid social and technological changes and a more inclusive view of justice. By using normative research, researchers will conduct an in-depth analysis of relevant literature on the philosophy of justice, labor law, and postmodernism as part of primary and secondary legal materials. The data collection process will involve a thorough literature review, analysis of legal texts, and examination of related documents and articles from reliable sources. The differentiation of this study from other studies is its comprehensive analytical approach to understanding justice in labor law and its focus on changes and adaptations that occur in the post-modern era. these findings will explain the concept of justice in the workplace that has adapted to the challenges of the times. In addition, this study aims to identify obstacles and opportunities in building a fair, diverse and efficient employment system for all stakeholders. By paying attention to social dynamics, technology, and postmodern values, researchers hope that labor law can be more responsive and flexible in maintaining a sense of justice and the balance of power between employers and workers.

Abstract

This research examines the ethical and legal implications of deploying Artificial Intelligence (AI) systems in law enforcement, with a particular focus on potential human rights violations in Indonesia. Utilizing a normative analysis approach, the study evaluates existing ethical frameworks, legal principles, and human rights standards to assess the governance and implications of AI-driven policing. Key findings indicate significant ethical concerns, including bias, discrimination, lack of transparency, and privacy violations. The legal analysis reveals gaps in Indonesia’s regulatory framework, highlighting the need for specific legislation to address AI’s complexities. Human rights implications, such as threats to privacy, freedom of expression, and equality, are critically analyzed. Comparative case studies from other jurisdictions provide empirical insights and underscore the importance of robust ethical and legal frameworks. The research proposes several recommendations, including the establishment of clear ethical guidelines, strengthening legal frameworks, enhancing transparency and accountability, promoting public engagement, and conducting regular impact assessments to ensure responsible AI governance in law enforcement. This study aims to contribute to the development of ethical AI governance frameworks and inform policy recommendations for responsible AI deployment in law enforcement practices.

Abstract

This study employs bibliometric analysis to explore the expansive field of data privacy and security, utilizing data extracted from VOSviewer to identify thematic clusters, discern research trends, evaluate research opportunities, and analyze author collaboration networks. The analysis reveals several key thematic areas, including data security, legal frameworks, information privacy, and technological challenges associated with big data. These themes have evolved over time, demonstrating a shift from foundational legal principles to addressing complex technological and demographic-specific challenges, such as those related to children's data privacy. The study highlights significant concentrations of research activity as well as less explored areas that offer new opportunities for research, such as the legal status of data and specific privacy concerns that are under-represented in current literature. Furthermore, the author collaboration network provides insights into the structure of the research community, showing both dense clusters of collaboration and potential for new entrants to establish niches in emerging topics. This bibliometric perspective not only elucidates the current landscape of data privacy and security research but also points to future directions that can enhance the field's development.

Abstract

Penelitian ini menyelidiki pengaruh sertifikasi Halal, pemasaran produk Halal, dan kepuasan konsumen terhadap pertumbuhan industri Halal di Indonesia melalui analisis kuantitatif. Sampel sebanyak 175 responden yang mewakili konsumen dan pemangku kepentingan industri berpartisipasi dalam penelitian ini. Structural Equation Modeling (SEM) dengan Partial Least Squares (PLS) digunakan untuk menganalisis data. Hasil penelitian menunjukkan efek positif yang signifikan dari sertifikasi Halal, pemasaran produk Halal, dan kepuasan konsumen terhadap pertumbuhan industri. Sertifikasi halal berfungsi sebagai mekanisme jaminan kualitas, sementara strategi pemasaran yang efektif dan kepuasan konsumen berkontribusi pada perluasan pasar dan daya saing. Temuan ini memiliki implikasi bagi pelaku usaha, pembuat kebijakan, dan pemangku kepentingan yang bertujuan untuk mendorong pengembangan industri dan meningkatkan daya saing di pasar Halal Indonesia.

Abstract

Undang-Undang Pokok Agraria (UUPA) dirancang untuk menciptakan distribusi tanah yang adil, namun implementasinya menghadapi berbagai tantangan, termasuk ketimpangan penguasaan tanah. Penelitian ini bertujuan untuk menganalisis asas keadilan dalam UUPA melalui perspektif hukum Islam, dengan fokus pada kesesuaian prinsip-prinsip keadilan distributif dan keberlanjutan. Metode penelitian yang digunakan adalah studi kepustakaan, dengan pendekatan deskriptif-analitis terhadap dokumen hukum nasional dan sumber hukum Islam. Hasil penelitian menunjukkan bahwa hukum Islam menawarkan pendekatan holistik yang dapat memperkuat asas keadilan dalam UUPA melalui pembatasan penguasaan tanah dan distribusi sumber daya yang lebih merata. Penelitian ini memberikan kontribusi dalam mengintegrasikan nilai-nilai hukum Islam ke dalam kebijakan agraria nasional untuk menciptakan pengelolaan tanah yang lebih inklusif dan berkeadilan.

Abstract

AbstractThis study examines the implementation of competition law regulation and enforcement in Indonesia through a comparative legal approach with Malaysia and Thailand. The research focuses on identifying both similarities and significant differences in regulatory frameworks, institutional authority, and enforcement mechanisms in fostering fair and competitive business environments. This study employs normative legal research using a comparative law approach, based on the analysis of statutory regulations and competition law enforcement practices in the three countries. The findings indicate that Indonesia, Malaysia, and Thailand have adopted modern competition law regimes that prohibit anti-competitive agreements and the abuse of dominant positions, while entrusting enforcement to independent competition authorities. Nevertheless, notable differences remain in terms of institutional structure, scope of authority, and enforcement effectiveness, which influence the level of competition protection in each jurisdiction. Accordingly, regulatory strengthening and policy adjustments in competition law enforcement are essential for Indonesia to enhance fair and effective market competition.AbstrakPenelitian ini menganalisis penerapan regulasi dan penegakan hukum persaingan usaha di Indonesia melalui pendekatan perbandingan hukum dengan Malaysia dan Thailand. Kajian ini berfokus pada persamaan dan perbedaan substansial dalam kerangka regulasi, kewenangan lembaga persaingan usaha, serta mekanisme penegakan hukum dalam menciptakan iklim persaingan usaha yang adil dan kompetitif. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perbandingan hukum yang didasarkan pada analisis peraturan perundang-undangan dan praktik penegakan hukum persaingan usaha di ketiga negara. Hasil penelitian menunjukkan bahwa Indonesia, Malaysia, dan Thailand sama-sama mengadopsi model hukum persaingan usaha modern, melarang perjanjian anti persaingan dan penyalahgunaan posisi dominan, serta menugaskan lembaga independen sebagai penegak hukum persaingan. Namun demikian, terdapat perbedaan signifikan dalam aspek kelembagaan, cakupan kewenangan, dan efektivitas penegakan hukum yang berdampak pada perlindungan persaingan usaha. Oleh karena itu, penguatan regulasi dan penyesuaian kebijakan penegakan hukum menjadi penting bagi Indonesia.
