Abstract

Law No. 3 of 2022 on the National Capital, as amended by Law No. 21 of 2023, has sparked legal and academic debates, particularly regarding its constitutionality. Despite six judicial review petitions in the Constitutional Court, the Special Regional Government of Nusantara Capital (Pemdasus Ibu Kota Nusantara) has not been comprehensively assessed. This study examines its constitutionality based on the 1945 Constitution (UUD 1945), global practices, and Constitutional Court rulings, focusing on three key issues: the nomenclature of Nusantara Capital, the status and leadership appointment of the Nusantara Capital Authority, and the absence of a Regional People's Representative Council (DPRD). Using a juridical-normative approach, this study analyzes UUD 1945, the National Capital Law, Constitutional Court decisions, and academic literature. The findings highlight three main points. First, Nusantara’s nomenclature aligns with Article 18B(1) of UUD 1945, which recognizes special regions. Second, the status and leadership appointment mechanism of the Nusantara Capital Authority do not violate Article 18(4), as confirmed in Constitutional Court Decision No. 11/PUU-IV/2008. Third, the absence of a DPRD is constitutionally valid since special regions allow institutional variations, as affirmed in Constitutional Court Decisions No. 81/PUU-VIII/2010 and No. 11/PUU-IV/2008. In conclusion, Nusantara’s governance is constitutionally grounded in Article 18B(1) of UUD 1945 and relevant Constitutional Court rulings. Its flexible institutional design remains valid as long as it is legally established.

Abstract

Pemberdayaan kelompok penyandang disabilitas dalam bidang ekonomi perlu dilakukan guna meningkatkan taraf hidup dan ketahanan ekonomi kelompok penyandang disabilitas. Hal ini sebagai langkah untuk memberikan wadah kepada kelompok penyandang disabilitas dalam menjalankan kegiatan ekonomi. Maka dari itu diperlukan pembentukan koperasi bagi penyandang disabilitas sebagai wadah bagi kelompok penyandang dalam menjalankan kegiatan ekonomi dan juga sebagai sarana untuk konektivitas penyandang disabilitas. Berdasarkan penjelasan tersebut maka Tim Pengabdi melaksanakan kegiatan pengabdian kepada masyarakat yang bertujuan membentuk koperasi perkumpulan penyandang disabilitas yang nantinya koperasi tersebut dapat digunakan untuk meningkatkan perekonomian dan konektivitas penyandang disabilitas. Metode yang digunakan dalam kegiatan pengabdian ini yaitu tim melakukan dalam 3 (tiga) tahap, yakni tahap persiapan, tahap pelaksanaan, dan tahap monitoring. Hasil dari pengabdian ini yaitu Tim Pengabdi membantu kelompok penyandang disabilitas membentuk badan usaha koperasi dan juga memberikan penyuluhan materi terkait cara pengelolaan koperasi yang baik dan benar. Selain itu Tim Pengabdi juga memberikan best practice kepada peserta terkait dengan pengelolaan koperasi.

Abstract

Dalam konteks globalisasi penangkapan ikan secara ilegal (illegal fishing) telah menjadi suatu tantangan yang sangat serius dalam pengelolaan perikanan di Indonesia maupun di dunia Internasional. Sebagai negara kepulauan dengan kekayaan sumber daya laut yang sangat melimpah, Indonesia secara konsisten berupaya untuk melindungi keberlanjutan ekosistem lautnya dari praktik illegal fishing. Meskipun demikian, praktik illegal fishing sendiri terus mengancam dari adanya keberlanjutan sumber daya perikanan dan merugikan nelayan yang beroperasi secara legal. Tujuan kami dalam pembuatan artikel ini adalah untuk memberikan solusi terkait penegakkan hukum laut Indonesia dari ancaman tindakan illegal fishing. Dalam pembuatan artikel ini kami menggunakan metode kualitatif deskriptif dengan teknik studi literatur dengan menghimpun sumber-sumber yang berasal dari jurnal, buku, dan artikel yang ada di internet. Melalui penulisan artikel ini kami berharap dapat merealisasikan tujuan kami dalam memberikan kontribusi terkait solusi penegakkan hukum laut di Indonesia.

Abstract

Recently, populist policies have increasingly been adopted by public officials to enhance their political image, including education-related policies issued by the Governor of West Java, which subsequently sparked criticism from various stakeholders. Therefore, this study aims to examine the policy of sending “problematic” students to military barracks through the lens of development law and a responsive, socially just conception of national defense (bela negara). This research employs a normative juridical method using a scientific approach that includes the statute approach and the conceptual approach. The findings of this study indicate that the policy of sending students to military barracks requires thorough legal examination to ensure that its legal objectives are clear and do not violate human rights. This is particularly important as not all members of society agree with such a policy; the aim of national defense is not the militarization of children but the internalization of Pancasila values and moral discipline. Thus, sending students to military barracks does not automatically align with the concept of national defense when the measures implemented are coercive, discriminatory, and unsupported by psychological and pedagogical educational principles. Furthermore, this policy is inconsistent with the characteristics of responsive development law, which prioritizes the protection of vulnerable groups and emphasizes social justice. A comprehensive evaluation of this policy is therefore necessary, taking into account sociological, legal, and human rights perspectives, as well as educational and rehabilitative approaches.

Abstract

Artikel ini menganalisis peran hukum sebagai alat rekayasa sosial (law as a tool for social engineering) dalam konteks transisi energi di Indonesia, dengan fokus pada pengembangan energi matahari sebagai sumber energi terbarukan strategis. Di tengah komitmen nasional mencapai Net Zero Emission (NZE) pada tahun 2060, Indonesia dihadapkan pada tantangan struktural berupa ketergantungan historis terhadap energi fosil, ketidakkonsistenan regulasi, serta lemahnya partisipasi publik dalam pengambilan kebijakan energi. Dengan menggunakan kerangka Sociological Jurisprudence dari Roscoe Pound, penelitian ini mengkaji bagaimana hukum energi difungsikan untuk menyeimbangkan kepentingan umum (keamanan dan stabilitas energi), kepentingan sosial (perlindungan lingkungan hidup), dan kepentingan individu (hak dan kesejahteraan masyarakat). Penelitian ini menggunakan pendekatan yuridis-empiris melalui analisis peraturan perundang-undangan serta studi kasus pengembangan PLTS Terapung Cirata dan dinamika regulasi PLTS Atap, yang kemudian dibandingkan dengan praktik partisipatif berbasis komunitas pada model Desa Energi Berdikari Keliki. Temuan penelitian menunjukkan adanya paradoks dalam hukum energi Indonesia: di satu sisi hukum berperan sebagai akselerator pembangunan infrastruktur energi surya berskala besar melalui pendekatan teknokratis dan sentralistik, namun di sisi lain mengalami disfungsi dalam merekayasa perubahan perilaku masyarakat akibat penghapusan insentif ekonomi serta degradasi prinsip partisipasi bermakna pasca berlakunya Undang-Undang Cipta Kerja. Artikel ini merekomendasikan rekonstruksi kebijakan energi yang menempatkan partisipasi publik dan keadilan transisi sebagai elemen utama, guna memastikan hukum berfungsi efektif sebagai instrumen transformasi sosial menuju energi bersih yang berkelanjutan.

Abstract

This study examines the elements of business conspiracy and the effectiveness of administrative sanctions imposed by the Indonesian Competition Commission (KPPU) in Decision Number 08/KPPU-L/2024, as well as compares them with the United States Antitrust Law framework. The research is motivated by the limited deterrent effect and lack of legal certainty for victims of unfair business competition in Indonesia, particularly in conspiracy cases causing substantial losses. This study employs a normative juridical method using statutory, case, and comparative approaches by analyzing Law Number 5 of 1999 and its implementing regulations alongside the Sherman Act, Clayton Act, and the Federal Trade Commission Act. The findings reveal that all elements of business conspiracy in Decision 08/KPPU-L/2024 were legally established; however, the administrative sanctions imposed were disproportionate to the losses incurred, did not include individual liability, and failed to provide direct restitution mechanisms for injured parties. Consequently, administrative sanctions have not functioned effectively as deterrence and legal protection instruments. The novelty of this study lies in its comparative analysis, positioning private enforcement and victim restitution under U.S. Antitrust Law as benchmarks for strengthening Indonesia’s administrative sanction regime. This study recommends enhancing KPPU’s authority, extending sanctions to both corporations and individuals, and establishing clear restitution mechanisms to ensure legal certainty and substantive justice in competition law enforcement.   Penelitian ini menganalisis unsur persekongkolan usaha dan efektivitas penerapan sanksi administratif oleh Komisi Pengawas Persaingan Usaha (KPPU) dalam Putusan Nomor 08/KPPU-L/2024, serta membandingkannya dengan rezim Antitrust Law Amerika Serikat. Penelitian ini dilatarbelakangi oleh masih lemahnya efek jera dan ketidakpastian hukum bagi korban praktik persaingan usaha tidak sehat di Indonesia, khususnya dalam perkara persekongkolan yang menimbulkan kerugian signifikan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, kasus, dan perbandingan melalui analisis Undang-Undang Nomor 5 Tahun 1999, peraturan pelaksananya, serta Sherman Act, Clayton Act, dan Federal Trade Commission Act. Hasil penelitian menunjukkan bahwa seluruh unsur persekongkolan usaha dalam Putusan 08/KPPU-L/2024 telah terpenuhi secara sah, namun penjatuhan sanksi administratif berupa denda dinilai tidak proporsional dengan kerugian yang ditimbulkan, tidak disertai sanksi terhadap individu pelaku, serta tidak memberikan mekanisme pemulihan langsung bagi pihak yang dirugikan. Kondisi ini menyebabkan tujuan sanksi administratif sebagai instrumen efek jera dan perlindungan hukum belum tercapai secara optimal. Kebaruan penelitian ini terletak pada analisis komparatif yang menempatkan private enforcement dan restitusi korban dalam Antitrust Law Amerika Serikat sebagai tolok ukur untuk memperkuat sistem sanksi administratif di Indonesia. Penelitian ini merekomendasikan penguatan kewenangan KPPU, pengenaan sanksi terhadap korporasi dan individu, serta perumusan mekanisme restitusi langsung guna mewujudkan kepastian hukum dan keadilan substantif dalam penegakan hukum persaingan usaha.

Abstract

The lack of harmonization in regulations governing internship programs in Indonesia has led to ambiguity regarding the legal status of interns, resulting in weak legal protection and the absence of fair compensation standards, thereby potentially giving rise to disguised employment. Based on an analysis using the theories of justice of Gustav Radbruch, John Rawls, and the Critical Legal Studies (CLS) perspective, it was found that the existing regulations, namely Minister of Manpower Regulation No. 6 of 2020, Minister of Education, Culture, Research, and Technology Regulation No. 63 of 2024, and Minister of Manpower Regulation No. 8 of 2025, still overlap and have not established clear compensation standards. This situation contradicts the principles of justice as fairness and substantive justice because it disregards the economic rights of interns. Therefore, a Presidential Regulation (Perpres) is needed as a legal umbrella to unify inter-ministerial provisions and establish National Compensation Standards Based on the Minimum Wage (UMP), with a scheme of 25% of the UMP for curricular internships, 40% for non-curricular internships, and 50% for fresh graduates, in order to realize a fair, adaptive, and legally certain internship system.

Abstract

Tulisan ini membahas kewajiban negara Indonesia dalam menjamin pemerataan akses energi terbarukan di wilayah 3T sebagai bagian integral dari pemenuhan hak atas pembangunan, hak atas lingkungan hidup yang baik, serta hak-hak dasar lainnya. Latar belakang penelitian didasarkan pada meningkatnya urgensi transisi energi dan ketimpangan struktural yang menyebabkan masyarakat 3T tertinggal dalam pemenuhan kebutuhan energi. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta analisis bahan hukum melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa energi terbarukan memiliki karakter sebagai enabling right yang memungkinkan terpenuhinya hak-hak fundamental seperti pendidikan, kesehatan, dan standar hidup layak, sehingga negara berkewajiban untuk menghindari diskriminasi akses energi melalui kebijakan afirmatif dan kerangka regulasi yang kuat. Selain itu, penelitian menemukan bahwa model pertanggungjawaban negara idealnya mencakup prinsip obligation to respect, protect, and fulfil, standar due diligence, mekanisme pengawasan dan pengaduan yang efektif, serta partisipasi masyarakat dalam perumusan kebijakan energi. Kesimpulannya, pemerataan energi terbarukan di wilayah 3T merupakan mandat konstitusional dan kewajiban HAM yang hanya dapat dipenuhi melalui model pertanggungjawaban negara yang komprehensif, partisipatif, dan berorientasi pada keadilan energi.

Abstract

Kasepuhan Karang is one of the Sundanese indigenous communities located in the Lebak Regency, Banten Province, Indonesia. This community is part of a network of kasepuhan around the Gunung Halimun Salak National Park (TNGHS). Their lives are closely related to environmental sustainability, especially in the management of customary forests. The social and cultural systems of the Kasepuhan Karang community reflect harmony between humans and nature. These values are reflected in customary traditions such as ngaseuk (planting), customary spatial planning that divides the area into restricted forests, production forests, and agricultural land, as well as tatali paranti (customary rules) that serve as guidelines for maintaining ecosystem sustainability. This study focuses on the importance of the Kasepuhan Karang Customary Forest in the context of environmental conservation and climate change mitigation. In addition, this study will identify the main challenges faced in preserving customary forests, including policy aspects, cross-sectoral understanding, and external pressures that threaten their sustainability. By prioritizing the perspective of indigenous peoples as the primary managers of the forest, this study aims to provide an overview of how synergy between local traditions and modern policies can be realized to support sustainable development.

Abstract

Social justice constitutes a fundamental principle embedded in the Fifth Precept of Pancasila and the Preamble to the 1945 Constitution of the Republic of Indonesia, positioning it as both a legal ideal and a guiding orientation for national development. This study examines the conceptual position of social justice as the objective of Indonesia's development law and evaluates the extent to which this principle is reflected in the National Medium-Term Development Plan (RPJMN) 20252029. Employing a normative juridical method with conceptual and statutory approaches, this research analyzes the integration of social-justice values into development policies articulated in the RPJMN. The findings reveal that, conceptually, social justice is affirmed as a central objective of Indonesia's development law, consistent with Mochtar Kusumaatmadja's Development Law Theory. The RPJMN 20252029 demonstrates partial incorporation of social-justice principles through its eight national priorities, particularly those emphasizing equitable development outcomes, the eradication of extreme poverty, and the development of distributive infrastructure. Nonetheless, key challenges remain in regulatory harmonization and evaluation mechanisms, which have not fully employed social-justice benchmarks. This study contributes to the existing scholarship by proposing the adoption of a social justice impact assessment as a mandatory component in development planning documents and advocating for strengthened inter-institutional coordination in implementing distributive justice-oriented development policies.
