Abstract

Pemberdayaan kelompok penyandang disabilitas dalam bidang ekonomi perlu dilakukan guna meningkatkan taraf hidup dan ketahanan ekonomi kelompok penyandang disabilitas. Hal ini sebagai langkah untuk memberikan wadah kepada kelompok penyandang disabilitas dalam menjalankan kegiatan ekonomi. Maka dari itu diperlukan pembentukan koperasi bagi penyandang disabilitas sebagai wadah bagi kelompok penyandang dalam menjalankan kegiatan ekonomi dan juga sebagai sarana untuk konektivitas penyandang disabilitas. Berdasarkan penjelasan tersebut maka Tim Pengabdi melaksanakan kegiatan pengabdian kepada masyarakat yang bertujuan membentuk koperasi perkumpulan penyandang disabilitas yang nantinya koperasi tersebut dapat digunakan untuk meningkatkan perekonomian dan konektivitas penyandang disabilitas. Metode yang digunakan dalam kegiatan pengabdian ini yaitu tim melakukan dalam 3 (tiga) tahap, yakni tahap persiapan, tahap pelaksanaan, dan tahap monitoring. Hasil dari pengabdian ini yaitu Tim Pengabdi membantu kelompok penyandang disabilitas membentuk badan usaha koperasi dan juga memberikan penyuluhan materi terkait cara pengelolaan koperasi yang baik dan benar. Selain itu Tim Pengabdi juga memberikan best practice kepada peserta terkait dengan pengelolaan koperasi.

Abstract

Seluruh dunia sepakat bahwa dalam menunjang pembangunan yang berkelanjutan harus mematuhi daripada 17 poin dari sustainable development goals yang mana salah satu dari poin tersebut adalah poin 14 yang meyakini adanya keberlanjutan dalam ekosistem laut. Nelayan menjadi salah satu hal yang mendukung blue economy. Namun dalam hal perlindungannya belum memadai dengan tidak adanya pengaturan perlindungan pada tingkat daerah lewat Peraturan Daerah sebagaimana diamanatkan lewat UU No. 7 Tahun 2016 tentang Perlindungan dan Pemberdayaan Nelayan, pembudi Daya Ikan, dan Petambak Garam, terutama di daerah Majakarta, Kabupaten Indramayu, Jawa Barat. Penelitian ini bertujuan untuk mengetahui bagaimana pengaturan ideal mengenai perlindungan dan pendanaan nelayan di Kabupaten Indramayu karena belum adanya pengaturan pada tingkat Perda dalam hal perlindungannya. Metode yang digunakan dalam penelitian ini adalah yuridis empiris dengan pendekatan perundang-undangan, pendekatan komparasi, dan pendekatan konseptual. Dalam menentukan konsep perlindungan dan pendanaan dalam teknis Peraturan Daerah belum diatur secara konteks kedaerahan. Terlebih dalam tingkat peraturan daaerah di Kabupaten Indramayu belum mengakomodasi terkait dengan perlindungan nelayan secara komprehensif. Dengan demikian diperlukan adanya pengaturan lebih lanjut dalam tingkat peraturan daerah dengan mengedepankan peran aktif nelayan dalam mengakses pendanaan di pemerintah daerah kabupaten agar mendapatkan perlindungan hukum yang lebih kuat.

Abstract

Studi ini mengulas penularan Human Immunodeficiency Virus (HIV) pada anak akibat kekerasan seksual, menggunakan pendekatan kualitatif dengan dasar analisis data kuantitatif. Desain penelitian ini dipilih untuk mendalami isu tersebut, dengan sumber data kuantitatif dari Badan Pusat Statistik (BPS) dan situs web Kementerian terkait. Temuan studi menunjukkan hubungan antara kekerasan seksual dan peningkatan penularan HIV pada anak, terutama melalui kontak seksual. Kondisi fisik yang belum matang membuat anak lebih rentan terhadap penyakit menular seperti HIV. Upaya pemerintah untuk menanggulangi penularan HIV atau Acquired Immuno Deficiency Syndrome (AIDS)  melibatkan regulasi, kampanye pencegahan, tes HIV, program Antiretroviral Therapy (ART), dukungan psikososial, dan peningkatan akses ke layanan kesehatan bagi anak-anak yang terkena HIV/AIDS.

Abstract

Climate change presents an urgent global challenge, prompting countries to adopt emission reduction strategies in accordance with the Paris Agreement. One such strategy is the implementation of a carbon tax to reduce greenhouse gas emissions and promote sustainable development. Indonesia and Singapore, as signatories to the Paris Agreement, have both introduced carbon pricing policies with differing legal and institutional frameworks. This study analyzes and compares the carbon tax regulations in Indonesia and Singapore to evaluate their alignment with climate commitments and identify practical lessons for Indonesia. The objective of this research is to examine the carbon tax regulations in both countries and identify aspects of Singapore's carbon tax policy that could serve as a lesson for Indonesia in formulating a more effective policy. This study employs a normative juridical method with a comparative approach and a statutory approach. The findings indicate that Indonesia’s carbon tax, introduced through Law Number 7 of 2021, represents an initial step toward achieving national climate targets. However, the policy is still limited in scope and lacks certainty in rate progression, coordination between institutions, and enforcement mechanisms. Conversely, Singapore’s Carbon Pricing Act 2018 provides a more structured and transparent system. It includes specific emission thresholds, gradually increasing tax rates, centralized reporting, and strict enforcement backed by legal sanctions. Therefore, Indonesia can draw lessons from Singapore in terms of policy design, institutional framework. These include establishing a clear carbon tax roadmap, improving inter-agency coordination, developing a centralized monitoring and reporting platform, and implementing firm sanctions for non-compliance.

Abstract

This article is about the implementation of the principles of non-refoulement related to refugee protection in Indonesia, the problem is that Indonesia still has not ratified the 1951 convention and the 1967 additional protocol, this has an impact on refugees who come to Indonesia. The purpose of this article is to see how the implementation of the principles of non-refoulement in Indonesian legislation, then to analyze the challenges and dynamics of refugees in Indonesia. The method used in this article is normative method, the type of analysis used is qualitative, the type of this article is library research. Then the results of this article found that the complexity of global problems related to refugees requires serious attention from the international community. Although Indonesia has not ratified the 1951 Convention and 1967 Protocol, the commitment to protect and assist refugees remains a focus to fulfill international responsibilities. The principle of non-refoulement is one of the foundations of refugee protection that prohibits forced return. Although Indonesia already has a national legal framework related to refugee protection, the implementation of the principle of non-refoulement needs to be analyzed more deeply. This article is important because it provides a deeper understanding of the challenges and steps that can be taken to improve refugee protection in Indonesia. This paper fills the knowledge gap regarding the implementation of the principle of non-refoulement in Indonesia and is expected to provide suggestions and recommendations to improve the protection and implementation of the principle of non-refoulement of refugees in Indonesia.

Abstract

In the development of information and technology, there are motion marks circulating in Indonesia in the trade of goods or services. In fact, the moving brand has not received legal protection because moving brands are not regulated as one of the signs regulated in Law Number 20 Year 2016 on Trademarks and Geographical Indications (Trademark Act) so that there is a legal vacuum and a motion marks can not be applied for registration which results in the absence of legal certainty for the community, but other Southeast Asian countries such as Singapore have protected motion marks. It is important to be considered by Indonesia, given the existence of free trade in the Southeast Asian region, namely the ASEAN Free Trade Area (AFTA). This research uses normative juridical research method that analyses the legislation with literature study using comparative and conceptual approaches and analysed with descriptive analytical legal materials. The results of this study found that the regulation of the registration of motion marks in Indonesia is not regulated in the Trademark Act and the trademark registration application does not accommodate the registration of motion marks so that the registration of moving trademarks can not be filed in Indonesia and motion marks also do not get legal protection in Indonesia which results in legal uncertainty. If the motion marks in Indonesia get a legal protection and can be applied for registration, then the Trademark Act should be made changes related to the concept of the definition of trademark, the scope of the protected trademark, and trademark labels in the application for registration of trademarks so that the public get legal certainty related to the registration of motion marks.

Abstract

The rapid urbanization in Southeast Asia has posed significant challenges in providing adequate and affordable housing, particularly for vulnerable urban groups. This article analyzes a comparative study of public housing policies in Jakarta and Singapore from the perspective of international law on the right to adequate and inclusive housing. Using a normative comparative method with a qualitative-descriptive approach, this study examines the effectiveness of each country’s housing policy based on Article 25 of the Universal Declaration of Human Rights (UDHR), Article 11 of the International Covenant on Economic, Social, and Cultural Rights (ICESCR), and General Comment No. 4 of the Committee on Economic, Social and Cultural Rights (CESCR). The findings reveal that Singapore, through its Housing and Development Board (HDB), successfully implements an inclusive public housing system with comprehensive subsidies and without discrimination based on marital status or employment type. Conversely, public housing policies in Jakarta remain exclusive due to strict administrative requirements that limit access for single individuals and informal workers. This article recommends reforming Jakarta’s public housing policies by relaxing discriminatory requirements and establishing a national public housing authority to ensure fair, inclusive, and internationally compliant housing access for all citizens.

Abstract

The principle of non-intervention is the main foundation in international relations that affirms the prohibition of interference by other countries in the domestic affairs of a country. However, increasingly complex global dynamics, especially related to the increasing humanitarian crises such as genocide, ethnic cleansing, and systematic human rights violations have raised serious challenges to the absolutism of the principle. This article aims to analyze how the principle of non-intervention is normatively reinterpreted in the practices and actions of the United Nations (UN), especially through the Responsibility to Protect (R2P) doctrine. Using a juridical-normative approach and case studies of interventions in Rwanda, Kosovo, and Syria, this study reveals a shift in the meaning of non-intervention from an absolute prohibition to a limited allowance for humanitarian protection. This finding confirms that in conditions of extreme humanitarian crises, the legitimacy of international action is not only measured by state sovereignty, but also by the moral and international legal obligations to protect civilians. The UN, as a multilateral actor, plays a key role in balancing the principle of non-intervention with humanitarian imperatives, thus giving rise to dynamic and contextual normative reinterpretations.

Abstract

This research is prepared with the aim of assisting the national interests of Indonesia by examining legal protection for the environment and gender equality in the context of the expansion of the economy resulting from the implementation of a free-trade agreement. Considering the situation in the ICA-CEPA negotiations, where Canada demands that Indonesia commit to legal protection for the environment and gender equality in the context of the FTA before the agreement can be ratified, and considering that there is no juridical research examining Indonesia's commitments in these relevant issues, it becomes urgent to conduct this research to support the country in obtaining its national interests in ICA-CEPA. This research uses the juridical-normative research method with a statute approach and employs the legal material collection method of literature study as well as the qualitative analysis method. The research findings show that Indonesia has legal protection for the environment in the context of the FTA through the ISPO mechanism and provisions in the IE-CEPA. Regarding gender equality, Indonesia has legal protection through its membership in CEDAW and various applicable national legal instruments, as well as through cooperation with EFTA in women's entrepreneurship. The lack of knowledge (research gap) regarding the law creates an urgency for this research to fill that gap and help Indonesia. Here lies the novelty of the research, namely in complementing previous research to answer unanswered questions. Penelitian ini disusun dengan tujuan untuk membantu kepentingan nasional Indonesia dengan mengkaji perlindungan hukum terhadap Lingkungan dan Kesetaraan Gender dalam konteks perluasan ekomomi hasil dari berlakunya suatu Free-Trade Agreement. Mengingat bahwa situasi dalam negosiasi ICA-CEPA, dimana Kanada menuntut Indonesia untuk memiliki komitmen hukum terlebih dahulu terhadap perlindungan lingkungan dan kesetaraan gender dalam konteks FTA agar perjanjian dapat disahkan, dan menimbang bahwa belum ada Penelitian Yuridis yang mengkaji komitmen Indonesia dalam isu yang relevan tersebut, maka hal ini menjadi urgensi dalam penyusunan penelitian ini agar dapat mendukung Negara memperoleh Kepentingan Nasional-nya dalam ICA-CEPA. Penelitian ini menggunakan Metode Penelitian Yuridis-Normatif dengan Pendekatan Statute Approach dan menggunakan Metode Pengumpulan Materi Hukum Studi Pustaka serta Metode Analisis Kualitatif. Hasil penelitian menunjukkan bahwa Indonesia telah memiliki perlindungan hukum untuk lingkungan dalam konteks FTA melalui mekanisme ISPO dan ketentuan dalam IE-CEPA. Mengenai kesetaraan gender, Indonesia memiliki perlindungan hukum melalui keanggotaannya dalam CEDAW dan dengan berbagai instrumen hukum nasional yang berlaku, serta melalui kerja sama dengan EFTA dalam kewirausahaan perempuan. Adanya kekosongan ilmu pengetahuan (research gap) tentang hukum,menimbulkan urgensi bagi penelitian ini untuk mengisi kekosongan tersebut, guna membantu Indonesia. Disinilah letak kebaruan penelitian, yaitu dalam melengkapi penelitian sebelumnya untuk menjawab pertanyaan yang belum terjawab.

Abstract

This research aims to examine the clause of the choice of law and forum in Indonesian grant agreement to foreign government based on Government Regulation 48 of 2018 as amended by Government Regulation 57 of 2019 (Grant Regulation). Issues frequently arise arise in grant agreements, specifically grant recipients' rejection of these clauses, which impedes grant implementation. The grant has a purpose as a tool of diplomacy, which is a form of public relations. In contrast, the grant agreements within the Grant Regulation contradictorily possess characteristics of civil relations due to the obligation to include the choice of law, the national law of the Republic of Indonesia, and the choice of forum in the Central Jakarta District Court. This research introduces novelty by presenting a perspective hitherto unexplored in previous studies. Most prior research has predominantly focused on the urgency of Indonesian grants before enacting the Grant Regulation, with no specific study dedicated to examining grant agreements regulated by this regulation. The research findings conclude that there needs to be more consistency between the objectives of the grant and the nature of the agreements stipulated in the Grant Regulation. Therefore, adjustments to the provisions of the Grant Regulation are deemed necessary transforming the substansce of grant agreement from civil relations to public relations by incorporating the choice of law and forum clauses in the grant agreements by the provisions applicable in international law. Penelitian ini bertujuan untuk mengkaji ketentuan klausul pilihan hukum dan pilihan forum dalam perjanjian hibah Indonesia kepada Pemerintah Asing berdasarkan Peraturan Pemerintah Nomor 48 Tahun 2018 sebagaimana diubah dengan PP Nomor 57 Tahun 2019 (PP Hibah). Permasalahan yang seringkali muncul terkait perjanjian hibah adalah penolakan oleh penerima hibah terhadap klausul tersebut, yang pada akhirnya menghambat kelancaran proses hibah. Hibah Indonesia berfungsi sebagai alat diplomasi yang memiliki karakteristik hubungan publik, sementara perjanjian hibah dalam PP Hibah memiliki karakteristik yang kontradiktif yakni hubungan perdata dengan adanya kewajiban perjanjian yang memuat pilihan hukum, hukum nasional Republik Indonesia, dan tempat penyelesaian sengketa di PN Jakarta Pusat. Penelitian ini memiliki kebaruan karena menghadirkan perspektif yang belum pernah dibahas oleh penelitian terdahulu. Sebagian besar penelitian terdahulu hanya membahas urgensi hibah Indonesia sebelum adanya PP Hibah, dan belum ada penelitian yang secara khusus mengkaji perjanjian hibah yang diatur dalam PP Hibah. Hasil penelitian menyimpulkan bahwa terdapat ketidaksesuaian antara tujuan hibah dengan sifat perjanjian yang diatur dalam PP Hibah. Oleh karena itu, diperlukan penyesuaian terhadap ketentuan PP Hibah dengan mengubah substansi sifat perjanjian hibah menjadi hubungan publik dengan menggunakan klausul pilihan hukum dan pilihan forum dalam perjanjian hibah sesuai ketentuan yang berlaku di hukum internasional.
