Abstract

Penelitian ini mengkaji praktik gratifikasi dalam sistem peradilan Indonesia melalui studi kasus putusan bebas Gregorius Ronald Tannur yang melibatkan tiga hakim Pengadilan Negeri Surabaya pada tahun 2024 dan perkembangannya hingga 2026. Penelitian menggunakan metode penelitian hukum normatif dengan pendekatan kualitatif, menganalisis ketentuan Pasal 12B dan Pasal 12C Undang-Undang Nomor 20 Tahun 2001 dalam perspektif Teori Gabungan Pemidanaan. Hasil penelitian menunjukkan bahwa ketiga hakim terbukti menerima gratifikasi sebesar Rp4,67 miliar yang memenuhi seluruh unsur tindak pidana korupsi. Perkembangan penegakan hukum hingga akhir 2025 memperlihatkan adanya pertanggungjawaban pidana terhadap seluruh pihak yang terlibat, termasuk hakim, pengacara, dan pemberi gratifikasi. Analisis Teori Gabungan menunjukkan bahwa putusan-putusan tersebut telah mencerminkan tujuan pemidanaan berupa pembalasan, pencegahan, dan perlindungan masyarakat. Penelitian ini menyimpulkan bahwa pencegahan gratifikasi di lingkungan peradilan memerlukan penguatan pengawasan, peningkatan integritas hakim, serta penerapan sanksi yang tegas guna menjaga independensi dan kepercayaan publik terhadap lembaga peradilan.

Abstract

General Elections (Pemilu) are a means of implementing the sovereignty of the people as stipulated in the 1945 Constitution of the Republic of Indonesia, which is carried out directly, publicly, freely, confidentially, honestly, and fairly. One of the main challenges in organizing elections is maintaining the neutrality of the State Civil Apparatus (ASN), which is legally prohibited from engaging in practical politics. The neutrality of ASN is a serious concern because their non-neutrality can affect the integrity of the election process and reduce public confidence in the results obtained. In the context of the 2024 Election, the role of the General Election Supervisory Agency (Bawaslu) of Palangka Raya City is very important in ensuring the neutrality of ASN. This study aims to analyze the role of the Election Supervisory Agency (Bawaslu) of Palangka Raya City in maintaining ASN neutrality during the 2024 Election and to examine the supervision strategy implemented to handle violations of ASN neutrality. Through systematic monitoring, strict law enforcement, and socialization of the importance of ASN neutrality, it is hoped that Bawaslu can ensure the holding of fair and democratic elections.

Abstract

This study aims to analyze the application of civil law related to default in land sale and purchase through a case study of Decision No. 119/Pdt.G/2024/PN Palangkaraya. This study uses a normative legal method with a case study approach, where the primary data used are court decisions and secondary data in the form of laws and regulations and related legal literature. The main findings of this study indicate that the defendant has committed default by not fulfilling his obligations in changing the name of the Land Ownership Certificate, which resulted in losses for the plaintiff. The court decided to grant the plaintiff the right to take care of the name change independently, thus providing effective legal protection for consumers. The contribution of this study lies in an in-depth analysis of the implications of the decision on consumer protection in land sale and purchase transactions. This study enriches the discourse on consumer protection by highlighting the importance of strong law enforcement and simpler administrative procedures to prevent similar disputes in the future. In addition, this study provides a new perspective on the court's role in strengthening consumer legal protection in land disputes.

Abstract

This research discusses the implementation of criminal law enforcement against the abuse of voting rights based on Law Number 7 of 2017 and the obstacles faced by the Palangka Raya City Election Supervisory Board (Bawaslu) in the 2024 elections. Using an empirical juridical method thru literature study and interviews, the research found that Bawaslu has handled cases of vote misuse, including double voting by two students, thru the Gakkumdu Center mechanism in accordance with legal procedures. However, the effectiveness of law enforcement is still hindered by time constraints in handling cases, a lack of evidence, low public legal awareness, and suboptimal support in technology and budget for training and political education. This research emphasizes the importance of strengthening institutional capacity, budgetary support, enhancing monitoring technology, and community participation to make election oversight and law enforcement more effective and integrity-driven.

Abstract

Penelitian ini mengkaji permasalahan struktural dalam sistem pembentukan peraturan perundang-undangan di Indonesia, dengan fokus pada tahapan pra-legislasi sebelum pembahasan Rancangan Undang-Undang (RUU) di Dewan Perwakilan Rakyat (DPR). Dalam praktiknya, proses pembentukan regulasi pada tahap awal meliputi pembulatan konsepsi, harmonisasi, dan evaluasi yang melibatkan berbagai kementerian dan lembaga negara dengan kewenangan yang tersebar dan tidak terintegrasi. Kondisi tersebut menimbulkan fragmentasi kewenangan yang berdampak pada lemahnya pengendalian kualitas legislasi sejak tahap awal pembentukannya. Fragmentasi ini semakin diperparah oleh penerapan prinsip kehati-hatian oleh masing-masing lembaga, yang mendorong setiap institusi untuk berfokus pada tugas pokok dan fungsi normatifnya masing-masing, sehingga membatasi intervensi lintas sektor dan menyebabkan tidak adanya lembaga yang memiliki kewenangan final terhadap kualitas substansi RUU. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual, melalui analisis terhadap peraturan pembentukan peraturan perundang-undangan, doktrin hukum, serta studi perbandingan kelembagaan. Hasil penelitian menunjukkan bahwa mekanisme harmonisasi regulasi yang saat ini dijalankan oleh berbagai lembaga masih bersifat koordinatif dan administratif, sehingga belum mampu menjamin konsistensi norma, kepastian hukum, dan efektivitas kebijakan secara optimal. Oleh karena itu, pembentukan Badan Regulasi Nasional sebagai lembaga terpusat dengan mandat pengendalian kualitas regulasi, termasuk perencanaan, harmonisasi substantif, evaluasi, serta penerapan regulatory impact assessment, merupakan solusi guna mewujudkan sistem legislasi nasional yang terintegrasi, efisien, dan selaras dengan prinsip good regulatory governance.

Abstract

This research delves into the asymmetry of rights and obligations between parking operators and consumers arising from the inclusion of exoneration clauses that absolve operators from accountability for vehicle loss or damage. The primary objective of this inquiry is to scrutinize the legitimacy of such clauses through the lens of the principle of contractual autonomy and the Consumer Protection Act, as well as to elucidate their implications for the legal standing of individuals utilizing parking facilities. This research uses a normative legal method and considers both statutory and conceptual approaches to investigate key legal documents such as the Civil Code and Law No. 8 of 1999 regarding Consumer Protection. The findings reveal that exoneration clauses inscribed on parking tickets lack juridical justification, as they contravene Article 18 of the Consumer Protection Law and engender an inequitable contractual relationship between the parties. These clauses weaken the consumer’s position by eliminating the right to compensation and contradict the principle of the deposit agreement, which requires operators to maintain the security of consumers’ vehicles.

Abstract

Kratom is an endemic plant originating from Southeast Asia that grows wild in Thailand, Malaysia, Vietnam, the Philippines, and Papua New Guinea. In Indonesia, this plant is predominantly found in Kalimantan. An examination of the legal underpinnings for the prohibition of kratom constitutes the primary objective of this study, alongside a determination of whether kratom warrants classification as a Schedule I narcotic. The research adopts a normative juridical methodology, operationalized through a statutory approach and substantiated by peer-reviewed scientific journals and authoritative instruments promulgated by competent institutions. The results indicate that, to date, there is no specific regulation governing kratom (Mitragyna speciosa) under Law Number 35 of 2009 on Narcotics; therefore, kratom has not been classified as a narcotic subject to criminal sanctions. The existing legal basis related to kratom remains limited to the Circular Letter of the Head of the National Agency of Drug and Food Control (BPOM) issued in 2016, which prohibits the use of kratom in traditional medicines and health supplements. The conclusion of this study is that the use of kratom in Central Kalimantan cannot yet be subjected to criminal provisions under Law Number 35 of 2009 on Narcotics, due to the absence of explicit regulation concerning kratom in the law and the fact that the existing legal framework is still limited to administrative policies issued by BPOM.

Abstract

This article presents a comparative analysis of the application of restorative justice principles within the criminal justice systems of Japan and Indonesia. Employing a normative juridical method with a comparative, statutory, and conceptual approach, the study explores how each country integrates restorative practices into their legal frameworks. Japan applies restorative justice informally through culturally rooted mechanisms such as chōtei (community mediation), shazai (apology), and baishō (compensation), emphasizing social harmony without explicit codification. In contrast, Indonesia adopts a formal legal approach through various regulations, including Law No. 11 of 2012 and the Attorney General of the Republic of Indonesia Regulation No. 15 of 2020. However, the Indonesian implementation remains limited to juvenile and minor offenses. Despite the existence of sectoral rules, the country lacks a comprehensive legal framework for general and adult crimes, leading to a normative vacuum and inconsistent enforcement across regions. To address this, the study proposes the development of a dedicated restorative justice law applicable across all categories of crime. This paper contributes to the discourse on building a more humanistic and justice-oriented criminal law system by advocating a contextually relevant restorative approach.

Abstract

Penerapan sistem tilang elektronik (Electronic Traffic Law Enforcement / ETLE) di Indonesia merupakan inovasi dalam penegakan hukum lalu lintas yang memanfaatkan teknologi informasi dengan tujuan meningkatkan efisiensi, akurasi, dan transparansi penindakan pelanggaran. Meskipun demikian, mekanisme penentuan pelanggar yang bertumpu pada data registrasi kendaraan menimbulkan persoalan hukum, khususnya ketika pelanggaran dilakukan oleh pihak yang bukan merupakan pemilik kendaraan. Artikel ini bertujuan untuk mengkaji pengaturan hukum positif di Indonesia terkait pelaksanaan ETLE serta menganalisis pertanggungjawaban hukum yang dibebankan kepada pemilik kendaraan dalam situasi tersebut. Penelitian ini menggunakan pendekatan yuridis normatif dengan telaah terhadap berbagai peraturan perundang-undangan, antara lain Undang-Undang Nomor 22 Tahun 2009, Peraturan Pemerintah Nomor 80 Tahun 2012, dan Peraturan Kepolisian Nomor 2 Tahun 2025. Hasil kajian menunjukkan adanya kekosongan pengaturan yang berpotensi bertentangan dengan prinsip fundamental hukum pidana, khususnya asas nulla poena sine culpa. Oleh karena itu, diperlukan pembaruan regulasi yang secara tegas dan komprehensif mengatur mekanisme pertanggungjawaban hukum yang berkeadilan, akuntabel, serta sejalan dengan prinsip-prinsip keadilan dalam hukum pidana
