Abstract

The case of cyanide-contaminated coffee involving Jessica Wongso in 2016 raised concerns and deep questions about the understanding of causality in Indonesian society. While the legal approach focused on proving that Jessica intentionally added cyanide to Mirna Salihin's coffee, the causality aspects in this case are complex and involve multidisciplinary sciences. Issues such as Jessica's motives, peculiarities in her actions, and claims that Mirna was not actually poisoned sparked public debates. Causality understanding was strengthened by forensic, toxicological, and psychological evidence, necessitating a multidisciplinary approach to combine legal, forensic, psychological, toxicological, and sociological perspectives. This research aims to comprehend causality in the context of this case from various angles for a more comprehensive understanding. The qualitative method was employed, utilizing theories of causality, forensic, and criminal psychology.The results, based on Article 340 of the Criminal Code regarding premeditated murder, showed that the legal approach required proving Jessica's intent to kill, planning the use of cyanide in coffee, and administering it to Mirna. Causality in the legal context involves the cause-and-effect relationship between Jessica's actions and Mirna's death, proven through autopsy results, forensic analysis, and witness testimonies. Toxicological and forensic medicine approaches ensured the scientific validity of evidence, while psychological and sociological perspectives provided insights into motives and the social context of the case. Consequently, in October 2016, Jessica Wongso was sentenced to 20 years in prison for premeditated murder, a decision upheld by the Jakarta High Court in April 2017.

Abstract

The murder of Wayan Mirna Salihin by her friend, Jessica Kumala Wongso, in 2016 was one of the most high-profile criminal cases in Indonesia. The case not only caused deep grief for the victim's family, but also had significant social implications. From a social perspective, the Mirna Salihin kopi case can be analyzed from various aspects, such as Social relations that The case shows that unhealthy social relations can be a trigger for criminal acts. In this case, Jessica is suspected of having a motive of revenge against Mirna because she felt betrayed by her; Gender That the case can also be seen as a form of violence against women. Jessica, as a woman, killed her own friend, who was also a woman. This shows that violence against women can be committed by anyone, including other women. Mass Media that played a key role in shaping public opinion on the case. Sensational and unbalanced media coverage can create negative stigma against Jessica and her family. The Mirna Salihin kopi case is a valuable lesson for Indonesian society. The case shows the importance of maintaining healthy social relations, preventing violence against women, and being wise in consuming information from mass media.

Abstract

In the cyanide coffee case of Jessica Wongso, Umberto Eco's lying theory can be applied to analyze Jessica's testimony. Based on Eco's theory of lies, lying is a complex form of communication that involves various factors, such as motivation, situation and ability to lie. Based on the available evidence, Jessica's testimony that she did not know that the coffee she gave Mirna contained cyanide is considered unreasonable. Such testimony can be considered a lie caused by several factors, such as a motivation to cover up a mistake, a desire to protect others, or an inability to remember the actual incident. The research paradigm is critical, with a qualitative research approach, which does not present specific measurements, but presents meanings from the analysis of the relationship between signs and other signs. This is in accordance with the semiotic research method, which links one sign to another to reach conclusions. The research results show that the analysis of the lie theory put forward by Umberto Eco and its application in the Cyanide Coffee case involving Jessica Wongso, can be seen how the concepts put forward by Eco can provide valuable insight in understanding the dynamics and complexity of the case. In this case, there are narrative elements constructed by the parties involved, including Jessica Wongso, the mass media and the general public. The use of strong narratives and persuasive rhetoric can influence public perception and understanding of the case. Furthermore, the concepts of play and manipulation in Eco's theory of lies are also relevant in the context of this case. There are allegations that Jessica Wongso played a role in the tragic death of Mirna Solihin by using coffee containing cyanide. Eco argues that lies and manipulation can be used to produce certain effects in communication. In this case, the alleged manipulation and games carried out by Jessica Wongso influenced the parties concerned. Apart from that, Eco's lie theory also highlights the importance of context and interpretation in understanding the truth. In this case, there are differences in interpretation and understanding between the parties involved, including Jessica Wongso, Mirna Solihin's family, and the public. The concept of multiple interpretations and subjectivity in understanding the truth can be seen as significant elements in this case.

Abstract

Abstrak Tujuan penelitian ini adalah untuk mengetahui prinsip kausalitas dalam hukum pidana diterapkan dalam kasus Jessica Wongso, di mana bukti langsung yang menghubungkan terdakwa dengan tindak pidana tidak tersedia secara jelas, untuk mengetahui dampak kasus Jessica Wongso terhadap diskusi publik mengenai standar pembuktian dan keadilan dalam sistem peradilan pidana, khususnya dalam kasus dengan bukti tidak langsung atau sirkumstansial. Metode penelitian yang digunakan adalah yuridis normatif (legal reasearch) melalui studi kepustakaan dengan pendekatan yuridis empiris (yuridis sosiologis) melalui studi lapangan yang bertujuan memperoleh pengetahuan hukum secara empiris. Hasil penelitian menunjukkan bahwa Dalam kasus Jessica Wongso, penerapan prinsip kausalitas dalam hukum pidana menghadapi tantangan unik karena kurangnya bukti langsung. Bukti sirkumstansial memainkan peran kunci, memungkinkan pengadilan untuk menyimpulkan hubungan sebab-akibat melalui analisis perilaku, motif, dan urutan peristiwa. Kasus ini menyoroti pentingnya interpretasi hukum dan standar pembuktian dalam kondisi ketidakpastian, serta menunjukkan dampak media dan opini publik dalam membentuk persepsi keadilan. Ini juga memicu diskusi yang lebih luas tentang perlunya reformasi dan keterbukaan dalam sistem hukum, khususnya dalam menangani kasus-kasus dengan bukti tidak langsung. Kasus Jessica Wongso berdampak signifikan terhadap diskusi publik mengenai standar pembuktian dan keadilan dalam sistem peradilan pidana. Hal ini memicu perdebatan tentang keandalan dan kecukupan bukti sirkumstansial dalam membuktikan kesalahan terdakwa, serta menyoroti pentingnya transparansi dan perlakuan yang adil. Kasus ini juga menunjukkan bagaimana media dan opini publik dapat mempengaruhi persepsi terhadap keadilan dan independensi sistem peradilan. Terakhir, kasus ini mendorong pertimbangan ulang tentang praktik hukum dan menunjukkan perlunya reformasi untuk memastikan proses hukum yang lebih adil dan objektif.

Abstract

Article 54 of Law No. 35 of 2009 concerning Narcotics, regarding drug rehabilitation, is an oppressive measure taken against drug addicts and victims of drug abuse. Police practices in Indonesia in making decisions with sanctions regarding the form of rehabilitation are very difficult and complex. The purpose of this study is to examine the effectiveness of the implementation of Article 54 of Law Number 35 of 2009 concerning Narcotics on the rehabilitation of drug addicts and victims of drug abuse. The research method used is the legal method and legal research specifications. Meanwhile, data analysis uses qualitative legal methods. The results of the study indicate that rehabilitation norms stipulated in Article 54 of the Republic of Indonesia Law No. 35 concerning drugs, according to questions about the circular letter from the Supreme Court (SEMA) No. 4 related to the placement of perpetrators of violence and victims of abuse in health and social organizations. Functional rehabilitation is higher than the penalty for imprisonment to reduce the number of finalists and increase the opportunity for social recovery for long-term drug addicts. Some positive effects of implementing Article 54: Increased ability to access rehabilitation and legal protection for drug addicts.

Abstract

Criminal law is a sub-section of law that creates peace and order in society, because the existence of criminal law in society cannot be separated from the state's efforts to create order. To determine the penalty for a criminal act, it is necessary to pay attention to the doctrine of cause and effect and evidence of the occurrence of the criminal act. For this reason, the aim of this research is to analyze the teachings of causality and evidence of the crime in the cyanide coffee case committed by the defendant Jessica Wongso against the victim Wayan Mirna Salihin in 2016. This research uses qualitative research methods. The data collection technique in this research uses the literature study method. The data that has been collected is then analyzed through three stages, namely data reduction, data presentation, and drawing conclusions. The research results show that the doctrine of causality is very important because it relates to which actions should be considered as the cause of prohibited effects. The judge assessed that Jessica's actions, namely putting cyanide poison in the coffee that Mirna drank, were the direct cause of Mirna's death. This decision was based on several considerations, namely the discovery of cyanide poison in Mirna's coffee, no one else had put cyanide poison in Mirna's coffee, and the defendant had a motive to kill the victim. In this case, the judge relied on witness testimony, expert testimony and evidence to prove Jessica's crime. Based on the teachings of causality and evidence, the judge sentenced Jessica as the defendant to 20 years in prison. This circumstantial evidence has given rise to much controversy. However, despite the controversy, the coffee cyanide case shows the importance of the teachings of causality and evidence of criminal acts in criminal law.

Abstract

This research aims to examine the concept of hybrid policing in the context of crime prevention, specifically cyber fraud in Sidrap Regency. This research uses an empirical legal research method. All collected data is then qualitatively analyzed to describe the problem and answer the research objectives. The results show that the characteristics of cyber fraud in Sidrap Regency exhibit anonymity and disregard for geographical boundaries, with the primary motivation of the perpetrators being personal gain. They employ fake identities and compromised devices to execute their schemes, exacerbated by technological advancements, the public’s lack of awareness, and existing regulatory gaps. Therefore, it is recommended that the POLRI renew and adapt their policing model to be more responsive to the dynamics of cybercrime by implementing a hybrid policing approach. This involves active collaboration with community organizations in prevention efforts, which are expected to increase public awareness and strengthen the cyber security network. Additionally, developing an effective knowledge management system is advised, facilitating the exchange of information and strategies for handling cybercrime cases more efficiently. For researchers, it is crucial to examine further the social and psychological impacts of cybercrime on victims, which can contribute to forming a theoretical and practical foundation for a more holistic and victim-oriented approach to preventing and handling cybercrime in Sidrap Regency.

Abstract

The concept of causality in criminal law is a fundamental element that determines the relationship between actions and consequences, which is essential in upholding criminal responsibility. The cyanide coffee poisoning case involving Jessica Wongso and Mirna Salihin highlights the complexity of applying the theory of causality, where the interaction between personal motives and actions leads to fatal consequences. This research aims to delve into the application of causality theory in criminal law in the case of cyanide-laced coffee poisoning involving Jessica Wongso and Mirna Salihin. The research method used is content analysis by referring to relevant literature sources related to causality theory in criminal law. The results of the study indicate that the concept of causality law becomes the main focus in determining criminal responsibility, where the importance of an action as a cause of a consequence that violates legal norms is the main concern in the analysis and assessment of the relevant actions. In the context of the cyanide-laced coffee poisoning case, the analysis of causality law using the Social Explanation method provides a deep understanding of the application of causality theory in criminal law. Thus, this research provides in-depth insights into the concept of causality in the realm of criminal law, especially in cases involving the infamous poisoning incident and cyanide elements.

Abstract

Human Rights (HAM) are rights inherent in every individual, including in the context of military health in the midst of armed conflict. This article reviews violations of International Criminal Law (HPI) that occur in conflict situations, such as murder, torture and forced labor. Protection of human rights in the midst of armed conflict is important, especially regarding access to adequate health services and freedom from treatment that violates human rights. Serious efforts are needed to ensure that military health does not violate human rights principles, so that the world community can maintain their dignity and human rights, even in the midst of conflict-ridden situations

Abstract

International legal protection of child soldiers in areas of armed conflict is a major concern on the global human rights agenda. The Convention on the Rights of the Child and the Additional Protocol on the Involvement of Children in Armed Conflict have provided an important legal framework in efforts to protect children from recruitment and use in armed conflict. However, implementation and enforcement of laws often face complex challenges, including non-compliance by parties involved in the conflict, social and economic factors, and limited legal and security institutional capacity in affected countries. Further research is needed to understand more deeply the dynamics and challenges in protecting children in areas of armed conflict and to develop more effective strategies in protecting their rights
