Abstract

Corporate punishment in the environmental aspect has not led to social justice based on Islamic law principles because of the lack of attention to the community as victims who suffer losses due to environmental pollution, which should be a life support. This study aimed to realize that social justice based on Islamic law principles incorporates punishment in environmental aspects for the future. This type of research uses a normative legal typology to approach the principles, systematics, and level of legal synchronization of legislation based on Islamic Law and Law No. 32 of 2009 concerning Environmental Protection and Management. Secondary data obtained through library studies were analyzed descriptively. The results show that the nature of corporate punishment in environmental aspects in Islamic Law aims to prevent corporations from repeating their actions, prevent other corporations from participating in environmental pollution, and foster corporations that have polluted the environment. Furthermore, the embodiment of social justice based on Islamic law principles incorporate punishment in the environmental aspect must contain the values of corporate culture and community development. Social justice is in line with the principle of the benefit of the people in Islamic Law, where each punishment contains aspects of paying attention to victims of crime.

Abstract

Cash Waqf in Islamic Banks for economic equality has become an essential topic in the legal framework regulated by Law Number 4 Year 2023 concerning the Development and Strengthening of the Financial Sector and Islamic Economic Law. Cash waqf in Islamic Banks provides a legal basis for raising funds needed to support economic equality, which aims for sustainable economic development. The purpose of this study is to explain Cash Waqf in Islamic Banks for economic equality, first, according to Law Number 4 Year 2023 concerning the Development and Strengthening of the Financial Sector and, second, according to Islamic Economic Law. The research method used normative juridical with a statute and conceptual approach, while the research specifications used descriptive analytical. The results of the study indicated that Law Number 4 Year 2023 provides a legal framework to support cash waqf in Islamic Banks by providing opportunities for them to become waqf nazirs. Then, this will support national economic equality in accordance with the objectives of waqf according to Islamic economic law. However, harmonization of regulations related to banks as cash waqf nazirs is needed.

Abstract

This library research focuses on books and literature as primary sources. It provides an overview of Indonesia's economic development from the perspective of sharia economic law philosophy and its application in DSN-MUI fatwas. Islamic economic philosophy is rooted in the Qur'an and Sunnah, which also guide DSN-MUI in formulating fatwas addressing economic issues. DSN-MUI plays a strategic role in developing sharia economic law to meet society's need for legal fatwas on economic activities, particularly in response to evolving product innovations.

Abstract

Perlindungan Hak Kekayaan Intelektual (HKI) di Indonesia masih menghadapi tantangan yang cukup besar, terutama dalam hal penegakan hukum dan kesadaran masyarakat. Dibandingkan dengan negara lain, regulasi HKI di Indonesia perlu diperkuat agar lebih efektif dalam melindungi hak intelektual. Untuk mengatasi masalah tersebut, diperlukan strategi yang komprehensif yang meliputi reformasi regulasi, peningkatan kapasitas aparat penegak hukum, edukasi publik, dan kerja sama internasional. Penelitian ini menerapkan metode yuridis normatif dengan menganalisis regulasi hukum terkait HKI di Indonesia dan negara lain. Data dikumpulkan melalui studi pustaka dari berbagai sumber, seperti jurnal akademik, buku, dan dokumen hukum yang relevan. Selain itu, digunakan pendekatan komparatif untuk mengevaluasi perbedaan dan persamaan regulasi HKI antara Indonesia dan negara lain. Hasil penelitian menunjukkan bahwa perlindungan HKI di Indonesia masih lemah, terutama dalam penegakan hukum dan kesadaran masyarakat. Untuk memperkuatnya, diperlukan reformasi regulasi, peningkatan kapasitas penegak hukum, edukasi publik, kerja sama internasional, dan insentif bagi inovator. Dengan langkah ini, Indonesia dapat menciptakan ekosistem HKI yang lebih kuat dan mendorong pertumbuhan ekonomi.

Abstract

Regional integration through ASEAN (Association of Southeast Asian Nations) Single Aviation Market (ASAM) is characterized by a complex landscape of opportunities and challenges for Indonesia, particularly considering its status as a vast archipelagic nation with intricate and evolving aviation needs. Therefore, this study aims to comprehensively analyze Indonesian position in ASAM, as well as identify any legal and institutional barriers to the implementation of the Open Sky Policy with a focus on regulatory harmonization in ASEAN aviation sector. It also aims to examine the extent to which domestic policies, specifically those protecting national airlines, interact with regional liberalization efforts. In order to achieve the stated objectives, a normative juridical approach was adopted, incorporating a conceptual and regulatory approach. The obtained results showed that the geographical characteristics of Indonesia, infrastructural disparities, and the tendency toward regulatory protectionism were the primary factors contributing to the caution in liberalizing the aviation market. Despite formal commitment to ASAM agreement, implementation in the field remains uneven due to sectoral interests and limited institutional capacity. Preventive and corrective efforts have been made through gradual policy reforms and bilateral agreements. However, the absence of a binding supranational authority was observed to significantly weaken the enforcement mechanism. Based on the observations made during the course of this exploration, an inference was made that Indonesia plays an essential but cautious role in ASAM, requiring strategic policy synchronization, infrastructure strengthening, and gradual market opening to gain benefits from regional aviation liberalization without sacrificing national interests.

Abstract

Indonesia merupakan negara dengan kekayaan budaya yang sangat melimpah, baik dalam bentuk ekspresi budaya tradisional, pengetahuan tradisional, maupun sumber daya genetik. Namun, belum optimalnya pendaftaran Kekayaan Intelektual Komunal (KIK) telah membuka celah bagi pihak asing untuk mengklaim budaya lokal sebagai milik mereka. Fenomena ini menimbulkan kerugian secara identitas nasional, ekonomi, maupun kedaulatan budaya. Artikel ini bertujuan untuk mengkaji urgensi pendaftaran KIK sebagai upaya preventif terhadap klaim budaya oleh pihak asing. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, menggunakan bahan hukum primer dan sekunder yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa meskipun Indonesia telah memiliki kerangka hukum terkait KIK, implementasinya masih lemah, terutama dalam aspek pendataan, sosialisasi, dan fasilitasi pendaftaran oleh negara. Pendaftaran KIK tidak hanya memberikan perlindungan hukum secara formil, tetapi juga berperan strategis dalam menjaga kedaulatan budaya nasional di tengah dinamika globalisasi dan perdagangan bebas. Oleh karena itu, diperlukan sinergi antara pemerintah pusat, daerah, serta masyarakat adat untuk mempercepat proses pendaftaran dan perlindungan hukum atas kekayaan budaya komunal. Artikel ini merekomendasikan penguatan regulasi teknis, pembentukan sistem inventarisasi nasional, dan peningkatan kesadaran hukum masyarakat adat sebagai strategi konkret dalam mencegah klaim budaya oleh pihak asing.

Abstract

Training is one of the crucial elements in strengthening the professional capabilities of Muthawwif, a spiritual and practical companion for Hajj and Umrah pilgrims in Saudi Arabia. This PKM explores the significance of training in improving the competence of Muthawwif, focusing on improving services and pilgrim experience. Effective training methods integrate key aspects, including religious knowledge, time management, intercultural communication, as well as emergency situation handling skills. Analysis of the training results shows a marked improvement in the quality of services provided by Muthawwif, as well as its positive influence on pilgrim satisfaction and safety. The implications of this increased competence pave the way for further development in supporting spiritual and safety experiences for Hajj and Umrah pilgrims in Saudi Arabia.

Abstract

The relationship between medical personnel and patients in health services should be viewed as a legal relationship between humans who have equal rights. There are two basic human rights in health services, the right to autonomy and the right to information. The results of the study indicate that the protection of patients' autonomy rights is one of the principles in biomedical ethics used as the moral basis for the provision of health services. The form of protection of patients' autonomy rights in health services is realized through regulations related to Informed Consent in Law Number 17 of 2023 Concerning Health and Minister of Health Regulation Number 290 of 2008 Concerning Consent to Medical Actions. Meanwhile, regulations related to the protection of patients' autonomy rights for high-risk health care actions have not met legal certainty because the health care actions are not classified as high-risk.

Abstract

One of the financing contracts offered by Islamic banks is the Murabahah financing contract. The Murabahah financing contract functions to increase the utility of money and capital, as well as the utility of goods. Article 127 of the Compilation of Sharia Economic Law (KHES) allows the seller to request the buyer to provide collateral in the Murabahah contract. Fatwa DSN-MUI No. 03/DSN-MUI/IV/2000 regarding Murabahah permits banks to request collateral from financed customers. This provision aims to ensure that customers are serious about making payments. Based on KHES and the fatwa, banks are allowed to request collateral from customers to protect or ensure that their rights are not violated. In practice, to ensure that customers comply with payments, banks request collateral from customers. This collateral can be movable or immovable property. Collateral in the form of immovable property is called fiduciary collateral. Fiduciary collateral is regulated in Law No. 42 of 1999 concerning Fiduciary Collateral (UUJF). According to Article 5 paragraph 1 of UUJF, the imposition of collateral with fiduciary collateral "must" be made by a notarial deed. With this provision of UUJF, there is a difference. KHES and the fatwa of DSN MUI do not require financing contracts to be made using a notarial deed, while UUJF requires it to be made by a notarial deed. Islamic banks, some of which require financing contracts to be made by a notarial deed, while others do not. The adoption of UUJF in Islamic financing is considered inappropriate because it violates Sharia values. Objectives: (1) Explain the regulations used in Murabahah financing contracts in Islamic banks with fiduciary collateral according to the objectives of legal certainty and utility. (2) Describe the implementation of legal protection for customers using Murabahah financing contracts in Islamic banks with fiduciary collateral according to the objectives of legal certainty and utility. Research Method: Research approach: normative juridical. Research nature: descriptive analysis. Data types: secondary data and primary data. Sample determination technique: purposive sampling. Data collection technique: literature study and interviews. Data analysis technique: interpretation and legal analogy.

Abstract

Private involvement in State-Owned Enterprises (SOEs) is a form of strategic transformation in an effort to improve efficiency, competitiveness, and better corporate governance. The problems in this study are: a) How is the implementation of private involvement in BUMN? and b) How is the impact of private involvement on People's Welfare? The research method used is normative juridical. The conclusion of this study is that the implementation of private involvement is carried out through privatization schemes with the main objective of increasing efficiency, capital, and modernizing BUMN management. The impact of private involvement in SOEs includes increased operational efficiency, more transparent and accountable governance, and increased contribution to the national economy. However, this involvement also brings challenges such as the potential for excessive commercialization, conflicts of interest, and the risk of weakening public service functions. Therefore, strong regulations and consistent supervision are needed to ensure synergy between state and private interests in the management of SOEs.
