Abstract

This article discusses the legal mitigation efforts of the Nanggroe Aceh Darussalam provincial government in response to the Rohingya refugee crisis. The crisis poses a threat to national defense and security, and the government must take legal measures to mitigate its impact. The article examines the legal strategies employed by the government to address the crisis and protect the nation's territorial defense.

Abstract

Intelligence is the knowledge, organization, and activities related to formulating policies, national strategies, and decision-making based on analyzing information and facts collected through work methods for early detection and warning to prevent, deter, and overcome threats to national security. Therefore, for accuracy in reading world political trends and other dimensions in the context of very rapid world change, the role of intelligence is crucial, especially in analyzing emerging threats (current threat trends) and formulating appropriate, contextual, and predictive strategies. These strategies are essential in responding to challenges in times that are changing and relatively uncertain (uncertain periods and conditions).

Abstract

This study examines the efforts of National Defense carried out by referring to the management of reserve components in the form of indigenous communities in managing the pandemic and natural disasters. Many indigenous institutions have shown extraordinary abilities in responding to crises quickly and effectively. The purpose of this study is to show that local indigenous institutions play a key role in coordinating aid and reconstruction efforts. The mutual cooperation system that is deeply embedded in the indigenous social structure allows for the rapid mobilization of community resources to help victims and begin the recovery process. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description when the research was conducted. The results of this study indicate that the integration of local wisdom in disaster mitigation also has the potential to strengthen the resilience of the community as a whole. By respecting and utilizing local knowledge, disaster mitigation efforts are not only more effective but also more accepted and supported by the local community in order to maintain state sovereignty.

Abstract

Constitutional Court rulings are final and binding, having a direct impact on the validity of existing legal regulations. This study aims to highlight the lack of uniformity in the legislative steps taken after Constitutional Court decisions. Employing a qualitative, descriptive approach, the research systematically collects data to provide an accurate and timely representation of the current legislative context. The findings reveal that the inconsistency in legislative processes following Constitutional Court rulings contributes to legal uncertainty, underscoring the necessity for standardized procedures in the legislative follow-up.

Abstract

The provision of suspension sanctions and administrative sanctions is intended as an effort to train personnel and to provide a deterrent effect for law violators, as well as to prevent being imitated by other TNI soldiers. The purpose of this study is to show that TNI soldiers are different from civilians who are only bound by general legal rules, TNI soldiers in addition to being bound by general legal rules are also bound by military legal rules (military discipline law and military criminal law), so it can be said that it is not easy for a TNI soldier when faced with the enforcement of legal rules Qualitative research uses a descriptive approach to collect data systematically, factual, and fast according to the picture when the research is carried out. The results of this study show that for TNI soldiers who violate the law, being suspended and administrative sanctions are two things that are closely related to the legal process and personnel development, this condition causes a separate burden for a TNI soldier who violates the law because it has an impact on his career and income.

Abstract

Abstract. Viewed from the perspective of law enforcement, with the rarity of filing a claim for compensation or a request to merge a claim for compensation, it requires careful research because after all the core of law enforcement is upholding rights and carrying out obligations. The purpose of this study is to show that the use of the right to claim compensation or a request for compensation is very rare. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description when the research was conducted. The results of this study indicate that the method of claiming compensation can be done by merging a claim for compensation in a criminal case, through unlawful acts and through a request for restitution.

Abstract

Fenomena hukum di Indonesia semakin berkembang secara linear dengan kemajuan zaman. Hukum Positivis berdasar teori para filsuf dunia semakin dirasa tidak sanggup lagi dalam menerjemahkan peristiwa hukum dengan regulasi hukum yang dihadirkan. Pergeseran paradigma hukum positivis menjadi harapan dalam merumuskan substansi hukum nasional yang lebih sesuai dengan karakter hukum nasional sehingga hukum nasional lebih relevan dalam penegakan hukum yang mumpuni guna mencapai tujuan hukum menurut Gustav Radburch dengan tiga tujuan hukum, yaitu keadilan, kepastian hukum dan kemanfaatan. Dengan menggunakan pendekatan kajian paradigmatik guna menemukan titik pergeseran paradigma positivis hukum kepada paradigma baru serta menemukan beberapa kebijakan dan gagasan dalam penanganan fenomena hukum nasional. Pada akhirnya menemukan alasan untuk dilakukannya rekonstruksi substansi hukum nasional yang lebih menyesuaikan dengan cita luhur bangsa Indonesia.

Abstract

The human body is a complex, integrative system where all its components work harmoniously to maintain balance and survival. The principle of homeostasis is the basis for maintaining this stability. In the context of national defense, the TNI Joint Operation adopts a similar approach, where synergy between the Land, Sea, and Air Forces is needed to ensure national integrity and sovereignty. Using the physiological analogy of the human body, this paper examines the dynamics of the TNI Joint Operation through a reflective and conceptual approach. Each organ of the human body is analogous to an operational element in the TNI, starting from the brain as the command center, nerves as the communication system, lungs as the mobility system, blood as the logistics network, muscles as the maneuvering force, and the skin as the defense layer. Emphasis is placed on coordination, adaptation to stressors, effective communication, and comprehensive integration between elements. This article concludes that applying physiological principles to the joint operation strategy will increase the effectiveness, flexibility, and resilience of the TNI in facing the complexity of contemporary threats.

Abstract

Purpose: This study aims to analyze the interaction between civil law settlements and criminal law settlements in the Indonesian military justice system, focusing on the implications of Military Court Decision I-05 Pontianak Number 46K/PM. I-05/AD/IX/2021. This study explores the complexity of overlapping jurisdictions and their effects on the rights and obligations of the parties involved. Research Methodology: The research method used is a conceptual approach with a normative analysis of laws and regulations, relevant legal practices, and library research. The conceptual approach is intended to analyze legal materials so that the meaning contained in legal terms can be understood. Results: The findings show that criminal proceedings significantly influence civil dispute resolution, particularly in determining liability and shaping civil court decisions. Conversely, the outcomes of civil cases may also affect criminal proceedings when overlapping elements exist. This case study demonstrates how fraud rooted in debt relations blurs the boundaries between civil and criminal domains, creating legal uncertainty. Conclusions: There is a strong need for harmonization and coordination between civil and criminal legal systems to prevent overlapping jurisdictions and ensure fairness. Integrating compensation claims into criminal trials can provide more efficient and comprehensive justice. Limitations: This study is limited to a single military court decision, which may restrict generalization to other jurisdictions and legal contexts. Contribution: This research contributes to legal scholarship by clarifying the interaction between civil and criminal dispute resolution and offers practical recommendations for policymakers, military judges, and practitioners to strengthen legal certainty and justice in Indonesia’s dual legal system.

Abstract

The proliferation of gangsterism in Indonesia’s industrial zones has emerged as a serious threat to the investment climate and national economic stability. Informal violence, extortion of logistics, and the monopolisation of distribution channels by mass organisations operating under gangsterism create legal uncertainty, reduce business efficiency, and generate hidden economic costs that negatively affect investor confidence. This study aims to systematically explore the behavioural and cultural characteristics of gangsterism in industrial areas and to examine the social, legal, and economic factors driving its expansion. Employing a descriptive qualitative approach, the research draws on secondary data from academic journals, institutional reports, and legal documents. The findings reveal that gangsterism is not merely a consequence of weak law enforcement but also a product of social inequality, structural unemployment, and the involvement of local political actors in informal power relations. The study further shows that gangsterism disguised as community organisations follows a systematic pattern with the potential to disrupt industrial supply chains and undermine long-term investment certainty. Its original contribution lies in the identification of two forms of industrial gangsterism—informal and formal-political and in mapping their nexus with the degradation of microeconomic security. The study recommends the establishment of an Anti-Gangsterism Task Force in strategic industrial areas as well as the strengthening of regulations and inter-agency coordination to foster a clean, stable, and globally competitive industrial ecosystem.
