Abstract

Suatu negara sebagai entitas membutuhkan cara untuk mempertahankan eksistensinya sebisa mungkin dari kemampuan sendiri. Militer nasional dibentuk untuk melaksanakan tugas pertahanan negara. Pada umumnya, yang disebut sebagai militer hanyalah prajurit aktif dan organik dari militer. Kemudian, muncul golongan orang yang dipersamakan dengan militer berdasarkan undang-undang. Indonesia pada masa Presiden Soekarno pernah menerapkan wajib militer karena menginginkan keterlibatan aktif rakyat yang lebih besar dalam angkatan bersenjata. Perkembangan saat ini, terdapat juga golongan orang yang dipersamakan dengan militer yaitu prajurit siswa, militer tituler, dan warga negara yang dimobilisasi sebagai pasukan komponen cadangan. Bertambah dan meluasnya golongan orang yang dipersamakan sebagai militer memiliki dampak terhadap keberlakuan hukum militer, karena mereka termasuk kedalam subjek hukum militer. Hukum militer memiliki cakupan dan pengertian yang luas. Kementerian Pertahanan dalam hal ini memiliki kewajiban untuk membina dan mengembangkan hukum militer di Indonesia untuk semua subjek hukum militer.

Abstract

Hospital service standards are closely linked to a hospital’s ability to provide healthcare services following its qualifications. This study aims to demonstrate how declining public trust in doctors has led to rising lawsuits, often associated with perceived failures in medical treatment. This qualitative research employs a descriptive approach to systematically and factually collect data promptly based on the conditions during the study. The findings indicate that doctors who commit medical negligence can be held legally accountable through both professional and non-professional institutions. Furthermore, non-professional dispute resolution can occur outside the court (non-litigation) or within the court system (litigation).

Abstract

This study explores customary law’s role in managing natural resources in rural areas of Indonesia, focusing on its contribution to national defence and the preservation of national sovereignty. Adopting a qualitative approach based on a literature review, this research examines the interactions between customary law, state law, and local practices within the resource management framework. The findings reveal that customary law remains a vital institution in regulating access to and utilization of natural resources despite the challenges posed by modern development policies and globalization. The study identifies various adaptive mechanisms within customary law that allow it to evolve in response to socio-ecological changes, thus supporting sustainable resource management. Furthermore, the research highlights the importance of incorporating customary law into formal policy frameworks to enhance the effectiveness of natural resource management at local and national levels.

Abstract

This study examines the paradox of justice that emerges when Baduy’s customary law interacts with universal concepts of justice and human rights. It explores how the Baduy community’s notion of justice—rooted in the principle of “pikukuh” and focused on maintaining cosmic balance—often clashes with modern interpretations of justice and individual rights. By analyzing Baduy’s legal practices in depth, the study identifies key challenges in reconciling customary law with Indonesia’s national legal system. It also considers how this paradox affects efforts to preserve Baduy’s cultural identity amid growing pressures from modernization. In conclusion, the study underscores the need to understand the complex interplay between customary law, human rights, and national development within Indonesia’s legal pluralism framework

Abstract

This research aims to examine further regulations regarding the provisions of Article 8 paragraph 3 of the 1945 Constitution of the Republic of Indonesia. The Republic of Indonesia declares itself to be a legal state, which means that all aspects of the state must be based on the rule of law. On the other hand, the President of the Republic of Indonesia acts as both head of state and head of government, which indicates the nature of a presidential republic. Therefore, the position of President cannot be vacant because this position is so important and central. The research method used in this research is qualitative method with normative juridical analysis, namely explaining the legal norms that should be fulfilled (das sollen ) compared to the current situation (das sein). This research is also descriptive in nature, namely by describing the existence of a legal vacuum in the field of state administration, especially filling the position of interim president in Indonesia and its relationship with the threat of emergencies. The country's constitution regulates how to fill the vacancy in the presidential position in the event that the President and Vice President are permanently absent at the same time. However, this provision must be further regulated through laws and implementing regulations based on law. Twenty-two years have passed since the last amendment to the constitution but there is no legal regulation regarding this matter even though this situation is a threat and could result in a state of emergency status in the country. To facilitate the consideration and formulation of filling the position of president, the author presents a comparison with several countries so that it can be used which one is most suitable for the conditions of the Republic of Indonesia.

Abstract

Indonesia’s fiscal management framework grants the government authority to implement policies that sustain national economic stability within the bounds of legality and accountability. One such policy is the 2025 State Placement Program, established through the Minister of Finance Decree No. 276 of 2025, which allocates IDR 200 trillion of public funds to state-owned banks to enhance liquidity and support growth.  This study addresses the legal ambiguity surrounding this policy and aims to assess whether such discretion is legally and administratively legitimate within Indonesia’s fiscal governance framework. Using a normative-juridical method, the research analyzes its legal basis, mechanisms of accountability, and institutional coordination, particularly regarding the management of the Accumulated Budget Surplus (SAL) and the authority of the State General Treasurer (BUN). The findings show that fiscal discretion in this policy is legally justified when exercised according to statutory mandates and subject to transparent reporting under the State Revenue and Expenditure Budget Law (APBN). However, its implementation requires clear coordination within the Financial System Stability Committee (KSSK). The study concludes that the decree is a valid exercise of fiscal authority but necessitates stronger safeguards linking SAL and the APBN, reinforced institutional coordination, and risk-based monitoring to ensure compliance with the rule of law. The implications of this study highlight the importance of aligning discretionary fiscal actions with constitutional oversight mechanisms to preserve legality and public accountability in Indonesia’s financial administration.

Abstract

Purpose: This study aims to analyze the interaction between civil law settlements and criminal law settlements in the Indonesian military justice system, focusing on the implications of Military Court Decision I-05 Pontianak Number 46K/PM. I-05/AD/IX/2021. This study explores the complexity of overlapping jurisdictions and their effects on the rights and obligations of the parties involved. Research Methodology: The research method used is a conceptual approach with a normative analysis of laws and regulations, relevant legal practices, and library research. The conceptual approach is intended to analyze legal materials so that the meaning contained in legal terms can be understood. Results: The findings show that criminal proceedings significantly influence civil dispute resolution, particularly in determining liability and shaping civil court decisions. Conversely, the outcomes of civil cases may also affect criminal proceedings when overlapping elements exist. This case study demonstrates how fraud rooted in debt relations blurs the boundaries between civil and criminal domains, creating legal uncertainty. Conclusions: There is a strong need for harmonization and coordination between civil and criminal legal systems to prevent overlapping jurisdictions and ensure fairness. Integrating compensation claims into criminal trials can provide more efficient and comprehensive justice. Limitations: This study is limited to a single military court decision, which may restrict generalization to other jurisdictions and legal contexts. Contribution: This research contributes to legal scholarship by clarifying the interaction between civil and criminal dispute resolution and offers practical recommendations for policymakers, military judges, and practitioners to strengthen legal certainty and justice in Indonesia’s dual legal system.

Abstract

The digital era has changed the dynamics of social interaction, including in multicultural societies, by expanding communication spaces while simultaneously presenting new challenges in the form of polarization, the spread of hoaxes, and cultural stereotypes. This article aims to analyze peacebuilding strategies in multicultural societies in the digital era through an inclusive approach that emphasizes digital literacy, legal awareness, and ethical online interactions. The research method used is qualitative, with a desk study approach and normative analysis of academic literature, regulations, and best practices in maintaining social harmony. The analysis results indicate that an effective strategy requires a combination of formal and non-formal education to improve digital literacy, ongoing public campaigns to build social and legal awareness, and multi-stakeholder collaboration between the government, educational institutions, civil society organizations, and technology platforms. This inclusive approach is expected to not only strengthen individuals' capacity to respond to the dynamics of cyberspace but also create a safe, harmonious digital space that supports the strengthening of humanitarian values ​​and social cohesion in multicultural societies. These findings contribute to academic thinking on digital-based peacebuilding and adaptive strategies in the context of cultural plurality.

Abstract

Penelitian ini menganalisis inkonsistensi pengaturan pemenuhan hak atas pangan dalam keadaan darurat di Indonesia dengan meninjau dua instrumen hukum utama, yaitu Undang-Undang Peraturan Pemerintah Pengganti Undang-Undang Nomor 23 Tahun 1959 tentang Keadaan Bahaya dan Undang-Undang Nomor 18 Tahun 2012 tentang Pangan. Permasalahan mendasar yang dikaji adalah ketiadaan harmonisasi antara kedua regulasi tersebut dalam mengatur mekanisme pemenuhan hak atas pangan ketika negara berada dalam kondisi darurat. UU Prp No. 23 Tahun 1959 yang lahir pada era Demokrasi Terpimpin memberikan kewenangan luas kepada penguasa darurat untuk membatasi hak-hak warga negara, namun tidak mengatur secara spesifik mengenai jaminan pemenuhan kebutuhan dasar termasuk pangan. Di sisi lain, UU No. 18 Tahun 2012 mengatur mengenai cadangan pangan dan krisis pangan, namun tidak terintegrasi dengan rezim hukum keadaan darurat. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis normatif melalui studi kepustakaan dan analisis doktrinal. Hasil penelitian menunjukkan bahwa terdapat kekosongan hukum (rechtsvacuum) dalam pengaturan kedaruratan pangan di Indonesia yang disebabkan oleh fragmentasi regulasi, ketidakjelasan kewenangan antarlembaga, dan ketiadaan mekanisme yang terintegrasi untuk menjamin pemenuhan hak atas pangan dalam situasi darurat. Kondisi ini berimplikasi pada lemahnya perlindungan hak atas pangan sebagai bagian dari hak asasi manusia yang dijamin konstitusi dan instrumen hukum internasional yang telah diratifikasi Indonesia.

Abstract

National economic stability constitutes a fundamental pillar of national development and security. Global challenges, including trade wars, financial crises, and pandemics, have amplified the vulnerability of national economies. As a state governed by law, Indonesia bears a constitutional obligation to safeguard public welfare pursuant to the 1945 Constitution. This article analyzes the function of the rule of law in preserving economic stability as an integral component of national security strategy. The study employs a normative juridical method, examining constitutional mandates and regulations related to emergencies and economic regulation, namely the 1945 Constitution, Law No. 23/1959 on State of Emergency, Law No. 9/2016 on Prevention and Handling of Financial System Crises as updated by Law No. 4/2023 on Financial Sector Development and Strengthening (P2SK Law), and Law No. 3/2002 on National Defense. The findings reveal that Indonesia lacks an explicit legal recognition of economic emergencies as a distinct category. Consequently, legal reform is deemed necessary to ensure legitimacy, institutional clarity, and regulatory certainty in managing financial crises within the framework of national security.
