Abstract

The fintech business of peer-to-peer lending has experienced a period of considerable growth in recent years. However, it is still the subject of debate and controversy from the perspective of Sharia law. This article aims to analyze Sharia law on fintech peer-to-peer lending businesses, with a particular focus on usury and gharar banking. The methodology employed in this study is descriptive and analytical in nature. This entailed the collection of data from a range of sources, including literature, legal documents, and expert opinions. The findings indicate that the peer-to-peer lending fintech business can be classified as usury and gharar due to the implementation of several practices by the platform, including high interest rates and a lack of transparency regarding the associated risks. From the perspective of Sharia law, usury and gharar are prohibited, as they contravene the principles of justice and balance. Consequently, fintech peer-to-peer lending businesses must adhere to the tenets of Shariah law, such as abstaining from exorbitant interest rates and ensuring transparency regarding risks. In conclusion, fintech peer-to-peer lending businesses must be meticulously analyzed from the perspective of Shariah law to ensure their halalness in Islam. It is also imperative for the government and regulators to prioritize Shariah law aspects in regulating fintech peer-to-peer lending businesses

Abstract

Background: The rapid development of information technology has significantly increased the incidence of online fraud, including fraud related to job vacancies. This phenomenon has reached an alarming level and poses serious legal and social challenges, particularly in ensuring legal protection for victims and effective law enforcement against perpetrators. Objective: This study aims to identify the factors contributing to the occurrence of online fraud crimes related to job vacancies and to analyze the efforts undertaken by law enforcement authorities to prevent and address such crimes. Methods: This research employs a normative juridical approach by examining primary and secondary legal materials, including legislation, court decisions, and relevant legal literature. The analysis focuses on legal norms governing fraud crimes and law enforcement practices in addressing online fraud cases. Results: The findings indicate that online fraud crimes are influenced by economic, environmental, and socio-cultural factors, as well as the ease of committing online fraud and the relatively low risk of detection. Law enforcement efforts to combat online fraud include preventive measures such as public legal awareness campaigns, increased supervision of online transactions, and dissemination of warnings through media platforms, as well as repressive measures in the form of investigation, prosecution, sentencing, and correctional rehabilitation of offenders. Conclusion: Online job vacancy fraud requires comprehensive legal handling through a combination of preventive and repressive strategies. Strengthening law enforcement, increasing public awareness, and improving caution among online users are essential to reduce the incidence of online fraud crimes.

Abstract

Penelitian ini dilatarbelakangi oleh meningkatnya tindak pidana lalu lintas yang melibatkan anak di bawah umur yang tidak hanya merugikan korban, tetapi juga berdampak pada masa depan pelaku. Rumusan masalah dalam penelitian ini adalah bagaimana penerapan restorative justice dalam penanganan tindak pidana lalu lintas dengan pelaku anak di Polres Mojokerto serta kendala yang dihadapi dalam penerapannya. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan kualitatif melalui wawancara, observasi, dan studi dokumen. Hasil penelitian menunjukkan bahwa penerapan restorative justice di Polres Mojokerto dilakukan dengan mengutamakan musyawarah antara korban, pelaku, dan keluarga dengan tujuan pemulihan keadaan semula serta menghindari dampak negatif pemidanaan bagi anak. Namun, pelaksanaannya masih menghadapi kendala berupa kurangnya pemahaman masyarakat mengenai konsep restorative justice, adanya tekanan emosional dari pihak korban, serta keterbatasan sumber daya aparat dalam memfasilitasi proses mediasi. Kesimpulan penelitian menegaskan bahwa restorative justice dapat menjadi alternatif penyelesaian perkara yang lebih humanis bagi anak, tetapi membutuhkan dukungan regulasi, sosialisasi, dan peningkatan kapasitas aparat

Abstract

This study aims to analyze the concept of legal protection for women victims of domestic violence based on Law Number 23 of 2004 concerning the Elimination of Domestic Violence, as well as to identify the factors that influence the effectiveness of the implementation of such legal protection in Indonesia. This research employs a normative juridical approach with qualitative analysis. The results show that legal protection for women victims of domestic violence has been comprehensively regulated in the Domestic Violence Law, covering emergency protection mechanisms, psychosocial recovery, and legal assistance services. However, its effectiveness remains hampered by several factors, including weak law enforcement, entrenched patriarchal culture, limited victim support infrastructure, and low legal literacy among women. Therefore, synergistic efforts from the state, society, and law enforcement officials are needed to realize holistic and equitable legal protection

Abstract

This study aims to analyze the effect of community development by the police on increasing citizen participation in neighborhood watch programs in Windurejo Village, Kutorejo District. The method used is a juridical-empirical approach with interview, observation, and documentation study techniques. The results show that the active role of Bhabinkamtibmas in community development has a significant contribution in fostering legal awareness and citizen involvement in security activities. The success of the program is determined by factors such as personnel competence, operational facilities, support from community leaders, and synergy with the village government. However, there are also obstacles such as limited personnel and cultural constraints. This study recommends institutional strengthening, capacity building for officers, and a local participatory approach in community development programs to create sustainable environmental security

Abstract

This study provides a juridical review of the formation of Special Committees (Pansus) as an integral part of the Regional House of Representatives (DPRD) in Indonesia. Using a normative legal research approach, this study analyzes the legal basis, mechanisms, and practical implications of the Pansus's existence. The findings indicate that the Pansus is a legitimate and vital ad hoc instrument, created to address specific issues that require focus and efficiency. Its formation is formally regulated through the DPRD Plenary Meeting's Decree and is based on relevant legislation, including Law Number 23 of 2014 and Government Regulation Number 12 of 2018. This process ensures the Pansus has strong legitimacy, accountability, and representation. The Pansus enables the DPRD to carry out its legislative and oversight functions more thoroughly, expedites decision-making, and enhances local government transparency. This study concludes that the Pansus is not merely a formal structure but a crucial mechanism for making the DPRD more responsive, efficient, and accountable in serving the public's aspirations

Abstract

The settlement of minor criminal cases in Indonesia has been dominated by a formal and bureaucratic retributive approach, which is inefficient and causes dissatisfaction among the parties involved. In response to this situation, the restorative justice approach has emerged as an alternative that focuses more on restoring relationships between perpetrators, victims, and the community. This study aims to analyze the legal application of restorative justice in the settlement of minor criminal offenses based on the Criminal Procedure Code and PERMA No. 2 of 2012, as well as a case study of its implementation in the Mojokerto District Court. This study uses a normative legal method, with a literature study approach through analysis of legislation, court decisions, and relevant scientific literature. The results show that although the Criminal Procedure Code does not explicitly regulate the mechanism of restorative justice, the scope for its application can be found in Article 82 of the Criminal Procedure Code, reinforced by PERMA No. 2 of 2012 and Attorney General Regulation No. 15 of 2020. A case study in Mojokerto City proves that this approach is capable of resolving cases quickly, efficiently, and satisfactorily for all parties, especially in cases of minor assault and petty theft. There are still serious challenges, such as the lack of integrated technical regulations, low understanding among law enforcement officials, and cultural resistance to non-punitive approaches. Therefore, policy reformulation, intensive training, and public education are needed to broaden acceptance of restorative justice. This study confirms that the restorative justice approach is not only normatively relevant but also proven to be practically effective in realizing a more just, humane, and sustainable criminal justice system

Abstract

Household organic waste management remains a serious problem in urban areas, including in Tambak Sarioso Village, Surabaya City. The high volume of organic waste, low level of waste sorting at source, and limited community participation indicate a gap between normative regulations and the implementation of waste management policies. This condition necessitates research, considering that waste management is directly related to environmental protection and the fulfillment of the community's right to a healthy environment. This study aims to analyze the empirical conditions of organic waste management in Tambak Sarioso Village and to examine the implementation of eco-enzymes as a community empowerment strategy within the legal framework of waste management. The main research question focuses on the effectiveness of eco-enzymes in bridging legal norms and social practices of household-based organic waste management. The results show that organic waste management in Tambak Sarioso is not yet optimal due to low legal awareness and limited supporting facilities. The implementation of eco-enzymes has been proven to increase community participation, reduce organic waste generation, and improve the quality of the residential environment. These findings contribute to strengthening the concept of community empowerment as an instrument of environmental law effectiveness. The research conclusion confirms that eco-enzymes are an innovative model of community-based organic waste management that is relevant for strengthening the implementation of waste policies. The novelty of this research lies in the integration of empirical, normative, and community empowerment approaches into a single framework of sustainable waste management.

Abstract

This article examines a high value gold transaction dispute that illustrates how fragmented judicial reasoning, prosecutorial discretion, and corporate governance failures can converge to produce a miscarriage of justice in complex economic-crime cases. Using a socio-legal case study approach, the analysis reconstructs a transaction in which a buyer paid IDR 1.2 trillion for 4,000 kilograms of gold but received only 2,400 kilograms, a shortfall acknowledged by the selling corporation in civil proceedings. Early criminal cases convicted corporate insiders for fraud, recognizing the buyer as a victim. However, subsequent corruption proceedings reversed this position, alleging without evidentiary support that the buyer unlawfully obtained excess gold and caused state financial loss. Criminal courts accepted this narrative despite auditor testimony confirming the absence of state loss and despite inconsistencies with civil judgments. The findings reveal four systemic weaknesses: disregard of documentary evidence, role inversion from victim to offender, contradictory civil–criminal outcomes, and liability shifting driven by corporate governance failures. These dynamics align with broader patterns of wrongful convictions in economic-crime contexts. The study underscores the need for stronger evidentiary standards, improved inter-court coordination, enhanced forensic capacity, and clearer boundaries between commercial disputes and corruption enforcement

Abstract

Kepolisian merupakan salah satu lembaga negara yang memiliki tugas utama dalam bidang penegakan hukum, khususnya melakukan penyelidikan dan penyidikan terhadap tindak pidana. Dalam menjalankan fungsinya, kepolisian tidak hanya berperan sebagai aparat penegak hukum, tetapi juga bertugas memelihara ketertiban dan keamanan umum di tengah masyarakat. Selain itu, kepolisian juga menjalankan tugas sosial dan kemanusiaan, memberikan pendidikan kesadaran hukum, serta melaksanakan fungsi pemerintahan terbatas (bestuurlijk). Oleh karena itu, keberadaan penyidik sebagai bagian dari Polri memiliki peran penting dalam proses penanganan suatu perkara pidana, karena penyidik bertanggung jawab mengumpulkan bukti dan mengungkap kebenaran guna membantu penyelesaian kasus pelanggaran hukum. Namun, dalam praktik pengungkapan perkara pada tahap penyidikan, tidak jarang terjadi tindakan yang bersifat sewenang-wenang oleh penyidik. Perlakuan tersebut sering kali dilakukan dengan tujuan agar tersangka segera mengakui perbuatannya. Padahal, dalam proses penyidikan, yang dibutuhkan bukanlah pengakuan yang diperoleh melalui tekanan atau pemaksaan, melainkan keterangan yang diberikan secara bebas dan sesuai ketentuan hukum yang berlaku. Seharusnya tersangka memiliki kebebasan dalam memberikan keterangan tanpa adanya intimidasi, ancaman, atau kekerasan. Hal ini penting agar proses penyidikan tetap berjalan secara adil dan tidak menyimpang dari aturan dalam Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Dengan demikian, perlindungan hak-hak tersangka harus dijunjung tinggi demi terwujudnya proses peradilan pidana yang objektif dan sesuai prinsip hukum.
