Abstract

Transportasi online berkembang pesat di era disrupsi, membawa tantangan besar dalam sektor kebijakan publik, terutama dalam pengaturan dan pembangunan hukum yang sesuai dengan perkembangan teknologi. Di tengah pesatnya pertumbuhan transportasi berbasis aplikasi, terdapat kesenjangan dalam regulasi yang menyebabkan ketidakpastian dan potensi konflik. Pembaharuan dan pembangunan hukum transportasi online menjadi kebutuhan mendesak untuk menciptakan sistem yang adaptif, efisien, dan adil. E-governance dan dynamic governance dipandang sebagai solusi untuk menciptakan regulasi yang lebih responsif terhadap perubahan teknologi dan dinamika sosial. Penelitian ini bertujuan untuk menelaah politik hukum pembaharuan dan pembangunan hukum transportasi online dan tawaran model regulasi hukum transportasi berbasis e-governance dan dynamic governance. Penelitian ini menggunakan metode hukum normatif dengan analisis kualitatif berdasarkan data sekunder dari bahan hukum, teori, dan pendapat ahli. Kajian ini mengusulkan desain model regulasi hukum transportasi online berbasis e-governance dan dynamic governance yang mampu menciptakan keseimbangan antara inovasi teknologi dan perlindungan hak-hak konsumen serta pekerja. Pemerintah, dalam hal ini, harus memperbaharui regulasi yang mengatur sektor transportasi online, seperti tarif, keselamatan, hak-hak pengemudi, serta transparansi operasional perusahaan aplikator. Sinergi antar kementerian terkait, seperti Kementerian Perhubungan, Kementerian Ketenagakerjaan, dan Kementerian Komunikasi dan Digital, juga penting untuk memastikan regulasi yang komprehensif dan inklusif. Dengan adanya regulasi yang lebih adil dan jelas, diharapkan sektor transportasi online dapat berkembang secara berkelanjutan, memberikan manfaat optimal bagi masyarakat, dan melindungi kepentingan semua pihak yang terlibat.

Abstract

The Constitutional Court is a judicial institution responsible for maintaining law and justice through its decisions known as landmark decisions. One of the decisions that is currently controversial in society is Decision Number 85/PUU-XX/2022 concerning the establishment of a special judicial body that should have been formed before the regional head elections which will be held simultaneously in 2024. However, until now there has been no legal certainty regarding the establishment of a special judicial body and the Constitutional Court remains authorized to handle regional head election disputes. The purpose of this study is a form of examination to determine whether the Constitutional Court Decision Number 85/PUU-XX/2022 meets the criteria as a landmark decision or not as interpreted by the Constitutional Court. By using a qualitative approach, this study uses a normative legal analysis based on descriptive legal theory. The data sources used in this study are journals, books and the results of previous studies that have been published. The results of the discussion in this study indicate that the Constitutional Court Decision Number 85/PUU-XX/2022 successfully meets the four criteria for a landmark decision. However, there is one criterion that was not met, namely a decision that annulled the entire law because the panel of judges only annulled Article 157 paragraph (1), (2) and the phrase in Article 157 paragraph (3) so that this decision cannot be fully categorized as a landmark decision.

Abstract

Introduction: The news that contains the identity of children involved in legal cases, whether as perpetrators, victims or witnesses, is a crucial issue because it can interfere with their physical, emotional and social development. Indonesian law has established various regulations that strictly prohibit the disclosure of children's identities in order to protect their rights. This research focuses on analyzing legal policies governing the protection of children in mass media coverage, particularly in the context of disclosing their identities.Purposes of the Research: In addition, the study also evaluated potential legal consequences, including criminal sanctions and possible violations of the journalistic code of ethics.Methods of the Research: Using a descriptive normative juridical method, this research explores the applicable legal provisions, the pattern of media coverage, and the impact caused by violations of these rules.Findings of the Research: The findings of the study show that although there are clear rules regarding the protection of children's identities, their implementation is still hampered by several problems, such as the lack of understanding of journalists of relevant laws and indecisiveness in sanctioning violations. This study also identifies a number of laws that regulate criminal liability against mass media, including "Law Number 40 of 1999 concerning the Press, Law Number 11 of 2012 concerning the Aanak Criminal Justice System, Law Number 35 of 2014 concerning Child Protection, and the Criminal Code".

Abstract

Pencemaran nama baik adalah suatu tindakan yang menyerang kehormatan atau nama baik seseorang atau yang lebih dikenal dengan istilah penghinaan, pencemaran nama baik sebagai bentuk penyalahgunaan hak kebebasan berpendapat di media elektronik menjadi isu yang semakin sering terjadi seiring dengan berkembangnya era digital saat ini. Penelitian ini bertujuan untuk menganalisis bagaimana perkembangan pengaturan tentang pencemaran nama baik dan bagaimana upaya-upaya aparat penegak hukum dalam menangani tindak pencemaran nama baik, dengan studi kasus selebgram Medina Zein. Metode penelitian yang digunakan adalah hukum yuridis normatif, dengan mengkaji perkembangan pengaturan pencemaran nama baik dan upaya penegak hukum dalam menangani tindak pencemaran nama baik di media elektronik. Hasil dari penelitian menunjukkan bahwa terdapat perkembangan pengaturan seiring dengan kemajuan era digital, sehingga memerlukan pengaturan hukum yang lebih mengikat. Dalam upaya penegakkan hukum terhadap pencemaran nama baik di media elektronik, terdapat dua upaya yang dapat mengurangi dan meminimalisir tindak pencemaran nama baik di media elektronik. Kasus Medina Zein mencerminkan bagaimana informasi yang tidak akurat dapat menyebar dengan cepat di media sosial, merugikan reputasi individu, dan memicu tindakan hukum. Penelitian ini juga menemukan bahwa masih banyak masyarakat yang kurang memahami batasan dalam menggunakan media elektronik, sehingga diperlukan edukasi hukum yang lebih intensif untuk meningkatkan kesadaran akan hak dan tanggung jawab dalam berpendapat. Dengan demikian, penelitian ini diharapkan dapat memberikan kontribusi bagi pemahaman hukum masyarakat mengenai pencemaran nama baik dan kebebasan berpendapat di era digital.

Abstract

Residivisme di kalangan anak yang berhadapan dengan hukum menjadi perhatian serius dalam sistem peradilan pidana anak. Anak yang telah selesai menjalani masa tahanan sering menghadapi stigma sosial, kurangnya dukungan rehabilitasi, dan minimnya pengawasan, yang berpotensi mendorong mereka kembali melakukan tindak pidana. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum terhadap anak dalam sistem peradilan pidana anak serta mengidentifikasi langkah strategis untuk mencegah residivisme pasca-penahanan. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan deskriptif analitis. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap anak masih menghadapi kendala signifikan, terutama dalam aspek pengawasan dan rehabilitasi pasca-penahanan. Upaya pencegahan residivisme dapat dilakukan melalui langkah preventif seperti pendidikan, pelatihan keterampilan, dan dukungan psikologis, serta langkah represif berupa implementasi peraturan hukum yang lebih tegas. Kerja sama yang terintegrasi antara pemerintah, masyarakat, dan keluarga sangat diperlukan untuk memastikan keberhasilan rehabilitasi dan reintegrasi sosial anak dalam mencegah residivisme.

Abstract

Penelitian ini berjudul “Tinjauan Hukum Implementasi PHK Dihubungkan Pasal 157A Undang-Undang Nomor 6 Tahun 2023 di Kalimantan Timur”. Melihat kenyataan (das sein) yang tidak sesuai dengan apa yang seharusnya (das sollen), maka penting kiranya dilakukan penelitian untuk mengungkap permasalahan yang menjadi penyebab Pasal 157A Undang-Undang Nomor 6 Tahun 2023 Tentang Cipta Kerja terkait Pemutusan Hubungan Kerja (PHK) tidak diimplementasikan pekerja/buruh dan pengusaha. Dari penelitian yang dilakukan menggunakan metode yuridis normatif dengan penalaran deduktif yaitu penalaran dari yang luas ke yang lebih khusus ini, dengan landasan analisis studi kepustakaan dan kasus diharapkan dapat memberikan gambaran penyebab dan kendala dari permasalahan yang masih terjadi tersebut sehingga bisa memberikan solusi. Dalam penelitian yuridis normatif ini, bahan hukum yang mengikat menjadi sumber data sekunder, yang dapat dikategorikan sebagai bahan hukum primer, hukum sekunder, atau hukum tersier, tergantung pada tingkat kekuatan kewenangannya dalam berbagai perspektif. Selain itu, pendekatan deskriptif kualitatif digunakan untuk menjelaskan fenomena secara sistematis, faktual, dan valid. Data primer yang diperoleh secara langsung dari sumber data dengan observasi langsung dianalisis secara komprehensif dan terinci untuk memberikan jawaban terhadap permasalahan yang sedang diteliti. Hasil penelitian ini diharapkan dapat memberikan kontribusi pemikiran secara teoritis dan praktis, sehinga Pasal 157A Undang-Undang Nomor 6 Tahun 2023 Tentang Cipta Kerja Klaster Tenaga Kerja ini dapat diimplementasikan yang bermuara pada terwujudnya keadilan hukum bagi pekerja/buruh dan pengusaha, serta mewujudkan kesejahteraan secara keseluruhan kepada rakyat Indonesia.

Abstract

Crimes against children are increasingly occurring, especially sexual violence that does not only recognize place and time, but also does not recognize who will be the perpetrator and victim. For example, the child perpetrator in Decision Number 27/Pid.Sus-Anak/2023/PN Smr and Decision Number 12/Pid.Sus-Anak/2024/PN Smr. The difference in punishment (criminal disparity) seen in both decisions can create a bad stigma in the eyes of the victim and the community, especially since both perpetrators committed crimes with a similar level of seriousness. This study aims to analyze the disparity that occurs between the two verdicts and analyze the judge's consideration in sentencing child offenders. This research uses a normative juridical method with qualitative analysis, and relates the theory of justice and juvenile punishment. The results of this study indicate that the disparity in punishment given is due to differences in the legal basis used so that the final punishment given in the two decisions is also different. This can be influenced by the different views of judges who, in making their decisions, are not only derived from juridical considerations but also non-juridical considerations.

Abstract

Introduction: As technology continues to advance, it brings significant changes to people’s lives. However, these advancements are also accompanied by threats, one of which is cybercrime. A particular form of this crime is the dissemination of pornographic content, which has substantial negative impacts, both on individual victims and on society as a whole.Purposes of the Research: This study aims to examine the legal regulations in Indonesia governing the dissemination of pornographic content and to analyze the legal protection for victims as stipulated in Law Number 12 of 2022 concerning Sexual Violence Crimes.Methods of the Research: The research method used is normative juridical approach, involving an analysis of relevant laws, such as the Criminal Code, the Electronic Information and Transactions Law, the Pornography Law, and the Law on Sexual Violence Crimes.Findings of the Research: The results of the study show that the dissemination of pornographic content is regulated in articles 282, 296, and 50 of the Criminal Code, as well as Article 27 paragraph (1) and Article 45 paragraph (1) of the Electronic Information and Transaction Law, with strict criminal threats. The Pornography Law and Law Number 1 of 2024 strengthen supervision of electronic systems and administrative sanctions. The Sexual Violence Crime Act provides comprehensive protections for victims, including the right to legal services, psychological support, content removal, and protection from perpetrator threats and lawsuits.

Abstract

Introduction: The phenomenon of insults on social media as a form of Cyberbullying or bullying in cyberspace is an act of intimidation, humiliation, humiliation, or deliberate harassment through the internet, focusing on the case study of Decision Number: 21/Pid.Sus/2020/PN.lbo. The main issues raised are the legal protection of victims of cyberbullying and the effectiveness of law enforcement in Indonesia.Purposes of the Research: To identify the protection mechanisms available to victims and assess the extent to which the law can be enforced against the perpetrators of cyberbullying.Methods of the Research: The research method used is normative juridical, with a legislative approach and case studies. Data were collected through a review of the literature, including relevant Laws and the results of previous research.Findings of the Research: Showing that in the Cyberbullying case at the Lamboto District Court, the defendant was sentenced in accordance with the Electronic Information and Transaction Law for defamation on social media. This decision emphasizes justice, legal fairness, and protection for victims and provides a deterrent effect for perpetrators while showing that the Judge's commitment to providing justice in the judiciary in handling crimes in cyberspace.

Abstract

Corruption is a special crime that is different from general crimes because it requires state financial losses as a basic element. Constitutional Court Decision No. 25/PUU-XIV/2016 emphasizes that corruption must be viewed as a material crime, so that the element of real and definite state losses (actual loss) must be proven investigatively. This concept requires an accurate and final calculation of state losses as part of at least two valid pieces of evidence as specified in Article 184 of the Criminal Procedure Code. This study aims to examine the judge's error in the Pretrial Decision No. 113/Pid.Pra/2024/PN Jkt.Sel, which does not make actual loss a valid piece of evidence in the application of coercive measures against corruption suspects. Using normative research methods through a legal approach and case studies, as well as qualitative analysis, it was found that pretrial judges still use a formal crime approach and accept evidence that does not meet the actual loss standard. This error has implications for legal uncertainty and has the potential to harm the suspect's rights in the criminal process.
