Abstract

Along with the times, the number and complexity of legal cases in the village also increased. Paralegals who have a good capacity can help handle these cases more efficiently and effectively. In remote villages, access to professional lawyers or legal aid agencies is often limited. Paralegals who have a good capacity can be an important alternative in providing legal assistance. Paralegals who have adequate capacity can play an active role in resolving conflicts at the local level, such as land disputes or family matters, so there is no need to take them to higher courts. As mandated by Article 9 of Law Number 16 of 2011 concerning Legal Aid. It is undeniable that the handling of legal cases must be based on ethical principles to maintain public integrity and trust. Paralegals trained in ethical principles can ensure that the case handling process is carried out fairly and transparently. Villages have a very important role in supporting the implementation of legal aid in their communities, namely by providing Facilitation of Access to Training and Education, in addition to which Villages can collaborate with legal aid institutions, universities, and non-governmental organizations to hold training and workshops for paralegals and the community, and can initiate legal counseling programs involving paralegals to disseminate legal knowledge to residents. Village communities can be facilitated to gain access to legal and educational information related to their rights.

Abstract

With effective land dispute resolution, agricultural productivity and the welfare of village communities can increase. Non-disputed land can be optimally utilized for economic activities that benefit the community. The method of implementing this service activity is in several stages: coordination with the village community, literature study, and face-to-face socialization. The results of community service on paralegal training where the presence of deme dua village paralegals can help minimize the occurrence of land cases in the village, existing cases can be handled more effectively and efficiently. The presence of village paralegals is one of the alternatives to researching local village conflicts. It can also help in resolving disputes peacefully and effectively before the problem becomes bigger. The settlement of land disputes that have not been certified is regulated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 21 of 2020 concerning the Handling and Settlement of Land Cases. Paralegals act as mediators, the duties of mediators are based on article 14 of Perma no. 1 of 2016 concerning mediation procedures.

Abstract

Kehidupan rumah tangga menjadi lingkup domestik yang sulit untuk disentuh oleh masyarakat, perilaku atau kekerasan yang terjadi dalam rumah tangga merupakan fakta sosial yang banyak terjadi saat ini. Sebagian besar perempuan dan anak-anak yang menjadi korbannya. Undang-Undang No. 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga menjadi salah satu  alat yang digunakan dalam upaya pemerintah memberikan perlindungan hukum terhadap korbannya. Penyuluhan dan Sosialisasi Hukum yang dilaksakan di Desa Mulyonegoro Kecamatan Pulubala Kabupaten Gorontalo, pada Tanggal 18 Agustus 2022, merupakan salah satu upaya yang dilakukan oleh Lembaga Bantuan Hukum Universitas Gorontalo untuk memberikan pengetahuan hukum kepada masyarakat. Adapun hasil yang diperoleh yakni kegiatan ini sangat bermanfaat bagi masyarakat yang awam perihal tentang hukum.

Abstract

This study examines the universal concept of human rights as fundamental to all individuals. Human rights reflect dignity, equality, autonomy, and legal protection, and must be ensured by the state. Although broadly accepted, continuous education and public awareness—especially for marginalized groups—remain essential. In Gorontalo Province, the Ministry of Law and Human Rights’ Regional Office plays a pivotal role in responding to alleged human rights violations through its Community Communication Services Program, as regulated by Ministerial Regulation No. 23 of 2022. Using an empirical legal approach, the study gathers data through literature reviews, legal documents, and interviews with relevant stakeholders. Findings show that the Regional Office serves as a key constitutional institution promoting access to justice and upholding legal protections. Its activities include handling public complaints, forming investigative teams, and coordinating with law enforcement and legal aid bodies. Legal aid—both state-sponsored (pro deo) and volunteer-based (pro bono)—emerges as a crucial tool for promoting justice, especially for the underprivileged. The structured complaint mechanism under Ministerial Regulation No. 23 of 2022 strengthens the state’s role in ensuring equality before the law and fulfilling its constitutional obligations to protect human dignity and human rights.

Abstract

Introduction: Pretrial is the initial thought to carry out supervisory actions against law enforcement officials so that in carrying out or carrying out their duties there is no abuse of authority.Purposes of the Research: To review and analyze Pre-Trial As Investigation Process Control System.Methods of the Research: The research method used in this study is Empirical Juridical law research with the reason that the author wants to examine norms related to pretrial and seek information directly about the implementation of pretrial at the Merauke Merauke Police.Results of the Research: Pretrial is a form of control both from superiors (Vertical) as well as from fellow law enforcers or third parties, namely the attorneys of suspects, suspects and their families (Horizontal) to see that the arrest, detention and determination of suspects are in accordance with applicable rules and pretrial. must have rules regarding inspection techniques so that there is uniformity.

Abstract

This research analyzes the effectiveness of Gorontalo Province Regional Regulation No. 10 of 2014 concerning Smoke-Free Areas (KTR), identifies influencing factors, and formulates improvement efforts. Employing a normative empirical method with a sociology of law approach, the study examines the regulation's implementation in society. The findings indicate that the implementation of the KTR Regional Regulation is not yet effective. Smoking activities persist in KTR areas without significant action from authorities, despite stipulated sanctions. Factors hindering effectiveness include low public awareness, insufficient support from the government and law enforcement, minimal public participation, and limited funding and infrastructure. To enhance the effectiveness of the KTR Regional Regulation, the research recommends socialization efforts, inter-agency coordination, the establishment of a supervisory team, strict law enforcement, and clear sanctions for violators. Furthermore, it is crucial to increase public education and guidance regarding the dangers of smoking and the urgency of KTR. Recommendations for the public include complying with the KTR Regional Regulation, particularly in health facilities and schools. The Regional Government is expected to continue its socialization efforts. Effective enforcement of the KTR Regional Regulation is anticipated to improve the community's quality of life by making it healthier and free from cigarette smoke.

Abstract

Pemerintah Provinsi Gorontalo memiliki komitmen besar untuk mewujudkan tata kelola pemerintahan yang bebas korupsi, kolusi dan nepotisme (KKN) dengan menerapkan sistem pengukuran prestasi kerja (SIRANSIJA). Permasalahan penelitian berfokus pada, Pertama, bagaimana pelaksanaan Sistem Pengukuran Prestasi Kerja (SIRANSIJA) Aparatur Sipil Negara (ASN) di Dinas Pertanian Provindi Gorontalo: Kedua faktor-faktor apa yang mendukung dan menghambat pelaksanaan Sistem Pengukuran Prestasi Kerja (SIRANSIJA) Aparatur Sipil Negara (ASN) pada Dinas Pertanian Provinsi Gorontalo. Metode penelitian menggunakan pendekatan dekskriptif kualitatif yaitu memberikan gambaran secara cermat dan faktual terhadap objek penelitian. Hasil penelitian menunjukkan bahwa, Pertama, Pelaksanaan Sistem Pengukuran Prestasi Kerja (SIRANSIJA) di Dinas Pertanian Provinsi Gorontalo kedisiplinan Aparatur Sipil Negara sudah efektif dalam pengoptimalan absensi namun dari segi kinerja masih kurang efektif. Kedua, ditemukan faktor yang mempengaruhi, yaitu Faktor Pendukung: Keharusan Fingerprint dan Fitur yang mengontrol Kinerja Faktor Penghambat: Sistem Error, Mesin Finger Rusak, Jarak Lokasi Tugas dan Kantor, Listrik Padam, Tupoksi Timpang Tindih. Rekomendasi penelitian kepada Aparatur Sipil Negara di Dinas Provinsi Gorontalo agar menyempurnakan sistem SIRANSIJA untuk penggunaan yang lebih merasa nyaman.

Abstract

Muslim-majority countries face unique challenges in managing constitutional change because of complex interaction between religion, politics, and law. Formal and informal constitutional amendments occur through legal procedures and judicial interpretation, political practice, and social norms, respectively. This study analyzes the dynamics of these amendments in Muslim-majority countries, focusing on Indonesia, Turkey, Egypt, and Pakistan. The research method used here adopts a normative juridical approach with a comparative approach. Reportedly, Indonesia stands out with a combination of formal amendments, such as the reform of the 1945 Constitution, and informal changes through the Constitutional Court, creating a stable and flexible legal system. In contrast, Egypt and Pakistan show that the pressure of political crises and the influence of the military often hinder the sustainability of formal reforms, although informal change remains an adaptation mechanism. These findings highlight the importance of the social and political context in shaping the path of constitutional change and indicate that informal change can serve as an adaptation tool without the need for legal text revision. The novelty of this study is its simultaneous focus on formal and informal amendments in the Muslim-majority countries, offering a contribution to the literature on global constitutionalism by explaining how informal mechanisms can complement formal reform.

Abstract

Every human being has rights that have been given since humans are in and the right to life is an absolute right that must be lived by every human being. Law Number 39 of 1999 concerning Human Rights does not provide space for euthanasia because euthanasia is contrary to the provisions of the Human Rights Law, especially the right to life of a person. The right to life in Law Number 39 of 1999 concerning Human Rights explains that every human being or every person without exception has the right to life, the right not to be tortured, the right to personal freedom thought and conscience, the right to religion, the right not to be enslaved, the right to recognized as a person and equality before the law, and the right not to study based on applicable law is a human right that cannot be reduced under any circumstances and by anyone.

Abstract

The purpose of this research is to find out and analyze the basis of the judge's consideration in imposing a conditional criminal sentence at the Marisa Court, Pohuwato Regency and to find out and analyze the provisions of conditional punishment in achieving the objectives of punishment in the Indonesian punishment system. The implementation of this research is empris research. In this study, researchers used a qualitative method. The consideration of judges in imposing conditional criminal decisions is a complex and diverse process. It involves an evaluation of the offender's circumstances, community safety, rehabilitation needs, as well as the effectiveness of the punishment in preventing future law violations. By carefully considering these factors, judges can make fair and effective decisions. The judiciary is known as the mouthpiece of the law. Conditional punishment in the Indonesian punishment system can be implemented where the Judge can set a general condition, namely that the convicted person during the specified probation period will not commit a criminal act, and a special condition, which is specifically aimed at the behavior of the convicted person. Conditional punishment can be imposed if the Judge imposes a maximum imprisonment of 1 (one) year.  Conditional punishment is an important instrument in the Indonesian punishment system because it provides an opportunity for criminal offenders to rehabilitate themselves and avoid re-engaging in criminal activities.
