Abstract

The main issues in this thesis are Juridical Analysis of the importance of forming Regional Regulations regarding the provision of Legal Aid to the Poor in Tanah Datar District and Siyasah Dusturriyah's Analysis of the importance of forming Regional Regulations related to Legal Aid to the Poor in Tanah Datar District? The type of research used was field research with a qualitative approach conducted at the Tanah Datar District Office of Social Affairs, the Office of the Legal Aid Institute (LBH) Fiat Justitia Batusangkar, while the technique for collecting data was direct interviews, with Mr AZ (head of the Tanah Datar Social), Mr. YA (head of LBH Fiat Justitia Batusangkar), and Mrs. AH, (Young Expert Legal Analyst for the Tanah Datar District Government), and documentation studies, through library literature such as books, scientific papers, journals, documents, laws, and others. The results of the author's research show that in Tanah Datar there are still very many people who are classified as poor and some of them are caught in legal cases, but not all of the poor who are caught in these legal cases get legal assistance from the government, Constraints in providing legal aid this is an unclear regulation and the lack of budget from local government for organizing legal aid for the poor, this is because Regional Regulation No. 1 of 2021 concerning the Implementation of Social Welfare has not been realized. The type of research used was field research with a qualitative approach conducted at the Tanah Datar District Office of Social Services, the Office of the Legal Aid Institute (LBH) Fiat Justitia Batusangkar, while the technique for collecting data was direct interviews, with Mr. AZ (head of the Tanah Datar Social), Mr. YA (leader of LBH Fiat Justitia Batusangkar), and Mrs. AH, (Young Expert Legal Analyst for the Regional Government of Tanah Datar Regency)

Abstract

TheprobleminthisresearchishowthelegalsystemoflitigationinIndonesiaandthelegalsystem of litigation in Indonesia from the siyasah dustiriyah perspective. The purpose of thisresearchistofindouthowthelegalsystemforlitigationinIndonesiaandthelegalsystemforlitigationfromthesiyasadusturiahperspective.Thetypeofresearchusedisthetypeoflibrary research or (library research) which is normative juridical. The data source in thisresearch is a secondary data source. Secondary data sources consist of: primary legalmaterials, secondary legal materials. Primary legal material for this research comes from acollection of legal materials in the form of legislation related to research, and secondary legalmaterialsintheformofmaterialsthatprovideexplanationsorsupportandexplorestatutoryregulationsfrombooks,articlesandjournals.Theresultsofthestudyshowthattheshiftinthe litigation process from HIR and RBg to Perma No. 1 of 2019 is seen in 3 stages, namely:thepreparationstage,theexaminationstageandthedeterminationstage.TheshiftinPermaNo.1of2019onlyappliestolitigantsanddoesnotapplytotheinternalcourtenvironment,because the purpose of enacting this Perma is to make it easier for the community to resolvetheir cases and to support the principles of a simple, fast and low-cost trial. Abstract

This study examines the mechanisms of price determination, profit distribution, and loss management in consignment sales transactions at Ombilin Market, Nagari Simawang. The research aims to analyze how prices are set, how profits are shared, and how losses or unsold consigned goods are handled within consignment-based trading practices at the market. The research adopts a field-based qualitative approach using a descriptive method. Data were collected from both primary and secondary sources. Primary data were obtained through observations and semi-structured interviews with traders and owners of consigned goods at Ombilin Market, while secondary data were gathered from other traders and community members with knowledge of local consignment practices. Snowball sampling was employed to identify relevant informants. Data analysis was conducted by systematically describing the empirical findings and interpreting them using relevant theoretical and legal frameworks. The findings reveal that price determination is carried out through mutual agreements between traders and consigned goods owners, taking into account prevailing market prices, operational costs, and demand conditions. Profit distribution is generally based on prior agreements, whereby traders receive approximately 30–40 percent of the total profit, while the remaining share is allocated to the owners of the consigned goods. In cases of losses arising from unsold goods, several mechanisms are applied, including returning the goods to the owners, renegotiating prices through sales to wholesalers at lower rates, sharing storage-related losses, or purchasing the goods at reduced prices upon mutual consent. When consigned goods are damaged, liability rests with the owner, provided that the trader has fulfilled the obligation to report the damage. From the perspective of Sharia economic law, the implementation of consignment agreements at Ombilin Market is consistent with the principles of wakālah bi al-ujrah. Price determination practices reflect Sharia principles of fairness and economic welfare, profit distribution corresponds to agreed-upon proportions, and loss management aligns with the concept of ḍamān in Islamic economic law.
