Abstract

Pemerintah Aceh telah diberi wewenang untuk menerapkan syariat Islam, termasuk dalam hal hukum jinayat, melalui undang-undang No. 18 Tahun 2001, No. 44 Tahun 1999, dan No. 11 Tahun 2006. Meskipun demikian, penerapan hukuman qishas dan diyat, yang merupakan bagian dari hukum jinayat, masih belum direalisasikan. Oleh karena itu, penelitian ini bertujuan untuk mengkaji lebih lanjut konsep hukuman qishas dan diyat dalam Islam, serta kebijakan hukum pidana terkait dalam qanun jinayat Aceh di masa mendatang. Penelitian ini menggunakan metode yuridis normatif, dengan sifat penelitian  deskriptif  analisis  terkait  tentang  kebijakan  hukuman qishas dan diyat dalam qanun jinayat Aceh. Berdasarkan hasil penelitian, konsep hukuman pidana bagi pelaku pembunuhan dalam Islam dapat dibagi menjadi tiga kategori. Pembunuhan yang dilakukan dengan sengaja akan mendapatkan hukuman balasan (qishas), yang dapat diganti dengan diyat jika pelaku dimaafkan. Pembunuhan yang serupa dengan sengaja akan dikenakan hukuman diyat, sedangkan pembunuhan yang tidak disengaja akan mendapat hukuman diyat, kafarat, dan tazir sebagai pengganti. Penerapan hukuman qishas dan diyat dalam qanun jinayat Aceh dianggap sebagai suatu keharusan, didukung oleh payung hukum yang kuat, yaitu Undang-undang No. 18 Tahun 2001 tentang Otonomi Khusus bagi Provinsi Nanggroe Aceh Darussalam (NAD), Undang-undang No. 44 Tahun 1999 tentang Keistimewaan Propinsi Daerah Istimewa Aceh, dan Undang-undang No. 11 Tahun 2006 tentang Pemerintahan Aceh. Penerapan qanun jinayat terkait hukuman qishas dan diyat bagi pelaku pembunuhan di Aceh sesuai dengan teori kebijakan hukum pidana dan mendapatkan dukungan dari kondisi sosial masyarakat Aceh yang mayoritas beragama Islam.

Abstract

The number of cases of violations that occurred in the process and implementation of elections, both administrative violations, election crimes, violations of the election organizers' code of ethics, Disputes between Election Participants (PSAP), Election Contestant Disputes with Election Organizers (PSPP). This research was created to analyze election law enforcement in Indonesia, with a focus on disputes that occur between election contestants (PSAP), disputes between election contestants and election organizers (PSPP), which are based on constitutional law, associated with theories which is relevant. In this study, the authors used a normative juridical method by analyzing data through a review of literature or secondary data which included primary legal raw materials, secondary legal materials and tertiary legal materials, both in the form of documents and applicable laws and regulations related to normative juridical analysis. implementation. election and election law. The results of the study show that: Election law enforcement and settlement is carried out by Bawaslu, Provincial Bawaslu, and Regency/Municipal Bawaslu with the authority to settle election process disputes and processes according to their respective levels, with the process of receiving requests, reviewing requests through formal verification and material verification, conduct mediation between disputing parties, conduct adjudication between disputing parties and decide. Bawaslu accepts the PSPP request as a result of the issuance of a KPU decision in the form of a Decree and/or Minutes. So that the elections to be held in 2024 can run according to the applicable laws and regulations. It is recommended that in upholding election law, election administration (KPU), Bawaslu and election participants, they must be able to guarantee free and fair elections, by guaranteeing the constitutional rights of all parties in a proportional and fair, honest and fair manner, as well as election results. which legitimizes the presence of leaders in accordance with the people's choice.

Abstract

Aparatur Sipil Negara (ASN) memiliki peran penting dalam sistem demokrasi sebagai pelayan masyarakat, pelaksana kebijakan publik, dan perekat persatuan bangsa, dengan kewajiban untuk menjunjung asas netralitas, terutama dalam pemilihan kepala daerah (Pilkada). Netralitas ini bertujuan untuk menjaga profesionalitas, integritas, dan kepercayaan masyarakat. Namun, sering terjadi pelanggaran, seperti keterlibatan ASN dalam kampanye terselubung, yang merusak citra mereka dan mencederai proses demokrasi. Penelitian ini menggunakan metode penelitian hukum normatif dan pendekatan perundang-undangan (statute approach), yang dipilih karena topik yang dibahas berkaitan dengan pengaturan netralitas ASN dalam UU No. 20 Tahun 2023 tentang Aparatur Sipil Negara. Hasil penelitian menunjukkan bahwa terdapat tiga faktor yang menyebabkan ASN tidak netral dalam Pilkada. Pertama, faktor sistematis, yaitu lemahnya penegakan aturan hukum dan kenyataan bahwa promosi jabatan serta penilaian kinerja ASN dikelola oleh pejabat politik. Kedua, faktor budaya, yaitu anggapan bahwa berafiliasi dengan partai politik tertentu dapat memberikan manfaat bagi karier mereka. Ketiga, faktor politik, yaitu tekanan dari pejabat politik atau penguasa daerah yang meminta ASN untuk mendukung kandidat tertentu dalam Pilkada.

Abstract

Tindak pidana pemalsuan surat oleh seorang Pegawai Negeri Sipil (PNS) dalam perkara pencairan dana Jaminan Kesehatan Nasional di Puskesmas Blang Cut Kota Lhokseumawe menunjukkan adanya ketidaksesuaian antara kenyataan (das sein) dan kewajiban hukum serta etika PNS (das sollen) sebagaimana diatur dalam Pasal 263 ayat (2) KUHP dan Undang-Undang Tindak Pidana Korupsi. Penelitian ini bertujuan untuk menganalisis unsur-unsur tindak pidana pemalsuan surat dan menelaah pertimbangan hakim dalam Putusan Nomor 229/Pid.B/2018/PN Lsm. Penelitian menggunakan metode yuridis normatif dengan pendekatan peraturan-undangan dan pendekatan kasus, serta dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa penipu terbukti secara sah unsur memenuhi Pasal 263 ayat (2) KUHP, yaitu menggunakan surat palsu berupa cek yang ditandatangani tanpa wewenang, menyadari kepalsuan tersebut, dan menimbulkan kerugian negara sebesar Rp191.133.000 untuk kepentingan pribadi. Majelis Hakim mempertimbangkan unsur-unsur anggotanya berupa perlindungan dan kerugian negara serta unsur meringankan seperti pengampunan dan pengembalian kerugian, lalu pidana penjara selama 2 tahun 6 bulan. Meskipun unsur tindak pidana korupsi juga telah terjadi, hukuman tersebut tidak mengacu pada UU Tipikor, yang menimbulkan pertanyaan terhadap efektivitas dan efektivitas hukum. Kebaruan dari penelitian ini terletak pada sorotan terhadap terbatasnya penerapan UU Tipikor dalam perkara yang seharusnya masuk dalam ranah korupsi jabatan. Kesimpulannya, diperlukan penegakan hukum yang lebih komprehensif dan saran bagi pembentuk kebijakan untuk menyusun pedoman yurisprudensi terkait pemidanaan PNS dalam kasus serupa guna mendorong keadilan yang konsisten dan berkeadaban hukum.

Abstract

Penelitian ini mengkaji peran kepolisian dalam upaya pencegahan peredaran narkoba melalui jalur perairan di Indonesia. Sebagai negara kepulauan terbesar di dunia. Indonesia menghadapi tantangan besar dalam mengawasi wilayah perairannya dari aktivitas penyelundupan narkoba. Penelitian ini bertujuan untuk menganalisis efektivitas strategi yang diterapkan oleh kepolisian, khususnya Direktorat Polisi Perairan (Ditpolair) dalam menanggulangi peredaran narkoba melalui jalur laut. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan yuridis empiris dan teknik purposive sampling. Data diperoleh melalui wawancara, observasi, dan dokumentasi, kemudian dianalisis secara deskriptif. Hasil penelitian menunjukkan bahwa kepolisian telah mengembangkan beberapa strategi untuk mencegah peredaran narkoba melalui jalur perairan, antara lain: penguatan koordinasi antar-lembaga, penggunaan teknologi pengawasan modern, patroli rutin di wilayah-wilayah rawan dan pelatihan khusus bagi personel. Namun penelitian juga menemukan beberapa kendala, seperti keterbatasan sumber daya manusia dan peralatan, luasnya wilayah perairan yang sekitarnya, serta kompleksitas modus operandi penyelundupan yang terus berkembang. Penelitian ini menyimpulkan bahwa peran kepolisian dalam pencegahan peredaran narkoba melalui jalur perairan masih perlu ditingkatkan melalui penguatan kapasitas institusional, peningkatan anggaran operasional, modernisasi peralatan serta penguatan kerja sama regional dan internasional. Rekomendasi meliputi peningkatan sistem pengawasan berbasis teknologi dan partisipasi masyarakat dalam sistem pelaporan, dan kerja sama antar negara-negara tetangga dalam operasi gabungan pengawasan perairan.

Abstract

A total of 50 beggars and homeless people have been recorded in Lhokseumawe City. This number has increased compared to the previous year, which recorded 37 beggars and homeless people. Article 34 paragraph (1) of the 1945 Constitution of the Republic of Indonesia affirms that the poor and neglected children shall be cared for by the state. In general, under Indonesia’s positive law, the activities of begging and vagrancy are classified as criminal acts. Substantively, criminal law provisions for beggars and homeless people remain necessary to address these issues in Lhokseumawe City. Based on this, the main problems are how criminal law policy regulates the handling of beggars and homeless people in Lhokseumawe City and how the implementation of criminal law enforcement is carried out against them. This research employs an empirical juridical method. The data sources consist of primary and secondary data, collected through interviews, observation, and document study, then analyzed qualitatively. The results show that there is no specific qanun (regional regulation) regarding beggars and homeless people. The existing criminal law policy still provides a legal basis for law enforcement against them. Efforts to address this issue include law enforcement, social rehabilitation, and social empowerment in accordance with Law Number 11 of 2009 and Government Regulation Number 31 of 1980. Therefore, handling beggars and homeless people can utilize provisions in the Indonesian Penal Code (KUHP), particularly Articles 504 and 505, which regulate begging and vagrancy in public places. The implementation of criminal law enforcement against beggars and homeless people in Lhokseumawe City still faces various obstacles in terms of legal structure, legal substance, and legal culture. Overall, law enforcement in this context requires regulatory reform, capacity building of law enforcement officers, and changes in the mindset of society and law enforcers to provide more effective and comprehensive solutions in addressing this issue.

Abstract

Demokrasi adalah sistem pemerintahan di mana keputusan politik didasarkan pada kesepakatan mayoritas yang diberikan secara bebas oleh rakyat dewasa, dengan tujuan menciptakan sistem pemerintahan yang responsif terhadap kebutuhan masyarakat. Di Indonesia, pemilihan kepala desa (Pilkades) merupakan salah satu bentuk perwujudan demokrasi di tingkat desa, yang diatur dalam Undang-Undang Nomor 6 Tahun 2014 tentang Desa dan dilaksanakan secara serentak di seluruh wilayah Indonesia, termasuk Kabupaten Pakpak Bharat. Penelitian ini bertujuan untuk menganalisis pelaksanaan Pilkades serentak di Kabupaten Pakpak Bharat berdasarkan Peraturan Bupati Pakpak Bharat Nomor 9 Tahun 2021, dengan fokus pada aspek hukum dan implementasi teknis pelaksanaannya. Metode penelitian yang digunakan adalah pendekatan normatif, dengan mengkaji peraturan perundang-undangan yang relevan, seperti UU Desa, Peraturan Pemerintah, dan Peraturan Bupati. Hasil penelitian menunjukkan bahwa meskipun Pilkades serentak telah dilaksanakan pada 13 desa di Kabupaten Pakpak Bharat, pelaksanaan di 39 desa lainnya masih tertunda karena ketidakjelasan dalam peraturan terkait pelaksanaan secara bergelombang. Penelitian ini menyimpulkan bahwa Peraturan Bupati Pakpak Bharat Nomor 9 Tahun 2021 perlu disesuaikan dengan peraturan perundang-undangan yang lebih tinggi untuk menghindari benturan hukum dan memberikan kepastian hukum dalam pelaksanaan Pilkades. Disarankan agar peraturan daerah dan peraturan bupati mengakomodasi ketentuan yang lebih rinci mengenai pelaksanaan Pilkades secara bergelombang, serta memastikan kepatuhan terhadap peraturan yang lebih tinggi.

Abstract

The hydrometeorological floods that struck several regions of Sumatra in late 2025 generated extensive humanitarian impacts, marked by significant loss of life, severe damage to vital infrastructure, and serious disruptions to socio-economic resilience across multiple provinces. Despite the escalation of these impacts, the government did not declare a national disaster emergency status, citing the adequacy of state capacity. This article examines the conformity of this policy decision with the statutory indicators for declaring a disaster emergency as stipulated in Law Number 24 of 2007 and Government Regulation Number 21 of 2008, and analyzes its constitutional implications for the protection of citizens’ fundamental rights. This study employs a normative legal research method using statutory, conceptual, and critical juridical approaches. The analysis focuses on disaster law norms, principles of administrative law, and the doctrine of constitutional state responsibility, particularly the concept of state omission. The findings demonstrate that disaster emergency indicators are objective, cumulative, and impact-based, and therefore cannot be reduced to administrative discretion or claims of state capacity alone. Empirically, the scale of casualties, damage to vital infrastructure, and cross-provincial reach indicate that the emergency threshold had been met, thereby narrowing policy discretion into a conditional legal obligation. Delaying the declaration of emergency status risks undermining command legitimacy, recovery budgeting, and the protection of the rights to life, health, and public safety. This article concludes that the Sumatra flood crisis risks transforming from a natural disaster into a constitutional disaster due to the absence of a decisive, transparent, and accountable legal determination by the state.

Abstract

General Background Character education is a core mandate of Indonesia’s national education system, yet classroom practices often prioritize cognitive achievement over value internalization. Specific Background In Pancasila and Civic Education learning, especially in Lhokseumawe City, teaching remains largely normative and theoretical, with limited integration of students’ socio-cultural realities. Knowledge Gap Although Acehnese local wisdom contains rich ethical teachings, Narit Maja as an oral tradition has not been systematically utilized as contextual teaching material in Civic Education. Aims This study aims to explore the ethical values embedded in Narit Maja and examine their relevance for integration into Pancasila and Civic Education learning. Results Using a descriptive qualitative ethnopedagogical approach, the study identifies values of honesty, deliberation, mutual cooperation, responsibility, and patriotism within Narit Maja that align with the dimensions of the Pancasila Student Profile. The findings also reveal structural and practical challenges, including limited regulations, insufficient documented materials, and institutional sectoral constraints, while highlighting digitalization as a strategic pathway. Novelty This study positions Narit Maja as a culturally grounded source of Civic Education content that bridges national curriculum objectives with Acehnese socio-cultural contexts. Implications Integrating Narit Maja into Civic Education supports contextual character formation, strengthens students’ cultural identity, and offers a sustainable approach to aligning national character education with local wisdom in Lhokseumawe City. Highlights: Acehnese oral expressions contain structured ethical principles aligned with national character frameworks. Contextual learning rooted in local culture addresses gaps between normative curriculum and student realities. Abstract

Criminal acts committed by youth motorcycle gangs have become a serious concern in many cities across Indonesia, including Lhokseumawe. Over recent years, Lhokseumawe has faced numerous criminal cases linked to these gangs, such as brawls, slashings, and muggings that disrupt public safety and road users. Despite various measures implemented by the Lhokseumawe City Government and Forkompimda, including curfews and night raids by Satpol PP, WH, and the Police, these efforts have yielded limited results. Many apprehended gang members repeatedly return to criminal activities, highlighting the ineffectiveness of current strategies. A new policy model is urgently needed to address this issue and ensure community safety. This research aims to propose a new preventive policy for the Lhokseumawe City Government. Using an empirical juridical method with a qualitative approach, the study examines field data and existing regulations. Laws governing juvenile involvement in motorcycle gangs include the 1945 Constitution, the Criminal Code, and laws on child protection and juvenile justice. Key factors driving gang involvement include lack of parental guidance, negative social environments, and restricted educational opportunities. Effective handling requires a dual approach: prevention through education, patrols, and social outreach, alongside repressive and rehabilitative measures to help reintegrate affected youth into society.
