Abstract

Restorative justice is a process of resolving criminal cases that involves the parties to restore justice, prioritizing a peaceful agreement and the fulfillment of the rights of victims and the responsibilities of perpetrators. Although it has been included in the provisions of each law enforcement agency, the implementation of restorative justice often experiences a differentiation between the requirements and the reality that occurs in the field. This attracted the author to conduct an implementation study of the restorative justice process in a case involving the fraudulent buying and selling of arisan, with a get-or-decline system handled by the Sat. Reskrim Polres Jombang. By using a type of juridical-empirical legal research method with a case approach, and a statutory approach, where the data is obtained from interviews and documents. Based on the study's results, the fraud case meets the formal and material requirements outlined in Police Regulation No. 8 of 2021, Article 4. At the level of the concept of criminal procedure law, the process of investigation, from investigation to termination of the case, has been in line with the standard operating procedures in the Criminal Procedure Code. Second, the case of fraudulent social gatherings has reflected the fulfillment of the context of maqāṣid al-syarī‘ah and the principle of ṣulḥ in efforts to resolve it according to Islamic law.

Abstract

Penelitian ini membahas penegakan hukum dan tanggung jawab korporasi atas eksploitasi lingkungan di sektor pertambangan yang hingga kini masih menyisakan berbagai persoalan serius. Dengan menggunakan metode yuridis normatif dan pendekatan deskriptif-analitis, penelitian ini menganalisis efektivitas regulasi lingkungan, implementasi tanggung jawab korporasi, serta hambatan dalam penegakan hukum. Hasil kajian menunjukkan bahwa meskipun terdapat kerangka hukum yang relatif komprehensif, pelaksanaannya masih lemah akibat keterbatasan pengawasan, rendahnya kepatuhan perusahaan terhadap dokumen AMDAL dan RKL, serta dominasi kepentingan politik dan ekonomi. Studi perbandingan dengan negara lain, seperti Jerman dan Australia, memperlihatkan pentingnya regulasi yang tegas, partisipasi publik, pemanfaatan teknologi pemantauan, serta kolaborasi multipihak dalam mewujudkan tata kelola pertambangan berkelanjutan. Penelitian ini menegaskan urgensi reformulasi kebijakan hukum yang responsif dan progresif sebagai instrumen substantif untuk melindungi lingkungan, memastikan akuntabilitas korporasi, dan mendorong terciptanya keadilan serta keberlanjutan pembangunan nasional.

Abstract

Indonesia’s penal system has long been dominated by a retributive approach inherited from colonial legal traditions, where imprisonment serves as the primary punishment for criminal offenders. This model has led not only to chronic prison overcrowding but also to the dehumanization of inmates, who still possess fundamental human rights. The newly enacted Indonesian Penal Code (KUHP) marks a significant shift toward a more progressive and humanistic penal paradigm, grounded in the values of Pancasila and the principles of restorative justice. This article aims to normatively analyze the paradigm shift in criminal punishment introduced by the new KUHP and its implications for Indonesia’s penal system, particularly in encouraging the implementation of alternative punishments such as community service, probation, and fines. The study employs a normative legal approach with qualitative analysis of relevant laws, regulations, and legal literature. Findings indicate that the application of alternative sanctions offers a viable solution to prison overcrowding while aligning with the rehabilitative and reintegrative goals of the correctional system. Nonetheless, several challenges remain, including the readiness of law enforcement institutions, infrastructure limitations, and the persistence of a punitive legal culture that views imprisonment as the only legitimate form of punishment. Therefore, a comprehensive implementation strategy is required, involving strong collaboration among government institutions, law enforcement, academia, and civil society to ensure a smooth transition toward a more just, restorative, and humane penal system.

Abstract

Artikel ini bertujuan untuk mendeskripsikan penemuan hukum dalam penafsiran putusan hakim Mahkamah Konstitusi (MK), dengan menggali beberapa kasus yang dimohonkan di MK yang kemudian menyebabkan adanya inkonsistensi asas hukum. Artikel ini menggunakan metode penelitian dengan melakukan pendekatan yuridis normatif, yakni dengan berfokus pada Undang-undang, Putusan MK, serta sumber hukum lainnya. Bahan sumber hukum yang diambil merupakan sumber data primer dan sekunder dengan pendekatan kepustakaan. Hasil penelitian menunjukkan untuk menghindari disharmoni asas hukum, maka diperlukan penafsiran oleh hakim konstitusi. Dalam Putusan MK Nomor 90/PUU-XXI/2023 ditemukan penafsiran hakim konstitusi yang berbanding dengan amar putusan MK. Dengan demikian, dapat disimpulkan bahwa adanya dissenting opinion oleh hakim konstitusi hadir sebagai instrumen penyelesaian dan sebagai cerminan independensi atau kebebasan hakim dan imparsialitas hakim, rekomendasi yang diperlukan adalah dengan adanya transparansi dalam pemilihan hakim MK dalam penanganan suatu perkara untuk menghindari konflik kepentingan dalam suatu perkara.

Abstract

This paper examines the integrative potential of legislative, rehabilitative, and educational strategies in Malaysia’s counter-terrorism policy, particularly within the framework of Preventing and Countering Violent Extremism (PCVE). The main problem addressed is the fragmented implementation of these three pillars, which often operate in isolation despite their complementary roles. The objective of this study is to analyze how these strategies interact, and to assess the extent to which Malaysia’s PCVE framework aligns with integrative models applied in other regions, such as South Asia and Latin America. Employing a qualitative literature-based method, the study draws from official policy documents, academic research, and comparative analysis to explore institutional strengths, implementation gaps, and strategic opportunities. The findings show that while Malaysia has developed a comprehensive legal and institutional infrastructure, coordination among state actors and involvement of civil society remain limited. The comparison reveals that inclusive governance and cross-sector collaboration significantly enhance the effectiveness of counter-terrorism efforts. The paper concludes that Malaysia’s PCVE strategy would benefit from a more interconnected approach that emphasizes transparency, participatory frameworks, and education-driven resilience. These insights offer valuable contributions to the refinement of Malaysia’s national security strategy and provide broader implications for sustainable and rights-based counter-terrorism policies globally

Abstract

This study examines the role of the International Monetary Fund (IMF) in promoting gender equality within its macroeconomic stabilization programs. It analyzes whether the IMF’s gender mainstreaming strategy genuinely advances women’s economic empowerment or remains constrained by traditional fiscal discipline and market-oriented objectives. Using a qualitative literature review, the paper synthesizes academic studies, IMF policy documents, and institutional reports published between 2015 and 2024, the period during which gender was formally integrated into IMF frameworks. Rather than producing new statistical analysis, this research reviews existing empirical evidence to assess how IMF-supported reforms influence gender outcomes. The findings indicate that although the IMF increasingly recognizes gender equality as “macro-critical” and has introduced tools such as gender-responsive budgeting and gender impact assessments, implementation remains uneven. In several low- and middle-income countries undergoing fiscal consolidation, particularly those heavily dependent on public-sector employment and limited social protection systems, austerity measures have reduced spending in health, education, and childcare—sectors crucial to women’s labor force participation. While gender-focused initiatives show potential, their effectiveness depends on institutional capacity and political commitment at the national level. The study concludes that meaningful progress requires a structural shift from austerity-centered stabilization toward inclusive macroeconomic governance, including counter-cyclical social spending, sustained investment in care infrastructure, and systematic integration of gender metrics into fiscal policy to strengthen long-term economic resilience and equitable development. Abstract

The correctional system in Indonesia emphasizes a rehabilitative approach that respects human rights, including the right to health for female inmates who are pregnant and breastfeeding. However, the fulfillment of maternal health rights in correctional institutions still faces several challenges, including limited health facilities, shortages of medical personnel, and limited understanding among inmates regarding their health rights. This community service activity aims to improve female inmates’ understanding of basic maternal health rights for pregnant and breastfeeding mothers and to encourage correctional services that are more responsive to the needs of mothers and children. The program applied the Participatory Action Research (PAR) method, which emphasizes inmates' active participation in identifying problems, discussing possible solutions, and reflecting on the outcomes of the activities. The activity was conducted on July 14, 2025, at the Women’s Correctional Institution Class IIA Pontianak, involving 40 female inmates, including four pregnant inmates and three breastfeeding inmates, with support from correctional officers and an academic team from Universitas Tanjungpura. The program included educational sessions, interactive discussions, and participatory reflections on maternal health rights, nutrition during pregnancy and breastfeeding, and procedures for accessing health services inside and outside the correctional institution. The results show increased understanding of maternal health rights and the importance of proper nutrition and accessible health services. Discussions also identified institutional limitations, including maternal health facilities, lactation support, and availability of medical personnel.

Abstract

The rapid advancement of digital technology has transformed the nature of crime and evidence, requiring legal systems to accommodate electronic forms of proof. This study analyzes the admissibility of electronic evidence in Indonesian criminal procedure law and its implications for the protection of privacy, particularly in cases involving the dissemination of sexual content. Using a normative juridical approach, this research examines statutory frameworks, including the ITE Law and its 2024 amendment, the 1945 Constitution, Law No. 20 of 2025 on the new Criminal Procedure Code, and Law No. 27 of 2022 on Personal Data Protection. It also employs a case study of the Pandeglang District Court Decision No. 71/Pid.Sus/2023/PN Pdl to assess the gap between das sollen and das sein. The findings indicate that Indonesia has normatively established a clear legal basis recognizing electronic evidence as valid and binding. However, judicial practice, particularly in cases decided prior to the enactment of the new KUHAP and the Personal Data Protection Law, tends to prioritize evidentiary validity over the protection of victims’ privacy. The Pandeglang case demonstrates that although electronic evidence was lawfully admitted, the absence of procedural safeguards created risks of re-victimization and undermined the victim’s dignity. This study concludes that while the issue of admissibility has been resolved under the current legal framework, challenges remain in ensuring privacy protection in judicial practice. Therefore, courts must adopt rights-sensitive approaches, including closed hearings, anonymization, and proportional use of evidence, to balance evidentiary effectiveness with the protection of fundamental rights in the digital era.

Abstract

Indonesia adalah negara hukum, sesuai bunyi dalam Pasal 1 Ayat 3 UUD 1945, Maka dalam sekecil apapun perbuatan yang kita lakukan hendaklah berdasarkan norma hukum, jangan sampai perbuatan kita melanggar norma hukum. Maraknya kasus bullying terhadap anak di Indonesia membuat penulis tertarik meneliti soal efektifitas regulasi perundang-undangan Indonesia dalam penanganan kasus bullying anak yang ada di Indonesia berdasarkan tujuan hukum. Beberapa peraturan perundang-undangan yang mengatur mengenai masalah di atas diantaranya; UU No 35 Tahun 2014 tentang perubahan atas UU No 23 tahun 2002 tentang perlindungan anak, UU No 19 Tahun 2016 tentang perubahan atas UU No 11 Tahun 2008 tentang informasi dan transaksi elektronik, KUHP (UU No 1 Tahun 2023), dan UU No 1 Tahun 2024 Tentang Perubahan Kedua Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik, dan beberapa peraturan pendukung lainnya. Setelah melakukan beberapa penjabaran dan penjelasan penulis menyimpulkan beberapa hal. Pertama tidak ada permasalahan signifikan terhadap regulasi hukum Indonesia, namun ada beberapa tambahan. Kedua, ada pelaksanaan regulasi yang efektif maupun tidak. Ketiga, penulis berharap untuk oknum yang terlibat dan bertugas untuk lebih jujur dan tegas demi kemajuan hukum yang ada di Indonesia.
