Jurnal Jurusan Pendidikan Kewarganegaraan Undiksha adalah jurnal ilmiah yang diterbitkan oleh Jurusan Pendidikan Kewarganegaraan, Fakultas Hukum dan Ilmu Sosial, Universitas Pendidikan Ganesha. Jurnal ini bertujuan untuk mewadahi artikel-artikel hasil penelitian dan hasil pengabdian masyarakat dibidang pendidikan dan sosial pembelajaran. Pada akhirnya Jurnal ini dapat memberikan deskripsi tentang perkembangan ilmu pengetahuan dan teknologi di bidang pendidikan kewarganegaraan bagi masyarakat akademik. Abstract

Indonesia is a country that has a variety of diversity in it, be it diversity of religion, ethnicity, language, and culture. This diversity has the potential to create various conflicts in society. For this reason, Multicultural Education is important as a means of creating a harmonious situation in the midst of diversity in Indonesia. The purpose of this article is so that people can form awareness and understanding within themselves, to be able to respect, appreciate and be tolerant of cultural diversity in Indonesia. The method used in this research is a qualitative research method in the form of literature study by collecting relevant data, which supports the writing of this article. The result of this research is that Multicultural Education provides an understanding that cultural diversity is not an obstacle, but can be a factor that can form unity in society, so as to create a harmonious life.

Abstract

This study aims to analyze and identify the dynamics of the relationship between the residents of the Bali Traditional Village and the Chinese population in Singaraja City, Bali. This study also focuses on several important things, namely: (1) Knowing and analyzing the harmonization of relations between the indigenous people of the Balinese Traditional Village and the Chinese population in Singaraja City, (2) Attitudes and behaviors between residents (Balinese and Chinese Traditional Villages), and (3) How to maintain harmony between communities. This research uses ethnographic methods and focuses on cases or phenomena that occur in the field. In addition, this study also uses a descriptive qualitative approach, so that later the results of the research will be described through deeper and more detailed descriptions and explanations. Some of the final results obtained in this study are: (1) Despite having different customary traditions, races, and beliefs, the residents of Balinese and Chinese Traditional Villages highly uphold harmony with each other, (2) The positive attitudes and behaviors reflected from both sides of the population strongly reflect high harmonization and tolerance, and (3) Both types of residents attach importance to mutual cooperation (nyama braya), solidarity, and very high tolerance.

Abstract

Seiring dengan kemajuan teknologi di era globalisasi, masuknya budaya asing ke Indonesia juga semakin pesat. Namun, masyarakat tetap perlu melestarikan kearifan budaya lokal dengan mempelajari dan menghayati budayanya sendiri. Salah satu warisan budaya di Bali adalah tradisi Megoak-goakan yang berasal dari Desa Panji, Kecamatan Sukasada, Kabupaten Buleleng. Tradisi ini dilakukan sebagai bentuk penghormatan kepada Ki Gusti Panji Sakti, Raja Buleleng, dan masih dilestarikan hingga saat ini dalam bentuk permainan tradisional yang diselenggarakan pada hari Ngembak Geni, sehari setelah Hari Raya Nyepi. Tradisi Megoak-goakan mengandung berbagai nilai budaya, seperti nilai religius, persatuan, sosial budaya, dan gotong royong. Nilai-nilai tersebut menumbuhkan karakter religius, gotong royong, nasionalisme, integritas, dan kemandirian dalam masyarakat. Implementasi tradisi ini dalam bentuk permainan tradisional juga dapat diterapkan di sekolah untuk menanamkan karakter positif pada siswa, maupun di masyarakat untuk meminimalisir perilaku negatif. Dengan demikian, terciptalah kehidupan sosial yang harmonis dan menjunjung tinggi persatuan. Dapat disimpulkan bahwa Megoak-goakan merupakan media penguatan karakter berbasis kearifan lokal yang relevan di tengah derasnya arus globalisasi..

Abstract

This study aims to examine the development of digital constitutionalism within the framework of human rights protection, with particular emphasis on the right to internet access from national and global perspectives. The research employs a normative legal method using statutory, conceptual, and comparative approaches. Primary legal materials include international human rights instruments, provisions of the Indonesian Constitution, and relevant judicial decisions concerning internet access restrictions. Secondary materials are drawn from scholarly literature on digital constitutionalism and human rights in the digital era. The findings indicate that although the right to internet access is not explicitly recognized as a constitutional right under the 1945 Constitution of the Republic of Indonesia, its normative foundation can be derived from constitutional guarantees of freedom of expression and the right to information. The case of Anuradha Bhasin v. Union of India demonstrates that state-imposed restrictions on internet access must comply with the principles of legality, proportionality, and necessity. This study concludes that the internet has evolved beyond a mere technological tool into a fundamental prerequisite for the effective exercise of various human rights, thereby requiring states to regulate and protect internet access within a democratic and human rights–based framework of digital constitutionalism.
