Abstract

This study aims to evaluate the effectiveness of Nahdlatul Ulama (NU) Coin fund management in improving community welfare in Pekalongan City, Indonesia. LAZISNU, as one of the Amil Zakat Institutions, has a work program that focuses on collecting infak and alms from the community through the NU Coin movement (NU-care). NU Care-LAZISNU is a non-profit organization under the Nahdlatul Ulama (NU) association. This research is a type of qualitative research with a case study approach using primary data sources and secondary data. This research revealed that the management of NU coin funds in Pekalongan City has not reached the expected level of effectiveness, because only a few branches are consistently involved in fundraising activities, resulting in the planned work program has not reached its maximum potential.Penelitian ini bertujuan untuk mengevaluasi efektivitas pengelolaan dana Koin Nahdlatul Ulama (NU) dalam meningkatkan kesejahteraan masyarakat di Kota Pekalongan, Indonesia. LAZISNU, sebagai salah satu Lembaga Amil Zakat, memiliki program kerja yang berfokus pada pengumpulan infak dan sedekah dari masyarakat melalui gerakan NU Coin (NU-care). NU Care-LAZISNU adalah organisasi nirlaba di bawah asosiasi Nahdlatul Ulama (NU). Penelitian ini merupakan jenis penelitian kualitatif dengan pendekatan studi kasus menggunakan sumber data primer dan data sekunder. Penelitian ini mengungkapkan bahwa pengelolaan dana koin NU di Kota Pekalongan belum mencapai tingkat efektivitas yang diharapkan, karena hanya beberapa cabang yang secara konsisten terlibat dalam kegiatan penggalangan dana, sehingga program kerja yang direncanakan belum mencapai potensi maksimalnya.

Abstract

The term "creative economy" refers to a way to pursue sustainable development through creativity. Information technology plays an important role in marketing because it has the ability to create new sectors and change the way people use technology and conduct business. The purpose of the research is to understand how marketing development strategies use technology and information, identify factors that support and hinder marketing development using information technology, and find out how Sharia economic law views marketing development strategies using information technology at Online Shop Fifau hijab Cirebon during the COVID-19 pandemic. The methodology used in this research is qualitative. Interviews, documentation, and literature studies were the data collection methods. The findings of this study show that the marketing development plan of Fifau hijab Cirebon during the COVID-19 pandemic was made using information technology, namely social media sites such as FB, WA, Shopee, Instagram, and TikTok. This tactic is acceptable in Sharia Economic Law if it does not interfere with the basics of muamalah.Istilah "ekonomi kreatif" mengacu pada cara untuk mengejar pembangunan berkelanjutan melalui kreativitas. Teknologi informasi memainkan peran penting dalam pemasaran karena memiliki kemampuan untuk menciptakan sektor-sektor baru dan mengubah cara orang menggunakan teknologi dan menjalankan bisnis. Tujuan dari penelitian adalah untuk memahami bagaimana strategi pengembangan pemasaran menggunakan teknologi dan informasi, mengidentifikasi faktor-faktor yang mendukung dan menghambat pengembangan pemasaran menggunakan teknologi informasi, dan mengetahui bagaimana pandangan hukum ekonomi syariah terhadap strategi pengembangan pemasaran menggunakan teknologi informasi pada Online Shop Fifau hijab Cirebon di masa pandemi COVID-19. Metodologi yang digunakan dalam penelitian ini adalah kualitatif. Wawancara, dokumentasi, dan studi literatur menjadi metode pengumpulan data. Temuan penelitian ini menunjukkan bahwa rencana pengembangan pemasaran Fifau hijab Cirebon selama pandemi COVID-19 dibuat dengan menggunakan teknologi informasi, yaitu situs media sosial seperti FB, WA, Shopee, Instagram, dan Tiktok. Taktik ini dapat diterima dalam Hukum Ekonomi Syariah jika tidak mengganggu dasar-dasar muamalah.

Abstract

Fintech equity crowdfunding is now available in Indonesia, providing an alternative option for MSMEs to raise capital. As the majority of Indonesia's population is Muslim, sharia-based fintech equity crowdfunding is a more suitable option for those seeking funding according to Islamic principles. This system has the potential to be a capital solution for MSMEs more simply and ethically. This research aims to explore the potential of Sharia crowdfunding as an effective means for MSMEs to expand their business operations, ultimately contributing to broader economic sector improvements in Indonesia. Additionally, it assesses the conformity of this practice with OJK regulations and Fatwa DSN-MUI, as well as its compliance with Sharia principles. The descriptive-analytical method is employed, analyzing various documents and texts from various sources. The results indicate that Sharia-based fintech, particularly in the form of crowdfunding, can be an effective means for MSMEs to obtain capital through online platforms. Crowdfunding also presents opportunities for investors who wish to contribute to the funding of MSMEs in a manner that aligns with Sharia principles.

Abstract

BMT Ibadurrahman is an economic and financial institution that applies Shariah principles in all its activities. The main target of BMT Ibadurrahman is micro, small, and medium enterprises abbreviated as MSMEs. The empowerment of MSME actors is one of the patterns of creating distributive justice patterns in the Islamic economy. In addition to creating distributive justice in the economy, making people aware of the dangers of usury is one of the objectives of BMT Ibadurrahman's presence in order to prevent people from getting involved in the vicious practice of usury. The empowerment pattern carried out by BMT Ibadurrahman is not so smooth because there are several things that need to be prepared. There are two factors that are one of the causes of obstruction of the MSME empowerment pattern carried out by BMT Ibadurrahman, both from internal and external perspectives. This is an obstacle for BMT Ibadurrahman in achieving the empowerment of MSMEs in Sukabumi City and Sukabumi Regency.BMT Ibadurrahman merupakan lembaga yang bergerak di bidang ekonomi dan keuangan yang dalam segala aktivitasnya menggunakan prinsip syariah. Sasaran utama BMT Ibadurrahman dalam para pelaku usaha mikro kecil menengah atau yang disingkat UMKM. Pemberdayaan para pelaku UMKM menjadi salah satu pola terbentuknya pola keadilan distributif dalam ekonomi Islam. Selain dari terciptanya keadilan distributif dalam perekonomian, menyadarkan masyarakat akan bahayanya riba menjadi salah satu tujuan hadirnya BMT Ibadurrahman dalam menjaga masyarakat agar tidak terjerat ke dalam ganasnya praktik riba. Pola pemberdayaan yang dilakukan oleh BMT Ibadurrahman tidak begitu mulus karena ada beberapa hal yang harus di persiapkan. Ada dua faktor yang menjadi salah satu penyebab terhambatnya pola pemberdayaan UMKM yang dilakukan oleh BMT Ibadurrahman, baik dari segi internal maupun eksternal. Hal ini menjadi rintangan BMT Ibadurrahman dalam tercapainya pemberdayaan UMKM yang ada di Kota Sukabumi maupun Kabupaten Sukabumi

Abstract

This research examines the legal consequences of the choice of forum clause for resolving Sharia banking disputes in the general court in the agreement made by the parties. Prior to the issuance of Constitutional Court Decision Number 93/PUU-X/2012, the parties could determine the clause of choice of forum for resolving banking disputes by litigation through the district court. The research objectives examine 1) the authority of religious courts in adjudicating and resolving Sharia banking disputes before the issuance of Constitutional Court Decision Number 93/PUU-X/2012; and 2) the legal consequences of the choice of forum for resolving Sharia banking disputes in the district court in the agreement before the issuance of Constitutional Court Decision Number 93/PUU-X/2012. This type of doctrinal research uses a conceptual approach and legislation. The technique of analyzing research materials uses a prescriptive approach with the aim of providing arguments for the results of research that has been done. This research concludes that: 1) the choice of forum clause for resolving Sharia banking disputes before the issuance of Constitutional Court Decision Number 93/PUU-X/2012, cannot override the legal provisions related to the absolute competence of religious courts; 2) the legal consequences of the lawsuit for Sharia banking disputes through the district court, either before or after the issuance of Constitutional Court Decision Number 93/PUU-X/2012, the decision on the case must be declared unacceptable (niet ontvankelijke verklaard).     Penelitian ini mengkaji akibat hukum klausula pilihan forum penyelesaian sengketa perbankan syariah di peradilan umum dalam perjanjian yang dibuat para pihak. Sebelum keluarnya putusan MK Nomor 93/PUU-X/2012, para pihak dapat menentukan klausula pilihan forum penyelesaian sengketa perbankan secara litigasi melalui pengadilan negeri. Tujuan penelitian mengkaji: 1) kewenangan pengadilan agama dalam mengadili dan menyelesaikan sengketa perbankan syariah sebelum keluarnya putusan MK Nomor 93/PUU-X/2012; dan 2) akibat hukum pilihan forum penyelesaian sengketa perbankan syariah di pengadilan negeri dalam perjanjian sebelum adanya putusan MK Nomor 93/PUU-X/2012. Jenis penelitian doktrinal dengan menggunakan pendekatan konseptual, dan peraturan perundang-undangan. Teknik analisis bahan penelitian menggunakan pendekatan preskriptif dengan tujuan untuk memberikan argumentasi terhadap hasil penelitian yang telah dilakukan. Penelitian ini menyimpulkan bahwa: 1) klausula pilihan forum penyelesaian sengketa perbankan syariah sebelum keluarnya putusan MK Nomor 93/PUU-X/2012, tidak dapat mengesampingkan ketentuan hukum terkait dengan kompetensi absolut pengadilan agama; 2) akibat hukum gugatan sengketa perbankan syariah melalui pengadilan negeri, baik sebelum atau setelah keluarnya putusan MK Nomor 93/PUU-X/2012, maka putusan atas perkara tersebut harus dinyatakan tidak dapat diterima (niet ontvankelijke verklaard).

Abstract

The Indonesian Ulema Council should maintain professionalism and independence when providing halal certification to ensure that the needs of Muslim consumers are met in accordance with religious teachings. Objectivity should be prioritized to avoid any subjective evaluations. The purpose of this research was to investigate the mechanism for issuing halal guarantee certification in the Processed Food Industry in West Java. Additionally, the study aimed to examine the application of the principles of independence and professionalism of the Indonesian Ulema Council in issuing Halal Guarantee Certification. The methodology employed in this research involved a qualitative approach through field research. The process for obtaining halal assurance certification starts when the Company provides written confirmation that it intends to implement SJH in accordance with the rules outlined by LPPOM MUI. Independence is not just determined by the organizational structure of an institution; expertise, field data, and appearance must also be considered. The Indonesian Ulema Council's application of the Professionalism principle in granting Halal Guarantee Certification to the food processing industry in West Java is evident in its product assessment methods. The Council has effectively coordinated with LPPOM to carry out the process appropriately and efficiently. Majelis Ulama Indonesia senantiasa dituntut untuk menjunjung profesionalisme dan independensi dalam pemberian penetapan halal agar kebutuhan konsumen muslim dapat tetap terjaga dari hal-hal yang diharamkan menurut ajaran agama. Penelitian dilakukan untuk mengetahui mekanisme penerbitan sertifikasi jaminan halal pada Industri Olahan Makanan di Jawa Barat; serta penerapan prinsip independensi dan profesionalisme Majelis Ulama Indonesia dalam menerbitkan Sertifikasi Jaminan Halal. Penelitian ini merupakan penelitian lapangan (field research) dengan pendekatan kualitatif. Mekanisme penerbitan sertifikasi jaminan halal diawali dengan Perusahaan menyatakan secara tertulis tujuan penerapan SJH di perusahaannya sesuai dengan aturan yang telah digariskan oleh LPPOM MUI. Aspek independensi tidak hanya dilihat dari kemandirian dalam penyelenggaraan suatu lembaga saja, jauh dari itu pertimbangan keahlian, data lapangan dan juga penampilan harus menjadi tolak ukur utama. Penerapan prinsip Profesionalisme Majelis Ulama Indonesia dalam menerbitkan Sertifikasi Jaminan Halal pada industri makanan olahan di Jawa Barat dapat dilihat pada metode pengkajian produk industri olahan makanan. Majelis Ulama Indonesia telah mampu melaksanakan koordinasi yang baik dan tepat dengan memberikan peran ini pada LPPOM.

Abstract

This research is provided to examine cryptocurrency airdrop business activities as Hibah contracts in Fiqh muamalah, focusing on the Sharia framework and legal provisions in Indonesia. The main goal is to promote the promotion of new cryptocurrencies and increase the liquidity and value of cryptocurrencies. The research method used is the juridical normative research method, which specifically explores the implementation of norms, rules, and regulations contained in positive law and Islamic law. The research results confirm that the cryptocurrency airdrop business activities according to Fiqh Muamalah require fulfillment of the terms and conditions of the grant agreement, Ijarah agreement, and compliance with national legal provisions. In implementing an airdrop, crucial aspects such as the type of cryptocurrency being distributed, strict terms and conditions, and airdrop security are the main focus. Considering all these elements, it is hoped that cryptocurrency airdrop business activities can run efficiently and provide optimal benefits for all parties involved.

Abstract

Indonesia's economic landscape has been significantly impacted by the COVID-19 pandemic, both at micro and macro levels. To address these challenges, it is imperative to implement optimal and sustainable financial management strategies. Given Indonesia's predominantly Muslim population, the development of an Islamic financial system, including the use of Zakat as a distribution instrument, holds great potential. As an obligation for Muslims, Zakat can be a highly productive means of addressing the country's economic challenges.     This study proposes a model for economic empowerment through productive Zakat to effectively address the impact of the COVID-19 pandemic on the Indonesian economy. The research methodology utilized a library research approach with descriptive qualitative methods. Data was meticulously collected from various sources including books, articles, journals, news, homepages, and other scientific references. The management of productive Zakat has great potential for contributing to the economic recovery of Indonesia after the COVID-19 pandemic. Productive Zakat involves an economic empowerment model that has personal and spiritual dimensions, and its impact on social life is significant. The management of productive Zakat is a support system for the better and sustainable development of Indonesia's economy.

Abstract

This research aims to examine the relationship between the market share of sharia banks in Malaysia and Indonesia simultaneously as a function of profit sharing, number of offices, and Third-Party Funds (TPF), with Return on Assets (ROA) as an intermediary variable. Both countries have similarities in being a country with a Muslim majority population and implementing a dual banking system. The annual financial reports of Sharia banks in Indonesia and Malaysia from 2016-2021 are the secondary data source for this quantitative research. A technique called path analysis is used. According to research, there is no statistically significant relationship between TPF and market share. The market share of Sharia banks is strongly influenced by profit sharing. Market share is strongly influenced by the number of offices. The impact of TPF on ROA-based market share is not significant. ROA is the main mechanism by which profit sharing affects market share. Through the ROA of Sharia banks, the number of offices influences market share. If Sharia banks want to maximize income, grow their overall assets, and increase their market share, then Sharia banks must think about how to manage TPF more effectively and efficiently, based on the conclusions of this research.

Abstract

This study aims to determine the SWOT analysis of the halal industry in Indonesia using a mix method, namely the NVIVO analysis method and literature review studies. Research samples are news articles from trusted sources and national and international journals. From the study results, it was found that the words halal, industry, Indonesia, and product became the dominant words appearing in the discussion of the halal industry. There are four main topics discussed, namely strengths, weaknesses, opportunities, and challenges of the halal industry. The strongest relationship occurs between the challenges of the halal industry and the strength of the halal industry (0.840396), and the weakest between the opportunities of the halal industry and the challenges of the halal industry (0.542586). The results of the literature review show that the strengths and opportunities outweigh the weaknesses and challenges so that the halal industry in Indonesia is feasible to run. The implication of this study is to provide an overview of the topic of the halal industry and the feasibility of the halal industry in Indonesia. It is expected to be used as a reference for prospective entrepreneurs in the halal industry and related policy stakeholders to maximize the halal industry in Indonesia.
