Abstract

The marital beslag plays an important role in protecting common property. The urgency of submitting a marital beslag request was to protect the integrity of the communal property so that, during the process, neither the husband nor the wife could transfer the communal property to a third party. Sometimes, the marital beslag request might have been granted or denied by the judge. The purpose of this research was to understand and analyze the reasons why judges did not grant marital beslag requests, to understand and analyze the evidence of the marital beslag submitted by the plaintiff so that it could be accepted by the judge, and to examine and analyze Religious Court Decision Number 533/Pdt. G/2021/PA.Bn and Decision No. 561/Pdt. Bn. G/2025/PA.Krw regarding marital status. This study employs normative legal research. The research approach used in this thesis is legislative, conceptual, and case-based. The analysis results indicate that (1) In Decision Number 533/Pdt. G/2021/PA.Bn, a marital beslag could not be granted because the lawsuit was declared obscuur libel (vague/unclear), thus formally not meeting the requirements of legal proceedings (Article 8 RBg jo. Article 118 HIR). Meanwhile, in Decision No. 561/Pdt. G/2025/PA.Krw, the marital beslag was denied because the divorce lawsuit as the main matter was not materially proven, so the matter of joint property along with its marital beslag was automatically not accepted; (2) The requirements for accepting marital beslag are: the lawsuit must not be vague, the object of the dispute must be described in detail; there must be authentic evidence demonstrating that the property is joint property acquired during the marriage; there must be urgent reasons to protect the property from potential transfer or concealment; and the seizure must not harm third parties. Failure to meet these requirements, both formally and materially, results in the denial of the marital beslag request. The rejection of marital beslag in Decision Number 533/Pdt. G/2021/PA.Bn and Decision No. 561/Pdt.G/2025/PA.Krw emphasizes that a request for marital beslag could only be granted if it met the formal and material requirements according to the provisions of civil procedural law.

Abstract

Bureaucratic reform in Indonesia concerning the simplification of structures by transforming positions from structural to functional positions has been issued, starting with SE MenPANRB No. 391/2019 and implemented through PermenPANRB No. 17/2021. However, at the regional level, regulatory synchronization and operational readiness are often imbalanced. This is because the sequence of issuance of laws, regulations, and instructions (for example, the equalization mechanism precedes structural simplification) and the unavailability of adequate technical guidelines cause implementation gaps in the project. The Padang City Bappeda is a relevant case study. The need for 47 new functional positions should be filled, yet only 17 have been fulfilled; even promotions, transfers, and deaths of employees are not balanced with quick filling mechanisms and post-equalization training/certification availability. This study analyzes the effectiveness of the policy using a qualitative descriptive approach through a purposive sample of key officials and civil servants. Data were collected through in-depth interviews and documentation, validated using source triangulation, and analyzed using reduction, presentation, and conclusion drawing. The results showed insufficient formation of functional officers, a mismatch of competency with position, an administrative system that was not efficient and integrated, and the absence of a job map based on workload analysis. Viewed through the lenses of Dunn's framework, dimensions such as effectiveness, efficiency, adequacy, responsiveness, and precision have not been optimally achieved in the current study. As a result, the workload was concentrated on a few functional officers, often handling multiple subfields; this, in turn, slowed data/planning services and reduced the quality of strategic decision-making. Therefore, in the face of a shortage of functional officers in Bappeda Kota Padang, it is recommended that the regional government immediately prepare and implement clear and integrated technical regulations on the functional position staffing mechanism.

Abstract

This study investigates the relationship between Islamic finance development and environmental performance in ten Organisation of Islamic Cooperation (OIC) countries from 2010 to 2023, focusing on the moderating role of governance quality. Using the Environmental Performance Index (EPI) as a composite measure of sustainability, we employ fixed-effects panel regression models to test whether a higher share of Islamic finance in national banking sectors is associated with improved environmental outcomes and whether governance quality strengthens this relationship. Contrary to prevailing theoretical expectations, the results reveal a persistent and statistically significant negative association between the Islamic finance share and environmental performance across all model specifications. Governance quality shows a modest, positive direct effect on environmental performance, but fails to moderate the Islamic finance environment nexus in a statistically significant way. GDP per capita consistently negatively influences EPI scores, indicating a growth environment trade-off, while foreign direct investment remains insignificant. These findings challenge the assumption that Islamic finance is inherently aligned with environmental goals and highlight the need for targeted policy interventions, such as explicit environmental screening in Shariah governance, development of green Islamic finance products, and integrated sustainability mandates that the sector contributes meaningfully to environmental sustainability in OIC countries.

Abstract

The Society 5.0 era requires human resource development that goes beyond technical competence to include strong moral integrity and sustainability principles. Local wisdom, such as the Poda na Lima philosophy from the Sipirok community, offers potential as a foundation for holistic HR development. This study examines the relevance of Poda na Lima’s philosophy to HR development among Sipirok migrants living in Medan City. Using a descriptive qualitative approach, the study involved 12 informants from various professional backgrounds selected through purposive and snowball sampling techniques. Data collection was carried out through in-depth interviews, participatory observation, and documentation, and then analyzed using the Miles, Huberman, and Saldana data analysis model with support from the source, method, and theoretical triangulation. Results show that the five principles of Poda na Lima—Paias Rohamu (Cleansing the Soul), Paias Pamatangmu (Cleansing the Body), Paias Parabitonmu (Cleansing Clothing), Paias Bagasmu (Cleansing the House), and Paias Pakaranganmu (Cleansing the Environment)—have strategic relevance to modern HR development concepts. This philosophy works as an operational framework for building professional competence, character, and performance, while offering solutions to globalization challenges. This research confirms that Poda na Lima can be positioned as an Indigenous Management Framework that provides a competitive advantage by integrating noble local wisdom values with contemporary management principles

Abstract

The abolition of criminal sanctions in Law Number 2 of 2017 concerning Construction Services creates a vacuum and uncertainty in law enforcement. Previously, in cases of construction failures and accidents that caused injuries and deaths, the perpetrators could be charged with Article 43 of Law Number 18 of 1999 concerning Construction Services, but with the removal of this criminal provision, law enforcement was carried out using the Criminal Code and/or building law. This condition results in disparities in the law enforcement. This research aims to discuss the void of criminal law in Law Number 2 of 2017 concerning Construction Services and comprehensively examine policies and legal protection for construction accident victims. The type of research used is normative juridical with a descriptive-analytical approach, discussing existing legal symptoms and problems and testing them based on applicable laws and regulations. The results of this study show that the void in criminal law in construction services law occurs due to the elimination of criminal sanctions based on legal political factors; thus, law enforcement for construction accidents cannot be carried out using special laws on construction services. Legal protection for victims of construction accidents is emphasized in law enforcement to provide a deterrent effect against perpetrators, consisting of the application of strict sanctions, compensation for victims, and the implementation of occupational health and safety management standards.

Abstract

This study analyzes the effect of regional taxes on Regional Own Source Revenue (ROSR) in Bengkulu City and explains the dynamics of ROSR development from 2018 to 2023. Using a quantitative approach, the research employs multiple linear regression with secondary data from regional budget realization reports and regional tax realization by type, covering hotel, restaurant, entertainment, parking, and street lighting taxes. ROSR is treated as an indicator of local fiscal capacity and independence. The results show that hotel, restaurant, and street lighting taxes have a positive and statistically significant effect on ROSR, indicating that hospitality, culinary, and electricity-based tax bases are the dominant contributors to locally generated revenue. In contrast, entertainment and parking taxes do not have a significant effect, reflecting limited sector potential and suboptimal tax administration in these areas. Simultaneously, all five tax types significantly influenced the ROSR, and the model explained a large proportion of its variation, underscoring the importance of regional tax management as an integrated system. The findings highlight the need to strengthen regulations, enhance supervision, expand the formal tax base, and intensify the digitalization of tax collection to optimize the ROSR and support the long-term fiscal independence of Bengkulu City.

Abstract

In the digitalization era, language strategy has become an important part of tourism brands to enhance a destination's appeal and image. This study examines the language on the Mandailing Natal Regency Tourism Office Website (https://pariwisata.madina.go.id/), which is used for tourism branding. The research method used is qualitative descriptive analysis with a critical text analysis approach, including data collection from website content. The study results indicate that the language used on this website has several shortcomings, such as less attractive narratives, inconsistent language style, a lack of emphasis on local identity, and a suboptimal information structure. In addition, the visual elements on the website are not supported by relevant narratives. This means that the potential of Mandailing Natal Regency tourism branding has not been fully utilized using a language strategy. They could do a better job with language style consistency, local feeling emphasis, and findability elements. The findings of this study offer strategic recommendations for improving website quality and advancing tourism communication strategies.

Abstract

The rapid integration of artificial intelligence (AI) into education has shifted the paradigms of teaching and professional development. AI has been positioned not as a substitute for teachers but as a partner that relieves them from routine tasks, allowing greater focus on higher-order learning and reflective pedagogy. Professional standards and national regulations highlight the centrality of reflection and continuous professional growth as essential elements of teacher professionalism. Nevertheless, reflective practices backed by AI/technology lack empirical evidence, particularly for in-service teachers in primary and secondary education. To this end, this study employed an SLR design to investigate and synthesize how AI serves as a reflective partner in teachers’ PD. The review included 9,083 articles chosen from searches in the SpringerLink database and resulted in the selection of 26 articles using the PRISMA protocol. Thematically, these papers indicate AI’s contribution to enhanced reflective awareness, producing critical analyses of teaching practices, supporting reflection-informed decision making, prompting pedagogical innovation and experimentation, and promoting collaborative and continual professional learning. The results imply that AI supports teachers’ professional development and helps develop teacher noticing, providing data-driven feedback, speeding up personalization, and fostering professional learning communities. Instead of replacing teachers, AI should become a reflective partner to facilitate evidence-based pedagogy in a supportive educational policy system

Abstract

This study investigates the relationships among financial literacy, product innovation, risk management, and financial performance in small and medium-sized enterprises (SMEs) located in East Kalimantan, a region in Indonesia characterized by its resource abundance. While prior studies underscore the importance of financial literacy and innovation for SME success, there is limited research focusing on non-urban, commodity-reliant settings. Using a quantitative methodology, this study employs Partial Least Squares Structural Equation Modeling to analyze data gathered from 200 SME owners in non-extractive industries through a structured survey. This study explores whether financial literacy and product innovation directly affect financial performance and whether risk management mediates these dynamics. The findings reveal that financial literacy has a significant positive effect on financial performance, whereas product innovation strengthens risk management but does not directly influence financial outcomes. Additionally, risk management does not mediate these relationships, indicating potential contextual constraints in resource-limited environments. These insights advance the understanding of SME operations in non-urban, resource-dependent regions and highlight the need for customized financial education and innovation. This study provides actionable recommendations for policymakers to enhance SME resilience through targeted strategies, addressing a key gap in the literature on economies tied to natural resources.

Abstract

The Malay-Patani ethnonationalism conflict in Southern Thailand reflects the complex dynamics between identity construction, violence, and the violation of International Humanitarian Law (IHL). The background to the conflict is rooted in the political, cultural, and religious marginalization of the Malay-Muslim community by a Thai state that emphasizes the homogeneity of the Thai-Buddhist national identity. The suppression of the Malay language, religious institutions, and collective historical memory led to armed resistance and escalation of violence in the region. This research aims to analyze in depth how the construction of the Malay-Patani identity contributes to violence and forms of violation of the basic principles of IHL, such as distinction, proportionality, and necessity. This study used a descriptive qualitative method with a case study approach. Data were obtained through literature studies, reports from international organizations (International Committee of the Red Cross, Amnesty International, Human Rights Watch), and critical discourse analysis of identity narratives and violence. The results show that the construction of identity suppressed by state policy results in the legitimization of violence by separatist groups, while the state also responds with repressive actions that violate international humanitarian norms. Both state and non-state actors have been involved in systematic violations of IHL, including attacks on civilians, torture, and the use of banned weapons.
