Abstract

This study aims to analyze the falsification of authentic data in court proceedings from the perspectives of positive law and Islamic criminal law, focusing on the conformity of legal norms and the sanctions applied. This article falls under library research with a qualitative approach. The methodology used includes normative legal studies and comparative studies. The findings reveal that, in Indonesian positive law, the falsification of authentic data is regulated under the Criminal Code (KUHP) with strict criminal sanctions, while in Islamic criminal law, such actions are categorized as crimes that undermine the principles of justice, with ta'zir sanctions adjusted to the severity of the violation. This study emphasizes the importance of enforcing fair laws to maintain the integrity of the judicial system.

Abstract

This study explores criminal sanctions for defamation offenders from the Islamic criminal law perspective, focusing on applying maqāṣid al-sharī‘ah as a normative foundation. The objective is to compare the restorative justice-oriented approach of Islamic criminal law with Indonesia's positive law, particularly the Electronic Information and Transactions Law (UU ITE), which regulates defamation in the digital era. Using a normative juridical method, the research analyzes primary and secondary legal sources to extract relevant principles. The findings reveal that Islamic criminal law employs ta'zir sanctions, which are flexible and oriented toward restoring social harmony, contrasting with the retributive approach of Indonesia's positive law that often leads to legal uncertainty and risks to freedom of expression. Moreover, Islamic criminal law offers mediation and reconciliation-based solutions to mitigate the social impact of defamation. This study suggests integrating the principles of maqāṣid al-sharī‘ah into Indonesia's positive legal framework to create more just and balanced regulations. These findings are relevant for policymakers in addressing legal challenges in the digital era and encourage the development of more inclusive approaches to defamation cases.

Abstract

Abstract: The curriculum is agreed upon as the method and path taken in the process of achieving goals. In Indonesia, there has been a process of curriculum revision starting from the 1947 syllabus, the 1994 syllabus, the 2006 syllabus, the 2013 syllabus, and uniquely, the curriculum currently in use. The main task of jinayah law is to make the perpetrator aware not to repeat similar actions, which then leads to a disciplined attitude that creates a positive impression on others, so as not to fall into sin. committing criminal acts, as well as individuals who have committed those criminal acts, and if you have not been caught, you will think long and hard about repeating your activities. Thus, peace will be created in this world. The obligation to understand Jinayah material is urgent, because the status of the University is an Islamic educational institution and the concentration in the study program also leads to Islamic Criminal Law itself. Therefore, it is very inappropriate if students of the Islamic Criminal Law program do not understand the essence of the study program they are undertaking. In fact, this contradicts the CPL (Curriculum Learning Plan) of the Islamic Criminal Law (Jinayah) program, because the students do not fully master the study of Jinayah in its broad or narrow sense. Therefore, the researcher intends to explicitly examine the curriculum of the Islamic Criminal Law (Jinayah) program in relation to Jinayah itself. Keyword : curriculum, courses, Islamic criminal law. Abstrak: Kurikulum disepakatai menjadi metode dan jalur yang diambil dalam proses pencapaian tujuan. Di Indonesia, telah terjadi proses rekap kurikulum mulai dari silabus 1947, silabus 1994, silabus 2006, silabus 2013 dan uniknya kurikulum yang digunakan saat ini. Tugas utama hukum jinayah yaitu memberikan kesadaran pelakunya untuk tidak kembali berbuat hal serupa kemudian bermuara pada sikap disiplin tersebut menciptakan kesan positif bagi orang lain, agar tidak terjerumus ke dalam dosa. melakukan tindakan kriminal, serta individu yang telah melakukan tindakan kriminal tersebut dan Jika Anda belum tertangkap, Anda akan berpikir panjang dan sulit untuk mengulangi aktivitas Anda. Dengan demikian, perdamaian akan tercipta di dunia ini. Kewajiban memahami materi Jinayah adalah hal yang urgent, dikarenakan status Universitas adalah sebuah lembaga pendidikan Islam dan konsentrasi pada program studi juga menjurus kepada Hukum Pidana Islam itu sendir, jadi sangatlah tidak ajar jika mahasisa prodi Hukum Pidana Islam tidak memahami hakikat dari program studi yang sedang diampu mereka. Bahkan hal ini berseberanagn dengan CPL kuriulum hukum pidana islam (jinayah), dikarenakan para mahasiswa tidak begitu menguasai kajian jinayah yang sebenarnya dalam arti luas maupun dalam arti sempit. Untuk itu peneliti hendak mengkaji secara eksplisit terhadap kurikulum pada program studi hukum pidana islam (jinayah) pada jinayah itu sendiri.  Kata kunci : kurikulum, mata kuliah, hukum pidana islam.

Abstract

Although land certificates serve as official documents that validate ownership rights, cases of land disputes and violations still often occur. Many individuals face challenges in defending their rights due to the lack of legal protection or the presence of parties who try to harm them. The purpose of this study is to determine how the decision of the state administrative court number 115/G/2023/PTUN.MDN regarding the cancellation of the certificate of ownership rights from the perspective of fiqh siyasah. This study uses a normative legal research method. The results of the study indicate that the PTUN Decision to cancel the Certificate of Ownership Rights (SHM) in the name of Parulian Damanik is contrary to applicable legal procedures and the principle of justice in fiqh siyasah, because the certificate was issued legally by the BPN and has a clear legal basis. Cancellation without evidence of administrative defects causes legal uncertainty, which violates the principle of legal certainty and the government's responsibility to protect individual rights transparently and fairly. This study includes a limited focus on one PTUN case, without expanding the analysis to other similar cases, as well as limited access to supporting documents from related parties. This study is based on the use of the fiqh siyasah approach in analyzing PTUN decisions, which is rarely discussed in the context of modern Indonesian law, and its emphasis on the impact of court decisions on legal uncertainty and justice in land administration. This study contributes to offering a new perspective on the relationship between state law and fiqh siyasah in maintaining individual rights to land.

Abstract

This study examines the decriminalization of Article 549 of the Indonesian Penal Code (KUHP) from the perspective of Islamic criminal law, focusing on livestock negligence in Sukadame Village, Silangkitang District, South Labuhan Batu Regency. The issue arises from unconfined livestock damaging private land, leading to legal disputes and calls for regulatory reform. This research aims to analyze the necessity of decriminalizing Article 549 KUHP by evaluating its application in local cases and comparing the legal framework of positive law and Islamic law regarding livestock negligence. A qualitative approach with an empirical juridical method was employed, collecting data through interviews with legal practitioners, community leaders, and affected parties, alongside document analysis. The findings indicate that decriminalizing Article 549 KUHP requires legal reform to ensure alignment with current socio-economic conditions. However, prior to implementation, community engagement is crucial to prevent legal uncertainty and unintended consequences. The study suggests that legal adjustments should balance societal needs and legal enforceability, ensuring fairness while maintaining public order. These findings contribute to ongoing discussions on legal reform in Indonesia, particularly in harmonizing statutory law with Islamic legal principles.

Abstract

This study aims to analyze student responses to the use of a biochemistry e-module on carbohydrate material and its impact on learning independence. This quantitative descriptive research involved 40 students from the Biology and Chemistry study programs who had used the e-module. Data were collected through a questionnaire covering five indicators: ease of use, effectiveness of material delivery, level of interactivity, learning independence, and general response. The results showed that for the ease of use indicator, the carbohydrate e-module received an average response of "very good" with an average percentage of 83%. The effectiveness of material delivery scored 82.75%, while the level of interactivity reached 85.7%. However, the learning independence indicator had a lower average score (78.7%), indicating the need to strengthen self-learning motivation and encourage further exploration of additional information. The study concludes that the biochemistry e-module on carbohydrate material is effective in enhancing students' understanding but requires some improvements, such as adding a glossary feature and interactive elements to optimally support learning independence. The integration of technology in learning is expected to continue developing to improve the effectiveness of science-based education.

Abstract

In Indonesia, although policies such as Law No. 23 of 2004 on the Elimination of Domestic Violence and Law No. 12 of 2022 on Sexual Violence Crimes have been enacted, their implementation and enforcement face numerous challenges, including social stigma, weak law enforcement, and limited support facilities. These issues are exacerbated by a patriarchal culture that often views violence as a private matter, making it difficult to address through the legal system. As a state that guarantees human rights under Articles 28A–28I of the 1945 Constitution, Indonesia has a constitutional obligation to protect women from all forms of violence. However, this effort is hindered by weak inter-agency coordination, low public awareness, and limited infrastructure to support victims' recovery. This study aims to analyze the extent to which women’s constitutional rights are protected in policies addressing GBV in Indonesia. The research examines the harmonization of national policies with international instruments such as CEDAW, evaluates the capacity of law enforcement, and analyzes victims’ access to protection services. The findings are expected to provide strategic recommendations, including strengthening policies through harmonization with international standards, enhancing the capacity of law enforcement agencies, and expanding access to services for victims in remote areas.

Abstract

This study aims to isolate and identify terpenoid compounds from kluwih leaves (Artocarpus camansi). Extraction was done using methanol solvent, followed by n-hexane fractionation, which produced a concentrated blackish green extract. Compounds were separated through column chromatography with silica gel as the stationary phase and n-hexane as the mobile phase, and a mixture of n-hexane: ethyl acetate, producing eight fractions. The third fraction, obtained as green crystals, exhibited a positive reaction to the Liebermann-Burchard reagent, a specific test for the presence of terpenoid compounds. The observed colour change indicated the presence of terpenoids, making this fraction a promising candidate for isolation and detailed analysis. After recrystallisation, white needle-shaped crystals were obtained with a melting point of 141–142.8°C. Purity testing using thin layer chromatography (TLC) showed a single spot in various eluents, indicating that the isolated compound was pure. Further characterisation using UV spectroscopy showed maximum absorption at 210.2 nm, while IR spectroscopy showed the presence of OH, methyl, and non-conjugated C=C double bonds. Based on these data, the isolated compounds can be identified as terpenoid compounds. This study provides a basis for further studies on the structure and biological activity of kluwih leaves.

Abstract

Misconception is a serious problem faced by high school students. Through the application of inquiry learning model, this study tries to reduce students' misconceptions, especially on thermochemical material.  The experimental method with the pretest-posttest randomized control group design was used in this study. The samples of the research were 72 eleventh-grade high school students. The inquiry model was applied to the experimental class and the scientific approach was applied to the control class. The three-tier multiple choice with the Certainty of Response Index (CRI) was used to look at misconceptions experienced by the students. The results of the statistical calculation found that the toserved was greater than tcritical. The reduction of misconception categories and the percentage of reduction of misconceptions in the experimental class was 47.53 % in the medium category. Based on the results, it can be concluded that the inquiry learning model helped the students to overcome the misconceptions in thermochemical material. The researcher recommends that the inquiry learning model can be applied to other chemistry materials because their learning can help students find the correct concepts and reduce misconceptions.

Abstract

Plagiarism is often the most frequently faced thing by all universities, especially among final students who make scientific work. Law Number 28 of 2014 concerning Copyright itself states that scientific work is the object of protection from the law, In this study the author uses a statutory approach and a concept approach because it is considered relevant to the type of author's research which is normative juridical. The results showed that in the analysis of Law Number 28 of 2014 concerning Copyright against plagiarism tests among universities themselves is an effort to protect the copyright of the author. However, plagiarism testing itself is only an effort to reduce the chances of plagiarism, not to overcome and eradicate plagiarism as a crime of copyright infringement. The plagiarism test itself is the minimum form of effort in overcoming copyright infringement committed among universities. Legal protection against plagiarism among universities itself is not only carried out by plagiarism tests alone. Copyright infringement with plagiarism if only punished by a delay in the trial is considered not too meaningful.  Eligibelization is a program from Kemenristekdikti as an effort to protect law against copyright infringement. However, this plagiarism test according to Law Number 28 of 2014 concerning Copyright has still not been able to overcome legal protection from copyright infringement. Eligibleization is an ideal form of legal protection among universities in reducing the number of copyright violations that occur in plagiarism of student scientific works.
