Abstract

Abstract This research aims to analysis to what extent business and Human Rights principles have been implemented to protect workers/laborers in Indonesia according to the gender perspective. This research employed a normative method by analyzing the norms set forth in international law synchronized with the provisions in the statute (statutory approach) in Indonesia in a descriptive form and a conceptual approach. The research concludes that business and Human Rights principles were initiated by Ruggie as a new concept regarding corporate responsibility to meet the development of human rights. The protection of human rights for workers/laborers, especially women, has not been sufficiently given. The management of the dimension of human rights in employment-related matters requires business relations and human rights with the concept of three pillars. First, the state is responsible to prevent violations of human rights. Second, corporates are responsible to respect human rights. Third, this pillar is to manage access to the recovery of the victims of human rights violations. Furthermore, the protection of workers/laborers is governed in Employment Law that needs to be elaborated further by normalizing business and human rights principles in employment sector.

Abstract

The resurgence of troubling actions about unilateral withdrawal of collateral objects by creditors, makes people restless and afraid to carry out financing based on treasury collaterals. This community service activity aims to improve community literacy, especially the mothers of TP PKK RT 06/03 Sumbersekar Village regarding collaterals and risks. Service activities are carried out by the socialization method. The results of the service activities show that there is an increase in the understanding of community law regarding collaterals and risks and makes the community more careful in choosing the form of collateral to be used in the agreement and understands the risks to the collateral agreement carried out between the community and finance companies. Peningkatan Literasi Hukum kepada Masyarakat tentang Jaminan dan Resiko Maraknya kembali aksi meresahkan tentang penarikan objek jaminan secara sepihak oleh kreditur, membuat masyarakat menjadi resah dan takut untuk melakukan pembiayaan berbasis jaminan kebendaan. Aktifitas pengabdian masyarakat ini berujuan untuk meningkatkan literasi masyarakat terkhusus ibu-ibu TP PKK RT 06/03 Desa Sumbersekar terkait jaminan dan risikonya. Kegiatan pengabdian dilakukan dengan metode sosialisasi. Hasil kegiatan pengabdian menunjukan bahwa terdapat peningkatan pemahaman hukum masyarakat perihal jaminan dan resikonya, dan membuat masyarakat lebih berhati-hati dalam memilih bentuk jaminan yang akan digunakan dalam perjanjian dan memahami risiko terhadap perjanjian penjaminan yang dilakukan antara masyarakat dan perusahaan pembiayaan.

Abstract

Abstract

Indeks Persepsi Korupsi (IPK) Indonesia saat ini berada diangka 38, naik empat poin sejak 2014 yang berada di angka 34. Namun kenaikan ini masih belum bisa diapresiasi karena IPK di bawah 50 menunjukan Indonesia masih rawan korupsi. Agar pemberantasan korupsi di Indonesia semakin masif dan intensif, maka seluruh elemen masyarakat di Indonesia harus mengambil peran dalam pemberantasan korupsi, tidak terkecuali siswa sekolah dasar. Siswa sekolah dasar dapat mengambil peran melalui penerapan nilai-nilai anti korupsi sebagai upaya membangun integritas diri. Salah satu cara melalui pembelajaran dengan media video mapun poster. Metode ini digunakan karena kondisi pandemi COVID-19 saat ini menyebabkan pertemuan tatap muka tidak mungkin dilakukan. Hasil pengabdian menunjukan bahwa ada peningkatan pemahaman nilai-nilai anti korupsi pada siswa sekolah dasar dan kantin kejujuran dapat dijadikan sarana dan prasarana praktik siswa dalam menerapkan nilai-nilai anti korupsi seperti jujur, bertanggung jawab, disiplin dan adil.

Abstract

Social media is currently used optimally by the public as a means of sharing information. No exception in terms of providing massive education. In the realm of law, increased education can be done through legal counselling. Increasing education is important because various studies have proven that high legal literacy can prevent legal problems, especially family law. Family law issues themselves are an issue in society, as evidenced by the high divorce rate in various religious courts, including the Religious Courts of Malang City and Malang Regency. Together with LBH Peradi Malang Raya, the servant optimizes legal counseling through Instagram and Tiktok social media, targeting Instagram and Tiktok user communities in Malang City, Batu City and Malang Regency. Servants compiled 9 (nine) legal educational videos with the theme of family law. Public enthusiasm is quite high in this video with a total of 33,035 views, 2,212 likes, and 169 comments.

Abstract

This research aimed to analyse where the legal politics concerning outsourcing in Indonesia's legal system by scrutinizing its regulation in Book III of the Civil Code and enforcement of the Government Regulation in lieu of Law concerning Job Creation Law Number 6/2023, with its following implication to protect workers at the national level. This research employed doctrinal legal research on legal instruments related to outsourcing with statutory, conceptual, and historical approaches. The research showed that legal politics concerning outsourcing had experienced dynamic congruence with the political configuration when the legislative product on outsourcing was made. The differences emerge where outsourcing is not restricted to certain occupations in Book III of the Civil Code of Indonesia. However, Law Number 13/2003 restricted the definition of outsourcing to occupations not related to core businesses. Law Number 11/2020 and Government Regulation Number 35/2021 fit employers. Both laws govern the legal protection for outsourced employees with the transfer of undertaking to protect employment regarding changing vendors with the condition that the jobs are still available. Meanwhile, the type of work outsourced is unlimited, resulting in a deficit compared to the previous norm.

Abstract

Covid-19 has interrupted the fulfillment of Indonesian migrant workers’ rights, while the State has promulgated Law Number 11 of 2020 concerning Job Creation and revised Law Number 18/2017 concerning Protection of Indonesian Migrant Workers. This research aims to find out how protection and law reinforcement are given to Indonesian migrant workers by the state during the pandemic according to Law Number 18/2017 in conjunction with Law Number 11/2020. This research employed a normative method and a statutory approach. The research results have revealed that according to Law Number 18/2017, the protection given to the migrants only took repatriation, and another form of protection is still deemed to be not optimal since it did not take the engagement of roles of the companies sending Indonesian migrants. Moreover, pursuant to Law Number 11/2020, there is no reinforcement implied since the changes taking place are likely to ease administrative measures, contrary to the fact that strict permits could reduce the likelihood of illegal and non-procedural placement of migrant workers. This issue affects the fulfillment of the rights of Indonesian migrant workers, especially during the pandemic. Thus, it is essential that the state reinforce the protection given to Indonesian migrant workers during the pandemic by reinforcing legal protection every company providing labor placement service has to take into account and by imposing administrative measures as sanctions or sentencing in case of failing to abide by regulations. Moreover, permit issuance to the companies running labor placement services for Indonesian migrants has to be made stricter to ensure that only credible companies pass the requirement of migrant placement services, allowing the status of the rights of Indonesian migrant workers to be properly met amidst the pandemic. Keywords: legal protection; Indonesian migrant workers; COVID-19 Perlindungan Hukum Buruh Migran Indonesia yang Terdampak Covid-19AbstrakCovid-19 telah mengganggu pemenuhan hak-hak pekerja migran Indonesia, sedangkan negara telah menerbitkan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dan merevisi Undang-Undang Nomor 18 Tahun 2017 tentang Perlindungan Tenaga Kerja Indonesia. Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan dan penguatan hukum yang diberikan negara kepada pekerja migran Indonesia di masa pandemi menurut Undang-Undang Nomor 18/2017 jo Undang-Undang Nomor 11/2020. Penelitian ini menggunakan metode normatif dan pendekatan perundang-undangan. Hasil penelitian mengungkapkan bahwa menurut Undang-Undang Nomor 18 Tahun 2017 perlindungan yang diberikan kepada TKI hanya berupa pemulangan, dan bentuk perlindungan lainnya masih dirasa belum optimal karena tidak melibatkan peran perusahaan pengirim TKI. Apalagi, menurut Undang-Undang Nomor 11/2020, tidak ada penguatan yang tersirat karena perubahan yang terjadi cenderung memudahkan tindakan administratif, padahal izin yang ketat dapat mengurangi kemungkinan penempatan pekerja migran ilegal dan non-prosedural. Isu ini berdampak pada pemenuhan hak-hak pekerja migran Indonesia, terutama di masa pandemi. Oleh karena itu, negara perlu memperkuat perlindungan kepada TKI di masa pandemi dengan memperkuat perlindungan hukum yang harus diperhatikan oleh setiap perusahaan penyedia jasa penempatan tenaga kerja dan dengan memberikan tindakan administratif berupa sanksi atau hukuman jika tidak mematuhi peraturan.Kata Kunci: Perlindungan Hukum; Pekerja Migran Indonesia; COVID-19. Правовая Защита Индонезийских Трудовых Мигрантов, Пострадавших от Covid-19 АннотацияCovid-19 помешал осуществлению прав индонезийских трудовых мигрантов, в то время как государство обнародовало Закон № 11 от 2020 г. о создании рабочих мест и пересмотрело Закон № 18/2017 о защите индонезийских трудовых мигрантов. Цель этого исследования - выяснить, каким образом государство обеспечивает защиту и укрепление законодательства индонезийским трудовым мигрантам во время пандемии в соответствии с Законом № 18/2017 в сочетании с Законом № 11/2020. В этом исследовании использовался нормативный метод и законодательный подход. Результаты исследования показали, что в соответствии с Законом № 18 от 2017 г. защита, предоставляемая TKI (Индонезийским трудовым мигрантам), предусматривает только репатриацию, а другая форма защиты по-прежнему считается неоптимальной, поскольку она не предполагает участия компаний, отправляющих индонезийских трудовых мигрантов. Более того, в соответствии с Законом № 11/2020 не подразумевается никакого усиления, поскольку происходящие изменения, вероятно, облегчат административные меры, вопреки тому факту, что строгие разрешения могут снизить вероятность незаконного и непроцессуального размещения трудовых мигрантов. Эта проблема влияет на соблюдение прав индонезийских трудовых мигрантов, особенно во время пандемии. Таким образом, важно, чтобы государство усилило защиту, предоставляемую индонезийским трудовым мигрантам во время пандемии, усилив правовую защиту, которую должна учитывать каждая компания, предоставляющая услуги по трудоустройству, и путем введения административных мер в виде санкций или наказания в случае несоблюдения правил. Кроме того, необходимо ужесточить выдачу разрешений компаниям, предоставляющим услуги по трудоустройству индонезийских трудовых мигрантов, чтобы гарантировать, что только заслуживающие доверия компании удовлетворяют требованиям служб трудоустройства трудовых мигрантов, что позволит должным образом соблюдать статус прав TKI в условиях пандемии.Ключевые слова: Правовая защита; Индонезийские трудовые мигранты; COVID-19.

Abstract

The popularity of working from home or remote working is rising globally. In Indonesia, the existence of the internet underpins the trend of working from home since accessing this technology is effortless. However, existing regulatory provisions mostly govern matters regarding office work, while the rights and responsibilities between employers and employees in the remote working scheme have never been specifically regulated. This situation creates a huge gap between what is stated in a written law and law in action. This research aims to analyze the congruence of agreements with the fulfilment of rights of workers working from home from the perspective of legislation and the principles of labor development. This research employed sociological and legal methods. The research results indicate that the fulfilment of labors’ rights in both the agreement and implementation has not met the principles of labor development. The conflict of rights and criminal violations regarding this matter is obvious since workers’ rights governed in the legislation are not governed in the work agreement. Moreover, there is still incongruence between the regulations and implementation of the rights of workers regarding the portion of break/leave and overtime wages.

Abstract

The quality of the decision is not only related to the judge's considerations but also its suitability to the composition of the decision so that the resulting decision is not easily overturned at the level of legal action and increases public confidence in the judicial institution. This research aims to analyze the quality of judges' decisions in Indonesia in terms of the composition of the decision texts that have been made. This research uses normative legal research methods, a statutory approach, and a comparative approach. The study results show that decisions are not based on the structure of decisions determined by the Supreme Court. One of the reasons is the minimal use of AI, even though AI can help judges identify which parts of the decision structure are not yet in the decision prepared by the judge and improve them so that it is hoped that it will produce uniformity and decisions that are certain and not easily overturned. Indonesia needs to learn from New Zealand guidelines for using AI at the court and tribunal level. Judges can apply AI, some related to summarizing information and administration.

Abstract

Pemberantasan tindak pidana narkotika menjadi isu utama di berbagai negara. Hal ini disebabkan karena akibat buruk dari dampak penyalahgunaan narkotika yang muldimensi yakni pada aspek kesehatan fisik dan mental, perekonomian, sampai menjadi pendorong. terjadinya tindak kejahatan. Pengabdian ini bertujuan untuk melakukan pencegahan penyalahgunaan narkotika di Jakarta Selatan. Metode yang digunakan adalah sosialisasi. Aktifitas pengabdian yang dilakukan dalam pelaksanaan penvegahan tindak pidana narkotika cukup efektif dilaksanakan dengan metode sosialisasi secara daring mengingat jangkauan yang lebih luas dan tidak terbatas waktu. Dalam sosialisasi, dipaparkan materi terkait definisi dan ragam maca narkotika, dampak buruk penyalahgunaan narkotika hingga ancaman hukuman yang akan didapatkan oleh penyalahguna narkotika.   Abstract Optimizing Digital Media as a Preventive Legal Effort against Drug Abuse in South Jakarta.The eradication of narcotics crime has become a major issue in various countries. This is due to the adverse effects of the multidimensional impact of narcotics abuse, namely on aspects of physical and mental health, the economy, to become a driver of crime. This service aims to prevent drug abuse in South Jakarta. The method used is socialization. The service activities carried out in the implementation of drug crime prevention are quite effective with the online socialization method considering the wider reach and unlimited time. In the socialization, material was presented related to the definition and variety of narcotics, the adverse effects of narcotics abuse to the threat of punishment that will be obtained by narcotics abusers.
