Abstract

Covid-19 has interrupted the fulfillment of Indonesian migrant workers’ rights, while the State has promulgated Law Number 11 of 2020 concerning Job Creation and revised Law Number 18/2017 concerning Protection of Indonesian Migrant Workers. This research aims to find out how protection and law reinforcement are given to Indonesian migrant workers by the state during the pandemic according to Law Number 18/2017 in conjunction with Law Number 11/2020. This research employed a normative method and a statutory approach. The research results have revealed that according to Law Number 18/2017, the protection given to the migrants only took repatriation, and another form of protection is still deemed to be not optimal since it did not take the engagement of roles of the companies sending Indonesian migrants. Moreover, pursuant to Law Number 11/2020, there is no reinforcement implied since the changes taking place are likely to ease administrative measures, contrary to the fact that strict permits could reduce the likelihood of illegal and non-procedural placement of migrant workers. This issue affects the fulfillment of the rights of Indonesian migrant workers, especially during the pandemic. Thus, it is essential that the state reinforce the protection given to Indonesian migrant workers during the pandemic by reinforcing legal protection every company providing labor placement service has to take into account and by imposing administrative measures as sanctions or sentencing in case of failing to abide by regulations. Moreover, permit issuance to the companies running labor placement services for Indonesian migrants has to be made stricter to ensure that only credible companies pass the requirement of migrant placement services, allowing the status of the rights of Indonesian migrant workers to be properly met amidst the pandemic. Keywords: legal protection; Indonesian migrant workers; COVID-19 Perlindungan Hukum Buruh Migran Indonesia yang Terdampak Covid-19AbstrakCovid-19 telah mengganggu pemenuhan hak-hak pekerja migran Indonesia, sedangkan negara telah menerbitkan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dan merevisi Undang-Undang Nomor 18 Tahun 2017 tentang Perlindungan Tenaga Kerja Indonesia. Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan dan penguatan hukum yang diberikan negara kepada pekerja migran Indonesia di masa pandemi menurut Undang-Undang Nomor 18/2017 jo Undang-Undang Nomor 11/2020. Penelitian ini menggunakan metode normatif dan pendekatan perundang-undangan. Hasil penelitian mengungkapkan bahwa menurut Undang-Undang Nomor 18 Tahun 2017 perlindungan yang diberikan kepada TKI hanya berupa pemulangan, dan bentuk perlindungan lainnya masih dirasa belum optimal karena tidak melibatkan peran perusahaan pengirim TKI. Apalagi, menurut Undang-Undang Nomor 11/2020, tidak ada penguatan yang tersirat karena perubahan yang terjadi cenderung memudahkan tindakan administratif, padahal izin yang ketat dapat mengurangi kemungkinan penempatan pekerja migran ilegal dan non-prosedural. Isu ini berdampak pada pemenuhan hak-hak pekerja migran Indonesia, terutama di masa pandemi. Oleh karena itu, negara perlu memperkuat perlindungan kepada TKI di masa pandemi dengan memperkuat perlindungan hukum yang harus diperhatikan oleh setiap perusahaan penyedia jasa penempatan tenaga kerja dan dengan memberikan tindakan administratif berupa sanksi atau hukuman jika tidak mematuhi peraturan.Kata Kunci: Perlindungan Hukum; Pekerja Migran Indonesia; COVID-19. Правовая Защита Индонезийских Трудовых Мигрантов, Пострадавших от Covid-19 АннотацияCovid-19 помешал осуществлению прав индонезийских трудовых мигрантов, в то время как государство обнародовало Закон № 11 от 2020 г. о создании рабочих мест и пересмотрело Закон № 18/2017 о защите индонезийских трудовых мигрантов. Цель этого исследования - выяснить, каким образом государство обеспечивает защиту и укрепление законодательства индонезийским трудовым мигрантам во время пандемии в соответствии с Законом № 18/2017 в сочетании с Законом № 11/2020. В этом исследовании использовался нормативный метод и законодательный подход. Результаты исследования показали, что в соответствии с Законом № 18 от 2017 г. защита, предоставляемая TKI (Индонезийским трудовым мигрантам), предусматривает только репатриацию, а другая форма защиты по-прежнему считается неоптимальной, поскольку она не предполагает участия компаний, отправляющих индонезийских трудовых мигрантов. Более того, в соответствии с Законом № 11/2020 не подразумевается никакого усиления, поскольку происходящие изменения, вероятно, облегчат административные меры, вопреки тому факту, что строгие разрешения могут снизить вероятность незаконного и непроцессуального размещения трудовых мигрантов. Эта проблема влияет на соблюдение прав индонезийских трудовых мигрантов, особенно во время пандемии. Таким образом, важно, чтобы государство усилило защиту, предоставляемую индонезийским трудовым мигрантам во время пандемии, усилив правовую защиту, которую должна учитывать каждая компания, предоставляющая услуги по трудоустройству, и путем введения административных мер в виде санкций или наказания в случае несоблюдения правил. Кроме того, необходимо ужесточить выдачу разрешений компаниям, предоставляющим услуги по трудоустройству индонезийских трудовых мигрантов, чтобы гарантировать, что только заслуживающие доверия компании удовлетворяют требованиям служб трудоустройства трудовых мигрантов, что позволит должным образом соблюдать статус прав TKI в условиях пандемии.Ключевые слова: Правовая защита; Индонезийские трудовые мигранты; COVID-19.

Abstract

Wage is a fundamental right of labor. Since the passage of the Job Creation Law, the wage policy has changed. In order to aid national development, the wage is ruled to be distributed following the principle of job creation. Instead of bringing peace, that change has led to public criticism towards the Job Creation Law, which is deemed to injure labor rights. This study aims to analyze the legal protection and the implementation of labor development principles in the Job Creation Law. This study is normative legal research and applies a juridical approach. The primary data were obtained from the regulation analysis, while the secondary data were collected from a literature review regarding wage rights. This research reveals that the legal protection of wages in the new regulation is not far better than the previous law. The wage policies initially stipulated explicitly in the Labor Law were revoked from the Job Creation Law, where the labor principles are not applied. By the protection not better than that of the former regulation, it is implausible to improve the welfare of workers and their family members.

Abstract

Introduction to The Problem: Until 2018, the problem in the realm of family law (marriage and inheritance) were the highest problems faced in religious courts. Through the Community Program for Women and Children Care (Madupria), the family welfare movement of Sumbersekar Village (PKK Desa Sumbersekar) wants to help in speaking out about the family’s legal problems that have been faced by the community in Sumbersekar village. Family legal issues in the community can be diminished if the community has good legal knowledge (intelligent legal). Nowadays, the current digital, legal collaboration, and information technology, should be utilized. One of the ways is through a legal knowledge management system, which will create a family legal savvy community in Sumbersekar village.Purpose/Objective Study: The purpose of this research is to perceive why family law problems occur in the village of Sumbersekar, and what kind of family law knowledge is needed, as well as modeling cases through a legal knowledge management system.Design/Methodology/Approach: This is multidisciplinary research that uses sociological legal research method, as well as using the method of research and development in the field of information technology.Findings: Family law issues in these cases are the rights and obligations of husband and wife and the distribution of inheritance. The causes of legal problems that happened regarding the rights and obligations of husband and wife are economic problems (10%), lack of education (20% lack of knowledge), poor communication (25%), and adverse environmental impacts (45%). In comparison, the problem of inheritance is caused by internal personal desires on controlling legacy (40%) and the lack of education/knowledge (60%). Whereas, the required legal experience to overcome these issues are family law and inheritance law is consisting of statutory regulations, judges’ decisions, and scientific articles.

Abstract

Introduction to The Problem: The rapid flow of globalization has brought indigenous peoples to prolonged horizontal and vertical conflicts. The majority of conflicts triggered by who has the right to own the land and functionalize it. The land that belongs to indigenous peoples and it inherited from generation to generation, suddenly taken by investors and it even supported by the government. The indigenous people are often victimized and forced out from their customary lands. They who try to claim the rights sometimes experience obstacles because of the stronger and dominant government position in the court. One of these conflicts occurred in the Dayak community in Central Borneo Province.Purpose/Objective Study: This study aims to determine the problems experienced by indigenous peoples in Central Borneo Province, as well as to find out the mechanism for establishing a legal protection system in order to provide recognition and strengthening ownership of customary land in the Central Borneo Province.Design/Methodology/Approach: This study uses normative research methods, with statute approaches and conceptual approaches.Findings: there are serious problems experienced by indigenous people in Central Borneo Province, related to customary land in their territory. However, there are legal safeguards that can be carried out through formal and administrative land recognition.

Abstract

In financial agreement, a bank as creditor has the authority to ask a client as debtor to place a guarantee such as a mortgage guarantee based on the Article 8 of Banking Regulation. Based on the Article 20 of Law of Mortgage, the availability of mortgage guarantee enables the bank to execute the object of guarantee when the debtor is in default. However, a concrete regulation concerning on the resolution procedure of banking dispute has not been stipulated. The only reference for this issue is the Regulation of OJK (Financial Service Authority) Number 1/POJK/.07/2014 pertaining to the Alternative Institution for Dispute Resolution in Financial Service Sector (POJKLAPS). The problem is, the institution only exists in Jakarta. In fact, there are many cases where the debtors considered themselves as the victim of banking crime due to unclear procedure of the execution of the object of guarantee. This study aimed to investigate the procedure of financial dispute resolution with the object of mortgage guarantee in sharia banks in Malang City and to figure out the constraints encountered during the process.

Abstract

Regulating administrative efforts as the mandatory procedure is expected to be able to filter and reduce the number of disputes that must be tried by the State Administrative Court. However, the position of administrative efforts is only interpreted as a formality. This study aims to analiyz the position of administrative efforts in the settlement of state administration disputes and to find out how effective the administration efforts in reducing the number of state administration disputes in the State Administrative Courts in East Java. The results indicated that administrative efforts were the embodiment of the state law of Pancasila, but the effectiveness of administrative efforts in East Java was still very low or ineffective in reducing the number of state administrative disputes in the State Administrative Court.

Abstract

Pinjaman online atau yang dikenal dengan peer to peer lending semakin marak di masyarakat. Proses yang cepat dan persyaratan yang sederhana membuat banyak masyarakat tertarik meminjam pada aplikasi pinjaman online. Namun, dibalik kemudahan tersebut, banyak permasalahan yang lahir pasca pencairan peminjaman, seperti: 1) Waktu pembayaran/jatuh tempo yang terlampau cepat; 2) Bunga pinjaman yang mencekik; 3) Biaya administrasi tinggi yang dipotongkan pada nominal pinjaman, namun pokok pinjaman tetap dihitung dari jumlah total pencairan; 4) Teror dari perusahaan pinjaman online karena keterlambatan pembayaran. Solusi untuk permasalahan ini, masyarakat harus diberikan edukasi melalui penyuluhan hukum tentang peer to peer lending secara online kepada anggota TP PKK Desa Sumbersekar sehingga dapat memahamani risiko-risiko dari pinjaman online dan langkah pencegahannya. Metode yang digunakan dalam pengabdian ini adalah penyuluhan. Hasil pengabdian menunjukan bahwa mitra telah menerima dan memahami materi perihal peer to peer lending yang didasrkan pada kemampuan menjawab seluruh daftar pertanyaan lisan yang diajukan oleh Pengabdi.   Efforts to Improve Community Legal Literature on Peer-to-Peer Lending Online lending or known as peer-to-peer lending is increasingly rife in the community. The fast process and simple requirements make many people interested in borrowing on online loan applications. However, behind these conveniences, many problems are born after the disbursement of loans, such as: 1. Payment time/maturity is too fast; 2. Suffocating loan interest; 3. High administrative costs are deducted on the loan nominal, but the principal of the loan is still calculated from the total amount of disbursement; 4. Terror of online loan companies due to late payments. The solution to this problem, the public must be given education through legal counseling about online peer to peer lending to members of the TP PKK Sumbersekar Village so that they can understand the risks of online loans and their prevention steps. The method used in this devotion is counseling. The results of the service show that partners have received and understood material about peer-to-peer lending based on right answer for the question that asked by the conselor.

Abstract

Indonesia's marriage law prohibits interfaith unions. However, this provision has not yet taken effect. This study aims to find out how the legal status of marriage is different religions and how the recording provisions are valid in the eyes of the law. This research uses normative legal research methods, with a regulatory approach and data presentation in the form of descriptive analysis. The results of the research show that, first, regarding legal status, interfaith marriage is invalid in the eyes of the law, because it is contrary to the provisions of Law on marriage. However, based on the Supreme Court's decision couples of different faiths can request a court determination, henceforth to continue to carry out the marriage according to the beliefs held by each bride and groom.  Second, regarding the registration of marriages for interfaith marriages, the bride and groom record them with the civil registry office and will be recorded as non-Islamic marriages.

Abstract

In the Industrial Era 4.0, all electronic work systems can support the concept of remote working. The relationship between workers and companies arises from a work agreement. The fact is that work agreements are inseparable from conflicts, especially in Particular Time Employment Agreements. Remote working workers in a Particular Time Employment Agreement are carried out online, which must comply with the applicable laws and regulations. This study uses a normative legal method by analyzing and comparing the norms of the Indonesian state legislation (statute approach) descriptively, namely the updated Labor Law, the Job Creation Law, and the ITE Law. And take a conceptual approach, namely remote working (conceptual approach). Furthermore, the researcher describes the formulation of the problem, namely the Remote Working Concept with a Particular Time Employment Agreement system. The Remote Working Concept of Worker Protection is reviewed in the Job Creation Law. In principle, the mechanism for implementing the remote working concept is subject to the provisions of the Labor Law and the Job Creation Law. In addition, there is a need for a new clause regarding the concept of remote working to protect remote working concept workers fairly.

Abstract

Sejak 2014 hingga 2020, sengketa hukum perkawinan adalah sengketa tertinggi di Pengadilan Agama Kota Malang. Advokasi dalam ranah hukum perkawinan sangat dibutuhkan para pihak yang bersengketa. Pimpinan Daerah ‘Aisyiyah Kota Malang adalah organisasi sosial kegamaan yang aktif memberikan advokasi baik kepada sesame anggota maupun di luar anggota PDA Kota Malang. Namun, kondisi COVID-19 saat ini membuat proses advokasi terkendala ruang dan waktu. Tujuan pengabdian ini adalah memberikan solusi advokasi dalam ranah hukum perkawinan, melalui upaya digitalisasi. Metode pelaksanaan pengabdian yang diimplementasikan adalah metode pelatihan. Aplikasi Masyarakat Peduli Hukum (Maduhukum) adalah Knowledge Management System (KMS), yang bertujuan memecahkan permasalahan hukum berbasis komunitas, terutama pada topik hukum keluarga. Hasil pelatihan menunjukan seluruh peserta pelatihan cakap menggunakan dan melakukan diseminasi aplikasi Maduhukum. Selain itu, dilakukan pembaruan dan penambahan fitur untuk memaksimalkan kinerja Maduhukum dalam mewadahi pelaksanaan advokasi secara digital.
