Abstract

This study evaluates deceptive practices involving the giveaway scheme through the lens of the ITE Law. The investigation primarily centers its attention upon regulations that have not explicitly mentioned fraudulent acts using the giveaway method in legislation, thus giving rise to conflicting norms between laws. This study focuses on analyzing: how is the legal regulation of fraudulent acts using the giveaway method in Indonesia and how is the law enforced against perpetrators of fraud using the giveaway method. This inquiry employs a normative legal research design, integrating legislative, theoretical, and judicial precedent perspectives. The results indicate that although Indonesian legislation does not explicitly regulate giveaway fraud as a distinct criminal offense, such conduct can nevertheless be prosecuted under the existing legal framework. The fraudulent giveaway schemes currently fall under the jurisdiction of Article 492 of the Criminal Code (lex generalis) and Article 28 subsection (1) of the ITE Law (lex specialis). Perpetrators of fraud will be punished in accordance with the applicable legal basis in order to pay attention to the application of the principle of lex specialis derogat legi generali as a basis for determining norms to realize legal certainty and provide protection to victims of technology-based fraud. The findings provide guidance for law enforcement agencies, including investigators, prosecutors, and judges, in determining the appropriate legal basis for prosecuting giveaway fraud conducted through electronic media. The recognition of electronic information and electronic documents as valid evidence further strengthens the effectiveness of criminal investigations and prosecutions in cybercrime cases.

Abstract

This study examines the transformation of inheritance rights in Balinese customary land within the context of customary and national legal systems. The research addresses legal issues arising from changes in customary membership, which may alter or terminate inheritance rights over communal land. Employing a normative legal research method with statutory and conceptual approaches, this study analyzes the interaction between customary norms and national agrarian law. The findings reveal that inheritance rights over customary land are inherently linked to social-religious obligations and active membership within the customary community, resulting in the transformation or loss of such rights when these obligations are no longer fulfilled. Furthermore, the study identifies a normative tension between the communal character of customary law and the individualistic principles of national inheritance law, leading to legal uncertainty. The novelty of this research lies in its integrative analysis of inheritance transformation through the lens of legal pluralism, emphasizing the need for harmonization between legal systems. The study concludes that clearer legal recognition and contextual legal approaches are necessary to ensure certainty and substantive justice in customary inheritance disputes. Future research is recommended to explore empirical perspectives and judicial practices in resolving similar disputes.

Abstract

This study aims to determine the effect of infrastructure and service quality on tourists’ visiting interest at the Alas Kedaton Tourist Attraction, located in Kukuh Village, Marga District, Tabanan. This research employs a causal quantitative design. The total population in this study is unknown; therefore, the data are treated as an infinite population. The sampling technique used is purposive sampling, with a total of 110 respondents. Data were collected through questionnaires and analyzed using multiple linear regression analysis. The hypothesis was tested using the t-test and F-test, with SPSS version 25 software. The results of the study indicate that: (1) partially, infrastructure has a positive and significant effect on tourists’ visiting interest; (2) partially, service quality also has a positive and significant effect on tourists’ visiting interest; and (3) simultaneously, both variables have a positive and significant effect on tourists’ visiting interest at the Alas Kedaton Tourist Attraction. Based on these findings, it is recommended that the management improve supporting facilities and service quality to attract more tourists to visit Alas Kedaton,

Abstract

This community service is motivated by the economic dynamics influenced by global challenges, including the impact of the COVID-19 pandemic, which increases the risk of bad debts in Village Credit Institutions. This community service aims to examine how Village Credit Institutions (LPD) in Bali handle bad debts through the integration of customary values ​​and principles of good faith to support financial stability and build trust in the community. This type of research is a case study with a qualitative approach. The research subjects involved include LPD managers, indigenous peoples, village officials, and debtors to understand the process and results of resolving credit problems, including bad debts. Data collection methods are carried out through interviews, observations, and document studies. The data analysis method used is thematic analysis or descriptive-qualitative analysis. The analysis of the collected documents was carried out in the FGD forum. Empirical findings show that the combination of customary values ​​and good faith creates a positive image of LPD, increases customer loyalty, and strengthens LPD's position as a trusted and socially responsible financial institution. This integrated approach not only reduces the risk of bad debts but also supports sustainable growth and LPD resilience in facing economic dynamics.

Abstract

Indonesia has no codified private international law rule identifying which law governs child custody when a mixed marriage dissolves, so courts default to the lex fori. This gap converts choice-of-law questions into status-denial problems, as illustrated by the District Court of Tabanan Decision No. 375/Pdt.G/2019/PN.Tab., where the resolution of marital validity extinguished the paternal relationship altogether. This article develops a normative model to determine the applicable law governing child custody in Indonesia, anchored in the best interests of the child. Using normative (doctrinal) legal research with statute, conceptual, case, and comparative approaches, primary, secondary, and tertiary legal materials were analyzed through grammatical, systematic, teleological, and constitutional interpretation. The analysis shows that Indonesian practice conflates the preliminary question of marital validity with custody, producing outcomes that are vertically inconsistent with the 1945 Constitution and horizontally inconsistent with the Child Protection and Human Rights Laws. Because lex loci celebrationis governs only the formal validity of marriage, it cannot properly govern custody. The article proposes a Best-Interests-Anchored Cascade: custody is characterized as an autonomous connecting category; the child's habitual residence serves as the primary connecting factor; lex patriae applies only subsidiarily; and public order operates as a narrow shield that may never extinguish filiation. The model offers courts an operable decision sequence and legislators a drafting template for a future Indonesian private international law statute.

Abstract

The absence of explicit legal regulation concerning beneficialownership within Indonesian corporate law has generateduncertainty regarding the legal position of investors operatingthrough nominee agreements. This study examines the legal standing of beneficial ownership and its legal consequences withinnominee arrangements involving domestic limited liabilitycompanies in Indonesia. Normative legal research was employedusing statutory, conceptual, and case approaches to examine theinteraction between the Company Law, the Investment Law, theCivil Code, and related regulations governing beneficialownership. The analysis demonstrates that Indonesian corporatelaw recognizes only registered shareholders as holders ofcorporate rights, whereas beneficial owners remain confined toadministrative recognition without acquiring enforceable civillegal standing. Nominee agreements established to conceal theidentity of the actual investor are inconsistent with the objectiverequirements of lawful contracts under Articles 1320 and 1337 ofthe Civil Code and constitute fraus legis, rendering suchagreements legally void and incapable of creating valid shareholder rights. Consequently, beneficial owners cannoteffectively enforce corporate rights or contractual claims whendisputes arise with nominees. The novelty of this study lies in integrating corporate, investment, and contract law to explain thenormative inconsistency governing beneficial ownership andproposing regulatory harmonization to strengthen legal certainty, investor protection, and corporate governance. Future studies maycomparatively examine beneficial ownership regulation acrossdifferent jurisdictions to support legislative reform in Indonesia.
