Abstract

Collaboration programs with international organizations develop all aspects, especially in the field of education that the university has carried out. The activity was educating the elementary school teachers because it has a significant component in the educational process. The university education system has a substantial role in preparing competitive human resources. This study result findings in the form of language and cultural differences is the main issues in the implementation of the international collaboration programs. The method was used group discussions between Indonesian and Thai teachers through an innovative approach to digital learning media in a more structured and in-depth way. Group discussion case studies successfully provided practical and interactive experiences to the participants. It was concluded that mutual understanding of culture between teachers and students was fundamental and needs to be considered so that learning can be done effectively and comfortably. Educators can jointly build awareness of the effectiveness of using technology in the classroom. Technology was not only used but has a significant impact on learning processes and outcomes. The implementation of this international collaboration program aims to solve the problems faced and enhance cooperation between the two countries further.

Abstract

Pesantren in this day and age must be an educational institution that instills Islamic values as a whole, both teaching worship procedures and social social procedures. The management of the pesantren must synergize with other fields in order to make students independent in meeting their life needs. This study aims to analyze the synergy between pesantren management and sharia economics in fostering student independence at the At-Tamur Islamic Boarding School. The research method used is qualitative with a case study approach. Data were collected through observations, in-depth interviews, and documentation studies. The results of the study show that the integration between effective pesantren management and the application of sharia economic principles is able to create an environment that supports the development of student independence. Programs such as sharia cooperatives, entrepreneurship training, and sharia-based financial management are the main keys in achieving these goals. This synergy not only increases the financial independence of students but also forms a character in accordance with Islamic values.

Abstract

Legal maxims are essential in determining Islamic law and resolving branching legal problems. Scholars have formulated legal maxims to address issues related to mubâsyir and mutasabbib, as well as legal responsibility. This research aims to describe the legal maxims formulated by the ulama, particularly those related to mubâyir and mutasabbib, and analyze their application in sharia economic law. The research uses a normative juridical approach and uses secondary data for qualitative data analysis. The results show that the ulama have formulated at least five rules related to mubâyir and mutasabbib jurisprudence: (1) If the direct perpetrator and cause come together, the law relies on the direct perpetrator; (2) The direct perpetrator must be held responsible even if not intentional; (3) The cause is not responsible unless intentional; (4) An action is based on the perpetrator, not the person who orders it; and (5) An animal's error is not the owner's responsibility.

Abstract

Sejak permulaan diberlakukannya karantina wilayah bahkan nasional, masjid-masjid nampak sepi dari jama™ahnya. Munculnya fatwa MUI nomor 14 tahun 2020 tentang penyelenggaraan ibadah dalam situasi terjadi wabah covid-19 menjawab pertanyaan masyarakat seputar penyelenggaraan aktivitas beribadah di masjid untuk kemudian berpindah ke rumah masing-masing. Dalam kondisi seperti saat ini, dewan kemakmuran masjid (DKM) diharuskan untuk memikirkan gagasan inovatif konstruktif dalam memaksimalkan potensi sumber daya manusia (SDM) yang ada di masjid. Program pendampingan DKM yang berada di kelurahan Tamansari dijadikan objek pendampingan Tim PKM dari Fakultas Syariah Unisba. Target luaran dari kegiatan ini agar para DKM semakin kuat dan kokoh dalam manajemen masjid dalam masa pandemi, diantaranya dengan beberapa kegiatan seperti pemberdayaan dan pendampingan DKM dalam manajemen pengelolaan imam dan khatib, serta keuangan masjid. Pendampingan dilakukan hingga akhir masa pelaksanaan program PKM dan setelah program PKM ini berakhir.

Abstract

One of the financing contracts offered by Islamic banks is the Murabahah financing contract. The Murabahah financing contract functions to increase the utility of money and capital, as well as the utility of goods. Article 127 of the Compilation of Sharia Economic Law (KHES) allows the seller to request the buyer to provide collateral in the Murabahah contract. Fatwa DSN-MUI No. 03/DSN-MUI/IV/2000 regarding Murabahah permits banks to request collateral from financed customers. This provision aims to ensure that customers are serious about making payments. Based on KHES and the fatwa, banks are allowed to request collateral from customers to protect or ensure that their rights are not violated. In practice, to ensure that customers comply with payments, banks request collateral from customers. This collateral can be movable or immovable property. Collateral in the form of immovable property is called fiduciary collateral. Fiduciary collateral is regulated in Law No. 42 of 1999 concerning Fiduciary Collateral (UUJF). According to Article 5 paragraph 1 of UUJF, the imposition of collateral with fiduciary collateral "must" be made by a notarial deed. With this provision of UUJF, there is a difference. KHES and the fatwa of DSN MUI do not require financing contracts to be made using a notarial deed, while UUJF requires it to be made by a notarial deed. Islamic banks, some of which require financing contracts to be made by a notarial deed, while others do not. The adoption of UUJF in Islamic financing is considered inappropriate because it violates Sharia values. Objectives: (1) Explain the regulations used in Murabahah financing contracts in Islamic banks with fiduciary collateral according to the objectives of legal certainty and utility. (2) Describe the implementation of legal protection for customers using Murabahah financing contracts in Islamic banks with fiduciary collateral according to the objectives of legal certainty and utility. Research Method: Research approach: normative juridical. Research nature: descriptive analysis. Data types: secondary data and primary data. Sample determination technique: purposive sampling. Data collection technique: literature study and interviews. Data analysis technique: interpretation and legal analogy.

Abstract

Tujuan penelitian ini adalah untuk memaparkan konsep ‘urf serta kedudukannya dalam metode penemuan hukum serta aplikasinya dalam bidang hukum ekonomi syariah. Metode dalam penelitian ini menggunakan pendekatan yuridis normatif dan teknik pengumpulan data melalui studi pustaka dan bersifat deksritif analisis. Hasil penelitian menunjukan bahwa ‘urf memiliki kedudukan dalam penemuan hukum karena disepakati oleh para pakar sebagai dalil hukum dalam Islam. Aplikasi ‘urf dalam bidang mu’âmalah mâliyyah terdiri atas kebolehan akad jual-beli mu’âthah, jual-beli istishna, keuntungan dalam akad gadai, jual-beli barang yang belum wujud dan wakaf produktif dan sewa atas jasa.

Abstract

Fiqh rules have a role in the legal istinbath process, especially in contemporary legal issues such as sharia economics or muamalah transactions. One of the problems in muamalah is related to the terms of an agreement (contract). This study aims to determine the principles of fiqh relating to terms and their application in sharia economic transactions. This study uses a qualitative method with a normative juridical approach. This research includes the type of literature study research. The primary data sources used were books on fiqh principles (al-qawâ'id al-fiqhiyyah), secondary sources in this study were articles in journals, as well as books/books on relevant fiqh rules. The results show that the fiqh rules relating to conditions include must meet the requirements as much as possible, something that depends on certain conditions, then the legal provisions must exist if the conditions exist, promises in the form of ta'lîq (hanging) are binding (must be fulfilled), anyone who imposes something on himself voluntarily without coercion, then that something becomes his obligation, any conditions that differ from sharia principles are vanity.

Abstract

Abstract. This study aims to identify and analyze the legal constructions of capital guarantees in the AAOIFI Sharia Standards and the DSN-MUI Fatwas. This is normative legal research with a specific comparative approach. This research shows that the rulings of the AAOIFI Sharia Standards are more reassuring and prioritize the principle of ihtiyāth (precaution). Meanwhile, the legal provision of the DSN-MUI fatwas, allowing the capital manager to guarantee a return on business capital, is a commitment in the form of tabarru from the fund manager. T he commitment should be fulfilled since it is a wa’ad mulzim (binding promise). T his legal provision of the DSN-MUI Fatwas is a form of innovative ijtihad that seems different from the opinions of most scholars used as the legal basis of the AAOIFI. However, the DSN-MUI’s fatwa is supported by various arguments and is more applicative. Abstrak. Penelitian ini bertujuan untuk mengetahui dan menganalisis konstruksi hukum jaminan modal dalam Standar Syariah AAOIFI dan Fatwa DSN MUI. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan komparatif. Penelitian ini menunjukkan bahwa ketentuan Standar Syariah AAOIFI lebih tepat dan mengedepankan prinsip ihtiyāth (kehati-hatian). Sedangkan ketentuan hukum fatwa DSN-MUI yang memperbolehkan pengelola modal dengan jaminan pengembalian modal adalah komitmen dalam bentuk tabarru dalam pengelolaan dana. Komitmen tersebut harus dipenuhi karena merupakan wa’ad mulzim (janji mengikat). Ketentuan hukum Fatwa DSN MUI ini merupakan bentuk ijtihad inovatif yang nampaknya berbeda dengan pendapat kebanyakan ulama yang dijadikan landasan hukum AAOIFI. Namun, fatwa DSN-MUI didukung oleh berbagai argumentasi dan lebih aplikatif.

Abstract

The utilization of pawned goods by creditors is a significant issue in the study of fiqh muamalah, particularly regarding the principles of justice and validity in Islamic economic transactions. This study aims to analyze the utilization of pawned goods by creditors from the perspective of fiqh muamalah and assess its compliance with Shariah principles. The research employs a literature review method with a descriptive-analytical approach, examining primary and secondary sources of Islamic law. The findings indicate that in fiqh muamalah, the utilization of pawned goods by creditors is permissible under the condition that the pawner (rahin) grants explicit permission and that the practice does not involve elements of riba or injustice. However, if the utilization occurs without consent or causes harm to the rahin, it contradicts the principle of justice in Islam. This study also highlights the importance of clear and transparent contracts between the parties involved to prevent potential disputes. The research concludes that the practice of utilizing pawned goods requires strict supervision to ensure Shariah compliance and to foster equitable and blessed economic transactions.

Abstract

Abstract. The At-Tamur Islamic boarding school for street children is a religious and social educational institution that provides education and guidance to students who are street vendors, buskers, and school dropouts. This study discusses the role of the At-Tamur Islamic boarding school in protecting and empowering street children from a social fiqh perspective. In Islam, the protection of children is a social obligation that must be fulfilled by society, as emphasized in the principle of maqashid syariah. Islamic boarding schools, as Islamic educational institutions, have a strategic role in providing protection and shaping the independence of street children through education and economic empowerment. The research method used is a qualitative approach with a literature study of classical books, contemporary fiqh, supporting journals and books, in-depth interviews with boarding school administrators, teachers, students, and the surrounding community. The data was analyzed descriptively to illustrate the role of Islamic boarding schools from a social fiqh perspective. The results of the study show that social fiqh provides a normative basis for Islamic boarding schools in implementing rehabilitation, education, and skills programs for street children and underprivileged communities. With an approach based on Islamic values, Islamic boarding schools can be an effective solution in overcoming these social problems. Abstrak. Pesantren anak jalanan At-Tamur merupakan Lembaga Pendidikan agama dan sosial yang memberikan pendidikan dan pembimbingan kepada para santri yang memiliki profesi pedagang asongan, pengamen, dan anak-anak yang putus sekolah. Penelitian ini membahas peran pesantren at-Tamur dalam perlindungan dan pemberdayaan anak jalanan melalui perspektif fiqih sosial. Dalam Islam, perlindungan terhadap anak merupakan kewajiban sosial yang harus dipenuhi oleh masyarakat, sebagaimana ditegaskan dalam prinsip maqashid syariah. Pesantren sebagai lembaga pendidikan Islam memiliki peran strategis dalam memberikan perlindungan dan membentuk kemandirian anak jalanan melalui pendidikan dan pemberdayaan ekonomi. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan studi literatur dari kitab-kitab klasik, fiqih kontemporer, jurnal dan buku pendukung, wawancara mendalam kepada pengelola pesantren, para pengajar, santri dan masyarakat sekitar. Data dianalisis secara deskriftif analisis untuk mengambarkan peran pesantren dalam perspektif fiqih sosial. Hasil penelitian menunjukkan bahwa fiqih sosial memberikan dasar normatif bagi pesantren dalam menjalankan program rehabilitasi, pendidikan, dan keterampilan bagi anak jalanan dan Masyarakat kurang mampu. Dengan pendekatan yang berbasis nilai-nilai Islam, pesantren dapat menjadi solusi efektif dalam mengatasi permasalahan sosial ini.
