Abstract

The agreed sources of law in Islamic law are the Holy Koran and the Sunnah. However, in the literature on ushul fiqh, Islamic jurists have different opinions regarding the position of analogy (qiyâs) as a source and legal proposition that functions as a method of finding law in Islam. Then there are differences of opinion regarding the use of analogy in the context of sharia economic law. This research focuses on the position of analogy (qiysâs) as a method of discovering sharia economic law and its application in the contemporary transactions. This study uses a qualitative method with a normative juridical approach. This research includes the type of literature study research. The results of the study show that analogy (qiyâs) can be used as a method of legal discovery, especially in sharia economic law and its application in contemporary transactions including qiyâs of IMFZ contracts to bai' al-salam contracts; (2) qiyâs sale and lease back transactions to bai' al-istighlâl; (3) qiyâs wakâlah bi al-ujrah contract to ijârah contract; (4) qiyâs Wada'i al-Mashrafiyyah to qardh contracts; and (5) qiyâs deposits to mudhârib-yudhârib.Keywords: Qiyâs, Sharia Economic Law, Legal Discovery Method

Abstract

Abstract. The Indonesian Ulema Council (MUI) Fatwa No. 83 of 2023 affirms the obligation of Muslims to support the Palestinian struggle and prohibits any form of involvement that benefits Israel, including the consumption of products affiliated with it. This study aims to analyze the implementation of the fatwa in product sales policies at the Lecturer and Employee Cooperative (KOPKARDOS) of Universitas Islam Bandung (UNISBA), focusing on normative, ethical, and institutional dimensions. The research employs a normative juridical approach, examining the foundations of Islamic law through the Qur’an, Hadith, and fiqh principles, particularly the method of sadd al-dzari‘ah and the objectives of maqāṣid al-sharī‘ah. The findings reveal that the application of the fatwa in KOPKARDOS faces challenges such as limited public understanding, consumer resistance to product changes, and economic considerations of the cooperative. Nevertheless, product selection policies based on the fatwa hold strategic potential in shaping an ethical consumption culture within the campus environment, provided they are supported by education, dissemination, and institutional commitment. Thus, the implementation of MUI Fatwa No. 83 of 2023 functions not only as a legal guideline but also as a moral and social instrument that strengthens Muslim solidarity with the Palestinian cause through consumption practices aligned with justice and Islamic values. Abstrak. Fatwa Majelis Ulama Indonesia (MUI) Nomor 83 Tahun 2023 menegaskan kewajiban umat Islam untuk mendukung perjuangan Palestina serta melarang segala bentuk keterlibatan yang memberikan keuntungan bagi Israel, termasuk konsumsi produk yang berafiliasi dengannya. Penelitian ini bertujuan untuk menganalisis implementasi fatwa tersebut dalam kebijakan penjualan produk di Koperasi Karyawan Dosen (KOPKARDOS) Universitas Islam Bandung (UNISBA), dengan fokus pada dimensi normatif, etis, dan kelembagaan. Metode penelitian yang digunakan adalah pendekatan yuridis normatif, dengan menelaah landasan hukum Islam melalui Al-Qur’an, hadis, serta kaidah fiqhiyyah, khususnya metode sadd al-dzari‘ah dan prinsip maqāṣid al-syarī‘ah. Hasil penelitian menunjukkan bahwa penerapan fatwa di KOPKARDOS menghadapi tantangan berupa keterbatasan pemahaman masyarakat, resistensi konsumen terhadap perubahan produk, serta pertimbangan ekonomi koperasi. Namun, kebijakan seleksi produk berbasis fatwa memiliki potensi strategis dalam membentuk budaya konsumsi etis di lingkungan kampus apabila didukung oleh edukasi, sosialisasi, dan komitmen kelembagaan. Dengan demikian, implementasi Fatwa MUI No. 83 Tahun 2023 tidak hanya berfungsi sebagai pedoman hukum, tetapi juga sebagai instrumen moral dan sosial yang memperkuat solidaritas umat Islam terhadap perjuangan Palestina melalui praktik konsumsi yang sesuai dengan nilai keadilan dan syariah.

Abstract

One of the financing contracts offered by Islamic banks is the Murabahah financing contract. The Murabahah financing contract functions to increase the utility of money and capital, as well as the utility of goods. Article 127 of the Compilation of Sharia Economic Law (KHES) allows the seller to request the buyer to provide collateral in the Murabahah contract. Fatwa DSN-MUI No. 03/DSN-MUI/IV/2000 regarding Murabahah permits banks to request collateral from financed customers. This provision aims to ensure that customers are serious about making payments. Based on KHES and the fatwa, banks are allowed to request collateral from customers to protect or ensure that their rights are not violated. In practice, to ensure that customers comply with payments, banks request collateral from customers. This collateral can be movable or immovable property. Collateral in the form of immovable property is called fiduciary collateral. Fiduciary collateral is regulated in Law No. 42 of 1999 concerning Fiduciary Collateral (UUJF). According to Article 5 paragraph 1 of UUJF, the imposition of collateral with fiduciary collateral "must" be made by a notarial deed. With this provision of UUJF, there is a difference. KHES and the fatwa of DSN MUI do not require financing contracts to be made using a notarial deed, while UUJF requires it to be made by a notarial deed. Islamic banks, some of which require financing contracts to be made by a notarial deed, while others do not. The adoption of UUJF in Islamic financing is considered inappropriate because it violates Sharia values. Objectives: (1) Explain the regulations used in Murabahah financing contracts in Islamic banks with fiduciary collateral according to the objectives of legal certainty and utility. (2) Describe the implementation of legal protection for customers using Murabahah financing contracts in Islamic banks with fiduciary collateral according to the objectives of legal certainty and utility. Research Method: Research approach: normative juridical. Research nature: descriptive analysis. Data types: secondary data and primary data. Sample determination technique: purposive sampling. Data collection technique: literature study and interviews. Data analysis technique: interpretation and legal analogy.

Abstract

Pesantren in this day and age must be an educational institution that instills Islamic values as a whole, both teaching worship procedures and social social procedures. The management of the pesantren must synergize with other fields in order to make students independent in meeting their life needs. This study aims to analyze the synergy between pesantren management and sharia economics in fostering student independence at the At-Tamur Islamic Boarding School. The research method used is qualitative with a case study approach. Data were collected through observations, in-depth interviews, and documentation studies. The results of the study show that the integration between effective pesantren management and the application of sharia economic principles is able to create an environment that supports the development of student independence. Programs such as sharia cooperatives, entrepreneurship training, and sharia-based financial management are the main keys in achieving these goals. This synergy not only increases the financial independence of students but also forms a character in accordance with Islamic values.

Abstract

The low level of financial literacy among Generation Z has significantly affected their ability to manage personal finances, particularly in preparing emergency funds. From an Islamic finance perspective, term-based mudharabah investment offers an alternative that emphasizes not only profitability but also the principles of justice, honesty, and transparency between the capital provider (shahibul maal) and the fund manager (mudharib). This article aims to analyze the potential of term-based mudharabah as an emergency fund instrument for Generation Z by employing a qualitative conceptual literature approach. The analysis indicates that mudharabah investment possesses characteristics that align well with the objectives of emergency fund formation, as its profit-sharing mechanism provides a more equitable return compared to interest-based conventional instruments. Furthermore, the underlying Islamic values promote ethical and sustainable financial management. However, the limited understanding of Islamic financial instruments and the consumerist tendencies among Generation Z remain major obstacles to the broader adoption of this scheme. Therefore, stronger financial literacy education and innovative mudharabah products with flexible liquidity features are required to meet the needs of younger investors. Consequently, term-based mudharabah can serve as an effective and Sharia-compliant solution to enhance Generation Z’s financial resilience through ethical and well-managed emergency fund planning.

Abstract

This study aims to analyze strategies for utilizing sharia investment in empowering the halal business ecosystem in Indonesia. The method used is a Systematic Literature Review (SLR) with thematic analysis of publications from 2020 to 2025. The results show that Islamic investment through Islamic stocks, sukuk, mutual funds, fintech, and blended finance has great potential to finance and strengthen the halal value chain from corporations to MSMEs. However, its utilization is still hampered by low Islamic financial literacy, limited access for MSMEs, fragmented regulations, and suboptimal supporting infrastructure. Based on the analysis, an empowerment strategy based on the Halal Ecosystem Integration Model (HEIM) was formulated, emphasizing: (1) strengthening sharia financing infrastructure; (2) accelerating halal certification for MSMEs; (3) integrating the halal value chain; and (4) increasing literacy and human resource capacity. In conclusion, Islamic investment can serve as a catalyst for inclusive and sustainable halal industry empowerment, in line with the principles of maqashid syariah, if supported by integrated strategies and synergistic policies from all stakeholders.
