Abstract

As one of the implementations of the Work Practice program, the author chose to assist PT. Global Yupiter Indonesia in creating or designing a Work Agreement or it can also be called a Work Contract by following the directions of PT. Global Yupiter Indonesia, but still pay attention to the applicable laws. This is necessary to minimize the risk of problems between PT. Global Yupiter Indonesia as the employer and its workers. Considering that in the world of employment, there must be several rights and obligations that must be fulfilled by the parties in the employment relationship, namely the role of the employer and worker.The type of research that the author uses is normative-empirical / applied legal research using primary data sources obtained from the field and interviews with PT. Global Yupiter Indonesia. For the purpose of achieving within a period of 3 (three) months, the author adjusts the form of the Work Agreement according to the requests, circumstances, and also needs of PT. Global Yupiter Indonesia by staying guided by the applicable Labor Act. In making, the author divides the process into 3 (three) stages, namely the preparation stage as a prefix, then implementation, and then the assessment of reporting. The exterior of the Practical Work program that the author carries out is in the form of a draft of a Fixed Time Employment Agreement (PKWT) and a Fixed-Term Employment Agreement (PKWTT).

Abstract

Employment Contract Limited Time (PKWT) is a work agreement between workers and the company in establishing a working relationship for a certain period of time or for certain jobs. The latest regulations governing PKWT are Government Regulation Number 35 of 2021 concerning Employment Contract Limited Time, Outsourcing, Working Time, and Rest Time, and Termination of Employment. In a company, PKWT is one of the important documents because it can be valid evidence for both parties, namely the employee and the company. Therefore, the authors are encouraged to contribute in the form of PKWT design which is expected to help the company PT. Sarana Inspirasi Maju Bersaudara in creating good working relationships with workers in carrying out their business activities. The main problem is that adjustments must be made to the latest law, but PT. Sarana Inspirasi Maju Bersaudara has not carried out the adjustment due to the lack of manpower in the legal field. The implementation method used in this report uses empirical juridical. The empirical juridical method is a type of legal research that is examined directly in the field in the form of examining company documents or data obtained in the field which is then adjusted to the applicable law.

Abstract

Keagenan Kapal merupakan suatu kegiatan untuk mengageni kapal milik principal disuatu pelabuhan tertentu berdasarkan otoritas yang diberikan dari penunjukkan badan usaha baik berbentuk badan hukum maupun tidak yang sudah memiliki perizinan menurut hukum Indonesia. Penujukkan agen berdasarkan surat penunjukkan keagenan belum memberikan perlindungan dan kepastian hukum bagi para pihak sehingga mendorong penulis merancang sebuah kontrak kerjasama yang berbentuk format baku sesuai dengan ketentuan hukum yang berlaku untuk dapat diterapkan bagi PT. Pelayaran Nasional Lestari sebagai objek dimana penulis melakukan pengabdian kepada masyarakat. Acuan hukum yang digunakan sebagai dasar penyusunan berupa Peraturan Menteri Perhubungan Republik Indonesia No. PM 65 Tahun 2019 tentang Penyelenggaraan dan Pengusahaan Keagenan Kapal, dan Peraturan Menteri Perhubungan Republik Indonesia No. PM 121 Tahun 2018 Tentang Jenis, Struktur, Golongan Dan Mekanisme Penetapan Tarif Jasa Kepelabuhanan . Penyusunan laporan ini melalui tiga metode tahapan. Tahap pertama adalah tahap persiapan bagi penulis dalam memperoleh izin dari pihak bersangkutan untuk pelaksanaan pengabdian kepada masyarakat. Tahap kedua dilakukan observasi dan pengumpulan data untuk mengidentifikasi permasalahan hukum yang ada untuk diangkat sebagi topik yang akan dibahas dalam laporan serta menentukan luaran yang akan dihasilkan dan diberikan pada masyarakat. Tahap Ketiga merupakan tahap terakhir dimana penulis menghasilkan luaran kontrak kerjasama keagenan kapal ini untuk diimplementasikan. Hasil dari implementasi membawa perbaikan yang progresif pada PT. Pelayaran Nasional Lestari serta memudahkan dalam melakukan kerjasama dengan agen, hubungan kedua belah pihak menjadi lebih jelas akan hak dan kewajibanya dimana terdapat pengaturan yang lebih rinci daripada surat penunjukkan keagenan kapal.

Abstract

Radicalism and terrorism are closely related as threats to peace and harmony, as bothare flawed manifestations of religious values and ideologies. The radicalization processcarried out by members of various terror organizations in Indonesia has not receivedmuch attention and hasn’t been responded with concrete efforts to stop its spread asthe precursor to terrorism. The normative legal research method is used in this studyto analyze the positive elements and purposes of regulations related to the educationalsystem, free speech, and radicalism prevention in Indonesia. Findings of this studyillustrate the legal urgency in Indonesia to carry out normative construction regardingthe criminalization process of radicalization, as well as its limitations and obstacles,as part of the effort to prevent criminal acts of terrorism. As a point of prevention andresistance to the spread of radicalism and terrorism in Indonesia, this criminalizationprocess is juxtaposed with the existing education system.

Abstract

This research aims to analyze the legal aspects of electronic information dissemination that violates moral norms. The unethical dissemination of information, including hoaxes, hate speech, and other harmful behaviors, has become a significant concern in the digital environment today. The research method employed is normative legal research, utilizing three approaches: legislative, case-based, and conceptual. Research data were collected from secondary sources, including relevant laws and literature on legal issues related to electronic information dissemination. Additionally, tertiary data was derived from specific cases that exemplify the phenomenon of morally unethical information dissemination empirically, both within the digital space and outside the network. Data analysis involved stages of reading, note-taking, reduction, interpretation, and concluded with deduction. The research results outline the pertinent articles and sections within legal regulations concerning violations of moral norms in electronic information dissemination. Furthermore, the study discusses law enforcement measures that can be taken against the perpetrators of such violations. This research contributes to understanding the legal aspects related to morally unethical electronic information dissemination in the current digital era. It is essential to ensure that ethics and legal compliance are maintained in the increasingly complex online environment.

Abstract

Introduction: Making agreements in Indonesia can be done in written and unwritten form. This is in accordance with the principle of freedom of contract in the Civil Code. Unwritten agreements are also very often carried out in the business world because they are more efficient. However, unwritten agreements are problematic because they are very difficult to prove in civil court.Purposes of the Research: There are 2 (two) objectives in this research, namely first, to analyze the legal strength of unwritten agreements from the perspective of civil law books and second, to analyze evidence in civil courts for cases of breach of contract in unwritten agreements. Then to find the right legal solution in resolving default problems in civil court.Methods of the Research: The research method used in this research is normative juridical. This method uses literature study techniques. The type of data used comes from primary data, namely the Civil Code and legal principles, namely freedom of contract. then the secondary legal material used is in the form of previous research articles which examine the validity of unwritten agreements.Results of the Research: Based on the research results, it was found that unwritten agreements have binding legal force. However, in reality it is very difficult to prove it in court because evidence in civil law comes from written letters. Therefore, the solution that can be offered is the need for preventive and repressive legal efforts.

Abstract

This study delves into the pivotal role of animal health certification in overseeing animal quarantine in Batam City and its profound impact on the local animal product industry. Positioned as Indonesia's economic and industrial hub, Batam City has witnessed rapid growth in the animal product sector. Animal health certification significantly contributes to upholding the quality and safety of animal products in the region, addressing not only regulatory compliance but also considerations for environmental sustainability, human health, consumer trust, and adherence to regulations like Law Number 18 of 2009 regarding Livestock and Animal Health. The research aims to elucidate the urgency and relevance of animal health certification, pinpoint relevant regulations, and expound on the implications of certification within the contexts of animal health, consumer safety, and the trade of animal products in Batam City. The ramifications of animal health certification in Batam City are highly noteworthy, fostering heightened consumer confidence in animal products. Employing the normative legal research method with literature as the primary approach, the findings reveal administrative challenges and logistical hurdles in implementing animal health certification, proposing improvement measures for system efficiency to support the overarching goals of animal health, food safety, and community well-being.

Abstract

The principle of freedom of contract is one of the principles in an agreement where the parties can determine for themselves the form of the agreement that will be made. However, by implication, this principle reaps many injustices. One form of implementation of this principle is standard agreements made in the business world. Standard agreements are only made unilaterally so they have the potential to cause injustice. This research aims to analyze whether or not restrictions are necessary in the principle of freedom of contract. The research method used is normative juridical. The theoretical basis used is Economic Democracy Theory. The research results show that the principle of freedom of contract has resulted in a lot of injustice, for example, standard agreements are made in the business world for time efficiency but do not involve the parties in making them, so there are parties whose position is very weak in the agreement. This is not by the theory of economic democracy which should provide prosperity for all, not just certain parties. Therefore, it is necessary to limit the principle of freedom of contract.

Abstract

The Industrial Revolution 4.0, which was initially introduced in Germany, have brought significant implications for the industrial sector in various countries. One of them is Indonesia, as a country that felt the implications and experienced both positive and negative consequences from this change. To anticipate transformation in the industrial sector, the Ministry of Industry initiated the launch of the Making Indonesia 4.0 program. This program aims to accelerate the adaptation of the industrial ecosystem in Indonesia to the industrial era 4.0 which prioritizes the use of information technology in production and management processes. Apart from that, the Making Indonesia 4.0 program is also directed at intensifying the welfare of the Indonesian people through increasing the Gross Domestic Product (GDP) and creating new employment. The study method used is the normative juridical approach, this approach is a scientific study procedure that aims to find the truth based on legal scientific logic from a normative perspective. This study aims to investigate the implications of foreign investment and related regulations for example, Law No. 11 of 2020 concerning Job Creation and Law No. 25 of 2007 concerning Capital Investment, in increasing community welfare through the implementation of the Making Indonesia 4.0 program. The results of this research prove that there is a close relationship between the growth in the amount of foreign investment and the increase in social welfare, especially in terms of the increment in the number of employment opportunities.

Abstract

Introduction: Religious diversity in Indonesia has led to the practice of interfaith marriages, resulting in legal uncertainty. On July 17, 2023, the Supreme Court issued Circular Letter No. 2 of 2023 (SEMA 2/2023) to provide guidance to judges on adjudicating requests for the registration of interfaith marriages.Purposes of the Research: This study aims to analyze the implementation of SEMA No. 2 of 2023 concerning the registration of interfaith marriages within the framework of Bhinneka Tunggal Ika in Indonesia.Methods of the Research: The legal research method used is normative/doctrinal, with a qualitative research approach that includes legislative analysis of relevant regulations and conceptual analysis using legal theories related to the study.Results of the Research: The study reveals that SEMA 2/2023 provides legal certainty consistent with Indonesia's religious diversity and the Bhinneka Tunggal Ika motto. However, some judges continue to approve requests for the registration of interfaith marriages even after the issuance of SEMA, as evidenced by Decision No. 423/Pdt.P/2023/PN Jkt.Utr dated August 8, 2023. Thus, SEMA 2/2023 is insufficient to address the legal uncertainty surrounding interfaith marriages in Indonesia, despite its alignment with the spirit of Bhinneka Tunggal Ika. Legal harmonization across various regulations is needed to achieve the desired legal certainty.
