Abstract

Memperoleh data penting bagi kebebasan bersama yang dijamin oleh konstitusi negara sebagaimana diatur dalam Pasal “28F Undang-Undang Dasar Negara Republik Indonesia Tahun 1945” yang pada dasarnya bermakna bahwa negara memberikan sertifikasi kepada setiap individu sebagai komponen keistimewaan yang mereka perlukan. menyampaikan dan memperoleh data untuk menumbuhkan iklim individu dan sosial, serta mempunyai pilihan untuk mencari, memperoleh, memiliki dan menyimpan, dengan tetap memperhatikan keamanan informasi individu. 1Program Studi Ilmu Hukum Fakultas Hukum Universitas Internasional Batam2Program Studi Ilmu Hukum Fakultas Hukum Universitas Internasional Batam3Program Studi Ilmu Hukum Fakultas Hukum Universitas Internasional BatamInti dari pemeriksaan ini adalah untuk mengetahui bagaimana data diungkapkan dalam kasus-kasus umum dan dampaknya terhadap hak perlindungan dan keamanan informasi. Teknik eksplorasi ini menggunakan strategi pemeriksaan yang teratur dan sah dengan strategi yang jelas. Pengaturan pemeriksaan halal adalah penelitian yang dilakukan dengan menganalisis perpustakaan (informasi tambahan) atau eksplorasi perpustakaan yang sah. Konsekuensi dari pemeriksaan ini menunjukkan bahwa pengungkapan data dalam kasus-kasus umum dapat dilakukan dengan mengaburkan informasi kepribadian individu. Pentingnya kamuflase atau penggelapan informasi individu sebagaimana diatur dalam “Peraturan Nomor 27 Tahun 2022” bertujuan untuk menjamin data informasi individu tidak mudah diakses oleh masyarakat luas. Dalam tinjauan para ilmuwan, tindakan eksekusi di pengadilan tingkat dasar tidak cukup mempertimbangkan pengaturan dalam “(Pilihan Pengadilan Tinggi) KMA Nomor 1-144/KMA/SK/I/2011.” Hal ini harus terlihat dalam salah satu kasus demonstrasi kriminal yang berkualitas etis, baik nama pelaku maupun korbannya masih diungkapkan secara gamblang dan tidak dikaburkan atau digelapkan dalam kerangka berpikir pilihan tersebut. Benturan standar terjadi dalam penggunaan “Pasal 15 ayat (1) huruf a Perpres No. 27 Tahun 2022”, lebih spesifiknya terdapat intrik-intrik negara yang berebut kepentingan perseorangan sehingga bisa dikatakan di dalam aturan tersebut terdapat potensi pemutusan hubungan kerja yang sah. poin, hak istimewa yang ditetapkan tidak bersifat langsung.

Abstract

Penelitian ini mengkaji perlindungan hukum terhadap data pribadi debitur dalam aktivitas pinjaman online dengan fokus pada regulasi di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan studi kepustakaan. Hasil penelitian menunjukkan bahwa perlindungan data pribadi debitur telah diatur dalam berbagai peraturan, termasuk UU ITE, KUHPerdata, dan peraturan OJK. Namun, implementasinya masih menghadapi tantangan dalam dinamika pinjaman online. Pelanggaran data pribadi dapat dikenai sanksi pidana dan administratif. Penelitian ini bertujuan untuk meningkatkan pemahaman tentang kerangka hukum perlindungan data pribadi, sehingga masyarakat dapat memanfaatkan layanan pinjaman online dengan lebih aman dan terhindar dari penyalahgunaan data pribadi.

Abstract

Welfare constitutes a goal of the Indonesian State as mandated in the 1945 Constitution. The concept of welfare in Indonesia must be in accordance with Pancasila as the ideology of the Indonesian state. The purpose of this study is to analyze the concept of welfare from the Pancasila perspectives and its manifestation in the Sea Tribe community in Lingga Regency. The method in this study is empirical research with socio-legal approaches. The results of the study show that the welfare based on the Pancasila perspectives is the fulfillment of the rights of society, namely the rights to health, education, housing and adequate income. The realization of this right remains to be a challenge for the Sea Tribe in Lingga Regency, even though the local government has taken adequate regulatory measures by establishing a regional regulation regarding the empowerment of the Sea Tribe community. Therefore, contextual and concretes measures are needed through the integration of work programs in the education, health and social sectors. Public participation is also needed in supporting the government program.

Abstract

Introduction: Current technological developments have an influence on all aspects of human life, including government administration. Notaries are non-governmental public officials who provide public services in providing good governance for the community. However, notarial services in Indonesia are carried out conventionally, which slows down notarial services. Different things happened in America. America is a country that has advanced technology.Purposes of the Research: The aim of this research is to analyze the urgency of implementing cyber notary in Indonesia, find differences in legal regulations and application of law regarding cyber notary in Indonesia and America and find the right solution in organizing cyber notary in Indonesia.Methods of the Research: The research used normative juridical method with secondary data from primary legal sources including various laws and acts like Law Number 2 of 2014, Law Number 30 of 2014, and others related to notarial acts, personal data protection, and blockchain technology in California and Illinois.Results of the Research: The research reveals Indonesia lacks comprehensive laws for cyber notaries. Learning from the US, which has established regulations, Indonesia needs to revise its Notary Law to incorporate cyber notaries and uphold principles of good governance.

Abstract

Banking Credit is an agreement between a bank (creditor) and a borrower (debtor) that regulates the provision of loans by banks to customers. This agreement includes various terms and conditions that must be met by both parties, including the loan amount, interest rate, payment period, installment payment obligations, and the rights and obligations of each party. Examples of provisions often found in this agreement are the debtor's obligation to pay installments on time, provisions regarding late fees, and conditions governing the use of collateral in the form of assets that can be auctioned if the debtor fails to pay the debt. This research aims to discuss the rules related to banking credit agreements and the implementation of banking credit agreements, especially by banks, so that these agreements can be obeyed by debtors and run effectively. The method used in this research is the Empirical research method which uses data collection techniques through interviews. credit agreements use standard contracts that contain the rights and obligations of both parties. To mitigate the risk of default, collateral is required and can be sold if the debtor fails to pay. The principle of prudence is applied so that banks remain healthy and maintain public trust. An effective credit agreement involves analyzing the prospective debtor's eligibility, drafting a clear agreement, and monitoring the debtor's performance on an ongoing basis.Banking Credit Agreement is an agreement between a bank (creditor) and a borrower (debtor) that regulates the provision of loans by banks to customers. The percautionary principle is applied so that banks remain healthy, As well as maintaining public trust. an effective credit agreement involves analyzing the eligibility of the prospective debtor, drafting a clear agreement, and monitoring the debtor's performance on an ongoing basis to minimze risks and ensure debtor compliance

Abstract

The provisions of Article 433 of the Civil Code contain phrases that violate the rights of people with disabilities, especially for people with non-permanent mental disabilities. Through this provision, people with permanent mental disabilities are prevented from carrying out legal actions. This research aims to analyze the skills of people with disabilities in carrying out legal actions and analyze the provisions of Article 433 of the Civil Code with the Constitution. The research method used is normative juridical. In formulating the answer to the problem, a juridical basis and a theoretical basis are used. The research results show that the provisions of Article 433 have discriminated against people with non-permanent mental disabilities and it has been declared through the Constitutional Court Decision that Article 433 is conditionally unconstitutional. The challenge is that the district court as an institution that has the authority to form pardons must be truly careful and careful in making decisions/decisions on requests for pardons. Therefore, it is necessary to evaluate the implementation of these institutions on an ongoing basis to ensure that people with disabilities receive protection for their rights as people with disabilities.

Abstract

Carbon emissions play an important role in the acceleration of climate change, which threatens the livelihoods of many people around the world. Electronic vehicles (EVs) serve as a solution to this problem by reducing the amount of pollution and enabling the use of renewable energy as a source. This research analyzes the incentives provided by countries that are trying to reduce their carbon emissions with EVs, namely Indonesia and Malaysia. The analysis is supported by a comparative legal research method and statutory approach. This research finds that Malaysia’s framework of incentives is superior to that of Indonesia’s, as incentives provided by Indonesia do not address the issue of carbon emissions entirely and are buried within a very fragmented legal framework. The research proposes a number of changes that need to be made in Indonesia to support the EV industry in all of the aspects that are relevant to its development, such as R&D, human resources, consumer support, and financial support for manufacturers.

Abstract

This research emphasizes the urgent need to update legal protections for student rape victims to ensure their right to formal education. Many victims face barriers to education following rape, losing opportunities to continue their studies. This study critically examines the need for legal reform to safeguard their educational rights, focusing on legislative frameworks and provisions. Using a case-based methodology and juridical-normative analysis, the research explores existing legal approaches, such as the General Law No. 12 of 2022 and Government Regulation No. 43 of 2017, which address restitution for child victims of criminal acts. The findings stress the responsibility of educational institutions and stakeholders to uphold education rights for all students, regardless of circumstances. The research contributes to the discourse on restitution, suggesting legal reform to ensure perpetrators cover the costs of education and support for victims, thereby offering a path forward in protecting vulnerable students.

Abstract

Agriculture, as a significant contributor to carbon emissions and climate change, needs to not only change its ways to a more sustainable practice but also revisit what has long been considered conventional agriculture practices to support sustainable development. This requires a comprehensive legal framework to ensure that the transition to sustainable agriculture is supported by structured and streamlined legal compliance that can balance stakeholders’ interests. Employing the comparative legal research method, this study aims to analyze the potentials and challenges of applying sustainability in agriculture, using the comparison between Indonesia and Thailand. The findings of this study suggest that Indonesia’s legal framework for sustainable agriculture, focusing on its single Sustainable Agriculture Law, is more comprehensive than Thailand’s multiple regulations, effectively supporting sustainability across various agricultural processes. This framework aligns well with SDGs 2, 12, 13, and 15, which are crucial for agricultural sustainability. Conversely, Thailand faces challenges due to normative gaps and requires a more unified legal framework to address these SDGs adequately.

Abstract

Penelitian ini menganalisis implementasi Peraturan Menteri Perhubungan (Permenhub) Nomor 118 Tahun 2018 tentang taksi online di Kota Batam. Tujuan penelitian ini adalah untuk memahami substansi, struktur, dan implikasi hukum dari peraturan tersebut dalam konteks praktik lapangan. Metode penelitian yang digunakan adalah pendekatan analisis hukum normatif. Data diperoleh melalui analisis isi peraturan, literatur hukum, mengidentifikasi ketentuan tarif, promosi, dan wilayah operasi yang diatur dalam peraturan. Hasil penelitian menunjukkan bahwa Permenhub Nomor 118 Tahun 2018 memberikan arahan yang jelas terkait taksi online, namun pelaksanaannya masih memiliki tantangan dalam kepatuhan dan pengawasan. Implikasi hukumnya terhadap taksi online mempengaruhi tarif, promosi, dan kerjasama dengan perusahaan angkutan umum. Kata kunci: taksi online, Permenhub 118/2018, implementasi, tarif, wilayah operasi
