Abstract

Penelitian ini menganalisis implementasi Peraturan Menteri Perhubungan (Permenhub) Nomor 118 Tahun 2018 tentang taksi online di Kota Batam. Tujuan penelitian ini adalah untuk memahami substansi, struktur, dan implikasi hukum dari peraturan tersebut dalam konteks praktik lapangan. Metode penelitian yang digunakan adalah pendekatan analisis hukum normatif. Data diperoleh melalui analisis isi peraturan, literatur hukum, mengidentifikasi ketentuan tarif, promosi, dan wilayah operasi yang diatur dalam peraturan. Hasil penelitian menunjukkan bahwa Permenhub Nomor 118 Tahun 2018 memberikan arahan yang jelas terkait taksi online, namun pelaksanaannya masih memiliki tantangan dalam kepatuhan dan pengawasan. Implikasi hukumnya terhadap taksi online mempengaruhi tarif, promosi, dan kerjasama dengan perusahaan angkutan umum. Kata kunci: taksi online, Permenhub 118/2018, implementasi, tarif, wilayah operasi

Abstract

Introduction: Indonesia and Malaysia are countries with fairly good economic levels in the ASEAN. Economic growth in the business world also has an influence on contract law because the phenomenon that occurs is the use of standard agreement models in the business world to make business processes more effective and efficient.Purposes of the Research: The aim of this research is to analyze the differences in contract law in Indonesia and Malaysia, also describe the phenomenon of standard agreement practices that occur in Indonesia and Malaysia, and analyze the validity of standard agreements that apply in Indonesia and Malaysia.Methods of the Research: The research method used is normative juridical. The type of study used is through literature study. The type of data used is secondary data consisting of primary legal materials, namely the Civil Code, the Malaysian Contracts Act 1950, the 1957 Sale of Goods Deed.Results Main Findings of the Research: The research results show that Indonesia and Malaysia are countries that have implemented standard agreement. These two countries also have a legal basis that allows standard agreements to come into force on the condition that there must be clauses that emphasize the rights and obligations of the parties to achieve justice.

Abstract

Introduction: Technological developments have an impact on today's business world, which is buying and selling activities carried out through Instagram.Purposes of the Research: The purpose of this study is to examine the perspective of civil law books regarding the phenomenon of buying and selling via Instagram and analyzing the best solution so that buying and selling activities via Instagram do not violate the law.Methods of the Research: The method in this study is normative juridical which uses a library approach. In answering the formulation of the problem, the juridical basis is used, namely the civil law code book and the theoretical basis, namely modern contract law theory.Results of the Research: Based on research results, buying and selling activities via Instagram are very difficult to fulfill the legal requirements of an agreement as stipulated in the civil law code. This has also led to many cases of law violations through Instagram. Therefore, it is necessary to apply the principle of good faith in the buying and selling process on Instagram.

Abstract

Introduction: One type of human rights is civil rights. Correctional institutions are places to build relationships with civil rights concerns. However, in practice, when dealing with divorce cases, they cannot attend the divorce party and are not given a verstek decision. Purposes of the Research: The purpose of this study is to analyze the implementation of Law No. 12 of 1995 concerning Corrections.Methods of the Research: The research method is normative juridical. This study also uses a juridical basis and a theoretical basis. The juridical basis used is 1945 Constitution, Law Number 1 of 1974 concerning marriage, Law Number 12 of 1995 concerning Corrections and the theoretical basis used is theory of legal objectives according to Gustav Radbruch.Results of the Research: Based on the results of the study, the law on corrections has not yet achieved its legal objectives. This is due to the weak structure, substance and culture of prisons. This causes whether or not the civil rights are fulfilled. Therefore, it is necessary to revise the correctional law by taking into account civil rights when dealing with divorce cases.

Abstract

Radicalism and terrorism are closely related as threats to peace and harmony, as bothare flawed manifestations of religious values and ideologies. The radicalization processcarried out by members of various terror organizations in Indonesia has not receivedmuch attention and hasn”™t been responded with concrete efforts to stop its spread asthe precursor to terrorism. The normative legal research method is used in this studyto analyze the positive elements and purposes of regulations related to the educationalsystem, free speech, and radicalism prevention in Indonesia. Findings of this studyillustrate the legal urgency in Indonesia to carry out normative construction regardingthe criminalization process of radicalization, as well as its limitations and obstacles,as part of the effort to prevent criminal acts of terrorism. As a point of prevention andresistance to the spread of radicalism and terrorism in Indonesia, this criminalizationprocess is juxtaposed with the existing education system.

Abstract

Data protection is one of the most important aspects of the digital economy, with its legal implications extending across digital landscapes. The failure to protect data in data breaches can threaten the interests of owners and expose them to various risks. Legal compliance regarding how owners are notified of data breaches is important to prevent this, necessitating deep legal discourse and analysis. Using a comparative legal research method with a statutory approach, this study dissects norms within Indonesia and South Korea’s legal systems to analyze their differences in legal compliance regarding this issue. The findings of this study highlight the discrepancies in legal frameworks between Indonesia and South Korea. It particularly notes Indonesia's lack of a governing body for data breach notifications and the absence of comprehensive privacy impact assessments or cybersecurity compliance. Ultimately, the study underscores the need for Indonesia to develop a normative model for data protection to address its significant regulatory gaps—contrasting with South Korea's more robust legal mechanisms and the GDPR's systematic oversight.KEYWORDS: Data Breach, Data Breach Notification, Data Protection.

Abstract

Introduction to the Problem: Unfair competition threatens economic growth and is harder to detect in the digital era. For Indonesia and Thailand, growing digital economies depend on fair online marketplaces, yet these platforms face risks like price manipulation and visibility bias. Addressing these issues is crucial to unlocking their global trade potential. Purpose/Study Objectives: The purpose of this research is to analyze the normative potentials and challenges in enforcing antitrust laws in Indonesian and Thai online marketplaces, particularly in addressing antitrust challenges that are unique to the digital environment. Design/Methodology/Approach: This research utilizes normative legal research method and a comparative legal approach to examine the frameworks for protecting against unfair competition in online marketplaces in Indonesia and Thailand. Findings: Findings of this study highlight that the existing antitrust laws in Indonesia and Thailand are not equipped to address the unique challenges of digital markets, such as algorithm-driven price fixing, product visibility manipulation, and data monopoly. The study proposes a legal framework model focusing on enhancing algorithmic transparency, ensuring search neutrality, establishing robust market monitoring, and integrating data governance with antitrust measures. This model aims to bolster fair competition and consumer protection, positioning both nations to leverage their digital economy potentials effectively. Paper Type: Research Article

Abstract

Technological developments have an impact on the financial sector. One of the innovations that has occurred in the financial industry is regarding online loans. The regulations that apply in Indonesia relating to online loans are only regulated by financial services authority regulations and Bank Indonesia regulations. Meanwhile, online lending practices give rise to various legal issues that can no longer be resolved solely through these regulations. The research aims to analyze the urgency of establishing legislation regarding online loans. The research method used in this research is normative juridical in answering the problem formulation; a juridical and theoretical basis was used, namely the Legal Protection Theory. The research results show that the formation of a special law regarding online loans is very critical because of the widespread practice of online loans carried out by illegal institutions, which causes the rights and obligations between loan givers and recipients to be unbalanced, such as determining very high loan interest with short repayment periods, as well as personal data leaks and various other cases and other cases. Therefore, it is hoped that the establishment of this unique law can provide external legal protection.

Abstract

Pembeli menganggap paket yang mereka beli melalui jasa pengiriman dan sistem pembayaran online terutama sistem Cash on Delivery sangat menguntungkan. Tetapi tidak sedikit juga masalah yang timbul akibat belanja dari e-commerce dan menggunakan sistem pembayaran Cash on Delivery Banyak pembeli yang menolak untuk membayar paket yang mereka beli karena merasa paket tersebut tidak sesuai, bahkan sampai meminta pengembalian dana dari kurir. Sementara itu, kurir tidak bertanggung jawab atas ketidaksesuaian produk yang diterima, kurir hanya berfungsi sebagai perantara antara penjual dan pembeli kemudian mengantarkan paket dan menagih pembayaran dari mereka. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana regulasi tentang perlindungan hukum terhadap kurir dalam sistem pembayaran Cash on Delivery. Penelitian ini menggunakan penelitian yuridis empiris yang dilakukan dengan cara meneliti data primer kemudian didukung dengan data sekunder berupa studi kepustakaan dan perundang-undangan. Hasi dari penelitian ini menemukan bahwa adanya kerugian yang dialami oleh kurir, wajib ada ganti rugi dan pertanggungjawaban penjual apabila terbukti ketidaksesuaian dan kerusakan barang dari awal merupakan akibat dari kesalahan penjual.

Abstract

A notary is an official who is authorized to make an authentic deed that has legal force when used as evidence in a contract conference. The purpose of this study is to analyze the forgery of signatures on authentic deeds that are used as evidence in a civil trial. The research method used is normative juridical. The results of the study show that there are cases of forgery of authentic deeds that are used as evidence in a civil trial, while the judge in the civil trial only seeks formal truth, not checking the authenticity of the authentic deed data. If there is forgery of an authentic deed, it can go to criminal court. Therefore, in order for the civil trialto run efficiently, the judge in the civil trial should not only seek formal truth, but also material truth by using the judge's belief. Based on the coherence theory, the judge in the civil trial is still given the opportunity to find the law through the interpretation of statutory regulations. Then based on the theory of evidence, judges in civil trials can also use their beliefs which are referred to as material truth.
