Abstract

Waqf is a form of worship which in the Qur'an is referred to as al-habs, a synonym for the word al-waqaf, namely someone's property that is given to the public so that it can be used as long as the item is still there. Along with the large need for funds for the benefit and locations spread outside the area for the wakif, the idea of ​​cash waqf emerged. With the convenience of cash waqf, people can easily spend their wealth as waqf in religious ways. This research aims to understand the law of cash waqf in the study of fiqh, by looking at several views of fiqh scholars regarding cash waqf and its benefits from a maqasid sharia perspective. This research uses a qualitative-descriptive approach with content analysis techniques in library research and problem analysis using maqasid asy-syariah theory. The results of the research show that the jurists have different opinions in determining the law on cash waqf. Some scholars believe that cash waqf is permissible. Others view the law as makruh. There are even scholars who prohibit it. The results of the study show that cash waqf is in accordance with the principles of maqasid sharia, namely to improve the economy and obtain benefits in this world and the hereafter.

Abstract

The COVID-19 pandemic threatens all humans in the world. Many people died due to the plague of the world that has not disappeared yet from human civilization. Ministry of Social Affairs in 2021 through the Management Information System for Persons with Disabilities as of January 13, 2021, there were 209,604 persons with disabilities in Indonesia. This figure is a reference that there are quite a lot of people with disabilities that need to be considered with a large number of people with disabilities. Persons with disabilities are a group that is vulnerable to today's conditions, the spread of the COVID-19 pandemic in Indonesia. This research aims to determine the government's legal responsibility for persons with disabilities during the COVID-19 pandemic in Indonesia through regulations and legal remedies for handling them. This research uses the juridical-normative method and the conceptual approach and the statute Approach. The results of this study reveal that Persons with Disabilities have a right to health that cannot be reduced and requires the presence of the government to protect fundamental rights, that is the right to health which is included in human rights that have been stated in the laws and regulations in Indonesia. The fulfillment of rights for persons with disabilities during the COVID-19 pandemic has not been fully regulated and implemented by the government. It has been proven in several cases that there is discrimination against persons with disabilities in obtaining easy access and protection during the COVID-19 pandemic.

Abstract

This article analyzes the implementation of Maqasid Syariah in criminal law in four. This research examines the implementation of Maqashid Sharia in Islamic criminal law in Saudi Arabia, Iran, Malaysia and Indonesia by highlighting the variations in implementation based on each country's legal system. Saudi Arabia and Iran fully implement Islamic criminal law, while Malaysia and Indonesia adopt it to some extent through their national legal systems. This study also assesses the extent to which Islamic criminal law in the four countries safeguards the five main aspects of Maqashid Sharia, namely religion, soul, mind, offspring, and property, and examines its effectiveness in upholding justice and social order. The main research question posed is: how is Maqasid Syariah implemented in the criminal law systems in these countries, and to what extent are these principles in line with human rights and national law? This study uses a qualitative approach with a library study method, where data is obtained from academic literature, legal documents, and related articles. The research findings show that the implementation of Maqasid Syariah varies from country to country depending on their respective socio-political contexts. The study found that the implementation of Maqashid Sharia in Islamic criminal law in Saudi Arabia, Iran, Malaysia and Indonesia varies, with Saudi Arabia and Iran implementing it strictly, while Malaysia and Indonesia adopted it in a dual legal system. The academic contribution lies in the comparative analysis of the effectiveness of Islamic criminal law in achieving justice and the challenges of harmonization with human rights. Its application can be a reference for policy makers in designing a more adaptive Islamic criminal law system, balanced between Islamic law and the demands of modernity.

Abstract

Penelitian ini bertujuan untuk mengetahui strategi BUMDesa dalam mengembangkan usaha, dukungan sumber daya serta dampak BUMDesa pada organisasi dan pada kelompok masyarakat. Jenis penelitian pada penelitian ini yaitu menggunakan deskriptif kualitatif. Teknik pengumpulan data yang dipakai merupakan observasi, wawancara dan dokumentasi. Permasalahan yang dihadapi BUMDesa Kian Santang terletak pada belum optimalnya pengelolaan potensi desa, khususnya sektor kerajinan yang sebenarnya menjadi unggulan Desa Tutul, karena perhatian lebih difokuskan pada usaha simpan pinjam  perempuan. Selain itu, pemahaman masyarakat terhadap manfaat dan peran BUMDesa masih sedikit sehingga partisipasi masyarakat dalam pengelolaan BUMDesa rendah. Dalam hasil penelitian menyatakan bahwa pada strategi program, BUMDesa mengembangkan tiga unit usaha: kerajinan yang tidak lagi berjalan, Simpan Pinjam Perempuan yang bermanfaat luas namun terkendala pengembalian dan air mineral isi ulang yang stabil dan berdampak sosial dan ekonomi. Program BUMDesa memberikan dampak positif terhadap organisasi dan masyarakat, khususnya kelompok pengrajin dan pemuda, namun masih memerlukan penguatan pada aspek pemasaran dan tata kelola. Strategi sumber daya meliputi sarana prasarana memadai, pemanfaatan sumber daya alam yang efektif, serta sistem keuangan manual yang perlu digitalisasi.

Abstract

This research focuses on looking at the urgency of Islamic education in expanding understanding of maqashid sharia in the concept of ushul fiqh, Islamic education is important for expanding understanding of maslahah and mafsadah in legal istinbath methodology, and describes the methods proposed by Izzudin to resolve the contradiction between maslahah and sorry. This research includes qualitative research which is descriptive analysis with a logical and historical philosophical approach. The data collection technique used is library research. The primary source for this research refers to the book Qawaid al-Ahkam fi Masalih al-Anam and the book Syajarat al-Ma'arif wa al-Ahwal wa Salih al-Aqwal wa al-A'mal. These findings explain that the concepts of maslahah and mafsadah in Islamic law will become more optimal if their understanding is strengthened and disseminated through Islamic education, especially those closely related to maqashid sharia. Maslahah supports the objectives of sharia in kulliyah khamsah, while mafsadah contradicts it. Proposals to reconstruct maqashid sharia independently of kulliyah khamsah were rejected because they usually only combined or complemented existing principles. Maslahah and mafsadah are important elements in Islamic legal istinbath, and must be managed within the framework of sharia dhawabith to avoid subjectivity and legal instability. Izzudin offers four methods to resolve the contradiction between maslahah and mafsadah, namely jam'u (merging), tarjih (weighing), takhyir (selection), or tawaqquf (termination). He emphasized that the contradiction between these two concepts is often only relative and depends on perspective, suggesting to assess the dominance of one aspect over the other in a given situation. This will of course be more optimal if it is conveyed and emphasized through the participation of Islamic education, so that discussions related to tarjih maslahah on mafsadah, especially in the study of Islamic law will become more interesting and developed.

Abstract

Hospitals function as quarantine, prevention and control of the Covid-19 Pandemic era. However, the crucial issue is the hospital is lying; patients who have not confirmed Covid-19 but are considered positive by the hospital. This study discusses legal protection for hospitals to care for patients with suspected Covid-19. The research is compiled with the type of normative juridical research; namely, research focused on examining the application of the rules or norms in positive law. The result shows that the hospital as a legal entity (recht person) has risks under Article 58 (1) of the Health Law, namely compensating for errors/omissions of doctors and health workers. According to the Vicarious Liability doctrine, the hospital is legally responsible for all losses caused by its subordinates. According to the Hospital Liability doctrine, the hospital is responsible for taking over the mistakes or omissions of the hospital. With the right of regress, the hospital will ask for compensation back to the doctor who made a mistake. The Strict Liability Doctrine states that the hospital is responsible for the workhouse. The implementation of hospital legal protection has yet to be precise. Supervision and guidance by the government, including the government’s authority on health, still need to be made clear. Medical audits could have gone better. Doctors have the right to obtain legal protection as long as they carry out their duties under professional standards and standard operating procedures under Article 50 of the Medical Practice Act.

Abstract

bahwa Alquran adalah Kitab yang mampu mengontrol semua situasi dan kondisi manusia, termasuk sains kontemporer. Pendekatan ini disebut pendekatan logika analitik terhadap Alquran, karena tidak terjebak pada metode tafisr-tafsir klasik. Epistemologi analitis berusaha melampaui masa lalu, sambil mengokohkan kaidah-kaidah untuk menganalisis Alquran karena akan merangkaul atau mengadaptasikan persoalan-persoalan kontemporer. Alquran menurut Ḥâjj Ḥamad paralel dengan eksistensi kosmos dan pergerakannya, dan karenanya berbagai konsep baru dapat dikeluarkan dari kandungan Alquran yang terpendam dan anugerahnya yang kontinyu. Perlunya mengkritik semua pendekatan tafsir klasik yang berlaku sampai sekarang. Namun demikian, hal ini tidak berarti mengabaikannya sama sekali. Logika merangkul dan melampaui mengharuskan para peneliti mengkeritik hasil-hasil sains kontemporer, dan keterbatasannya dalam menemukan pendekatan antara al-ghaib, al-insân dan aṭ-ṭabi’ah sebagai dialektika absolut berdasarkan visi integralistik.

Abstract

Mencermati epistemologi ilmu-ilmu Islam membutuhkan dua model analisis yaitu analisis vertikal dan analisis horizontal. Karena itu wilayah kajiannya menjadi lebih luas dan cukup kompleks meliputi sejarah ilmu dan teori klasifikasi ilmu. Sejarah ilmu-ilmu Islam memperlihatkan peran sarjana muslim yang memelihara ilmu-ilmu bangsa terdahulu dengan cara mengoreksi dan meluruskan, kemudian menulisnya kembali dalam bentuk ringkasan dan komentar. Dalam melakukan klasifikasi ilmu, para sarjana muslim menggunakan banyak teori, namun klasifikasi ilmu perspektif filsafat cukup dominan sehingga ilmu-ilmu yang berada dalam lingkaran wahyu kurang mendapat perhatian. Namun terlepas dari semua ini, pencermatan epistemologi telah memperlihatkan integrasi ilmu dalam beragam bidang dan multi metode. Keterbukaan metodologi mempertegas doktrin relativitas ilmu namun tetap mengandung nilai-nilai yang sakral dan lebih berpeluang melakukan dialog antar peradaban.

Abstract

Abstract Several years ago, the legal world in Indonesia experienced a stir. The reason is that cases occur that ensnare ordinary people in order to survive. These cases are minor crimes with a small nominal amount and are categorized as light theft. In fact, most of these cases involve elderly people. Unfortunately, these cases were reported to law enforcers and some were even investigated and decided by the court. This article wants to examine what is meant by the rule of al-idtiraru la yubtilu haqqul ghair and how this rule is applied to cases of minor criminal acts committed by the elderly to survive which are linked to compensation. This paper uses research of the type normative legal research or doctrinal research. The approaches used in this paper are the statute and the case approach. The results of this research show that the rule of al-idtiraru la yubtilu haqqul ghair is a situation where if someone is in an emergency situation and inevitably has to use other people's belongings to deal with the emergency situation, then he still has the responsibility to replace other people's belongings that have been taken advantage of it. The application of the rule of al-idtiraru la yubtilu haqqul ghair in cases of light theft crimes such as people who in an emergency are still allowed to take or use other people's goods provided that they still have the obligation to replace the other person's goods with similar goods or value. Keywords: Darurat, petty theft, haqqul ghair Abstrak Beberapa tahun yang lalu, dunia hukum di Indonesia pernah mengalami kehebohan sekaligus menggelitik. Pasalnya terjadi kasus-kasus yyang menjerat rakyat jelata guna menyambung hidupnya. Kasus-kasus tersebut merupakan tindak piidana ringan dengan jumlah nnominal yang tidak terlalu besar dan dikategorikan pencurian ringan. Bahkan kasus-kasuss tersebut sebagian besar melibatkan orang-orang yang sudah lanjut usia (lansia). Sangat disayangkan kasus-kasus tersebut sampai diadukan kepada para penegak hukum bahkan ada yang sampai diperiksa dan diputus pengadilan. Tulisan ini ingin mengupas apakah yang dimaksud dengan kaidah al-idtiraru la yubtilu haqqul ghair dan bagaimana penerapan dari kaidah tersebut terhadapp kasus-kasus tindak pidana ringan yang dilakukan para lansia untuk menyambung hidupnya yang dikaitkan dengan ganti rugi. Tulisann ini menggunakannpenelitian yang berjenis penelitian hukum normatif atau penelitian doktrinal. Pendekatan yang digunakan dalam tulisan ini adalah pendekatan perundang-undangann(statute approach) dan pendekatan kasuss(case approach). Hasil dari penelitian ini menunjukkan bahwa Kaidah al-idtiraru la yubtilu haqqul ghair merupakan keadaan apabila seseorang dalam kondisi darurat dan mau tidak mau harus mengambil dan memanfaatkan barang milik orang lain untuk menanggulangi kondisi daruratnya maka ia masih memiliki tanggungan untuk mengganti barang milik orang lain yang telah ia manfaatkan. Penerapan kaidah al-idtiraru la yubtilu haqqul ghair pada kasus-kasus tindak pidana pencurian ringan seperti orang yang dalam keadaan darurat masih diperbolehkan mengambil atau memanfaatkan barang orang lain dengan catatan ia masih memiliki kewajiban untuk mengganti barang orang lain tersebut dengan barang atau nilai yang serupa. Abstract

Penelitian ini mengkaji konsep Kalender Hijriah Global Tunggal (KHGT) melalui integrasi pendekatan istihs?n dan maq?sid al-shar?‘ah sebagai landasan epistemologis dalam upaya penyatuan penetapan awal bulan kamariah. Ketidaksinkronan antara praktik rukyat lokal dan penggunaan hisab selama ini telah melahirkan perbedaan waktu ibadah, tidak hanya antarnegara, tetapi juga dalam satu wilayah yang sama. Kondisi tersebut dipicu oleh perbedaan metode dan kriteria penentuan awal bulan, serta belum optimalnya pemanfaatan pendekatan istihs?n dan maq??id al-shar?‘ah sebagai kerangka metodologis yang menjembatani tuntutan normatif teks syariat dengan perkembangan ilmu pengetahuan modern. Seiring dengan kemajuan teknologi astronomi, hisab modern dan model visibilitas hilal global kini memiliki tingkat akurasi yang tinggi, sehingga memungkinkan penyusunan kalender Hijriah yang stabil, konsisten, dan dapat diprediksi secara jangka panjang. Penelitian ini menggunakan pendekatan kualitatif melalui studi pustaka terhadap dokumen Kongres Internasional Penyatuan Kalender Hijriah Istanbul 2016, Keputusan Tanfiz Majelis Tarjih dan Tajdid Muhammadiyah, serta kajian konseptual terhadap istihs?n dan maq?sid al-shar?‘ah dalam hukum Islam. Hasil analisis menunjukkan bahwa istihs?n memberikan fleksibilitas metodologis untuk meninggalkan pembacaan rukyat secara literal ketika tidak lagi menghadirkan kemaslahatan, khususnya dalam konteks global, sementara maq?sid al-shar?‘ah menegaskan pentingnya kesatuan waktu ibadah sebagai bagian dari realisasi hifz al-d?n dan hifz al-ummah. Dengan demikian, KHGT dapat dipahami sebagai bentuk ijtihad kontemporer yang mengintegrasikan nilai-nilai syariat dengan kepastian ilmiah, sekaligus menawarkan solusi normatif dan praktis bagi penyatuan kalender Islam di tingkat global.
