Abstract

Hospitals function as quarantine, prevention and control of the Covid-19 Pandemic era. However, the crucial issue is the hospital is lying; patients who have not confirmed Covid-19 but are considered positive by the hospital. This study discusses legal protection for hospitals to care for patients with suspected Covid-19. The research is compiled with the type of normative juridical research; namely, research focused on examining the application of the rules or norms in positive law. The result shows that the hospital as a legal entity (recht person) has risks under Article 58 (1) of the Health Law, namely compensating for errors/omissions of doctors and health workers. According to the Vicarious Liability doctrine, the hospital is legally responsible for all losses caused by its subordinates. According to the Hospital Liability doctrine, the hospital is responsible for taking over the mistakes or omissions of the hospital. With the right of regress, the hospital will ask for compensation back to the doctor who made a mistake. The Strict Liability Doctrine states that the hospital is responsible for the workhouse. The implementation of hospital legal protection has yet to be precise. Supervision and guidance by the government, including the government’s authority on health, still need to be made clear. Medical audits could have gone better. Doctors have the right to obtain legal protection as long as they carry out their duties under professional standards and standard operating procedures under Article 50 of the Medical Practice Act.

Abstract

Lajnah Bahtsul Masa’il is used in Nahdlatul Ulama's Istinbathh procedure to determine Islamic law in Indonesia. Starting with the qauli approach, they directly reference the writings of the four madhhabs or their successors. There is also the manhaji approach, which combines a maqashidi approach with collective ijtihad. These three approaches make it possible to create rules adaptable to social and cultural developments in Indonesia while maintaining the core principles of Islamic law's universality. The Istinbathh technique of Nahdlatul Ulama is crucial in adapting to Indonesian society's dynamics and fostering harmony between traditional Islamic teachings and modern advancements. Lajnah Bahtsul Masa’il digunakan dalam prosedur Istinbathh Nahdlatul Ulama untuk menentukan hukum Islam di Indonesia. Lajnah ini mengacu pada empat mazhab saat membahas topik-topik keagamaan. Dimulai dengan pendekatan qauli, mereka membuat referensi langsung ke tulisan-tulisan dari empat mazhab atau penerusnya. Jika tidak ada sudut pandang yang jelas, mereka menggunakan pendekatan ilhaqiy, membandingkan penilaian masalah baru dengan yang sebanding dengan cara merujuk pada sumber-sumber kredibel (mutabar) dan mengutip sudut pandang yang sudah ada sebelumnya. Ada juga pendekatan manhaji, yang menggabungkan pendekatan maqashidi dengan ijtihad kolektif. Ketiga pendekatan ini memungkinkan terciptanya aturan-aturan yang dapat beradaptasi dengan perkembangan sosial dan budaya di Indonesia dengan tetap mempertahankan prinsip-prinsip utama universalitas hukum Islam. Teknik Istinbathh Nahdlatul Ulama sangat penting, karena dengannya keberadaan hukum Islam dapat beradaptasi dan menjalin keselarasan dengan perkembangan dan kemajuan zaman yang ada di tengah masyarakat secara menyeluruh.

Abstract

Pentingnya membangun kesadaran kolektif dalam pencegahan stunting di Desa Jatisari, Kecamatan Jenggawah, Kabupaten Jember, menjadi fokus utama pengabdian ini. Masalah utama yang diidentifikasi adalah kurangnya pemahaman masyarakat tentang stunting, pola makan tidak sehat, keterbatasan akses ke layanan kesehatan, dan faktor sosial-ekonomi yang kurang mendukung. Tujuan utama kegiatan ini adalah meningkatkan pengetahuan masyarakat, membangun kesadaran kolektif, meningkatkan akses dan pemahaman gizi seimbang, mendorong perubahan perilaku, serta melibatkan pemerintah dan tokoh masyarakat dalam pencegahan stunting. Populasi sasaran adalah keluarga dengan balita dan ibu hamil di Desa Jatisari, tokoh masyarakat, petugas kesehatan, dan pemerintah desa. Metode yang digunakan meliputi edukasi melalui penyuluhan dan seminar, pelatihan praktis tentang gizi seimbang, kegiatan pengawasan dan monitoring gizi, serta pendampingan oleh kelompok ibu pendamping. Hasil yang diharapkan adalah peningkatan pemahaman masyarakat, perubahan perilaku sehat, peningkatan partisipasi masyarakat, dan keterlibatan pemangku kepentingan. Kesimpulannya, pendekatan holistik berbasis komunitas sangat penting untuk mengatasi stunting secara efektif dan berkelanjutan di Desa Jatisari.

Abstract

This study investigates the challenges, solutions, strategies, and Sustainability Report models among sharia-compliant companies listed in North Sumatra, Indonesia. Using a descriptive qualitative approach and Analytical Network Process (ANP) as the analytical tool, data were gathered from seven experts and practitioners through interviews and ANP questionnaires. Supplementary insights were drawn from national and international journal sources on sustainability reporting. The study identifies key problem areas with varying agreement levels: operational issues (53%), OJK-related challenges (36%), community concerns (26%), human resources (3%), and supervision (2%). Operational barriers include IT readiness, data availability, and lack of roadmaps. OJK issues focus on unclear policies, weak enforcement, and political influence. Proposed solutions include strengthening IT infrastructure (18%), improving HR competencies (14%), and enhancing supervision through sharia compliance and collaboration (79%). External solutions involve policy reform, data integration, and technical guidance by OJK (21%), alongside limited community-based strategies (2%). Strategically, the study recommends increased synergy between OJK, stakeholders, and global frameworks like GRI, as well as greater education and socialization efforts for sharia issuers. The findings contribute to the global discourse on sustainable finance by highlighting localized barriers and actionable solutions for advancing ESG practices in Islamic finance.

Abstract

This paper discusses the use of blockchain technology in the perspective of Islamic economics/Islamic finance. Blockchain technology has changed various sectors, including the financial sector, by providing a secure, decentralized and transparent system. In the context of Islamic economics, blockchain can provide additional benefits by ensuring compliance with sharia principles. This paper outlines how blockchain technology can be used in Islamic finance, such as payment, financing and investment systems that comply with sharia principles. Apart from that, this paper also discusses the potential for using smart contracts in Islamic economics to increase efficiency and transparency in transactions. Through this paper, it is hoped that it can be seen how blockchain technology can strengthen the principles of Islamic finance and facilitate the development of a sharia-based financial sector.

Abstract

Perkembangan investasi perbankan Indonesia telah menunjukkan tren yang meningkat, namun sebagian besar dari investasi ini belum mempertimbangkan dampaknya terhadap aspek sosial dan lingkungan. Penelitian ini menyoroti keselarasan Responsible Investment (RI) dalam green banking dengan prinsip ajaran Islam tentang investasi yang bertanggung jawab terhadap lingkungan dan sosial. Green banking menekankan investasi dengan pertimbangan dampak lingkungan dan social (ESG), serta mengedepankan nilai-nilai, pengembalian finansial, dan lingkungan operasional. Tujuan penelitian ini adalah utuk mengetahui konsep Al-Qur’an tentang Responsible Investment dalam green banking. Data yang terkumpul dari studi pustaka dan dokumentasi disusun secara sistematis dengan penggunaan metode analisis interpretatif, yang melibatkan pengklasifikasian dan penafsiran makna teks-teks Alquran yang relevan dan diperoleh dari berbagai referensi. Hasil penelitian menunjukkan konsep Triple Bottom Line dalam keberlanjutan mempengaruhi keputusan investasi dengan menekankan nilai-nilai dan pengembalian finansial jangka panjang. Al-Qur'an (QS Al-A’raf: 31) menegaskan untuk menghindari pemborosan dan membagi harta dengan adil kepada yang membutuhkan (People). Tindakan berlebihan pada sumber daya alam (QS Hud: 85) dapat menciptakan bencana seperti banjir atau kekeringan. Pandangan Islam ini sejalan dengan upaya ESG dalam mengukur dampak lingkungan (Planet) seperti yang disebutkan dalam Surah Ar-Rum (30):41 dan Surah Al-Baqarah (2):267. Profit dalam aktivitas bisnis diizinkan selama sesuai aturan Islam, termasuk larangan terhadap riba dan ketidakjujuran (Surah An-Nisa [4]: 29). Perbankan syariah mengenal bagi hasil (syirkah), mengutamakan kerja sama antara pengusaha dan pemberi modal serta membagi hasil sesuai kesepakatan. Implikasi penelitian ini menunjukkan kesenjangan antara kesadaran terhadap prinsip-prinsip keberlanjutan dan implementasinya. Rekomendasi kebijakan termasuk pengawasan ketat untuk memastikan kesesuaian dan konsistensi implementasi prinsip-prinsip green banking dan ESG Investment, serta perhatian pada integrasi nilai-nilai Islam dalam kebijakan perbankan berkelanjutan menjadi penting untuk mengurangi kesenjangan antara kesadaran dan praktik implementasi keberlanjutan di sektor perbankan.

Abstract

The main objective of this study is to analyze the legal consequences of reducing the provision of additional income for health workers and to analyze the legal responsibility of local governments for reducing the right to provide additional income for health workers. The method used in this study is a normative juridical research method, so the approach taken in this research is a statutory approach (statute approach), historical approach (historical approach) and conceptual approach (conceptual approach). The results of the findings and studies in this study, it can be concluded that the legal consequences that occur if the actions taken by the local government to reduce the provision of additional income for Health Workforce Employees if they cannot be accounted for are revocable and invalid. So that the decision issued in February 2022 may be canceled, so that the Regent's regulation Number 1 of 2022 is reinstated. The legal responsibility of the local government regarding the reduction of the right to provide additional income for health workers is to return to the legal basis for providing additional income for employees based on government regulations number 12 of 2019 by looking at the principles of providing additional employee income which include the principles of justice, welfare and having legal certainty.

Abstract

Every year in Indonesia, hundreds of patients run away due to medical financing. No payment for medical services, consumables, and infrastructure costs used for the treatment of these patients causes material and immaterial losses for health workers and hospitals. As a result of this rampant, several hospitals, especially private hospitals, have implemented a down payment system. The problem and purpose of this study is to analyze the legality and legal responsibility of doctors who stop therapy for patients who do not pay for medical treatment. This study uses normative research methods with statutory approaches, conceptual approaches and comparative approaches. Doctors in carrying out their medical practice have the right to receive compensation for services and patients have the obligation to pay fees for the services they receive in accordance with the Medical Practice Law. If the patient does not fulfill his obligations to pay for the services he has received, the hospital and the doctor can sue the patient for default. If the patient does not fulfill his obligations to pay for the services he has received, the hospital and the doctor can sue the patient for default. If in the process of discontinuing therapy causes the patient to fall into a state of serious injury, disability or death, doctors and hospitals may be subject to criminal responsibility, civil and administrative liability. Abstract

Hospitals in improving service quality must have autonomy, hospitals are one form of public service reform so that public services can improve. Therefore, in an effort to improve hospital performance, it is necessary to provide guidance and supervision through the establishment of a Supervisory Board. The purpose of this study is to analyse the urgency of establishing a hospital supervisory board and the legal consequences for hospitals that do not have a supervisory board by using normative research methods and using statutory and conceptual approaches. In accordance with statutory provisions, hospitals that do not have a supervisory board do not violate statutory provisions as long as they do not fulfil the criteria required to form a supervisory board. However, legal protection of patients for hospitals that do not have a supervisory board must be guaranteed by the government through supervisory efforts by external supervisors and other stakeholders.
