Abstract

Penelitian ini mengkaji metodologi ijtihad moderat Yusuf al-Qaradhawi sebagai tawaran epistemologis beyond textualism–liberalism dalam diskursus hukum Islam kontemporer. Tulisan ini berangkat dari kritik terhadap dua kecenderungan ekstrem, yakni tekstualisme kaku (tashaddud) yang membekukan makna nash dan liberalisme longgar (tasāhul) yang berpotensi merelatifkan otoritas wahyu. Melalui paradigma wasathiyah, al-Qaradhawi mengembangkan metodologi ijtihad yang mengintegrasikan nash, maqāṣid al-syarī‘ah, dan realitas sosial secara seimbang. Dengan pendekatan kepustakaan dan analisis kritis-konseptual, Hasil penelitian ini menunjukkan bahwa ijtihad moderat al-Qaradhawi bukan sekedar posisi kompromis, melainkan kerangka metodologis yang menjaga integritas normatif syariah sekaligus memastikan relevansi hukum Islam dalam konteks modern. Pendekatan ini memberikan kontribusi penting dalam menghindari stagnasi hukum maupun relativisme normatif, serta menawarkan model ijtihad yang adaptif, proporsional, dan berorientasi pada kemaslahatan

Abstract

The purpose of this research is to identify and analyze the role of law in encouraging innovation in village financial management. Through a qualitative approach, this study collected data through interviews, observations, and documentation studies involving various stakeholders, including village officials, communities, and law enforcement. This method allows researchers to understand in depth the dynamics that occur in village financial management as well as the challenges and opportunities faced. The results of the study show that clear and firm regulations are a key factor in encouraging innovation. The law provides a framework that facilitates transparency and accountability in the management of village funds. In addition, regulations requiring community participation in the planning and supervision process further strengthen the relationship between village officials and the community, creating a greater sense of ownership over financial management. This study also found that the application of information technology in village financial management has resulted in increased efficiency and accuracy. The design of information systems that are transparent and easily accessible to the public contributes to better supervision. In addition, training and capacity building of village officials are critical in ensuring they have the necessary skills to manage finances effectively. This research confirms that the law not only functions as a regulatory tool, but also as a driver of innovation in village financial management. By strengthening cooperation between the government, communities, and law enforcement, villages can better manage their resources, thereby improving the overall well-being of the community.

Abstract

This study examines the role of law in encouraging community compliance with the payment of zakat and taxes, considering the importance of these two obligations for social welfare and state development. The research problem focuses on the low level of community compliance in fulfilling zakat and tax obligations in several regions. The purpose of this research is to understand how law, both Islamic law and state law, can contribute to increasing public awareness and compliance. The research method used is qualitative with a case study approach. The data was collected through in-depth interviews with various stakeholders, including religious leaders, tax officials, and the general public. In addition, analysis of related legal and policy documents is also carried out to gain a comprehensive understanding. The results of the study show that the law has a significant role in creating compliance. Legal education about zakat and tax obligations is very necessary to increase public understanding. The involvement of community leaders and scholars has proven to be effective in motivating the community to fulfill their obligations. Transparency in the management of zakat and taxes is also a key factor that increases public trust, thus encouraging them to be more compliant. This research provides recommendations to strengthen the legal framework and more intensive education programs, in order to create higher awareness among the public about the importance of zakat and taxes in social development.

Abstract

The fiqh rules aims to provide a foundation for all activities carried out by Muslims, including economic activities. The rules of fiqh can solve various contemporary economic problems by drawing a red thread from the previous arguments. For example, the phenomenon of online buying and selling that is currently rife can be found by linking the arguments that can be used as a reference. This implementation must be done because, with it, Islamic economic activity will be more straightforward to achieve its goals. The purpose of this study is to find out the application of the rules of fiqh in various Islamic financial products. The method used in this study is a systematic literature review which is done extracting several scientific journals related to the theme. The application of the rules of fiqh in various Islamic financial products has proven to be significant and had a positive impact on various economic sides. Applying the rules of fiqh gives all economic layers a foundation for doing something so that it does not come out of the principles of Islamic sharia.

Abstract

This study examines judicial review without new evidence (novum) in State Administrative disputes as a mechanism for ensuring legal certainty and expanding access to justice within Indonesia’s administrative law system. The research aims to analyze the normative basis, judicial interpretation, and practical implications of judicial review filed on the grounds of judicial error or manifest error, particularly in decisions that have obtained final and binding legal force. Employing normative legal research, this study applies a statute approach and a case approach by examining constitutional provisions, statutory regulations on judicial power and administrative courts, as well as relevant Supreme Court decisions. The analysis focuses on judicial reasoning and the interpretation of legal errors in the absence of novum. The results indicate that although judicial review without novum serves an important corrective function to address serious misapplication of law and safeguard substantive justice, the lack of clear normative parameters has led to inconsistent judicial practices and legal uncertainty. This condition weakens the principle of finality of judgments and risks transforming judicial review into an extended litigation mechanism, especially when utilized by state administrative bodies or officials. Nevertheless, judicial review without novum remains relevant for protecting citizens’ rights where injustice arises from legal misinterpretation rather than evidentiary shortcomings. The study concludes that clearer doctrinal standards and restrictive limitations on eligible applicants are essential to balance access to justice with legal certainty in State Administrative Adjudication.

Abstract

The transformation of former red-light districts into public spaces presents a complex policy challenge because it involves social, economic, and moral dimensions. This article analyzes collaborative governance and social innovation in the transformation of Burnik City in Situbondo Regency using a qualitative approach through interviews, observations, and document analysis. The research findings indicate that cross-actor collaboration functions as a social infrastructure enabling spatial change; however, this collaboration does not occur on equal terms due to the influence of power relations and the roles of key actors. This transformation yields social innovation across three dimensions: meeting social needs, transforming social relations, and community empowerment. Although it has succeeded in shifting stigma and boosting economic activity, the resulting innovations remain partial as they have not yet been strongly institutionalized. Furthermore, spatial transformation also has the potential to create new forms of exclusion for certain groups. Sustainability challenges related to institutional frameworks, participation, and the environment highlight the need for institutional strengthening to ensure that social innovations can endure in the long term.
