Abstract

Transboundary natural resource disputes—ranging from water rights and mineral extraction to fishing zones—pose complex challenges to the international legal system, often threatening regional stability, economic development, and diplomatic relations. This paper evaluates the effectiveness of international courts in resolving such disputes between sovereign states, focusing on how legal principles, judicial authority, and enforcement mechanisms interact to manage conflicts over shared resources. By examining case studies from the International Court of Justice (ICJ), arbitral tribunals, and other relevant judicial bodies, the study assesses both successes and limitations in achieving equitable and sustainable outcomes. The analysis highlights key factors that influence the effectiveness of international adjudication, including the clarity of legal norms, the willingness of states to submit to jurisdiction, the availability of evidence, and the political and economic stakes involved. While international courts have demonstrated the ability to provide neutral platforms, clarify legal obligations, and shape normative expectations, enforcement challenges and state resistance often limit their practical impact. Moreover, complex scientific, environmental, and technical issues can complicate judicial decision-making, particularly in disputes over shared watercourses, fisheries, and transboundary natural resources. Despite these challenges, the paper argues that international courts play a critical role in promoting accountability, preventing escalation, and guiding cooperative resource management. The study concludes that while courts cannot guarantee compliance or resolve all conflicts, their jurisprudence significantly contributes to the development of international law, offers frameworks for negotiation, and encourages peaceful, rules-based resolution of disputes. Strengthening legal frameworks, promoting regional cooperation, and enhancing compliance mechanisms are essential to maximize the impact of judicial intervention in resource conflicts.

Abstract

This study critically examines the implementation and effectiveness of legal protection mechanisms for child victims of sexual violence across selected Asian-majority countries. While many nations in the region have ratified international conventions (such as the CRC) and enacted specialized domestic legislation, the reality of enforcement is often undermined by socio-cultural dynamics and systemic weaknesses. Employing a victimology framework, this research analyzes the factors contributing to revictimization and the specific challenges faced by children navigating the criminal justice system within contexts characterized by strong familial hierarchy, community privacy norms, and prevalent gender biases. The study identifies three core implementation challenges common across the region: 1) the pervasive influence of stigma and victim-blaming rooted in traditional values, leading to underreporting and case withdrawal; 2) procedural inadequacies within law enforcement and judicial sectors, resulting in non-trauma-informed practices and secondary harm; and 3) the failure to effectively deliver restitution and holistic rehabilitation services due to funding gaps and lack of integrated inter-agency cooperation. Drawing upon comparative case analysis, this paper proposes alternative solutions that are culturally sensitive yet legally robust. Key recommendations include implementing mandatory specialized judicial training focused on child psychology and trauma-informed interviews, establishing state-funded victim compensation and rehabilitation schemes independent of criminal prosecution outcomes, and promoting community-level restorative justice initiatives that prioritize the child's well-being over solely punitive measures. Ultimately, this study advocates for a paradigm shift from a purely punitive legal response to a comprehensive, victim-centered approach tailored to the unique societal structures of Asian-majority countries.

Abstract

Indonesia, as a state based on the rule of law (rechtsstaat), places the supremacy of law and the protection of human rights (HAM) as fundamental pillars in governance and law enforcement. However, in practice, serious violations that undermine these principles still frequently occur, including incidents of error in persona or wrongful arrest accompanied by acts of violence perpetrated by law enforcement officers. The wrongful arrest of a snail collector in Grobogan Regency serves as a concrete example of abuse of power by investigators, which contravenes the principles of due process of law and human rights.This study aims to analyze the criminal liability of investigators who commit wrongful arrest (error in persona) accompanied by violence and to elaborate on the legal remedies available for restoring the rights of victims, using the Wrongful Arrest of a Snail Collector in Grobogan as the case study. The research employs a normative legal method with a legal principles approach, examining statutory regulations (KUHAP, KUHP) and relevant doctrines concerning criminal liability, abuse of authority, and human rights protections.
