Abstract

The purpose of this study is to examine whether women have the right to refuse pregnancy. This idea is an Islamic jurisprudence initiated by KH. Husein Muhammad, an Indonesian feminist scholar. This study analyzes the reasons for the emergence of Husein Muhammad's thoughts and provides constructive criticism. The article argues that in Indonesian society, married couples are always required to have children in their marriage. This demand leaves women with no opportunity to bargain over their position as bearers of the reproductive function, and even forces them to become pregnant. In contrast, Islam strongly upholds the interests and justice for women. By using a qualitative approach and literature, as well as data obtained by collecting references and documentation in accordance with the research theme, it was found that Husein Muhammad’s concept of women having the right to refuse pregnancy was influenced not only by the meaning of the text but also by the externalization of thoughts that arose as a result of the process of interaction and dialectics with the people around him. The objectivation process is carried out in the process of Husein Muhammad's self-interpretation of the knowledge that has been obtained, shaped by his history of studying women’s issues. Husein Muhammad based his thoughts on Islamic principles, namely justice, deliberation, equality, and peace. Therefore, the right to refuse pregnancy can be categorized as a natural right in human rights. Abstract

The prohibition against marrying in the month of Muharram (Suro) is a deeply rooted belief among Javanese communities, including Muslims in Pakuan Baru Village, Pakuan Ratu Subdistrict, Way Kanan Regency. Although Islam does not explicitly forbid marriage in Muharram, local customs—passed down through generations—consider this month inauspicious for wedding ceremonies. This study aims to reinterpret the tradition of prohibiting marriage during Muharram in light of Islamic teachings and Javanese cultural values. Employing a descriptive qualitative approach, the research collects data through field observations, interviews with community members, religious leaders, and local elders. Findings indicate that the prohibition is still strongly upheld due to reverence for ancestral customs and the perception of Muharram as a sacred and solemn month. While this belief aligns with the Javanese ethic of spiritual caution, it also reflects a syncretic understanding that merges Islamic reverence for sacred time with local cultural interpretations. The study offers a reinterpretation that encourages critical reflection on inherited traditions while promoting harmony between religious doctrine and cultural expression

Abstract

Anak adalah harta yang terpenting dalam sebuah keluarga yang selalu diidamkan oleh orang tua dan menjadi kebanggaan bagi mereka karena anak akan menjadi penerus yang akan menjadi tumpuan dan harapan kedua orang tua dimasa yang akan datang. maka tak heran banyak orang tua yang mengekolahkan anak-anak mereka agar harapan itu tercapai. Dalam keadaan normal anak dididik dilembaga formal yang menyelenggarakan pendidikan, namun disaat pendemi COVID-19 yang sedang mewabah di Indonesia khususnya, mengakibatkan anak harus belajar dari rumah, dan disinilah peran dan fungsi keluarga akan sangat penting dalam mendampingi proses belajar anak ditengah pandemi dan memberi dorongan kepada agar senantiasa tetap belajar. Tulisan ini akan menganalisa peran dan fungsi keluarga dalam proses pendampingan belajar ditengah pandemi COVID-19, penellitian ini menggunakan metode kualitatif dengan melakukan wawancara secara langsung, yang makan akan menemukan hasil dari peran dan funngsi keluarga ditengah pandemi, penelitian ini akan sangat bermanfaat bagi para keluarga sebagai referensi dalm proses pendampingan belajar anak dirumah ditengah pandemi COVID-19.

Abstract

This study investigates Indonesia’s response to the Rohingya refugee crisis, focusing on the tension between humanitarian commitments and national stability. It explores how a predominantly Muslim country situated in the Global South and not party to the 1951 Refugee Convention manages the arrival of refugees amidst growing regional insecurity and limited institutional capacity. The study aims to critically examine how Indonesia’s reception of Rohingya refugees reflects both Islamic values of solidarity and the political, legal, and economic dilemmas that follow. Employing an interdisciplinary literature-based approach, the research synthesis legal, sociopolitical, and religious perspectives to understand state responses to refugee movements. Findings reveal two key dynamics. First, the Rohingya have faced systemic persecution in Myanmar, particularly through Burmanization policies that led to ethnic cleansing and genocide, constituting gross human rights violations. Second, Indonesia’s moral support for Rohingya Muslims highlights its humanitarian orientation, yet this position generates challenges across various sectors, including religion, law, security, and the economy. The arrival of refugees has sparked domestic debates around state sovereignty, social cohesion, and resource allocation. This study contributes to the literature on human rights and refugee protection in the Global South by offering insights into how non-signatory states balance humanitarian values with national interests. It underscores the need for more adaptive, context-sensitive policy frameworks that protect vulnerable populations while ensuring domestic stability. The study encourages a deeper understanding of refugee governance in transitional democracies, where ethical responsibility and political pragmatism often collide.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi praktik membujang di masyarakat, alasan dan bagaimana agama mengatur praktik tersebut. Melaksanakan pernikahan berarti memenuhi perintah agama sekaligus memenuhi sunnah Nabi Muhammad SAW. Oleh karena itu, jika seseorang memenuhi syarat-syarat untuk menikah, maka ia diperintahkan untuk menikah karena dengan menikah maka hidupnya akan lebih sempurna. Penelitian ini merupakan penelitian lapangan dan penelitian ini bersifat deskriptif analitik. Metode penelitian ini bersifat fenomenologis, dan pengumpulan datanya menggunakan metode observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa fenomena hidup membujang diberi pengaruhi persiapan materi, mengalami kegagalan pernikahan dan trauma yang mendalam, serta terlalu fokus pada tanggung jawab dan pekerjaan. Dalam Islam, puasa merupakan jalan keluar bagi mereka yang tidak mampu membiayai biaya pernikahan, namun jika ada keadaan dimana seseorang sudah tidak mampu lagi menahan godaan syahwat dan tidak mampu membiayai biaya pernikahan, maka nikah menjadi wajib. Faktor-faktor tersebut dapat memberikan dampak yang beragam mulai dari dampak kesehatan, dampak psikologis, dampak sosial, keengganan menikah, hingga dampak keagamaan.

Abstract

Dispute resolution in indigenous communities tends to be based on family values. This is evident in the Sebambangan tradition where a man elopes with a girl and marries her as his wife. In these cases, dispute resolution is done through mediation (non-litigation) as it is considered more effective for creating harmonization, avoiding conflict, and justice. This research examines the process of non-litigation dispute resolution, namely mediation, in the tradition. This study is a qualitative study using a socio-legal approach. The study was conducted in the Mergo Sekampung indigenous community in East Lampung. Data were collected through observation and interviews with traditional leaders in five villages. The research findings show that the mediation process in the tradition begins with the male party apologizing for the mistakes made. This process is carried out in deliberation and is accompanied by traditional leaders as mediators. Mediation in Sebambangan is part of the living law that prioritizes kinship in dispute resolution. In positive law, the mediation process in the tradition of the Sekampung Marga community in East Lampung follows the material legal basis in Indonesia as in Article 1338 of the Civil Code and Articles 1851 to 1864 of the Civil Code concerning Peace. Thus, dispute resolution in the Sebambangan tradition makes it an alternative dispute resolution in a conflict carried out with family principles to achieve peace and contribute to legal reform in Indonesia and beyond.

Abstract

Artikel ini akan membahas tentang dispensasi kawin janda/duda dibawah umur. Dispensasi kawin merupakan pemberian izin menikah oleh Pengadilan kepada pasangan yang masih belum berusia 19 tahun melalui pengajuan dispensasi kawin ke Pengadilan. Dalam praktiknya terdapat beberapa kasus dispensasi kawin yang diajukan oleh janda/duda ke Pengadilan dikarenakan adanya penolakan permohonan menikah oleh KUA karena dianggap calon pengantin masih dibawah umur sebagaimana dalam UU Nomor 16/2019. Faktanya di beberapa Pengadilan Agama juga terdapat penolakan terhadap permohonan dispensasi kawin oleh janda/duda dengan alasan ketika seseorang telah menikah telah dianggap dewasa. Sehingga menimbulkan tidak adanya kepastian hukum bagi janda/duda dibawah umur yang menikah meskipun telah mengajukan dispensasi kawin pada pernikahan sebelumnya. Lalu bagaimana pandangan KUA dan Pengadilan Agama dalam kasus ini? artikel ini akan mengkaji pandangan KUA dan Hakim Pengadilan Agama di Kota Yogyakarta terkait dispensasi kawin bagi janda/duda dibawah umur. Jenis penelitian ini merupakan penelitian kualitatif dengan metode yuridis-normatif dengan pendekatan statute approach dan case approach. Temuannya; pihak KUA dalam menolak permohonan menikah janda/duda dibawah umur terkesan tekstualis terhadap Pasal 7 UU 16/2019 dan mengabaikan peraturan perundang-undangan lainnya dikarenakan tunduk terhadap instansi kementerian Agama, sementara pihak Pengadilan Agama tetap beranggapan bahwa janda/duda dibawah umur yang hendak menikah tidak perlu mengajukan dispensasi kawin karena telah dianggap dewasa sebagaimana KUHPerdata dan Peraturan Mahkamah Agung nomor 5 tahun 2019.

Abstract

This research wants to see how Article 463 in the New Criminal Code accommodates and protects the interests and rights of women's reproductive health. In addition to analyzing how it accommodates women, this study also analyzes how Article 463 of the New Criminal Code is viewed from the perspective of Jaser Auda's Maqashid Syari’ah. Before entering into the analysis, this research first compares Article 463 with the Health Law and the Law on criminal acts of sexual violence. This research uses normative legal research methods using a statutory approach or statute approach. Data sources are obtained from literature including laws and regulations and other internet sources. Primary data sources in this study are Article 463 of Law Number 1 of 2023 concerning the New Criminal Code and Law Number 36 of 2009 concerning Health. The theory used is comparative legal theory and Jaser Auda's Maqashid Syari’ah theory as an analysis knife in solving problems. The results showed that Article 463 of the New Criminal Code compared to the health law is more accommodating to women's interests is the health law because it more broadly explains what is included in sexual violence which is not only focused on three dimensions, namely forced prostitution, rape and sexual slavery. In addition, in terms of considering the health of pregnant women, the health law is more accommodating because it provides exceptions to abortion for pregnant women who have emergency health conditions that endanger themselves and their babies. In Jaser Auda's perspective, this article is not in line with Maqashid Syari’ah because it does not interpret wisdom and justice for all universally, in this case, the woman.

Abstract

This research discusses the role of Islamic law in the formation and interpretation of positive law in Indonesia through a study of the decisions of the Constitutional Court (MK). The main issue raised is the extent to which the principles of Islamic law are accommodated in the national legal system, especially in the process of legislation and judicial review. In a plural legal system like Indonesia, the existence of Islamic law is often faced with the challenge of harmonization with the constitution and the principles of human rights. Therefore, this study aims to examine how the values of Islamic law, such as justice, benefit, and protection of rights, are applied in the jurisprudence of the Constitutional Court and how the normative mechanism of absorption of these values into positive law. The research method used is normative qualitative with a juridical-constitutional approach and analysis of relevant Constitutional Court decisions. Data were obtained from literature studies, documentation of the Constitutional Court's decisions, as well as fiqh literature and Islamic legal theory. The analysis was conducted on sharia principles reflected in the Constitutional Court's decision, including aspects of maqāṣid al-syarī'ah. The results show that the Constitutional Court has selectively integrated Islamic legal values in various decisions, especially those concerning public morals, civil rights, and the Islamic economic system. Although Islamic law is not a formal source of national law, its values have substantially contributed to the formation of positive law and strengthened the ethical and justice dimensions of the Indonesian legal system.
