Abstract

Introduction: This study analyzes the Constitutional Court Decision Number: 82/PUU-XII/2014 which is a critical basis and an important basis for resolving the problem of women's representation in legislative institutions. Despite various legal provisions ensuring women's representation, challenges in practical implementation persist.Purposes of the Research: The research aims to examine the Constitutional Court's reasoning on the concept of women's representation and assess the consistency of equality principles through the lens of legal feminism.Methods of the Research: This study employs a normative juridical research method with a descriptive approach, focusing on the judicial interpretation of women's representation and its impact on affirmative policies in politics.Findings of the Research: The findings reveal that Decision Number: 82/PUU-XII/2014 reflects efforts to protect women's constitutional rights by reinforcing the phrase "prioritizing women's representation," despite its lack of explicit regulation. The study also indicates that the Constitutional Court consistently applies legal feminism principles to ensure equal opportunities in legislative institutions. However, the repeal of gender affirmative measures in Law Number: 17 of 2014 on MD3 has led to legal uncertainty, disadvantaging women.

Abstract

Mahkamah Konstitusi memegang peranan penting dalam menjaga konstitusi melalui otoritas menguji UU terhadap UUD 1945. Kewenangan ini menghasilkan putusan yang sifatnya akhir dan mutlak, juga berasaskan erga omnes, hal ini memberikan kekuatan hukum tetap pada semua pihak untuk patuh pada putusan tersebut. Penelitian ini bertujuan untuk mengkaji bentuk ketidakpatuhan terhadap pelaksanaan putusan Mahkamah Konstitusi, khususnya dalam hal tidak menindaklanjuti putusan dapat dikatakan sebagai bentuk menghina pengadilan (Contempt of Court). Pada penelitian ini menganalisis bahan hukum primer, sekunder, dan tersier untuk mengidentifikasi bentuk ketidakpatuhan terhadap putusan Mahkamah Konstitusi. Hasil penelitian menunjukkan bahwa dalam praktiknya terdapat beberapa kasus ketidakpatuhan terhadap putusan Mahkamah Konstitusi, baik dilakukan oleh individu ataupun lembaga negara. Ketidakpatuhan ini berdampak pada hilangnya kepastian hukum, melemahkan otoritas peradilan, dan mengancam supremasi hukum. Bentuk ketidakpatuhan ini terjadi pada pengabaian putusan dalam revisi UU Cipta Kerja, hal ini menunjukkan bahwa tindakan ketidakpatuhan pada putusan Mahkamah Konstitusi dapat dikelompokkan sebagai Contempt of Court dalam bentuk disobeying a court order. Ketidakpatuhan ini mencerminkan kurangnya penghormatan kepada otoritas pengadilan dan menghambat implementasi hukum secara adil.

Abstract

A form of responsibility that can be taken to reduce the impact of the mining business is implementing a Corporate Social Responsibility (CSR) program. This study aims to analyze the legal implications of implementing the social responsibility of mining companies in empowering local communities in East Kalimantan. The research method used is normative juridical, implementing the Limited Liability Company Law, which regulates CSR using a historical and comparative approach. The results show that CSR is a program that must be implemented by companies operating in the field and/or related to natural resources under the Law concerning Limited Liability Companies. CSR programs to empower local communities must be implemented under applicable principles, namely sustainability, accountability, and transparency. In conclusion, based on the findings, the implementation of this program has been carried out properly in accordance with the applicable principles and regulations by several mining companies in East Kalimantan. The East Kalimantan Provincial Government has implemented a Clean and Clear program for mining companies that do not implement CSR.

Abstract

Keberadaan dan hak-hak masyarakat hukum adat telah diterima dalam kerangka hukum tidak tertulis maupun hukum positif di Indonesia. Pada kenyataannya issue yang berkembang tentang kehadiran dan hak- hak masyrakat hukum adat adalah terbatasnya ruang dan gerak bagi komunitas-komunitas adat dalam mewujudkan demokratisasi pengelolaan wilayah adanya secara berkelanjutan, Konflik tenurial, keterbatasan dan kondisi kekayaan alam yang meliputi tanah dan kekayaan alam yang terkandung di dalamnya tidak asimetris dengan pertambahan penduduk. Sehingga perlu adanya  penegasan kembali bahwa adanya korelasi antara Kesatuan Masyarakat Adat dengan Pemerintah terkait pemenuhan  hak Konstitusionalnya yang terkandung dalam pasal Pasal 18B ayat (2), Pasal 28I ayat (3) dan Pasal 32 ayat (1) dan ayat (2) UUD NRI 1945  dimana aturan ini merupakan semangat otonomi yang diberikan seluas-luasnya kepada daerah. Ketentuan tersebut yang paling sering dirujuk ketika membicarakan mengenai keberadaan dan hak-hak masyarakat hukum adat. Kehadiran Mahkamah Konstitusi sebagai The Protector of the citizen’s and Constitutional Rights and guardian of constitution juga memberikan secercah harapan bagi para pencari keadilan khususnya yang berkaitan dengan perlindungan terhadap hak masyarakat hukum adat.

Abstract

Pemilihan umum (Pemilu) di Indonesia mengalami perubahan metode konversi suara dari Kuota Hare pada pemilu sebelumnya menjadi metode divisor Sainte-Laguë murni dalam Pemilu 2019 dan 2024. Perubahan ini berimplikasi langsung terhadap tingkat proporsionalitas hasil pemilu dan keadilan representasi di parlemen. Penelitian ini bertujuan untuk mengukur derajat bias keterwakilan yang dihasilkan oleh kedua metode tersebut, apakah menghasilkan keterwakilan tinggi (over-representation) atau rendah (under-representation), serta menilai dampak mekanis konversi suara terhadap distribusi kursi. Selain itu, penelitian ini juga meninjau kesesuaian masing-masing metode dengan prinsip keadilan dalam teori Justice as Fairness dari John Rawls. Metode yang digunakan adalah yuridis normatif dengan pendekatan deskriptif-kualitatif. Simulasi dilakukan terhadap hasil Pemilu Legislatif 2024 secara nasional dan lima daerah pemilihan (dapil) sebagai sampel, menggunakan metode Kuota Hare dan Sainte-Laguë murni. Hasil penelitian menunjukkan bahwa metode Kuota Hare menghasilkan derajat proporsionalitas dan distribusi representasi yang lebih adil dibandingkan metode Sainte-Laguë murni. Dari perspektif teori keadilan Rawls, Kuota Hare lebih mencerminkan prinsip keadilan distributif, khususnya asas perbedaan (difference principle) dan pemerataan manfaat politik.

Abstract

Peatland management in Kutai Kartanegara faces major challenges, especially due to the expansion of the coal mining industry. Regional Regulation No. 1 of 2016 is designed to protect peat swamp ecosystems and support the welfare of local communities, but its effectiveness is questionable amid the rapid exploitation of natural resources. This study aims to evaluate the effectiveness of the 2016 Regional Regulation in maintaining ecological and social balance through normative juridical law analysis that includes related laws and John Rawls' distributive justice theory approach. The Normative Juridical Citation Method and data are collected from primary legal sources, including Law Number 26 of 2007 concerning Spatial Planning, Law Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining, as well as Kutai Kartanegara Regional Regulation Number 1 of 2016 itself and secondary legal sources in the form of relevant literature, such as books, journals, articles and internet sources as well as mass media, both print and online and allow data triangulation to be carried out. The study results show that weak supervision and the absence of strict sanctions for mining companies hinder the optimal implementation of the Regional Regulation, causing adverse impacts on the environment and community welfare. The analysis shows that these regulations are not entirely fair to local communities that are vulnerable to the negative impacts of the mining industry. This study recommends the revision of the Regional Regulation to add strict environmental sanctions provisions and strengthen community participation in peatland management to achieve ecological justice that is in line with regional economic development.

Abstract

This study aims to examine Regional Regulation Number 4 of 2021 concerning Gerakan Etam Mengaji (GEMA) in Kutai Kartanegara Regency as a legal instrument rooted in local wisdom and Islamic values. Using a normative legal approach and Miles and Huberman’s interactive data analysis model, the research explores the regulation's content, its underlying philosophical values, and its role as a form of conservative religious engineering. The findings indicate that GEMA not only seeks to preserve the community's religious culture but also serves as a legal strategy to strengthen character development and Qur’anic literacy among students. This regulation represents a participatory legal framework supported by a reward system aimed at educational and religious institutions. GEMA exemplifies how local law can function both as a protector and driver of religious cultural values in the face of modernization.

Abstract

The transition to Society 5.0 signifies the deep integration of technology into everyday life driven by innovations such as artificial intelligence and the Internet of Things (IoT). This paper explores the dialectical relationship between law and technology in the context of Society 5.0 in facing the confrontation arising from the transformation towards the industrial era 5.0 with a focus on its impact on local wisdom or local wisdom. In the era of industry 5.0, the integration between humans and machines brings fundamental changes to various sectors of life. This change has an impact on the preservation of local wisdom which clashes with fast-paced technological advances. This study examines how law can play a role in regulating and controlling technological developments, whether technology can support or worsen local wisdom. Using a normative juridical methodology with a conceptual approach, this study reveals an imbalance in the development of increasingly advanced technology where legal adaptation is slow in protecting local wisdom. Therefore, it is necessary to understand the interaction of law and technology in the context of 5.0 for policymakers, legal practitioners and parties involved in the preservation of local culture regarding how important the synergy between law and technology is in facing challenges and opportunities in the industrial era 5.0. In addition, this research can be used as literature on law and technology and support the sustainability of local wisdom in the digital era. The study of dialectics between law, technology and local wisdom in the context of industrial transformation is still very limited and new perspectives related to the role of law in protecting local wisdom with the development of technological advancements.

Abstract

Di beberapa negara, teknologi transportasi udara perkotaan, khususnya mobil terbang (electric vertical take-off and landing/eVTOL), telah menjadi lebih komersil. Namun, tidak ada undang-undang khusus di Indonesia yang mengatur operasi mobil terbang di ruang udara rendah dan darat. Tujuan dari penelitian ini adalah untuk melihat betapa pentingnya membuat aturan khusus untuk mobil terbang, serta masalah hukum dan teknis yang terkait dengan memasukkannya ke dalam sistem transportasi Indonesia. Metode normatif, yaitu analisis konseptual, digunakan dalam penelitian ini. Data ini berasal dari sumber primer (UU Penerbangan No. 1/2009 dan UU Lalu Lintas No. 22/2009) dan sumber sekunder (buku, jurnal, dan laporan kebijakan). Analisis dilakukan dengan melakukan penelitian kepustakaan dan meninjau peraturan yang relevan. Hasil penelitian menunjukkan bahwa peraturan saat ini tidak memenuhi ciri-ciri unik mobil terbang, seperti kemampuan untuk beroperasi baik di udara maupun di darat. Harmonisasi hukum, sertifikasi, infrastruktur (vertiport), manajemen lalu lintas udara, dan keamanan siber adalah masalah utama. Selain itu, untuk menjamin efisiensi dan keselamatan, klasifikasi ruang udara rendah kelas E dan G memerlukan penyesuaian. Untuk menangani masalah teknis, operasional, dan hukum, diperlukan aturan khusus. Ini harus mencakup adaptasi standar internasional (ICAO), membangun lembaga sertifikasi nasional, membangun infrastruktur pendukung, dan memberikan pelatihan sumber daya manusia untuk pengendalian lalu lintas udara (ATC). Studi ini menekankan betapa pentingnya kerangka hukum yang komprehensif di Indonesia untuk mendukung inovasi mobil terbang.

Abstract

This article is to analyze the existence of other laws and regulations listed in Article 8 of Law Number 12 of 2011 concerning the Formation of Laws and Regulations; which is assumed to be regulation . The current condition is that the legal product in question is in its formation it is very easy and fast to handle state affairs. However, the scope and testing are not yet clear. and the amount is uncontrolled. The main problem of this research; First , in the form of the need to evaluate the characteristics of the legal product contained in Article 8 in the a quo provisions . Second , tracing position law or degree of other laws and regulations with regulation legislation is seen from the perspective of legal science. The method used is classified as normative legal research with a legal and doctrinal approach. Thus, the results of this study explain several important things, namely First , there were findings in the form of differences characteristics between statutory regulations (regeling) and legislative regulations other (policy regulations) or called as a Regulation Policy. The difference in legal status can be measured through several indicators such as the formation, scope or nature and its testing. Both sit down regulation legislation other as regulation implementer to synergize regulations and policies through separation of the position of other laws and regulations to be included in laws which are per se related to government administration with touchstone of General Principles of Good Governance through Administrative Justice
