Abstract

Mengurangi penindasan (bullying) di sekolah merupakan perhatian utama para pendidik, orang tua, dan legislator. Kekerasan terwujud dalam berbagai cara, dan semakin banyak bukti yang menunjukkan bahwa bentuk-bentuk kekerasan tingkat rendah atau mendasar mempunyai dampak yang besar terhadap lingkungan belajar di sekolah. Pengabdian ini menggunakan metode ceramah dan pendampingan penanganan kasus secara face to face yang meliputi identifikasi kasus, sosialisasi, pemberian materi, pendampingan hukum, solusi, diskusi serta mediasi. Tujuan dari pengabdian adalah menyelesaikan sengketa antara orang tua/wali murid terhadap tindakan bullying oleh siswa penyandang pendampingan psikolog serta memberikan solusi damai antar para pihak yang mengalami konflik. Pengabdian ini menghasilkan bahwa pada kenyataannya bentuk perilaku bullying disertai kekerasan paling umum terjadi di sekolah saat ini dan jika tidak ditangani dapat menyebabkan bentuk kekerasan yang lebih serius. Oleh karena itu, aspek penting dalam pencegahan kekerasan di sekolah adalah identifikasi dan penerapan intervensi ataupun strategi yang dirancang untuk mencegah atau mengurangi intimidasi di sekolah. Strategi pencegahan intimidasi praktis yang menargetkan berbagai tingkat (yaitu, individu, ruang kelas, dan sekolah) disediakan, dan pedoman praktik terbaik untuk menerapkan program pencegahan intimidasi di sekolah dengan banyak melakukan sosialisasi hukum dan parenting.

Abstract

Penelitian ini dilatarbelakangi oleh nilai-nilai yang terkandung dalam kearifan lokal Geraka Etam Mengaji. Kearifan lokal merupakan gagasan atau gagasan yang bijaksana, bernilai baik, dan dianut oleh sekelompok orang. Agar kearifan lokal suatu daerah tetap terjaga dan lestari maka perlu adanya perlindungan hukum. Salah satu bentuk perlindungan hukum untuk melindungi kearifan lokal di Kabupaten Kutai Kartanegara tertuang dalam Peraturan Daerah Nomor 4 Tahun 2021 tentang Pedoman Penyelenggaraan Gerakan Etam Mengaji dengan tujuan untuk membentuk kebiasaan dan budaya membaca Al-Qur’an bagi masyarakat di Kabupaten Kutai Kartanegara. Kabupaten Kutai Kartanegara. Penelitian ini bertujuan untuk mengetahui apa yang menjadi dasar Peraturan Daerah dalam penyusunan Peraturan Daerah GEMA Kabupaten Kutai Kartanegara dan untuk mengetahui pemberian perlindungan hukum kepada masyarakat lokal dalam melestarikan GEMA. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Teknik pengumpulan data dilakukan dengan studi kepustakaan yang didukung oleh data primer dan data sekunder. Analisis data dalam penelitian ini menggunakan metode kualitatif dan untuk menarik kesimpulan menggunakan metode induktif. Hasil penelitian diperoleh bahwa landasan terbentuknya Peraturan Daerah GEMA di Kabupaten Kutai Kartanegara dilihat berdasarkan sejarah masuknya agama Islam di Kabupaten Kutai Kartanegara, arus modernisasi dan teknologi, serta diselenggarakannya Musabaqah Tilawatil. Alquran setiap tahunnya. Kemudian perlindungan hukum terhadap masyarakat lokal dalam melestarikan GEMA berupa kebijakan yaitu perlindungan hukum preventif dan pembuatan Peraturan Daerah, tujuannya untuk mencegah dan melindungi program GEMA agar terlaksana dengan aman.”

Abstract

Agrarian conflicts in Indonesia, particularly those occurring in East Kalimantan, reflect a profound weakness in the system of fair and effective dispute resolution. Although court rulings have obtained permanent legal force—as exemplified by Decision No. 3/Pdt. Eks/2023/PN. Trg—the execution of such rulings still faces significant obstacles. This study aims to identify the causes behind the failure of agrarian dispute executions and to propose a model for more just and effective resolution. Adopting the perspective of Thomas Aquinas’s theory of justice, this research emphasizes three core principles of justice in resolving agrarian disputes: distributive justice, legal justice, and commutative justice. Based on these principles, the article proposes a set of strategic solutions to enhance the effectiveness of agrarian dispute settlements. These include strengthening mediation before execution, reconstructing execution regulations to limit baseless objections, harmonizing land data to prevent overlapping certificates, and applying a social approach to execution that considers the welfare of affected communities. This study is expected to contribute to the reform of agrarian dispute resolution regulations in Indonesia, with the ultimate goal of establishing a more efficient, equitable, and sustainable system.

Abstract

Sebuah studi dari Universitas Stanford menunjukkan bahwa Indonesia menempati peringkat terakhir sebagai negara dengan rata-rata jumlah langkah harian terendah dalam survei selama 68 hari. Menurut Ernawati Hendrakusumah, hal ini disebabkan oleh infrastruktur yang belum memadai. Padahal, berjalan kaki dapat meningkatkan interaksi sosial serta menciptakan kesan kota yang ramah dan berkelanjutan. Penelitian ini menggunakan metode normatif dengan mengkaji teori, konsep, serta peraturan perundang-undangan. Penelitian normatif bertujuan mengidentifikasi definisi, konsep, dan prinsip hukum.Walkability mempertimbangkan beberapa parameter, seperti kualitas fasilitas, konektivitas jalur, kondisi jalan, pola penggunaan lahan, dukungan masyarakat, kenyamanan, dan rasa aman. Berdasarkan indeks walkability global, komponen pendukungnya meliputi keselamatan, kenyamanan pejalan kaki, serta keberadaan regulasi hukum. Dalam Pasal 274 ayat (2) UU LLAJ, disebutkan ancaman pidana bagi pihak yang mengganggu fungsi sarana jalan, dengan hukuman penjara maksimal satu tahun atau denda hingga dua puluh juta rupiah.Pejalan kaki dapat dikategorikan menjadi pejalan penuh, pengguna kendaraan pribadi, dan pengguna transportasi umum. Indikator walkability mencakup infrastruktur, aksesibilitas, daya tarik, kenyamanan, pemerataan, dan keselamatan. Pemerintah daerah menghadapi berbagai tantangan dalam membangun infrastruktur pejalan kaki berbasis kota pintar, seperti keterbatasan anggaran, minimnya fasilitas, rendahnya kesadaran publik, serta lemahnya perencanaan. Terdapat kekosongan hukum mengenai hak pejalan kaki dalam konteks kota pintar, sehingga dibutuhkan produk hukum dan sistem teknologi informasi terpadu untuk menjamin perlindungan hak pejalan kaki di era modern

Abstract

This study discusses the legal analysis of unlawful acts in the transportation of mining products based on East Kalimantan Regional Regulation No. 10 of 2012 concerning the Management of Public Roads and Special Roads for the Transportation of Coal and Palm Oil. The research focuses on identifying elements of unlawful acts, the implementation of regulations by local governments, and criminal provisions imposed on corporations that violate mining transportation regulations. The research uses a normative legal method by examining legislation, legal literature, and field data as supporting evidence. The results of the study show that violations of the obligation to build special roads, the use of public roads without permission, and non-compliance with technical provisions constitute unlawful acts both formally and materially. The implementation of local regulations faces challenges such as weak supervision and compensation practices that are not in accordance with the law, but it still provides a strong normative basis for local governments through administrative and criminal sanctions. The criminal provisions in the local regulation play a significant role as an instrument of deterrence against corporations, while also supporting the application of the principle of good mining practice and the protection of public safety and interests. Thus, this study emphasizes the importance of local law enforcement in maintaining order, public safety, and the sustainability of mining governance in East Kalimantan.

Abstract

The absence of term limits for legislative members has resulted in a pattern of power entrenchment, thus hampering the process of leadership regeneration and strengthening oligarchic tendencies within parliament. The absence of term limits in the Law of MD3 opens up space for power entrenchment, the formation of political dynasties, conflicts of interest, and a decline in the integrity of representation, reflected in the increasing constituency disconnect, the phenomenon of self-serving legislation, and the high number of legislative corruption cases. Therefore, a comprehensive design is needed to formulate a term limit model that aligns with the constitutional mandate. The study uses normative legal methods through legislative and conceptual approaches, examining the 1945 Constitution, the MD3 Law, the Election Law, Constitutional Court decisions, as well as the theories of constitutionalism, Habermas's deliberative democracy, and Madison's theory of power limitations. The analysis is conducted descriptively-analytical and interpretative-normative to build a cohesive legal argument. The results show that constitutionally, term limits can be justified as an integral part of the principle of power limitation and legal certainty; the current absence of norms has been shown to reduce the effectiveness of the representation function and open up opportunities for abuse of authority. From a leadership regeneration perspective, term limits increase the plurality of political actors, reduce incumbency advantage, and encourage policy innovation, while simultaneously breaking patronage networks that hamper oversight functions. Meanwhile, from a checks and balances perspective, term limits can strengthen the collegial independence of the House of Representatives (DPR) and increase the credibility of its oversight function over the executive, but they need to be designed proportionally to avoid creating an expertise gap or disrupting policy continuity.

Abstract

Penelitian ini bertujuan untuk menganalisis peran dan efektivitas kearifan lokal sebagai instrumen hukum dalam pengelolaan lingkungan hidup di era industrialisasi, serta mengkaji strategi harmonisasi antara hukum positif dan hukum lokal untuk memperkuat tata kelola lingkungan berkelanjutan di Indonesia. Penelitian ini menggunakan pendekatan hukum doktrinal yang berfokus pada analisis norma hukum positif dan prinsip-prinsip hukum yang mengatur pengelolaan lingkungan hidup serta kedudukan kearifan lokal di dalamnya. Data diperoleh melalui studi kepustakaan yang mencakup peraturan perundang-undangan, putusan pengadilan, dan literatur akademik yang relevan, kemudian dianalisis secara deskriptif dan normatif untuk menafsirkan hubungan antara hukum nasional dan living law. Validitas temuan dijaga melalui ketelitian penalaran hukum dan konsistensi penggunaan sumber hukum yang otoritatif Hasil penelitian menunjukkan bahwa kearifan lokal seperti Tana’ Ulen di Kalimantan, awig-awig di Bali, dan sasi di Maluku memiliki daya ikat normatif yang berfungsi sebagai living law. Integrasi nilai lokal ke dalam hukum positif dapat meningkatkan efektivitas perlindungan lingkungan dan memperkuat keadilan ekologis, terutama di tengah kebijakan industrialisasi yang berorientasi pada pertumbuhan ekonomi. Studi ini dapat menjadi rujukan dalam pembentukan kebijakan hukum lingkungan berbasis pluralisme hukum dan pembangunan berkelanjutan. Penelitian ini menawarkan pendekatan konseptual baru yang menempatkan kearifan lokal bukan sekadar entitas budaya, tetapi sebagai instrumen hukum fungsional dalam sistem hukum nasional.

Abstract

The development of modern industrialization has created new tensions in the social structure, which have weakened human values and the moral legitimacy of law. This study aims to analyze the relationship between dehumanization in production relations and the crisis of legal consciousness, as well as to identify the sociological roots of the loss of morality in legal practice in the modern industrial era. This research is useful in enriching the study of legal sociology and providing a conceptual basis for strengthening the humanistic approach in legal policy and education. This study employs a qualitative method with a literature study approach, analyzing both classical and contemporary theories, as well as secondary data from books and national and international journals related to industrialization, dehumanization, and the transformation of legal consciousness. The findings reveal that the transition from mechanical to organic solidarity has shifted the orientation of law toward a more instrumental and formalistic character. Consequently, law has lost its moral essence and its function as a social balancer, being replaced by the logic of productivity and efficiency that generates anomie and weakens the fulfillment of humanistic values within production relations. The implications of this study emphasize the importance of rehumanizing the law through ethics-based legal education, strengthening community participation in the formation and implementation of law, and promoting legal policies that balance economic interests with social justice and human dignity. The recommendation is that it is very important to implement the concept of legal rehumanization based on social solidarity as a transformative solution to the crisis of moral legitimacy in law in the modern industrial era.

Abstract

The potential of natural caves spread across Sanggulan Village, Sebulu District, Kutai Kartanegara Regency, East Kalimantan Province, which is a buffer zone for the capital of the Indonesian archipelago, has great potential to be developed as a tourism and educational facility. Currently, ecotourism development is widespread in the IKN area to fulfill the smart city slogan which prioritizes aspects of nature conservation, social, cultural and economic empowerment of local communities as well as learning and educational facilities. These elements significantly influence traditions, socio-economic life of the community and the empowerment of local village products. The village's identity is summarized in a slogan that highlights the richness of natural resources, preservation of cultural heritage and IKN's ecotourism priorities. By using a policy model that is Meaningful Participation, Asset Based Community Development (ABCD) and SWOT analysis of Regional Government policies in regulating or making regulations regarding cave or karst ecotourism, the aim is to increase IKN tourism by integrating cultural, geotourism and legal aspects. This model promotes participatory legal regulation, empowerment of local communities and environmental conservation to encourage sustainable regional development.

Abstract

The transition to Society 5.0 signifies the deep integration of technology into everyday life driven by innovations such as artificial intelligence and the Internet of Things (IoT). This paper explores the dialectical relationship between law and technology in the context of Society 5.0 in facing the confrontation arising from the transformation towards the industrial era 5.0 with a focus on its impact on local wisdom or local wisdom. In the era of industry 5.0, the integration between humans and machines brings fundamental changes to various sectors of life. This change has an impact on the preservation of local wisdom which clashes with fast-paced technological advances. This study examines how law can play a role in regulating and controlling technological developments, whether technology can support or worsen local wisdom. Using a normative juridical methodology with a conceptual approach, this study reveals an imbalance in the development of increasingly advanced technology where legal adaptation is slow in protecting local wisdom. Therefore, it is necessary to understand the interaction of law and technology in the context of 5.0 for policymakers, legal practitioners and parties involved in the preservation of local culture regarding how important the synergy between law and technology is in facing challenges and opportunities in the industrial era 5.0. In addition, this research can be used as literature on law and technology and support the sustainability of local wisdom in the digital era. The study of dialectics between law, technology and local wisdom in the context of industrial transformation is still very limited and new perspectives related to the role of law in protecting local wisdom with the development of technological advancements.
