Abstract

Implementation of Undang-Undang Cipta Kerja and Undang-undang Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining is considered by the Government as a form of policy for managing mining business activities which in fact has a significant impact on environmental damage and the existence of indigenous peoples around the coal mining area. This study aims to describe the implications of coal mining management policies for the existence of indigenous peoples in Samarinda. The research method used is legal research with a qualitative non-doctrinal approach, with the research location in Pampang Village, Samarinda. The data collection techniques are in the form of interviews and observations by purposive sampling. The results of the study show that natural resource policies provide too much convenience for investors, thus creating implications for the existence of customary law and management of business licenses that are out of control. In conclusion, the impact of environmental damage is so great that it is necessary to deregulate and de-bureaucratize the granting of mining business permits to prevent the extinction of customary values ​​and the existence of indigenous and tribal peoples.

Abstract

Traditional health services in Indonesia play an important role in maintaining public health, but the increasing cases of malpractice in this practice can endanger patient safety. The main challenges are the lack of supervision and the lack of legality that exacerbate the potential for malpractice. Therefore, strict legal protection is needed to ensure that traditional medicine is safe, effective, and meets standards, as well as to protect patients and traditional health workers. This study uses a normative legal method with a legislative, conceptual, and case study approach. Data were collected through literature studies and analyzed descriptively to understand the legal protection for patients of traditional health services. This study proposes strengthening supervision of traditional health practices through the establishment of a Traditional Health Worker Supervisory Board and non-litigation dispute resolution mechanisms such as mediation or arbitration. In addition, strict law enforcement against malpractice through administrative, civil, and criminal law will increase the accountability of traditional health workers, improve the quality of services, and provide a sense of justice for patients. Thus, it is hoped that a balance will be created between preserving tradition and effective legal protection to create a safe and fair health system in Indonesia.

Abstract

The limitation of regional heads' terms in Indonesia is basically related to two things, the first is to avoid abuse of authority, and the second is to regenerate leadership in the regions, therefore the limitation of the regional heads' terms is very important. This research is normative legal research with a statute approach and a case approach, by analyzing the decisions of the Constitutional Court such as Decision Number 22/PUU-VII/2009, Number 67/PUU-XVIII/2020, and Number 2/PUU-XXI/2023. This study examines how the Constitutional Court interprets the term limits of regional heads, including the calculation of the term of office for regional heads who do not complete their term of office. The results of this study show that the Constitutional Court emphasizes that a term of office that is served for half of the term or more is counted as one full term, both for definitive officials and temporary officials. This interpretation aims to ensure legal certainty and prevent abuse of power, by providing protection for the constitutional rights of citizens who wish to run for re-election. The Constitutional Court's decision also confirms that the norm of term limits for regional heads is in line with the principles of justice, proportionality, and legal certainty guaranteed in the 1945 Constitution. Thus, this term limit is not only served to prevent the dominance of power, but also to encourage the regeneration of healthy leadership in the Indonesian democratic system. The implications of this Constitutional Court decision are very important for the implementation of the 2024 Simultaneous Regional Head Elections, where the KPU and Bawaslu must ensure the consistent implementation of this norm, to ensure the creation of fair, transparent, and quality elections.

Abstract

Peran Pemerintah dalam pengelolaan sumber daya alam berlandaskan kearifan lokal selalu menjadi pembahasan yang begitu hangat, di nilai bahwa masyarakat adat merupakan entitas yang diakui oleh Konstitusi Negara Republik Indonesia, serta mereka sudah hidup lama di wilayah yang memanfaatkan alam sebagai sumber mata pencarian. Pemerintah sebagai pihak yang menjamin keberlangsungan masyarakat adat, sering kali dalam hal pengelolaan sumber daya alam pemerintah di awal perencanaan Sudah tidak melibatkan masyarakat adat. Pengelolaan sumber daya alam masyarakat adat selalu mengabaikan nilai-nilai kearifan lokal. Sehingga masalah yang ingin diteliti adalah bagaimana peran pemerintah dalam mengelola sumber daya alam berdasarkan kearifan lokal. Tujuan pada penelitian ini adalah untuk menganalisis peran pemerintah dalam mengelola sumber daya alam yang berdasarkan nilai-nilai kearifan loka. Metode yang digunakan adalah penelitian normatif sehingga pendekatan yang digunakan adalah Statute Approach and Conceptual Approach, pendekatan yang digunakan mengkaji norma-norma hukum dan konsep-konsep hukum. Hasilnya bahwa pemerintah harus menjunjung tinggi nilai-nilai kearifan lokal untuk pengelolaan sumber daya yang sesuai dengan Undang-Undang No. 32 tahun 2009 Pasal 3 dan Deklarasi Johannesburg di tahun 2022 yang mana mewajibkan setiap negara untuk mengatur mengenai hak berdaulat negara atas sumber daya alam dan tanggungjawab pemerintah.

Abstract

Mengurangi penindasan (bullying) di sekolah merupakan perhatian utama para pendidik, orang tua, dan legislator. Kekerasan terwujud dalam berbagai cara, dan semakin banyak bukti yang menunjukkan bahwa bentuk-bentuk kekerasan tingkat rendah atau mendasar mempunyai dampak yang besar terhadap lingkungan belajar di sekolah. Pengabdian ini menggunakan metode ceramah dan pendampingan penanganan kasus secara face to face yang meliputi identifikasi kasus, sosialisasi, pemberian materi, pendampingan hukum, solusi, diskusi serta mediasi. Tujuan dari pengabdian adalah menyelesaikan sengketa antara orang tua/wali murid terhadap tindakan bullying oleh siswa penyandang pendampingan psikolog serta memberikan solusi damai antar para pihak yang mengalami konflik. Pengabdian ini menghasilkan bahwa pada kenyataannya bentuk perilaku bullying disertai kekerasan paling umum terjadi di sekolah saat ini dan jika tidak ditangani dapat menyebabkan bentuk kekerasan yang lebih serius. Oleh karena itu, aspek penting dalam pencegahan kekerasan di sekolah adalah identifikasi dan penerapan intervensi ataupun strategi yang dirancang untuk mencegah atau mengurangi intimidasi di sekolah. Strategi pencegahan intimidasi praktis yang menargetkan berbagai tingkat (yaitu, individu, ruang kelas, dan sekolah) disediakan, dan pedoman praktik terbaik untuk menerapkan program pencegahan intimidasi di sekolah dengan banyak melakukan sosialisasi hukum dan parenting.

Abstract

This research aims to describe the natural resources management policies in the mineral and coal sectors. The description is based on the social welfare value contained in Law No. 3 of 2020 concerning Amendment of Law No. 4 of 2009 concerning Mineral and Coal Mining, as well as Law No. 11 of 2020 concerning Employment and Labour Law. This research employed a normative judicial method based on law regulations that are conceptualized as principles or norms and have evolved into proper human behavior standards. Secondary data were employed by exploring literature correlated with the mineral and coal mining management law and analyzed using juridical-qualitative techniques. Subsequently, the research indicated that the Indonesian government policy in the Mineral and Coal, alongside Omnibus Laws, are unable to accommodate social welfare values and support only profit-oriented businesspersons. This research is expected to proffer suggestions for the central or regional government to make regulations prior to the social welfare principle.

Abstract

This study aims to; first, identify the problems and needs of the East Kalimantan Province in an effort to implement regional autonomy. Second, to formulate a regional autonomy policy model based on the fulfillment of regional and territorial needs in East Kalimantan Province. The research method used is sociological legal research (empirical juridical). Where the research location is at the East Kalimantan Provincial Government office and the East Kalimantan Provincial DPRD located in Samarinda city. The types and sources of data used are primary data and secondary data. The primary data collection techniques are interviews and public discussion forums or FGDs with related apparatus. Literature study to complement secondary data and data analysis in this study is classified as qualitative with deductive inference. The impact of the implementation of regional autonomy has an impact on the determination of regional policies in responding to all the problems that arise so that a regional autonomy implementation strategy is needed in accordance with the needs of the region and the conditions of the region. Regional autonomy must be in accordance with regional needs so that it has an impact on regional independence, community welfare, justice in terms of natural resource management, regional financial capacity and environmental damage, democracy and upholding human rights in accordance with the constitution and equity in terms of economy and infrastructure.

Abstract

Economic development will develop quickly if a green economic system is adopted. a green economic system that is oriented towards the relationship between ecosystem nature and the presence of human resource elements by prioritizing knowledge and technology. Changes in the economy from previously only about profit and welfare to a green economy that has environmental principles. Samarinda, as a supporting city for IKN, is one of the cities in East Kalimantan Province which is the center of attention for rice competitions. It cannot be denied that many immigrants who come do not bring the skills to become PMKS in Samarinda City. Referring to the principles of a green economy, namely prioritize quality, follow nature, waste can be recycled etc. The problem formulation of this research is regarding the legal arrangements for handling and handling empowerment people with social welfare problems in the form of policing in green spaces and what form of policy the Samarinda City Government takes in empowering people with social welfare problems through a green economy approach that prioritizes a livable city structure. The aim of this research is to find out legal regulations from an administrative and criminal perspective even civil law due to the relationship between the Samarinda City Government and the Community Incumbent Social Welfare Issues. Apart from that, to analyze the policy formulation of the Samarinda City government which prioritizes structuring room cities to reduce the risk of environmental damage. The conclusion of this research is that in terms of the legal structure it is adequate, where the Samarinda City Social Service is to assist in terms of empowerment while the Satpol-PP is tasked with carrying out handling. Substance the law is still there Not yet adequate, one of which is that the old regional regulations are still used and there are no guardians. Abstract

Meaningful participation in lawmaking can be understood as important input or suggestions to ensure the validity and relevance of legal products. The idea of meaningful participation emphasizes the importance of the community's role in the law-making process, especially in the formation of ideal local regulations (Perda) to support the implementation of regional autonomy. This research aims to examine the application and implications of meaningful participation in the formation of ideal local regulations, using a juridical-normative approach through three approaches: 1) statutory approach, by examining relevant regulations; 2) conceptual approach, by examining the values contained in the underlying legal concepts. This research uses primary, secondary, and tertiary legal materials to produce an ideal local regulation model in the implementation of regional autonomy. The results show that meaningful community participation is a crucial element in creating local policies that are inclusive, transparent, and responsive to community needs. The process of local regulation formation must substantially involve the community, expand public participation mechanisms, and increase transparency and the role of the legislature. Thus, meaningful participation will strengthen the legal and social legitimacy of regulations, and support the creation of democratic and accountable regional autonomy. The formation of ideal local regulations not only ensures the achievement of effective and transparent governance, but also strengthens public trust in local governments. Public participation is not just a procedure, but must be understood as the core of democracy that emphasizes the right of the people to be heard, considered, and explained for the decisions taken.

Abstract

The potential of natural caves spread across Sanggulan Village, Sebulu District, Kutai Kartanegara Regency, East Kalimantan Province, which is a buffer zone for the capital of the Indonesian archipelago, has great potential to be developed as a tourism and educational facility. Currently, ecotourism development is widespread in the IKN area to fulfill the smart city slogan which prioritizes aspects of nature conservation, social, cultural and economic empowerment of local communities as well as learning and educational facilities. These elements significantly influence traditions, socio-economic life of the community and the empowerment of local village products. The village's identity is summarized in a slogan that highlights the richness of natural resources, preservation of cultural heritage and IKN's ecotourism priorities. By using a policy model that is Meaningful Participation, Asset Based Community Development (ABCD) and SWOT analysis of Regional Government policies in regulating or making regulations regarding cave or karst ecotourism, the aim is to increase IKN tourism by integrating cultural, geotourism and legal aspects. This model promotes participatory legal regulation, empowerment of local communities and environmental conservation to encourage sustainable regional development.
