Abstract

Penelitian ini bertujuan untuk menganalisis pertimbangan hukum dasar dan implikasi hukum dari Putusan Kasasi Mahkamah Agung Nomor 1753 K/PDT/2015. Fokus utama penelitian ini adalah pada sengketa sertifikat tanah, dengan penekanan pada kesalahan identifikasi terhadap tergugat dan klaim kepemilikan tanah yang mengakibatkan kaburnya tuntutan hukum. Penelitian ini mengadopsi pendekatan hukum normatif dengan metode filosofis dan analitis. Penelitian ini melakukan analisis deskriptif analitis untuk menjelaskan peraturan yang berlaku, teori hukum, dan praktik penegakan hukum positif terkait isu tersebut. Analisis menunjukkan bahwa Mahkamah Agung membatalkan putusan Pengadilan Tinggi Mataram karena tuntutan yang tidak jelas dan kesalahan dalam menentukan identitas tergugat. Hal ini mengonfirmasi pentingnya bukti yang akurat dan kredibel dalam sengketa sertifikat tanah. Putusan ini menyoroti pentingnya kepastian hukum, khususnya dalam registrasi tanah dan transaksi jual beli, dengan mempertimbangkan bukti konkret untuk memastikan keadilan dan kepastian hukum.

Abstract

Cartels, or secret deals among competitors to set prices, limit production, or divide markets, pose a significant challenge to healthy competition and market integrity around the world, including in Indonesia. This study examines the use of indirect evidence, such as economic data and communication patterns, in uncovering such covert operations under the Indonesian Competition Law (Law No. 5 of 1999), using the normative juridical approach. The study uses statutory analysis to understand the legal framework, case analysis to explore the use of indirect evidence in law enforcement, and conceptual analysis to enhance theoretical understanding. This study analyzes the decisions of the KPPU and District Courts, KPPU regulations, and relevant legal frameworks to understand the applicability and challenges of using circumstantial evidence in legal proceedings. The results of the study make it clear that, despite its important role, the study identifies legal uncertainty and the need for corroborating evidence as the main obstacles to the effectiveness of indirect evidence. It reveals a significant gap in the acceptance and interpretation of indirect evidence between the KPPU and the judiciary, highlighting the need for clarity and consistency in the law. This review recommends the revision of Law No. 5 of 1999 and related procedural laws to include provisions for the acceptance and utilization of circumstantial evidence, improving the adjudication process of both the KPPU and the courts. This research contributes to Indonesia's understanding of competition law enforcement and promoting fair business practices.

Abstract

Kegiatan pengabdian masyarakat ini bertujuan untuk meningkatkan pemahaman dan keterampilan peserta dalam penggunaan aplikasi Statistical Package for the Social Sciences (SPSS) untuk pengolahan data penelitian dan penyusunan artikel ilmiah. Metode yang digunakan meliputi penyusunan materi pelatihan, presentasi materi, demonstrasi langsung menggunakan aplikasi SPSS, diskusi interaktif, serta evaluasi hasil. Hasil kegiatan ini menunjukkan peningkatan pemahaman peserta tentang konsep statistika dan keterampilan dalam menggunakan fitur-fitur SPSS untuk analisis data. Saran untuk kegiatan selanjutnya adalah memperpanjang durasi pelatihan dan meningkatkan interaksi antara peserta serta penyelenggara. Ucapan terima kasih kepada semua pihak yang telah mendukung kegiatan ini.

Abstract

Kegiatan ini bertujuan untuk meningkatkan kompetensi digital dosen dalam mendukung pembelajaran berbasis teknologi, sebuah kebutuhan mendesak dalam era Revolusi Industri 4.0 dan pascapandemi COVID-19. Pelatihan dilakukan secara daring dengan melibatkan 54 peserta dari berbagai kalangan. Metode yang digunakan mencakup pemaparan teori, simulasi praktis, dan diskusi kelompok. Berdasarkan hasil evaluasi, pelatihan ini berhasil meningkatkan pemahaman peserta terhadap teknologi pembelajaran digital, dengan 85% peserta menunjukkan peningkatan kemampuan. Peserta juga diapresiasi atas penerapan teknologi ke dalam pembelajaran dalam dua minggu setelah pelatihan. Dengan hasil ini, kegiatan ini berkontribusi pada mendukung kebijakan Merdeka Belajar-Kampus Merdeka (MBKM) di Indonesia. Keberhasilan pelatihan menunjukkan pentingnya tindak lanjut untuk memastikan implementasi yang berkelanjutan.

Abstract

This diversion of cash back for consumer spending often occurs in supermarkets, minimarkets and small stalls and has become a phenomenon in society, consumers are on the weak side because they accept the candy as a replacement for their cash back without any other choice. Even though this seems trivial, consumers feel uncomfortable with this action and it is possible that consumers still need their money back and not everyone likes or needs this candy. The phenomenon that occurred was consumer complaints regarding the actions of shop, supermarket and minimarket businesses who replaced their change with candy. The change that is replaced with candy is change worth hundreds of Rupiah. This often happens because the value of hundreds of dollars is considered to have little material value so consumers don't pay much attention to it. The actions of shop, supermarket and minimarket businesses who replace change with candy constitute a violation of consumer rights. Consumer rights are regulated in Law no. 8 of 1999 concerning Consumer Protection (hereinafter referred to as UUPK). Candy is not a legal means of payment in Indonesia. Article 2 paragraph (2) Law No. 23 of 1999 which was then changed to Law No. 3 of 2004 which was then changed again to Law No. 6 of 2009 concerning Bank Indonesia (hereinafter referred to as UUBI) states that: "Rupiah currency is a legal means of payment in the territory of the Republic of Indonesia".

Abstract

In achieving what is emphasized in article 33 paragraph 3 of the 1945 Constitution of the Republic of Indonesia, it is neither necessary nor appropriate for the Indonesian people or the State to act as land owners, it is more appropriate if the State, as the power organization of the entire people (nation) acts as the Body. Ruler. It is from this angle that we must look at the meaning of the provisions in article 2 paragraph 1 of the UUPA which states that "Earth, water and space, including the natural wealth contained therein, are at the highest level controlled by the State". In accordance with the principles stated above, the word "controlled" in this article does not mean "owned", but is an understanding, which gives authority to the State, as the ruling organization of the Indonesian Nation, to at the highest level regulate and carry out the allocation, use , provision and maintenance thereof, determines and regulates the rights that can be had over (part of) the earth, water and space, determines and regulates legal relationships between people and legal actions concerning earth, water and space. Understanding the concept of the meaning and substance of the state's right to control land is important to straighten out existing authority in the form of regulating, administering/managing and supervising to avoid confusion and arbitrariness. The right to control from the state is "the term given by the UUPA to legal institutions and the concrete legal relationship between the state and Indonesian land
