Abstract

This article discusses the obligation of companies to pay compensation to fixed-term contract workers whose employment relationship has ended due to violations committed by the workers based on laws and regulations, company regulations, and collective labor agreements. The purpose of this study is to analyze the mechanism of compensation payment by companies and the responsibility of companies regarding compensation payments to PKWT workers who violate PKWT or company regulations using an empirical juridical research method through analysis of labor regulations and empirical data obtained through observation and interviews with industrial relations mediators from the Semarang City Manpower Office and several company HR departments. Based on the results of observations and interviews, it was found that there was a discrepancy between the provisions of PP No. 35 of 2021 in conjunction with Law No. 13 of 2003 in conjunction with Law No. 6 of 2023 (das sollen), which requires companies to pay compensation to PKWT workers without exception. However, empirically (das sein), there are still many cases of disputes over rights arising because companies do not fulfill this obligation to workers. This situation has created a legal gap between normative provisions and practice in the field. The Constitutional Court Decision No. 168/PUU-XXI/2023, which requires companies to provide compensation without exception, and the Industrial Relations Court Decision No. 203/Pdt.Sus -PHI/2022/PN Jkt.Pst, which states that companies are required to pay compensation to workers, are examples of the legal consequences faced by companies that fail to comply with applicable regulations.

Abstract

Tabing Rimbah Village in South Kalimantan is highly prone to floods and land fires, as evidenced by the 2021 floods that affected nearly its entire population. To mitigate future casualties and losses, the Disaster Resilient Family (KATANA) program was implemented to strengthen community preparedness and resilience against these recurring threats. This activity employed a Participatory Action Research (PAR) Approach, emphasizing community involvement across three stages: problem identification of existing knowledge, implementation and targeted empowerment materials, and evaluation by comparing pre- and post-test results to measure the program effectiveness. The problem identification stage was carried out in order to find out in depth how the existing conditions of the community in Tabing Rimbah village related to their understanding of the KATANA Program. This service shows significant improvement results, which are based on the paired sample T-test Pre and Post Test results. It can be concluded that there has been a substantial increase in the level of community knowledge after participating in the delivery of material compared to before in both tests conducted. Building on this statistical success, the program has generated a multi-dimensional impact: by developing 27 change agents who reached 632 households, it created a multiplier effect in disaster resilience for a community with limited educational and economic resources. Ultimately, this initiative not only establishes a foundation for the transformation into a "Disaster Resilient Village" (KATANA) but also serves as a replicable national model and an empirical contribution to sustainable, community-based disaster risk reduction strategies in Indonesia.

Abstract

Gathering has become a culture that is closely related to the social life of society in Indonesia and is very crucial from an Islamic perspective, especially for a green future with sustainable Islamic values. Even the Prophet Muhammad SAW strongly recommended keeping in touch with each other, as has been mentioned in many hadiths. This research aims to discuss the urgency of Gathering from a hadith perspective to create a green future of Islamic values. The formulation of the problem in this research is how the hadith views the urgency of Gathering as an important factor for creating a green future of Islamic values. In this research, a qualitative approach was used with the application of the hadith thematic method. The formal object of this research is the understanding and urgency of Gathering which is formulated of the hadith theme. Then the results obtained indicate that the theme of hadith can be formulated into a theoretical framework about the urgency of Gathering in the perspective of hadith and gathering is very much needed in efforts to realize a green future of Islamic values. The discussion in this study explains that the urgency of Gathering is highly recommended by the prophet and has a special place because it has a direct relationship with Allah so that it will have a bad impact if it breaks the Gathering. The conclusion of this study is that Gathering has a crucial urgency for society and life so that it has a reciprocal impact and has various types according to the purpose of carrying out Gathering and can help in realizing a green future of Islamic values.
