Abstract

Layanan Kesehatan diera digital merupakan pola baru dalam layanan kesehatan yang belum tersosialisasi di Indonesia tidak terkecuali di Kelurahan Sukamulya Kota Bandung. Hal ini terjadi oleh karena masih rendahnya pengetahuan keluarga dan masyarakat terhadap aspek hukum layanan Kesehatan diera digital. Temuan ini menjadi suatu kendala dalam mewujudkan layanan Kesehatan digital yang aman. Tujuan pengabdian ini adalah memberikan edukasi dan pemahaman kepada Masyarakat Kelurahan Sukamulya tentang pentingnya aspek hukum layanan Kesehatan digital. Pelaksanaan kegiatan berupa pemberian edukasi kesehatan tentang aspek hukum layanan Kesehatan digital yang dilakukan dengan menggunakan metode ceramah interaktif dan tanya jawab serta juga menggunakan media pembelajaran berupa leaflet. Hasil edukasi menunjukkan bahwa pengetahuan masyarakat menjadi meningkat setelah diberikan edukasi dan pembagian leaflet. Untuk itu disarankan kepada seluruh Masyarakat Kelurahan Sukamulya untuk berhati-hati dalam memilih aplikasi layanan Kesehatan digital. Pemberian edukasi tentang aspek hukum layanan Kesehatan digital perlu dilakukan secara kontinyu sebagai upaya penyebaran informasi tentang aspek hukum layanan Kesehatan digital kepada masyarakat luas.

Abstract

Thrifting sangat diminati oleh kaum muda khususnya karena pakaian bekas yang diperjual belikan adalah pakaian yang bermerk dan masih berkualitas, sehingga aman di kantong, tetapi dengan banyaknya thrifting ternyata negara beberapa waktu yang lalu melarang peredaran dan penjualan baju thrifting. Masyarakat Kelurahan Sukamulya Kota Bandung khususnya remaja belum mengenal ruang lingkup dari bahaya trifting terhadap kesehatan. Hal tersebut terjadi, salah satunya karena kurangnya informasi yang di dapat baik dalam bentuk penyuluhan maupun sosialisasi, hal ini memunculkan kekhawatiran terjadinya permasahan bahaya trifting terhadap kesehatan. Edukasi bahaya thrifting terhadap kesehatan butuh kepedulian banyak pihak, tidak terkecuali lembaga pendidikan, terutama lembaga pendidikan. Universitas Langlangbuana dalam hal ini sudah mengambil perannya dalam upaya edukasi bahaya thrifting terhadap kesehatan. Diantara peran tersebut yang telah dilakukan adalah memberikan edukasi serta pendampingan kepada warga Masyarakat terkait dengan bahaya thrifting terhadap kesehatan. Pemberian edukasi yang dilakukan dengan metode ceramah dan pembagian leaflet ternyata mampu meningkatkan pengetahuan masyarakat tentang bahaya thrifting terhadap kesehatan. Edukasi ini tidak bisa hanya dilakukan sekali saja, namun harus dilakukan secara berkelanjutan agar mampu mewujudkan Masyarakat terbebas dari bahaya thrifting terhadap kesehatan.

Abstract

The Investigation is the initial series of the criminal justice process. In practice, the examination process requires witness statements in finding a bright spot in the case. Justice collaborators are a means to facilitate investigators in uncovering cases. Technically, protection in the form of awards for justice collaborators is carried out in accordance with the provisions of the Joint Regulations. Applications are submitted by the perpetrators themselves to the Attorney General. Furthermore, in the event that the Attorney General grants the request for an award, the Public Prosecutor must state in his lawsuit the role played by the justice collaborator in assisting the law enforcement process so that it can be considered by the judge in making a decision. The purpose of this study resulted in the determination of investigators who have the authority to determine the Justice collaborator. Results of the study The presence of a justice collaborator in disclosing a case, especially one that is organized crime is urgently needed considering that its role is very central and urgent. The cooperation of justice collaborators with law enforcement officials can facilitate the task of disclosing a crime, especially those related to the public interest (openbare order) or the state. The logical consequence is that one of the instruments that can be used to encourage disclosure or reporting of a crime is by providing guarantees and protection to justice collaborators because without this role it is very difficult to disclose organized crime, usually these difficulties arise due to weak support. evidence/evidence obtained due to the limitations of law enforcement officials in obtaining evidence that is significant enough to reveal the crime. Problematic and overlapping aspects of who can determine a person to become a justice collaborator, whether the LPSK, Investigator, Prosecutor, or Judge. In order to create legal certainty, the authority to determine someone to become a justice collaborator is the authority of the investigator as the first institution to carry out legal proceedings.

Abstract

Hospital Accreditation is an acknowledgment of the Minister of Health through the Hospital Accreditation Committee (an independent assessment agency), that the Hospital has met the quality service standards constinously. Research was conducted on the topic of service quality and patient safety at the Sartika Asih Hospital Bandung (RSBSA) in 2019 and 2020. The purpose was to obtain secondary data on the implementation of quality and patient safety indicators, service complaints data and solutions offered, also data on patient satisfaction. In January to March 2021, about 450 respondents were taken to see their perceptions on hospital services based on the primary data. Hospital failure to meet minimum service standards according to predetermined indicators can lead to the failure of therapeutic contract. This is supported by the Hospital Law Number 44 Year 2009 Article 32 letter (q) which states: every patient has the right to sue and/or sue the hospital, if the hospital is suspected of providing services that are not in accordance with standards, both civil and criminal. Thus, a violation of the rules might result in a lawsuit. With the preventive and repressive legal protection, it is hoped that the patients’ rights to quality and safety can be fulfilled by the hospital.

Abstract

Delegation of authority in health services in Indonesia is regulated in Article 290 of Law Number 17 Year 2023 on Health, which allows medical personnel (such as doctors) to delegate some of their authority to other health personnel (such as nurses), provided that the recipient has sufficient competence. The purpose of this delegation is to improve the efficiency and effectiveness of services, especially in emergency situations. However, its implementation must be accompanied by accountability, where the doctor as the person in charge of the service (Article 66) can be held legally responsible if malpractice occurs due to supervision or instructions that are not in accordance with standards. This research uses a normative analysis method of the Health Law and its implications in practice. The results show that mediation is the first step in dispute resolution, while compliance with SOPs and good medical documentation are key to preventing legal conflicts. Recommendations include improving the competence of health workers, socialising regulations, strengthening SOPs, and inter-professional collaboration to minimise the risk of malpractice.

Abstract

This research aims to find out the protection of workers' rights for unilateral termination of employment (PHK) carried out by the company. specifically aims to find out: first, how is the form of legal protection of the rights of workers / labourers who experience unilateral termination of employment (PHK) carried out by the company based on Law Number 6 of 2023 concerning Job Creation, second, how can legal remedies be taken by workers / labourers who experience termination of employment (PHK) who are not fulfilled their rights by the employer. This research uses normative juridical legal research methods with a statue approach and conceptual approach. The results of this study indicate that in the event of termination of employment (PHK) has a legal regulatory basis listed in Article 151 of the Job Creation Law which discusses the ways to terminate employment (PHK). Exceptions regarding termination of employment (PHK) are contained in Article 153 of the Job Creation Law. Various reasons for termination of employment (PHK) can be done but not done in a unilateral manner by the company which will harm workers/labourers. Legal protection against unilateral termination of employment (PHK) has been regulated in Article 153 of the Job Creation Law, where in the termination of employment (PHK), the company will be responsible for the termination of employment (PHK).

Abstract

This paper aims to explore the urgency of reconstructing the institutional role of the Witness and Victim Protection Agency (LPSK) within Indonesia’s criminal justice system. Using a normative and empirical legal research methods, which is done by literature review, field exploration, and analysis, it builds an accurate and concrete model for implementing the construction of the position of the LPSK in the current criminal justice system. This study found that bureaucratic challenges—such as financial limitations, inadequate human resources, and institutional stagnation—have constrained the justice system’s ability to function equitably. These conditions often lead to the centralization of investigative power and a compartmentalized system in which oversight is limited and reactive. Within this context, LPSK holds potential as a horizontal oversight mechanism, offering checks on investigators’ authority and ensuring victim and witness rights are safeguarded during proceedings. This paper further analyzes how the Criminal Procedure Code anticipates horizontal supervision between law enforcement agencies, particularly between investigators and public prosecutors, and how LPSK can contribute to this oversight structure. However, limitations in institutional capacity and the centralized nature of LPSK pose challenges to its accessibility and effectiveness. Strengthening LPSK’s institutional capacity and expanding its regional presence are critical for responding to the growing demand for witness and victim protection, including in cases involving gross human rights violations. This study underscores the need for systemic reform and political will to ensure that protection of witnesses and victims becomes an integral part of a due process-oriented criminal justice system in Indonesia.

Abstract

The migration of foreign workers (TKA) is a global phenomenon, not exclusive to Indonesia. Since the prophetic era, the role of foreign workers has been documented. In Indonesia, opposition to foreign workers persists because of the perceived threats to domestic employment. This study aimed to discuss the legal status and protection of foreign workers' rights in Indonesia based on Indonesian and Islamic laws. This study used a juridical-normative approach with a comparative law methodology. The findings revealed that Laws 13 of 2013 and 6 of 2023 acknowledge and protect foreign workers' employment in Indonesia, considering necessity, expertise, competence, and scientific advancements. The employment of foreign workers in Islamic jurisprudence is a novel legal challenge. The legal argument used was the Maslahah mursalah, which considers higher Islamic law principles. Islamic law permits foreign workers' employment, based on universal brotherhood, when benefiting from humanity. The recognition of foreign workers in Indonesia has implications for legally protecting their rights, which are aligned with human rights principles in labor law, including rights to facilities, wages, health care, religious freedom, political participation, and sociocultural engagement

Abstract

The holder of a Mortgage Right (Hak Tanggungan/HT) is granted the status of a preferred creditor under Article 1(1) of Law No. 4 of 1996 concerning Mortgage Rights (UUHT). HT is established through a Deed of Granting of Mortgage (APHT) and registered at the land office to obtain a Certificate of Mortgage Right (SHT). However, the enforcement of HT may be obstructed when third parties, particularly landowners, contest the object of HT in court, potentially resulting in cancellation decisions, as reflected in court rulings from Semarang, Cibinong, and Surakarta District Courts. This research aims to analyze the legal consequences and legal protection available to preferred creditors when HT is annulled by a court decision. The study employs normative legal research, which is grounded in the analysis of positive legal norms derived from statutory regulations (UUHT, KUHPerdata, HIR), reinforced by legal doctrines from scholarly literature, and jurisprudence from relevant court decisions. Utilizing a prescriptive analytical approach and secondary data sources, including legislation, books, journals, and verdicts, the findings show that HT cancellation leads to the reversion of land rights to third parties and alters the status of creditors from preferred to concurrent. Legal protection mechanisms available include filing a default lawsuit and submitting a request for asset seizure (conservatoir beslag) based on Article 1131 of the Indonesian Civil Code and Article 227(1) of HIR. Keywords: Cancellation ; Court;  Decision; Liability; Rights

Abstract

Sistem hukum pidana Indonesia telah mengalami reformasi untuk meningkatkan efisiensi dan aksesibilitas peradilan, salah satunya melalui penerapan asas peradilan cepat, sederhana, dan biaya ringan sebagaimana diatur dalam Kitab Undang-Undang Hukum Acara Pidana (KUHAP). Penelitian ini bertujuan untuk menganalisis implementasi asas tersebut dalam penanganan perkara pembunuhan Vina di Cirebon serta mengidentifikasi faktor-faktor yang menghambat dan mendukung penerapannya. Metode penelitian yang digunakan adalah metode hukum normatif dengan pendekatan perundang-undangan dan studi kasus. Hasil penelitian menunjukkan bahwa meskipun prinsip keadilan cepat tercermin dalam keberhasilan aparat kepolisian menangkap delapan tersangka dalam waktu empat hari, prinsip keadilan sederhana belum terwujud sepenuhnya akibat kompleksitas birokrasi dan perdebatan hukum terkait proses peninjauan kembali (PK). Sementara itu, durasi proses hukum yang mencapai delapan tahun menimbulkan beban biaya yang signifikan, sehingga tidak sejalan dengan asas peradilan biaya ringan. Oleh karena itu, penelitian ini merekomendasikan perlunya penguatan koordinasi antar lembaga penegak hukum, pemanfaatan teknologi dalam sistem peradilan pidana, serta peningkatan manajemen perkara guna mewujudkan sistem peradilan yang cepat, sederhana, dan terjangkau.
