Abstract

Purpose of the article This is to provide an overview of drug abuse regulations in Indonesia and explain protection for whistleblowers related to providing information on drug abuse. The methodology used in the article, which discusses the guarantee of protection given to whistleblowers regarding the provision of information about drug abuse, uses normative legal research, using a statutory legal approach in analyzing the legal issues discussed. In the end, specifically, Drug abuse is regulated in the Narcotics Law. Drug abuse is also regulated by other regulations, namely Supreme Court Circular No. 4 of 2010. However, the Supreme Court Circular only regulates the "placement of drug abusers, victims of abuse and drug addicts for medical and social rehabilitation." Apart from that, the form of regulation is still in the form of Supreme Court Circular which is limited to the scope of the Supreme Court Law. So far, there have been no special regulations that guarantee the protection of whistleblowers, especially against drug crimes. Therefore, these regulations must be presented as a law to ensure legal certainty. However, criminal reporting is regulated by Supreme Court Circular No. 4 of 2011. However, this regulation must provide certainty about what guarantees the state will provide to these whistleblowers. There still need to be more standards in the Narcotics Law and Supreme Court Circular No. 4/2011.

Abstract

The purpose of this paper is to analyze forms of legal protection for workers with disabilities in fulfilling their rights to occupational safety and health and to determine the obstacles in fulfilling their rights to occupational safety and health for workers with disabilities. The research method used for normative research is a robust approach that focuses on the study of the application of norms or rules in positive law. The data sources used in this normative legal research are secondary data in the form of primary legal materials, namely laws, and secondary legal materials in the form of legal books. The type of approach used in this writing is a statutory approach. The results of this writing show that. The protection of occupational safety and health is regulated in Article 86 paragraph (1) of the Manpower Law. A form of legal protection for workers with disabilities in fulfilling their rights to occupational safety and health can be in the form of fulfilling their rights to accessibility as regulated in the Law on Persons with Disabilities.There are obstacles in fulfilling these rights; employers or companies have not been able to fulfill the rights that workers with disabilities should receive. Therefore, it is crucial for the Government to conduct regular supervision to monitor the implementation of the provisions in fulfilling the rights to occupational safety and health for workers with disabilities.

Abstract

Tindaki Pidana Korupsii adalah tindak pidana yang memiliki kesulitan dalam pembuktiannya. Tujuan dari penelitian ini adalah untuk mengidentifikasi pembenahan pembalikan atas beban pembuktian dalam kasus tindakan pidana terbalik; serta menganalisis pertentangan asas dalam pembalikan beban pembuktian dalam perkara tindak perbuatan pidana kasus korupsi di Indonesia. Penelitian ini menggunakan pendekatan normative yang menggunakan data sekunder. Hasil penelitian menunjukkani bahwa sistem pembalikan beban pembuktian telah diatur dalam undang-undang tipikor dan digunakan sesuai aturan hukum acara yang berlaku dan tidak melanggar ketentuan atas asas praduga tak bersalah. Sistem pembalikan pembuktian terbalik merupakan sistem khusus dalam memberantas tindak khusus yaitu tindak pidana pidana korupsi serta sesuai dengan asas lex specialis derogate lex generali. Aparat penegak hukum belum sepenuhnya menggunakan sistem pembalikan pembuktian terbalik dalam tindaki pidana korupsi The Corruption is classified as a crime that poses challenges in terms of proof. Formula problems in this analysis: First, to know about this regulation of reverse evidence of reverse criminal acts in Indonesia; Second, what are the conflicting principles in reverse evidence in corruption cases in Indonesia? This research uses a normative approach that uses secondary data. As a results, hopefully it will show the reverse evidence as the system that has been regulated in the Corruption Law and is used in accordance with applicable procedural law rules and will not violate provisions of innocence that according to presumption. System that reversing the burden of proof is a special system to eradicating specific acts, namely criminal acts of corruption, in accordance with the principle of lex specialis of derogate lex generali. Also the law enforcement officials have not fully used the system to reversing the burden of proof in accordance of the criminal acts of corruption.

Abstract

Penelitian ini bertujuan untuk mengkaji kekosongan norma dalam sistem hukum positif Indonesia dan merumuskan kerangka regulasi yang ideal berdasarkan prinsip kepastian hukum dan perlindungan data pribadi. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan, dengan menelaah praktik di negara-negara civil law dan common law. Hasil kajian menunjukkan perlunya norma substantif yang menetapkan lembaga penyimpan (seperti ANRI), prosedur serah-terima, kewajiban digitalisasi, serta ketentuan pertanggungjawaban hukum terhadap penyimpanan jangka panjang. Diperlukan juga pengaturan tentang sistem e-protokol dan cyber notary sebagai langkah modernisasi arsip notaris. Regulasi ini diharapkan menjadi instrumen reformasi kenotariatan yang integratif dan futuristik, menjamin keberlanjutan perlindungan hukum dan akuntabilitas pengelolaan dokumen publik.

Abstract

Studi ini bertujuan untuk mengetahui validitas akta yang dibuat tanpa melibatkan penerjemah resmi serta aspek perlindungan hukum yang dapat diberikan kepada para pihak atas ketiadaan penerjemah resmi. Dalam penelitian ini diterapkan metode yurids normatif yang berorientasi pada analisis regulasi terkait permasalahan yang diteliti, terutama ketentuan dalam Undang-Undang Jabatan Notaris. Berdasarkan hasil penelitian, diketahui bahwa penggunaan penerjemah tidak resmi dapat mengancam validitas akta notaris yang kedudukannya terbatas sebagai  akta dibawah tangan yang diatur dalam Pasal 41 UU No. 2 tahun 2014 tentang Perubahan Undang-Undang Jabatan Notaris, serta notaris yang tidak menghadirkan penerjemah resmi dapat dimintai pertanggungjawaban berdasarkan pada dampak yang ditimbulkan akibat kelalaian tersebut secara perdata yaitu berupa ganti kerugian serta pertanggungjawaban secara administratif yaitu teguran lisan hingga pemberhentian notaris.

Abstract

Children are the nation's future generation whose rights are constitutionally guaranteed, yet contemporary crime developments indicate that children are not only victims but also perpetrators of criminal acts, including terrorism, which is classified as an extraordinary crime. The involvement of children in terrorist networks raises serious legal issues concerning criminal responsibility and the protection of children’s rights. This study aims to analyze the legal regulation of children who commit terrorism offenses and the forms of legal protection afforded to them under Indonesian law. This research employs a normative legal method, using statutory and conceptual approaches, to examine Law Number 11 of 2012 on the Juvenile Criminal Justice System, Law Number 35 of 2014 on Child Protection, and Law Number 5 of 2018 on the Eradication of Terrorism Crimes. The findings indicate that the legal framework applies the principle of lex specialis derogat legi generali in handling children involved in terrorism. Children are positioned not merely as offenders but as victims of ideological exploitation within organized networks. Consequently, legal treatment prioritizes rehabilitation, education, social reintegration, and restorative justice rather than retributive punishment. This approach is intended to safeguard the best interests of the child while maintaining the objectives of law enforcement and public security.

Abstract

Rabies, a global public health issue with a 100% mortality rate, affects tens of thousands annually, primarily in tropical regions, and is widespread in over 150 regions. Effective rabies control regulations are crucial in tropical regions due to limited healthcare, dense population, and virus-carrying species, promoting well-being, reducing costs, and promoting sustainability. This article aims to design effective regulations on rabies control in tropical regions. The study utilized a systematic literature review to explore effective rabies control in tropical regions. The analysis used Publish and Perish 8 tool and Mendeley Reference Manager software. The PRISMA was employed to guide the investigation. The study identified 26 significant research articles from 357 exclusions. The results reveal that pet rabies regulations may not effectively control outbreaks, requiring prioritizing awareness campaigns due to resource constraints, weak healthcare systems, and cultural factors in tropical regions. Therefore, the design of effective regulations on rabies control in tropical regions highlight: vaccination programs targeting pet domestications; reducing risk of rabies transmission through domesticated livestock; including rules on control, risk regulation, and animal population control; outlining minimum standards for health facilities and veterinary services; retraining healthcare workers and veterinarians involved in rabies prevention is necessary.

Abstract

This study aims to analyze the awareness and implementation of legal protection for nursing personnel at Dharma Yadnya General Hospital in Denpasar. The research is motivated by the high legal risks faced by nurses due to unclear boundaries of medical authority and the weak legal protection system within hospital institutions. The study employs an empirical legal method with a qualitative descriptive approach through in-depth interviews with nurses and hospital management, as well as document analysis of relevant regulations and internal policies. The findings reveal that legal protection for nursing personnel at Dharma Yadnya Hospital remains general in nature, lacks a specific legal assistance unit, and has no clear internal guidelines. Legal, structural, and cultural factors significantly influence the effectiveness of legal protection, where the hospital’s adherence to the Tri Hita Karana philosophy often creates a dilemma between maintaining harmony and asserting legal rights. In conclusion, strengthening legal protection for nurses requires the establishment of a legal protection unit, the formulation of internal delegation guidelines, and continuous legal awareness training grounded in professional and spiritual values.

Abstract

This study aims to analyze the legal status of female heirs in the Balinese customary inheritance system, which is traditionally based on the patrilineal principle or kapurusa system, where lineage and inheritance rights are passed down through the male line. In this system, married women are considered part of the husband's family (pradana) and generally do not receive inheritance rights from their family of origin. However, social developments, increasing legal awareness, and the influence of national law have driven a paradigm shift in the position of women in customary inheritance. This study uses a normative legal approach supported by qualitative empirical data through literature studies, legal document analysis, and interviews with Balinese customary leaders and women. The results show that there is a duality of norms between Balinese customary law and national law that guarantees gender equality as stipulated in the 1945 Constitution and the CEDAW Convention. Although customary law still maintains the concept of purusa-pradana, practice in the field has begun to show a shift towards a more inclusive system through the recognition of partial inheritance rights for women. Legally, this change strengthens the principles of non-discrimination and substantive justice, while socially it shows the transformation of cultural values towards equality without eliminating Balinese traditional identity.
