Abstract

This study aims to analyze the implementation of accountability from business actors to consumers who are harmed by damage to an item based on the Consumer Protection Act conducted using the literature study. The problem in this study is related to violations of rights rather than consumers for damage to an item purchased related to accountability rather than a business actor that causes these losses. The purpose of the implementation of this research is to analyze the conditions of accountability of business actors to consumers dynamics of their conditions in the territory of Indonesia. Literature study method as a method used to investigate scientific works, reports on the accountability of business actors and official documents that have a connection with the research conducted. The results showed that the accountability of business actors included compensation in the form of refund or returns to the same or equal value, but accountability still had an impact on the decline in consumer confidence in business actors. Conclusion this study states that the permeasun of legal protection efforts given to consumers for losses caused by business actors. The renewal of this research lies in the comprehensive approach used on the issues that occur and conduct in -depth research and not only look on the one hand.

Abstract

This examination means to decide the legitimacy of deals and buy arrangements through the Web from a common regulation point of view. The sort of exploration utilized is standardizing juridical. The nature of this research is descriptive and qualitative. Document study methods derived from relevant literature studies on the issues discussed were used in the process of data collection. The exploration results show that the legitimacy of a deal and buy understanding through the web should have a similar legitimacy as a regular understanding as long as it very well may be demonstrated and meets the arrangements in Article 1320 of the Common Code. The reason for legitimacy happens if the two of them commonly concur and there is an expression of understanding between the purchaser and merchant in conveying in regards to the proposal of merchandise and the determination of the ideal products and both have concurred that there is an arrangement.

Abstract

This article discusses the issue of the Kesiman Kertalangu Integrated Waste Management Site (TPST) which has an impact on the surrounding community because the smoke produced causes disruption to people's sense of smell and even threatens public health, but basically the community is not protesting regarding the existence of the TPST but rather the impact caused by its activities. This article uses a normative legal research method, by taking a statutory approach, then the data collected will be processed using a qualitative approach and explained descriptively. The Kesiman Kertalangu TPST violates the right to a clean and healthy environment as mandated by the constitution, UUPPLH and the Sustainable Development Goal's concept. It is hoped that the government's responsibility regarding the impacts that occur will refer to article 54 UUPPLH and 82 of the Job Creation Law, then the Kertalangu TPST must have an SDG concept, especially Village SDGs, guided by Village SDG number 3, environmental restoration efforts must be made based on UUPPLH and the Job Creation Law. and carrying out sustainable waste management based on SDG's principles as well as developing technology is very necessary in solving problems by comparing it with waste management in Singapore, namely processing smoke from combustion into electrical power and scarp metal which produces high economic value.

Abstract

The principle of good faith receives less attention than other principles in civil law literature. This study aims to determine how buyers who buy and sell land in good faith are protected by the law. The normative legal research methods used in this study are utilized. One concrete form of legal protection for buyers who act in good faith is that if a judge decides that the buyer is a buyer who acts in good faith, he or she must also decide the status of the sale and purchase that has taken place. These are the findings of the research study that are the subject of the discussion. Is the sale and purchase object still the buyer's property, or does the sale and purchase status end and the buyer has to pay back the seller the money? Rather than having to file a lawsuit in court, which takes a considerable amount of time and cannot guarantee buyers' certainty of legal protection, this type of thing is certain to be sufficient to provide buyers in good faith with protection.

Abstract

This research aims to analyze how legal protection is given to bamboo woven craft businesses whose copyrights have not been registered from a copyright perspective. The problem in this research is related to the existence of a violation of rights committed by other parties who carry out acts of imitation or duplication of woven bamboo crafts in terms of motifs, designs and shapes made by the original owner which are duplicated or imitated by irresponsible parties with the aim of traded without the permission or knowledge of the creator, causing losses to the original creator of the woven bamboo craft. The aim of carrying out this research is to analyze the condition of legal protection for the bamboo woven craft business that occurs in Indonesia. The legal research method used is normative legal research which is carried out by identifying and studying statutory regulations related to Copyright in the issue of providing legal protection in the bamboo woven craft business sector. The approach method used is the legal approach (statue approach) in analyzing existing problems, then the data collected and obtained are processed using qualitative methods. The results of the research are then explained descriptively to provide an overview related to the research results obtained, namely that copyright for works of art and crafts whose copyright ownership has not been registered can still receive legal protection, this is because the copyright of a work attaches automatically to a work created by the creator as long as it has met the requirements as an original work and has been expressed in a concrete form, in which case it has been expressed as a work of woven bamboo craft. However, to obtain stronger legal recognition, bamboo woven works that are developed into bamboo woven craft businesses need to register the copyrighted work.

Abstract

Technological developments, especially in the health sector, are currently growing very rapidly. Robotic Telesurgery or remote surgical robots are expected to become a technology that can realize health equality in Indonesia, but it is a shame that technological progress is not comparable to the relevant regulations that regulate it, it is feared that this will not guarantee legal certainty which could lead to malpractice. The method used in this research is a normative legal research method because the focus of the study departs from the vagueness of norms using the approach: statute approach, conceptual approach, as well as analytical approach. The legal material search technique uses document study techniques, and study analysis uses qualitative analysis. The results of this research are that there is a void in norms in Law Number 17 of 2023 concerning Health which does not regulate legal responsibility for failed operations through Robotic Telesurgery So it is necessary to create a law that specifically regulates the responsibilities of doctors.

Abstract

Abstract. The location of Indonesia which is between two continents and two oceans makes Indonesia vulnerable to criminal acts in the field of fisheries. This study aims to investigate the authority of state agencies in the investigation stage of illegal fishing crimes in Indonesian territorial waters. Research approach used in this study is through a normative juridical approach or the study of literature and documents aimed at written regulations or other legal materials related to the guarantee of legal certainty for the investigation of illegal fishing crimes in Indonesia. The results showed that for the handling of these criminal acts, legal politics in the formulation of Law No. 31 of 2004 concerning Fisheries stipulates that investigations into fisheries crimes are carried out by Civil Servants of Fisheries Investigators, Investigating Officers of the Indonesian Navy, and Indonesian National Police. The law does not provide strict limitations on the investigative powers of these three agencies, even with Law No. 45 of 2009 as an amendment to Law No. 31 of 2004 also does not clearly regulate the limits of the investigative authority of the three agencies. Therefore, in its implementation there may be overlap of authority. Therefore, it is necessary to harmonize law enforcement in the investigation stage. Letak Indonesia yang berada di antara dua benua dan dua samudera menjadikan Indonesia rentan terhadap tindak pidana di bidang perikanan. Penelitian ini bertujuan untuk mengetahui kewenangan lembaga negara dalam tahap penyidikan tindak pidana illegal fishing di wilayah perairan Indonesia. Pendekatan penelitian yang digunakan dalam penelitian ini adalah melalui pendekatan yuridis normatif atau studi literatur dan dokumen yang ditujukan pada peraturan tertulis atau bahan hukum lainnya terkait dengan jaminan kepastian hukum dalam penyidikan tindak pidana illegal fishing di Indonesia. Hasil penelitian menunjukkan bahwa untuk penanganan tindak pidana tersebut, politik hukum dalam rumusan Undang-Undang Nomor 31 Tahun 2004 tentang Perikanan mengatur bahwa penyidikan tindak pidana perikanan dilakukan oleh Penyidik Pegawai Negeri Sipil, Penyidik TNI Angkatan Laut, dan Penyidik Perikanan. Kepolisian Negara Republik Indonesia. Undang-undang tidak memberikan batasan tegas mengenai kewenangan penyidikan ketiga lembaga tersebut, bahkan dengan adanya Undang-Undang Nomor 45 Tahun 2009 sebagai perubahan atas UU Nomor 31 Tahun 2004 juga tidak mengatur secara jelas batasan kewenangan penyidikan ketiga lembaga tersebut. Oleh karena itu, dalam pelaksanaannya mungkin terjadi tumpang tindih kewenangan. Oleh karena itu, perlu adanya harmonisasi penegakan hukum pada tahap penyidikan. Abstract

Studi ini bertujuan untuk menganalisis pengaruh politik hukum dalam perkembangan investasi di Indonesia serta implikasi dari berlakunya Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal terhadap pengusaha kecil. Studi ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil studi menyatakan bahwa kebijakan dan peraturan perundang-undangan dalam UU Penanaman Modal terkait dengan penanaman modal asing tidak lagi membedakan antara penanam modal dalam dan luar negeri. Kebijakan UUPM adalah memberikan pelayanan yang sama kepada semua investor yang berinvestasi di Indonesia, baik dalam maupun luar negeri. Memberikan layanan fasilitasi kepada investor asing, seperti keringanan atau pembebasan pajak, repatriasi modal, bantuan perizinan, dan kemampuan untuk mengajukan sengketa ke badan arbitrase internasional. Namun demikian, prinsip penanaman modal asing dan liberalisasi perdagangan internasional bertentangan dengan prinsip demokrasi ekonomi yang tertuang dalam Pasal 33 UUD 1945. Pasal ini mengamanatkan bahwa semua orang, tanpa kecuali, harus dihormati hak-hak dasarnya. Sebaliknya, ketentuan liberalisasi perdagangan di WTO didasarkan pada ideologi kapitalis. membatasi hak-hak dasar ini; hanya mereka yang mampu bersaing yang dapat memperoleh manfaat dari ketentuan perdagangan internasional WTO. ABSTRACT This study aims to analyze the influence of legal politics in the development of investment in Indonesia as well as the implications of the enactment of Law Number 25 of 2007 concerning Capital Investment on small entrepreneurs. This study uses normative research methods with a statutory approach and a conceptual approach. The results of the study stated that policies and laws and regulations in the Investment Law related to foreign investment no longer distinguish between domestic and foreign investors. UUPM policy is to provide the same service to all investors who invest in Indonesia, both domestic and foreign. Provide facilitation services to foreign investors, such as tax relief or exemption, capital repatriation, licensing assistance, and the ability to submit disputes to international arbitration bodies. However, the principle of foreign investment and liberalization of international trade is contrary to the principle of economic democracy contained in Article 33 of the 1945 Constitution. This article mandates that all people, without exception, must have their fundamental rights respected. In contrast, the terms of trade liberalization at the WTO are based on capitalist ideology. restrict these fundamental rights; only those capable of competing can benefit from the WTO's international trade provisions.

Abstract

Tujuan dari penulisan ini adalah untuk mengetahui bagaimana sebenarnya perjanjian lisensi merek yang berlaku di Indonesia serta campur tangan dari Notaris akan hal itu dikarenakan merek merupakan langkah awal yang sangat berpengaruh bagi pemilik merek yang terdaftar dan merupakan hak eksklusif bagi pemilik agar dapat menggunakan merek dalam perdagangan barang dan jasa sesuai dengan tipe jasa apa yang didaftarkan. Tujuan dari adanya merek tentu saja supaya gampang dan mudah untuk dikenali, produk tanpa merek tentu tidak akan dikenal oleh konsumen dan menimbulkan kebingungan bagi konsumen sebagai pengguna produk barang dan/atau jasa tertentu. Jenis penelitian yang digunakan dalam jurnal ini adalah penelitian hukum normatif atau biasa disebut juga penelitian doktriner karena penulisan ini dilakukan hanya atas dasar peraturan tertulis yang sudah ada atau bahan lain. Hasil dari penulisan ini bahwa merek sebagai bagian dari HKI (Hak Kekayaan Intelektual) yang mempunyai nilai ekonomi, dengan ciri khusus yang membedakan eksistensi suatu produk dengan produk lainnya. Notaris mempunyai kewenangan dalam menjalankan tugasnya yaitu membuat akta yang asli dan pembuktiannya sempurna. Akta yang dibuat oleh notaris termasuk juga perjanjian lisensi, khususnya merek. Isu dari tugas notaris atas suatu perjanjian adalah bagaimana mekanisme pembuatan perjanjian lisensi merek dan bagaimana undang-undang yang berlaku saat ini mengatur peran dan pertanggungjawaban notaris terhadap perjanjian lisensi yang dibuatnya, termasuk menjelaskan konsep suatu akta notaris. ABSTRACT The purpose of this paper is to find out how the license about brand agreement actually applies in Indonesia and the intervention of a Notary in this matter because the brand is a very influential first step for registered tradebrand owners and is an exclusive right for the owner to be able to use the brand in trading goods. and services according to the type of service registered. The purpose of having a brand is of course to make it easy and easy to recognize, products without a brand will certainly not be recognized by consumers and cause confusion for consumers as users of certain goods and/or services. The type of research used in this journal is normative legal research or also known as doctrinal research because this writing is done only on the basis of existing written regulations or other materials. The result of this writing is that the brand as part of Intellectual Property Rights (IPR) has economic value, with special characteristics that distinguish the existence of a product from other products. In this case, the Notary is given some authority to carry out public functions in the civil field, namely making deeds that are original and have perfect proof. The deed made by a notary is one of the licensing agreements, especially the brand. The core issue of a notary's authority over an agreement is how the mechanism for making a tradebrand license agreement and how the current law regulates the role and responsibilities of a notary for the license agreement he makes, including explaining the concept of a notary deed.

Abstract

Negara Indonesia sangat menjujung tinggi Hak Asasi Manusia serta semua warga Negara Indonesia memiliki kedudukan yang sama di kehadapan hukum tanpa pengecualian. Biarpun orang tersebut telah diduga ikut serta dan sebagai pelaku tindak pidana dengan diperolehnya alat bukti permulaan, sesuai dengan Pasal 8 ayat (1) UU No. 48 Tahun 2009 tentang Kekuasaan Kehakiman, maka orang yang telah diduga sebagai pelaku tindak pidana tersebut wajib dianggap tidak bersalah sebelum adanya putusan pengadilan yang menyatakan kesalahannya dan telah memiliki kekuatan hukum tetap. Kebijakan dilapangan yang dilakukan oleh kepolisian jika dihubungkan dengan asas praduga tak bersalah maka dapat memunculkan permasalahan, yaitu bagaimana proses penerapan Pasal 8 ayat (1) Undang – Undang Kekuasaan Kehakiman, terkait dengan tersangka yang dianggap tidak bersalah sampai ada putusan pengadilan yang berkekuatan hukum tetap, ditingkat penyidikan di Polresta Denpasar serta apa saja faktor penghambat ditingkat penyidikan tersebut. Untuk menjawab pertanyaan tersebut maka dilakukanlah suatu penelitian. Jenis penelitian yang digunakan dalam penelitian ini yaitu penelitian hukum empiris, yaitu suatu metode yang dilakukan dengan observasi guna dapat melihat hukum dalam artian yang nyata atau dengan langsung melakukan penelitian turun ke lapangan. Berdasarkan hasil penelitian yang dilakukan maka dapat disimpulkan bahwa Kebijakan dilapangan yang dilakukan oleh kepolisian dapat dikatakan bertentangan dengan asas praduga tak bersalah, dikarenakan polisi telah melakukan konferensi pers terhadap para tersangka narkotika yang belum memiliki kekuatan hukum tetap, karena tersangka masih dalam proses penyidikan. Adapun faktor penghambat, yaitu terjadinya pertentangan antara kebijakan kepolisian dengan undang – undang yang berlaku. ABSTRACT The State of Indonesia is highly upholding Human Rights and all Indonesian citizens have the same position before the law without exception. Even if the person has been suspected of participating and as a criminal offense by obtaining the initial evidence, in accordance with Article 8 paragraph (1) of Law no. 48 of 2009 concerning Judicial Power, then the person who has been suspected as the perpetrator of the crime must be presumed innocent before a court decision which states his guilt and has permanent legal force. The policy in the field carried out by the police if related to the principle of presumption of innocence can raise problems, namely how the process of applying Article 8 paragraph (1) of the Judicial Power Act, related to suspects considered innocent until there is a court decision with permanent legal force, at the investigation level at Denpasar Police and what are inhibiting factors at the investigation level. To answer these questions, a study was conducted. This type of research used in this study is empirical legal research, which is a method carried out by observation in order to be able to see the law in the real sense or by directly carrying out research into the field. Based on the results of research conducted, it can be concluded that the policy in the field conducted by the police can be said to be contrary to the principle of presumption of innocence, because the police have conducted a press conference on narcotics suspects who do not have permanent legal force, because the suspect is still under investigation. The inhibiting factors, namely the conflict between police policy and applicable laws.
