Abstract

The application of Islamic rules in Aceh and Kelantan is also related to the political power. There is a significant difference about political treatment on the application of Islamic law in Aceh and Kelantan. In Aceh, the central government (Indonesia) thinks that it is needed to apply jinâyah law in Aceh as a strategy to solve conflicts. This political rule has been applied in the republic of Indonesia since the leadership of Habibie, Abdurrahman Wahid, Megawati Soekarno Putri to Susilo Bambang Yudhoyono. The main factor that influences the Indonesian political government rule is the central conflict with the Acehnese in the leadership of Soeharto presidential to the Helsinski Agreement 2005. Some vertical conflicts happened between the central government and the Acehnese were solved by giving special autonomy in applying the Islamic rules. Not only family law and economic law which are given autonomy to be applied in Aceh, but also the autonomy to apply jinâyah Law. In Kelantan, Federal government (Malaysia) did not have political wish to apply Jinayah Law in Kelantan since the leadership of Mahathir Muhammad, Abdullah Badawi to Najib Razak. Moreover the federal government made the issue of the application of jinâyah law as the political commodity to get the political sympathy from the people, who are the partner of non Moslem voters in the national ranks and some Moslem voters who are not affiliated with PAS. This political needs factor is kept by the Federal Government to respond the Kelantan’s government wish to apply Islamic rules.Copyright (c) 2015 by Al-Ihkam. Abstract

This paper discusses the radical façade of Islam demonstrated in number of media including articles, books and others in Indonesia. How Islam teaches to protect and apply its doctrines understood by some Indonesian Muslim activists and scholars representing some organizations is presented in this paper. It observes the continuity of the attempt of spreading quite radical Islamic doctrines by some publishers in the period of colonialization and that of independence. It argues that such the attempt has been influenced by the social and political changes, and led to actualize jihad notion as glorified by a number of Muslim countries in the words

Abstract

Jihad is nowadays often misunderstood and misused, especially by militant Moslems translating it as a fight against unbelievers in order to destroy them and/or to convert them to Islam. Such a view has reduced the real meaning of jihad. In the time of Muhammad, jihad was not necessarily acted as a fight against the “enemy” of God or the holy war as it is being widely understood today. It was applied as a hard effort to establish Islamic values in society. This article is all about the reduction and misunderstanding of jihad among moslems and nonmoslems. It delivers a historical analysis of view shifting on jihad, from its,wider meaning to its specific one that is using forces and practicing violance. It also launches some cases of misuse of jihad in society from its precedent to modern era. This article suggests a way back to the meaning of jihad as it was.

Abstract

Keuangan negara merupakan kebijakan negara yang berdimensi kedaulatan. Studi ini bertujuan untuk menelusuri politik dan hukum keuangan negara Indonesia dalam tinjuan siyasah syar’iyyah. Metode dalam studi ini adalah library research (penelitian kepustakaan) dengan pendekatan politik dan yuridis formal. Hasil dari penelitian ini menunjukkan bahwa pengelolaan keuangan negara dilaksanakan untuk kemakmuran rakyat. Tujuan besar ini dapat terselenggara jika keuangan negara dikelola dan dilaksanakan secara transparan, akuntabel dan partisipatif sebagai karakteristik utama dari tata kelola pemerintahan yang baik (good governance). Kedaulatan rakyat yang telah menjadi konsensus nasional dilaksanakan dalam wujud pengelolaan keuangan negara untuk kemakmuran rakyat. Dari aspek siyasah syar’iyyah, pengelolaan keuangan negara juga mencerminkan tujuan kemaslahatan rakyat yang mencerminkan prinsip amanah dan tidak bertentangan dengan aturan syariat.

Abstract

Conflicts related to houses of worship in some regions in Indonesia have indicated a tension between the majority and minority groups. The minority found it difficult to build a house of worship, for the majority opposed it. While an attempt of resolution was initiated by the central and regional government including community elites. However, conflict settlements had not always been successful although it was resolved through legal process and mediation. The conflict of GKI Yasmin in Bogor, for instance, was one example that legal process was not effective to resolve the conflict. Similarly, the conflict of mushalla As-Syafi’iyah in Denpasar was also another case where a mediation process with the involvement of local leaders also failed. However, a conflict of temple establishment in Tanjung Pinang showed a successful resolution by a mediation involving the religious leaders and the local government elites. This paper suggests that the resolution of conflicts pertinent to the cases of houses of worship depends favorably on the initiatives taken by the local government and the local religious leaders.

Abstract

Enthusiasm growth to comprehend the Islam more as “religious tradition that exist”, historical, compared to “set of doctrine” in al-Qur’an and Hadits, finding its momentum in growth of Islamic study in some notable and big university in United States. This then applied in religious Islam colleges. There also shift from more normative character of Islamic study to more historical, sociologic, and empiric one. Second, there’s tendency, broader scientific orientation. If at previously period scholar orientation tends to middle easterly, especially al-Azhar University, in the last two decade looked to be progressively wide of and immeasurable. Because that, nowadays started development of Islamic education instructing at demand of enhancing implementation quality, management, curriculum with the international standard. Abstract

This article investigates how women principals practice their leadership to address the global pandemic challenges encountered by Islamic-based junior high schools or madrasah Tsanawiyah (MTs). The study examines the key behaviors and practices school leaders, particularly women, implement to address the global pandemic challenges. Some challenges in the global pandemic, including learning management, developing an online curriculum, school facilities, teacher performance, and school members' psychological well-being, were indicated to hinder the learning effectiveness in MTs. The MTs principals, the top-level leaders in the institutions, play a critical role in addressing these issues. This research utilized a multiple case study approach and collected qualitative data from six MTs in Bogor, Tangerang, and Bekasi. An in-depth interview with 18 participants was conducted to investigate the women's principal leadership practices. The findings revealed that principals displayed a catalytic leadership approach through an agent of change where school members and stakeholders are invited to change the curriculum system and performance to respond to the challenges of the global pandemic. The results of this study also indicate that most female principals prioritize the well-being of teachers and students in facing learning challenges in the pandemic era.

Abstract

In the context of shari’a implementation in Aceh, there has been resistance among young people wanting freedom and openness in public space with its modernity values. This study aims at investigating the responses of Aceh’s young people to the implementation of Sharia in Aceh and how it implies for the Sharia law enforcement in the region. This is a socio-legal research relying on interviews and focused-group discussions as data collection methods. Respondents consist of young people aged 20-25. This research finds out that there has been a normalization of sharia in the Acehnese society with young people tending to accept sharia in Islamic tenets, propagation, attires, economic system, and penal system. Those who were born after or a while before sharia was implemented for the first time tend to get used to the sharia and consider it a part of their normal life. Their responses vary, from accommodation, adaptation, compromise to resistance. The resistance leads to the agency and creating a counterspace as their comfort zone to express creativity. In turn, this religiosity model contributes to sharia's moderatization in Aceh. Therefore, there is a need for the Aceh local government to maintain and develop spaces for young people to express creativity while maintaining sharia as a part of their lives.

Abstract

The emergence of Islamic political aspirations in Indonesia always occurs along with the development of national politics. It is delivered not only by Islamic elites from Islamic parties and Islamic movements but also by university students. This study explores the Islamic political aspirations of Islamic High School (STAI) students with a focus on the basic issues of the state, Islamic law, political system (democracy/Islamic caliphate), and the way to deliver the aspirations. This is quantitative research in which the data were collected through a representative survey in each province involving 222 university students in the fifth semester in the provincial capital, as the samples were allocated disproportionately to each selected university. This quantitative study was strengthened by qualitative data that were extracted by interviewing the directors of STAI in Padang, Semarang, Jambi, Kupang, Banjarbaru, and Samarinda. The findings of this study showed that Islamic political aspiration among university students was about the aspiration to implement Islamic law as state law in the Islamic caliphate system. The university students did not want democracy as a political system that implements Islamic law. These Islamic political aspirations are not delivered through violence but are expressed constitutionally. This Islamic political aspiration is built by integralistic/conservative religious identity and political independence/autonomy of university students.

Abstract

The radical religious thought can be traced from the Competences Standard and Basic Competences (SKKD), textbooks, teachers, and religious understanding. This research focuses on SKKD materials and textbooks, which potentially to increase understanding intolerant and radicalism. The study shows that intolerant and radicalism concepts were not found in SKKD materials, textbooks and the understandings of jurisprudence teachers in Islamic Senior High School in terms of marriage, inheritance, and politics. However, this study found that there is restriction on the rights of non- Muslims in the area of marriage, inheritance, and politics. This restriction is based on Islamic doctrine, which states that non-Moslems have no certain rights, such as inheritance, leadership, and representation. Keywords: Radicalism, jurisprudence, Islamic Senior High School, textbooks Paham keagamaan radikal di lembaga pendidikan dapat dilacak dari Standar Kompetensi dan Kompetensi Dasar (SKKD), buku ajar, dan paham keagamaan guru. Penelitian ini memfokuskan materi SKKD dan buku ajar yang berpotensi pada paham intoleran dan radikal. Penelitian ini menemukan, bahwa materi SKKD, buku ajar, dan pemahaman guru-guru fikih MA tidak ditemukan paham intoleran dan radikal dalam wilayah pernikahan, kewarisan, dan politik. Namun penelitian ini menemukan pembatasan hak-hak non-Muslim dalam wilayah pernikahan, kewarisan, dan politik. Pembatasan ini didasarkan pada doktrin Islam yang menegaskan, bahwa non-Muslim tidak mendapatkan hak-hak tertentu, seperti kewarisan, kepemimpinan, dan perwakilan. Kata Kunci: Radikalisme, fikih, Madrasah Aliyah, buku ajar.
