Abstract

Aksi terorisme di Indonesia sudah tidak lagi hanya melibatkan orang-orang dewasa, tetapi telah bertransformasi dengan melibatkan anak-anak sebagai pelaku aksi terorisme secara langsung. Mereka telah menjadi korban dari orang tuanya yang telah melakukan indoktrinisasi paham keagamaan radikal sehingga mereka terlibat dalam aksi terorisme. Penanganan aksi terorisme yang melibatkan anak pun telah dilakukan oleh pemerintah. Studi ini bertujuan untuk menganalisis penanganan anak yang terlibat aksi terorisme di Balai Rehabilitasi Sosial Anak Memerlukan Perlindungan Khusus (BRSAMPK) yang dikelola Kementerian Sosial dan Sekolah Luar Biasa emotion (SLBe) Handayani yang dikelola Kementerian Pendidikan dan Kebudayaan. Permasalahan penelitian yang ingin dijawab adalah deradikalisasi yang dilakukan BRSAMPK Handayani dan SLBe Handayani terhadap anak yang terlibat dalam aksi terorisme. Studi ini menggunakan penelitian kualitatif dengan pendekatan studi kasus terhadap anak yang terlibat terorisme di BRSAMPK Handayani dan SLBe Handayani di Bambu Apus, Jakarta Timur dengan melakukan observasi dan wawancara mendalam. Studi ini menemukan bahwa BRSAMPK Handayani menangani anak yang terlibat aksi terorisme dengan melakukan rehabilitasi dan deradikalisasi, sedangkan SLBe Handayani memberikan akses pendidikan dan deradikalisasi yang disisipkan di dalam mata pelajaran. Penanganan terhadap anak yang terlibat dalam aksi terorisme ini dilakukan dengan pendekatan integratif yang dilakukan secara bersama-sama antara BRSAMPK Handayani dan SLBe Handayani dalam satu atap layanan pendidikan khusus dan program rehabilitasi dan deradikalisasi. Muatan materi utama dalam melakukan deradikalisasi adalah rehabilitasi psikologis, wawasan keagamaan moderat, wawasan kebangsaan, dan ketrampilan sosial yang diberikan secara kolaboratif oleh Badan Nasional Penanggulangan Terorisme (BNPT), Kementerian Agama, Kementerian Sosial, dan perguruan tinggi.

Abstract

Since the beginning of independence, Pancasila as the state ideology has been becoming a debate along with the increasing Islamic political awareness among Muslims. This study aims to analyze the debate among college students, lecturers and directors of the Islamic Religious Colleges (STAIs) about Pancasila as the state ideology. It used a quantitative research method with a total sample of 222 students at semester 5 disproportionately allocated to each selected college. The sampling in this survey was conducted by means of Stratified Multistage Sampling with the confidence level of 95%. This research was also strengthened by qualitative data that were extracted by interviewing the directors and lecturers of Islamic Religious Colleges (STAI) in Semarang, Denpasar, Jambi, Kupang and Banjarbaru. From this research, it can be concluded that the college students, lecturers and directors of STAIN have supported Pancasila as the state ideology that is not contradicting to Islam and will defend Pancasila as the state ideology. They also do not expect Pancasila to be replaced with Islam. This tendency then has shown the face of inclusive and moderate Islamic politics among college students, lecturers and directors of STAI. Keyword: Islamic Politics, Pancasila, Academic Communities.

Abstract

Radicalism of Islamic politics in Indonesia has been characterized with violence. In the context of DI/TII (Darul Islam/Indonesia Islamic Army), Islamic politics refers to the rebel movements against the Indonesian government in view of both political disappointment and radical religious understanding. This study aims to analyze the adaptation of DI/TII in Islamic education in Olan Hamlet, Garut as the basis of the DI/TII movement. It used a qualitative method based upon primary data obtained from interviews with the Head of Islamic Boarding School Nurul Falah in Olan Hamlet, Garut, community figures, religious figures nearby and government. This study found that the radical Islamic political movement of DI/TII did not undergo any metamorphosis to the Islamic education movements through the Madrasah and Islamic boarding school of Nurul Falah in Olan Hamlet, Garut. In fact, the Islamic boarding school and Madrasah have had some efforts to campaign for moderate religious understanding through the programs and curricula. Hence, there are no worries of government about the emergence of the radical movements in Olan Hamlet. The religious figures, however, still suspect the metamorphosis of DI/TII in this hamlet. Keyword: Radicalism, DI/TII, Islamic Politics

Abstract

Human rights are still a serious debate among Muslims, even though the Medina Charter and the Cairo Declaration have established the universality of human rights. This study describes the contents of human rights in the Medina Charter and the Cairo Declaration and analyzes them from the perspective of siyasah syar'iyyah. Using a qualitative approach derived from secondary data, this study finds that the Medina Charter and the Cairo Declaration are relevant to the principle of human rights. The determination of human rights in the Medina Charter and the Cairo Declaration corresponds to the two categories of siyasah syar'iyyah, namely siyasah tasyri'iyyah and siyasah dawliyyah. In siyasah tasyri'iyyah, human rights values are formed by state bodies that provide legal certainty. In siyasah dawliyyah, human rights values are determined by Muslim countries as a response to international human rights initiated by Western countries. Keywords: human rights, Medina Charter, Cairo Declaration, siyasah syar’iyyah  Abstrak Hak Asasi Manusia (HAM) hingga kini masih menjadi perdebatan serius di kalangan umat Islam, meskipun Piagam Madinah dan Deklarasi Kairo telah menetapkan universalitas HAM. Studi ini mendeskripsikan muatan HAM dalam Piagam Madinah dan Deklarasi Kairo dan menganalisisnya dengan perspektif siyasah syar’iyyah. Dengan pendekatan kualitatif yang bersumber dari data-data sekunder, studi ini menemukan bahwa Piagam Madinah dan Deklarasi Kairo relevan dengan prinsip HAM. Penetapan HAM dalam Piagam Madinah dan Deklarasi Kairo ini sejaan dengan kategori dua siyasah syar’iyyah, yaitu siyasah tasyri’iyyah dan siyasah dawliyyah. Secara siyasah tasyri’iyyah, nilai-nilai HAM dibentuk oleh badan negara yang memberikan kepastian hukum. Secara siyasah dawliyyah, nilai-nilai HAM ditetapkan oleh negara-negara Muslim sebagai respon atas HAM internasional yang diinisiasi negara-negara Barat. Kata Kunci: Hak asasi manusia, Piagam Madinah, Deklarasi Kairo, siyasah syar’iyyah

Abstract

A question arises in the implementation of Sharia in Aceh: Is Sharia compatible with democracy as a political system in Indonesia? And with a comprehensive Sharia implementation, will it threaten the existence of the Indonesian state? This paper discussed Sharia's expansion, potentially leading to the establishment of the Islamic state of Aceh. This study was conducted using qualitative research. Primary data were taken from interviews with academics, journalists, non-governmental organization activists, youths, and focused group discussions with the leaders of the Islamic Sharia Office in Aceh Province. Meanwhile, the secondary data were gathered from historical documents, legislation, and Qanun in Aceh. The collected data were analyzed using the legal history theory of Pound (1923) and the Islamic democratic state theory of Hayes (2014). This research found the gradual implementation of Sharia in Aceh within the Indonesian democratic system. These constitutional ways were chosen to avoid the conflict between the Sharia and national legal and political systems. This, then, has led to the legalization of Sharia in the local and national political contestation. In the next phase, with the increasingly widespread Sharia rules and regulations on worship, criminal law, and economic law, Aceh can be called a small prototype of an Islamic state. With the significant historical, political, and social power, the roadmap of Sharia implementation in Aceh indicates a clear direction for the reflection of God's sovereignty as the foundation of the Islamic democratic state, even if it is in the local context.

Abstract

Currently, the scope and regulation of the criminal law system which only recognizes written law is deemed unable to accommodate the various legal needs of indigenous peoples who are still alive today. This is due to the principle of legality of criminal acts which is oriented towards individual-liberalism, not the plurality of society. Therefore, recognizing acts that violate customary law within the framework of the national legal system is considered appropriate in meeting the legal plurality needs of indigenous communities. The rigidity and arrogance of the current legalistic view of criminal law is no longer able to respond to plurality and a sense of justice, especially for customary law communities, because the reality of indigenous people's lives shows that there are countless customary law provisions outside of the law, which continue to live and are obeyed in every vein. community group members. The research method used in this study is a normative legal research method with a socio legal research approach. The socio-legal approach is intended as an approach in legal research that is focused on studying legal phenomena from the perspective of social sciences. The research results state that the position of traditional justice institutions is actually in a state of existence and absence, on the one hand it is not recognized by the Indonesian positive legal system but there are practices of these traditional justice institutions. However, cases decided based on customary law can still be found in a very limited number of cases.

Abstract

The relationship of power and resistance against it has been widely discussed as an intellectual discursive debates. However, resistance groups against the theological authority is off the debate. This paper analyses the resistance movement of Salawah Wahidiyah (SW) in the face of the erroneous fatwa by the Assembly of Indonesia Ulema (MUI). With the analysis of power relationships, knowledge, and resistance, this paper finds that SW is fighting against the misguided fatwa of Tasikmalaya MUI which is carried out as the majority of theological hegemony to defend the doctrine and amaliyah as well as to reject the deviating claim. This is all done to maintain the freedom to believe and practice the teachings of an inside democracy which guarantees and protects the right of religious freedom. Ironically, the resistance of SW in Tasikmalaya was not able to replicate the success of the Centre SW in conducting resistance against NU figures. SW Tasikmalaya failed to reconcile the differences of religious views with MUI. As a result, the motion of SW became limited because it is still stigmatized as deviant.

Abstract

Along with the widespread application of Islamic law, the Government of Aceh implemented an exclusive zone for the application of sharia economics. The issuance of Qanun No. 11/2018 concerning Islamic Financial Institutions emphasizes the exclusivity of the Islamic economy in Aceh. This paper aims to discuss the implementation of the Qanun of Islamic Financial Institutions from a public policy perspective. Data was collected through interviews with the heads of the Islamic Sharia Office, academics, non government activist, and stakeholders of Islamic financial institutions in Aceh. The data is then analyzed using an interpretive policy analysis approach. The results of the study found that the sharia economic exclusivity in Aceh was a public policy that began with the appearance of inputs in society in the form of demands and support that entered the political system. This is based on the fading of sharia values in the practice of the people of Aceh, giving rise to demands to restore Islamic identity within the local government framework. Through the conversion process, this demand produces output in the form of an exclusive public policy in implementing Islamic finance in Aceh. This policy has implications for people's difficulties in accessing inclusive finance, which can have an impact on the welfare of the people of Aceh.
