Abstract

Abstrak          Penelitian ini mengeksplorasi dan mengkaji secara kritis politik hukum RUU tentang perubahan UU No. 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa dengan menelaah naskah akademik RUU dan membandingkannya dengan kondisi normatif dan praktik penyelesaian sengketa melalui arbitrase di Indonesia guna memberikan kontribusi terhadap RUU tersebut dalam mengatasi problematika aktual. Penelitian ini menggunakan pendekatan yuridis normatif dan analisis kualitatif terhadap berbagai literatur mutakhir dari bahan hukum primer, sekunder dan tersier. Hasil penelitian ini menunjukan politik hukum dalam RUU perubahan UU No. 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa merupakan peluang strategis untuk memperbaiki sistem arbitrase Indonesia, namun harus dilakukan secara cermat dengan mengakomodir berbagai aspek seperti keadilan, kepastian hukum, konflik norma, arbitrase syariah, arbitrase internasional, dan penyelarasan dengan disrupsi teknologi (e-arbitration). Kata kunci: Politik Hukum, Arbitrase, Naskah Akademik RUU Arbitrase dan APS   Abstract This research explores and critically examines the legal policy of the draft bill on amendments to Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution by reviewing the academic text of the draft bill and comparing it with the normative conditions and practices of dispute resolution through arbitration in Indonesia in order to contribute to the draft bill in addressing current issues. This research uses a normative juridical approach and qualitative analysis of various recent literature from primary, secondary, and tertiary legal sources. The results of this study indicate that the legal policy in the draft amendment to Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution is a strategic opportunity to improve the Indonesian arbitration system. but it must be done carefully by accommodating various aspects such as fairness, legal certainty, conflict of norms, sharia arbitration, international arbitration, and alignment with technological disruption (e-arbitration). Abstract

This study aims to examine the problem of personal data leakage in Indonesia, with a focus on the factors causing the leakage, its impact on citizens' privacy rights, and legal protection measures taken by authorized institutions and electronic system organizers (ESE) within the framework of the Indonesian rule of law.This study uses a qualitative descriptive-analytical approach, combining empirical data from field interviews with legal analysis. Key stakeholders from government institutions responsible for the management and protection of personal data were interviewed, and existing regulations, such as the Personal Data Protection Law and Permendagri No. 17/2020, were analyzed to understand the effectiveness of existing legal protection. Research findings show that data breaches in Indonesia are caused by inadequate data security infrastructure, limited expertise at the local level, and inconsistent implementation of national regulations. Although regulatory frameworks such as ISO 27001 certification are in place, a lack of resources and training in local governments hampers effective data protection. Coordination between central and local governments is essential, but faces challenges in ensuring uniform data management practices and protecting personal data from external threats.

Abstract

Contract of Work is a legal instrument that plays an important role in natural resource management and investment in Indonesia. However, in practice, manyContracts of Work have been revoked by court decisions, giving rise to serious issues related to legal certainty and investor protection. This studyaims to analyze the legal considerations of judges in court decisions that cancel Work Contracts and their implications for the investment climate in Indonesia. The research method used is normative legal research with a legislative approach, a conceptual approach, and a case approach, by examining court decisions that have the force of law. The results of the study show that the annulment of Contracts of Work by the court is generally based on violations of the principles of agreement, inconsistency with the provisions of laws and regulations, as well as changes in legal policy in the field of mining and investment. These rulings have an impact on reducing legal certainty for investors, particularly in relation to contract stability and legal protection guarantees. Therefore, there is a need for regulatory harmonization, consistency in court rulings, and strengthening of the pacta sunt servanda principle in order to create a fair, sustainable, and legal certainty-oriented investment climate in Indonesia.ABSTRAKKontrak Karya merupakan instrumen hukum yang berperan penting dalam pengelolaan sumber daya alam dan penanaman modal di Indonesia. Namun, dalam praktiknya, tidak sedikit Kontrak Karya yang dibatalkan melalui putusan pengadilan, sehingga menimbulkan persoalan serius terkait kepastian hukum dan perlindungan investor. Penelitian ini bertujuan untuk menganalisis secara yuridis pertimbangan hakim dalam putusan pengadilan yang membatalkan Kontrak Karya serta implikasinya terhadap iklim investasi di Indonesia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus, dengan menelaah putusan pengadilan yang telah berkekuatan hukum tetap. Hasil penelitian menunjukkan bahwa pembatalan Kontrak Karya oleh pengadilan pada umumnya didasarkan pada adanya pelanggaran asas-asas perjanjian, ketidaksesuaian dengan ketentuan peraturan perundang-undangan, serta perubahan kebijakan hukum di bidang pertambangan dan investasi. Putusan tersebut berdampak pada menurunnya kepastian hukum bagi investor, khususnya terkait stabilitas kontrak dan jaminan perlindungan hukum. Oleh karena itu, diperlukan harmonisasi regulasi, konsistensi putusan pengadilan, serta penguatan asas pacta sunt servanda guna menciptakan iklim investasi yang adil, berkelanjutan, dan berorientasi pada kepastian hukum di Indonesia.
