Abstract

The movement of people across countries has both positive and negative impacts on society. Globalization has changed the way humans move massively and quickly. Indonesia, as a country with a strategic geographical position between two continents and two oceans, plays a role as a center of human crossing. Indonesia's vast sea area is an important potential to be developed, and President Joko Widodo initiated the World Maritime Axis policy to drive the economy in the sea area. Government agencies in the sea area are part of the ecosystem that supports policies in the sea area. Policies related to law enforcement in the sea area continue to develop along with the expansion of activities at the border. Immigration has a strategic role because it regulates traffic at the state border, maintains state sovereignty, and supports the implementation of sea area policies. This research aims to evaluate the strategic role of immigration by applying a progressive legal theory approach and using normative legal research methods. Progressive law returns the law to its substantial purpose, so that legal changes should not eliminate the substance. This research aims to answer the challenges of the times by adapting the law in accordance with the purpose of the law. In the context of international law of the sea (UNCLOS 1982), this research looks at the strategic role of immigration in law enforcement in the sea area, including the territorial sea zone and additional sea zone. The cooperation of law enforcement agencies in the maritime area is key to maintaining state sovereignty and security at the border. This research contributes to the understanding of the strategic role of immigration in supporting Indonesia's territorial sea policy.

Abstract

Child trafficking cases are one of the fastest-growing crimes in the world. Lack of education and limited information make them vulnerable to being trapped in human trafficking. In the Indonesian legal framework, human trafficking is regulated in Law Number 21 of 2007 concerning the Eradication of Human Trafficking and Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection which regulates the right to restitution. However, there are still weaknesses in law enforcement, namely for any criminal offense that restitution can be submitted, so law enforcement does not necessarily facilitate victims in applying for the right to restitution. The research method used in this study is a normative juridical research method. This approach involves problem analysis using primary reference materials which include statutory regulations as the main source (primary legal materials), as well as various secondary sources of legal materials, such as legal literature, legal books, scientific publications, and scientific articles. discusses the regulation and implementation of criminal sanctions against child traffickers and their rights to restitution to find appropriate and accurate answers. Based on the research results, law enforcement efforts regarding the crime of child trafficking and the right to restitution can be carried out in three stages, namely: during the crime, during the trial of the perpetrator of human trafficking, and after the verdict.

Abstract

The rapid growth of influencer marketing has revolutionized the way brands connect with their target audiences. However, this novel marketing strategy has also brought forth new legal challenges, particularly in consumer trust and intellectual property rights (IPRs). This study aims to bridge the gap in the current understanding of the interplay between consumer trust and IPR risks in the context of influencer marketing. Through a normative legal research method with a statutory approach, this study seeks to comprehensively examine the wider implications of influencer marketing. The research aims to contribute to developing a more robust legal framework that can effectively address the unique challenges posed by influencer marketing while fostering consumer trust and protecting intellectual property rights. The findings reveal inadequacies in the existing Indonesian legal frameworks, particularly the Consumer Protection Law, Copyright Law, and Trademark and GI Law, in addressing the unique challenges of influencer marketing. The study proposes targeted amendments to these laws, including mandatory disclosure requirements, clear guidelines on fair use and trademark usage, and stronger enforcement mechanisms to mitigate consumer trust and IPR risks.

Abstract

Abstract

Abstract The digital economy era has driven the use of technology that relies on data utilization to support various economic activities, such as the use of data analytics. The use of data analytics to provide more relevant features and ads to users of various online platforms has legal implications that must be supported by a legal framework for personal data protection in Indonesia. This study is done to analyze the gap in the development of legal framework in Indonesia in regards to the use of data analytics. Using normative legal research, this study explains the legal implications and outlines the legal issues related to the use of data analytics and the risks faced by online platform users as data owners. The analysis using the statutory approach in this research found that there are several legal issues and normative limitations that make it difficult to implement the concept of transparency and consent in efforts to protect personal data of online platform users, which is the main target of the use of data analytics. The findings of this study also indicate that the use of more complex technical terms is not found in regulations governing the protection of personal data, and hinders further normative exploration related to the use of data analytics that distinguish the types of data used into more complex terms and classifications.

Abstract

This study aims to analyze the comparison of legal regulations on post-mining ecosystem management in Riau Islands and Jambi, with a focus on SDGs 15, which addresses the preservation of terrestrial ecosystems. The research questions explore how the legal framework for post-mining management is regulated in Indonesia and how it compares between the two provinces. The findings show that Riau Islands does not have a regional regulation that specifically governs post-mining management, while Jambi has a regional regulation addressing this issue. The research adopts a juridical-normative approach, analyzing applicable regulations at both the national and regional levels related to sustainable post-mining ecosystem management. The data sources include primary legal materials such as the Omnibus Law, the Mineral and Coal Law, the Environmental Protection and Management Law, the Post-Mining Reclamation Government Regulation, and other relevant regulations. Secondary data, including books, journals, and related studies, were also utilized. Data collection was carried out through library research, with data analysis using a juridical-qualitative method. The results of this study are expected to provide recommendations for improving post-mining ecosystem management regulations that support the preservation of sustainable terrestrial ecosystems in line with SDGs 15, particularly for provinces like Riau Islands, which lack specific regional regulations.
