Abstract

Assault crimes are violent by nature and are often perceived as a serious threat to public safety. However, the complexity of each crime needs to be analyzed thoroughly in a legal procedure to make sure that important values and principles are applied. This is particularly important among juvenile offenders, where the enforcement of justice needs to be upheld without sacrificing the future of youth. This research is done to analyze the challenges in ensuring procedural rights for juvenile assault offenders in Indonesia. Through the normative legal research method combined with a statutory approach, this research uncovers the legal challenges that juveniles face in accessing their procedural rights in Indonesia’s juvenile justice system and how these challenges can be improved. Analysis of this research finds that the Indonesian legal framework is still lacking in many ways, particularly in ensuring the right to ease of access to information regarding the case and the protection of privacy. The analysisThe analysis also shows that these issues cause conflicts with other laws, constitutional principles, and international standards. This research not only highlights the gaps in Indonesia’s juvenile justice system but also lays a theoretical foundation for developing a more holistic and rights-based approach to juvenile justice reform.

Abstract

AbstracktThis study analyzes the limitations of diversion in the Indonesian Juvenile Criminal Justice System, specifically the requirements for implementing diversion, namely a sentence of less than 7 years and not repeat offenses. This study applies normative juridical research methods through a statutory and comparative legal approach. The study compares the application of restorative justice approaches in the Philippines through the Republic Act No. 10630 of 2013 and in New Zealand through the Oranga Tamariki Act 1989. The findings reveal that Indonesia's diversion policy remains limited by sentencing threats and repeat offenses, forcing children to undergo formal judicial proceedings. This condition contradicts the principle of child protection, which prioritizes rehabilitation and social reintegration. As a recommendation, this study proposes reconstructing Indonesia's diversion policy by referring to the experiences of the Philippines and New Zealand to establish a more inclusive, humane, and restorative-based juvenile justice system.  Keywords: Diversion, Restorative Justice, Reconstruction.

Abstract

Public procurement corruption is one of the most prevalent forms of corruption, with one of the most dangerous and potentially catastrophic impacts on public interests. Despite the continuous efforts to battle corrupt in Indonesia, Malaysia, and Thailand, the three countries are still haunted by the possibility of public procurement corruption, which can significantly stunt their economic growth and overall prosperity. Employing the normative legal research method, this study aims to assess the legal implications of corruption in public procurement and make a case for the acknowledgement of aggravating factors in the relevant criminalization. For this objective, this study analyzes elements of mens rea and causal nexus in the countries’ relevant anti-corruption frameworks. Analysis conclusively reveals that the three countries are not equipped to tie mens rea and causal nexus due to the lack of distinction between them in the relevant frameworks. The study therefore recommends possible amendment by adding a provision that would enable a dual-layered culpability approach, tying mens rea and the actual evidence of corrupt act to the knowledge of possible harm that the perpetrators have, to potentially build a case for a stronger punishment, or provide better normative foundation for future legal developments with the explicit acknowledgement of the broader harms caused by public procurement corruption. The significance of this study lies in its effort to increase the awareness on corruption, particularly by assessing the impacts of public procurement corruption and the mental state behind it, to ultimately make the legal case for harsher punishments against this enduring crime that has stunted growth in Indonesia, Malaysia, and Thailand

Abstract

Akta Notaris mempunyai peranan penting dalam setiap hubungan hukum dalam kehidupan masyarakat, terutama dalam hubungan bisnis, kegiatan di bidang perbankan, pertanahan, kegiatan sosial, dan sebagainya. Kewenangan pembuatan akta tersebut juga tidak terlepas dari fungsi notaris yang harus disesuaikan dengan Undang- Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris sebagaimana telah diubah dengan Undang-Undang Nomor 2 Tahun 2014. Sehingga, untuk mendukung akuntabilitas dan pengawasan terhadap kinerja Notaris yang ada di seluruh Indonesia, pemerintah telah menetapkan adanya Majelis Pengawas Daerah Notaris yang berada di setiap Kabupaten/Kota. Akan tetapi, meskipun telah terbentuk namun pelaksanaan fungsi pembinaan dan pengawasan yang dilakukan tidak selalu berjalan dengan baik, salah satu contoh adalah Majelis Pengawas Daerah (MPD) Notaris Kota Batam yang masih menghadapi berbagai kendala. Penelitian ini menggunakan metode yuridis empiris dengan jenis data primer dan data sekunder. Analisis data dilakukan secara kualitatif yang selanjutnya dilakukan pembahasan menggunakan Teori Hukum Pembangunan oleh Mochtar Kusumaatmadja dan Teori Perlindungan Hukum oleh Phillipus M Hadjon. Dari hasil penelitian yang penelitian lakukan terdapat beberapa kesimpulan, diantaranya Peran MPD Notaris Kota Batam belum dilaksanakan sesuai dengan UU No.30 Tahun 2004 dan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 25 Tahun 2014. Adapun yang menjadi kendalanya antara lain, belum adanya kesesuaian waktu antar anggota MPD dalam melaksanakan pengawasan dan pemeriksaan rutin, minimnya anggaran serta fasilitas, dan lain-lain. Solusi yang dapat diberikan antara lain anggota MPD perlu menetapkan penjadwalan ulang untuk melaksanakan pemeriksaan rutin serta perlu adanya fasilitas e-government.

Abstract

The exploitation of voice identity by artificial intelligence development and user companies through voice cloning technology has caused tangible economic losses. The fundamental issue lies within the positive legal systems in Indonesia and Thailand, which experience qualification barriers. Civil instruments such as torts become paralyzed because cyber law, intellectual property, and data protection regimes fail to classify voice as a commercial property right object. Therefore, this research aims to comparatively analyze these civil law qualification barriers using the United States and the European Union as benchmarks, while simultaneously formulating a prescriptive transplantation of the right of publicity doctrine. This normative legal research utilizes the statute approach, comparative approach, and conceptual approach to comprehensively dissect domestic instruments and foreign case law. The results of the comparative analysis affirm the United States’ supremacy in recognising voice as a property right. This protection standard is refined by an ethical restriction layer in the form of an absolute prohibition as a default prohibition from the European Union. Overcoming domestic paralysis requires reconceptualizing property boundaries within the Civil Code. Recognizing voice as an intangible property will directly activate the tort lawsuit instrument. This activation aims to demand the disgorgement of profits from entities that develop artificial intelligence without authorisation and train algorithms without authorisation. This lawsuit also applies to commercial user entities conducting advertising through voice cloning. This research concludes that the adoption of the right of publicity requires the formulation of specific regulations (lex specialis) to protect personality rights. These regulations must explicitly separate corporate liability and adopt a layered consent standard. These rules must also contain a fair use exception to maintain a balance between economic property protection and freedom of expression in society.

Abstract

The development of digital technology has given rise to a new form of violence in the form of digital sexual violence, including deepfake pornoghraphy which has not been fully accommodated in the Indonesian legal system. This study aims to compare legal protection for victims of digital sexual violence in Indonesia and South Korea and to formulate strategies for strengthening regulations in Indonesia. The method used normative legal research, with a legislative, conceptual, case, and comparative approach, analyzing regulations and legal practices in both countries. The results show that Indonesia already has a legal basis through the TPKS Law, the ITE Law, and the Criminal Code, but does not yet specifically regulate forms of AI-Based DBV such as deepfake pornography. Implementation challenges include digital evidence, inter-agency coordination, and mechanisms for content removal. In contrast, South Korea has more responsive regulations, supported by specialized agencies focused on victim protection and recovery. The novelty of this research lies in its comparative analysis that focuses on institutional strengthening and technical mechanisms for handling digital sexual violence as concrete recommendations for legal reform in Indonesia.
