Abstract

To date, Indonesia is still grappling with waste management issues, which is a significant obstacle to realizing Sustainable Development Goals (SDG) 11. One of the ways to deal with this issue is through the development of the waste-to-energy (WtE) system, which can be utilized to transform waste into precious energy resources. However, this system must also be supported with robust legal compliance to ensure that its development is not solely focused on generating profits through energy production but also meets its noble purpose of improving sustainability as conceptualized within SDG 11. This study utilizes the normative legal research method, along with a statutory approach. Analysis of this study finds that the current Indonesian legal framework is insufficient in providing a robust mechanism of compliance to ensure that the waste-to-energy system can contribute to the broader waste-management issues and their ramifications, specifically due to the lack of recognition of the unique intricacies of the development of WtE systems, along with the lack of normative implementation of SDG 11. The paper proposes a model of normative construction to cover these issues as a way of ensuring growth and environmental sustainability in Indonesia, particularly regarding waste management.

Abstract

Penelitian ini mengkaji permasalahan yang terkait dengan pengaturan paten di Indonesia, khususnya dalam konteks kepentingan publik atas aksesibilitas produk kesehatan. Penelitian ini bertujuan untuk mengevaluasi ketidakseimbangan antara perlindungan hak kekayaan intelektual dan kepentingan publik dalam sistem paten di Indonesia, dengan fokus pada sektor kesehatan. Metode penelitian yang digunakan adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan, terutama Undang-Undang Nomor 13 Tahun 2016 tentang Paten dan Code de la Propriété Intellectuelle (CPI). Penelitian ini juga membandingkan mekanisme pengaturan paten di Indonesia dengan sistem hukum di Prancis untuk mengidentifikasi upaya preventif dalam menjaga keseimbangan antara hak eksklusif pemegang paten dan akses masyarakat terhadap produk kesehatan. Hasil penelitian menunjukkan bahwa monopoli paten sering kali menyebabkan kenaikan harga produk kesehatan, yang berakibat pada terbatasnya akses masyarakat, khususnya kelompok berpenghasilan rendah, terhadap layanan kesehatan. Salah satu mekanisme yang diidentifikasi untuk mengatasi hal ini adalah penerapan lisensi wajib, yang memungkinkan produksi obat generik dalam situasi darurat kesehatan. Kesimpulannya, penerapan lisensi wajib sebagai langkah preventif harus dilaksanakan dengan hati-hati untuk menjaga insentif inovasi sekaligus memastikan akses kesehatan yang lebih luas bagi masyarakat. Implikasi penelitian ini menunjukkan perlunya kebijakan yang seimbang antara perlindungan hak kekayaan intelektual dan kepentingan publik, serta harmonisasi antara pengaturan paten nasional dengan standar internasional yang diatur dalam TRIPs Agreement.

Abstract

Syndicated credit refers to the provision of credit extended by more than one rural bank (BPR) for a single debtor loan. In Batam City, this type of credit is commonly practiced by BPRs to meet the needs of debtors requiring large loans. In this mechanism, one bank acts as the lead bank, serving as the principal institution leading the syndicated credit provision. This study provides an overview of the implementation of dispute resolution in syndicated credit in the event of default by the debtor, as well as the legal protection afforded to the lead bank during the dispute resolution process. The findings indicate that the resolution of syndicated credit disputes resulting from debtor defaults is effectively conducted through negotiation. The lead bank plays an active role in openly assisting the debtor to find the best solution to fulfill their obligations. Moreover, the lead bank is granted legal protection in resolving syndicated credit disputes, as stipulated in the syndicated credit agreement signed before the credit is extended to the debtor. This legal protection is highly effective in addressing default disputes, thereby safeguarding the lead bank from potential losses

Abstract

Pandemi COVID-19 mendorong pertumbuhan financial technology (fintech) yang memperluas akses keuangan, namun juga memunculkan tantangan baru dalam perlindungan konsumen, terutama terkait keamanan data pribadi dan rendahnya literasi keuangan. Indonesia memerlukan penguatan regulasi dan mekanisme pengawasan untuk memastikan transparansi, keamanan, dan keadilan dalam pemanfaatan fintech. Penelitian ini bertujuan untuk menelaah sejauh mana perlindungan konsumen pada sektor fintech di Indonesia efektif diterapkan, dengan mengandalkan pendekatan normatif yang mencakup analisis regulasi dan prinsip hukum yang relevan. Hasil penelitian menunjukkan bahwa meskipun Indonesia telah memiliki kerangka regulasi yang cukup, kelemahan terletak pada lemahnya pengawasan dan penegakan hukum terhadap entitas fintech ilegal. Oleh karena itu, penerapan teknologi seperti Regulatory Technology dan Supervisory Technology sangat potensial dalam meningkatkan efisiensi pengawasan serta menjamin perlindungan konsumen secara berkelanjutan. Harmonisasi regulasi nasional dengan standar internasional seperti GDPR memperluas cakupan perlindungan konsumen dalam ruang digital lintas batas. Upaya ini semakin relevan di tengah integrasi ekonomi digital global dan meningkatnya risiko pelanggaran data

Abstract

Protection of personal data is a human right that must be given legal protection. However, Indonesia does not yet have special rules governing the protection of personal data and the Personal Data Protection Supervisory Agency. As for when compared to Germany, which has special rules regarding the protection of personal data in full to the Institution that oversees the implementation of the rules for protecting Personal Data. The research method used by the author is a legal comparison method with the type of research being normative research. The author uses secondary data to analyze the results of the data, namely, primary materials, secondary materials, and tertiary materials. The analytical method used by the author is a qualitative method. Similarities and differences in personal data protection between Indonesia-Germany and the legal contributions of personal data protection that he can adopt or apply in Indonesia such as special arrangements for personal data protection, data classification, one of which is the deletion of personal data, and the establishment of a Personal Data Protection Supervisory Agency and the rules that govern it

Abstract

The emergence of regulations regarding personal data in 2022 is eagerly awaited and anticipated by consumers who feel aggrieved by online service managers, especially in the field of online-based loan financial services. The rules that specifically regulate the protection of personal data are Law no. 27 of 2022 concerning Personal Data Protection, prior to the existence of special regulations regarding personal data, the ITE Law and other similar legal regulations were used as a reference for consumer protection. Law Number 27 of 2022 concerning Personal Data Protection was formed so that it does not overlap with other regulations that guarantee the protection of personal data in the community. In addition to these regulations, there are still several regulations governing this matter, namely Law Number 11 of 2016 on amendments to Law Number 11 of 2008 concerning ITE, provisions of the Financial Services Authority (OJK) Number 1/POJK.07/2013 concerning Consumer Protection and OJK Provisions Number 77/POJK.01/2016 concerning Online-Based Loan Services. The research method used to write this article is a normative research method which is defined as research that has basic material from data in similar journals, articles, theses, theses, and so on. Consumers who are harmed can act legally with two choices, namely arbitration and litigation channels, if arbitration has been carried out then there is no agreement between the two parties for peace then they can pursue litigation channels by reporting this matter to the local police or can file lawsuits against the law to local District Court.

Abstract

Non-Fungible Tokens (NFTs) serve as a digital platform that aids creators of digital works, particularly E-Books, in marketing or introducing their creative outputs. This platform offers easy access and high-security systems to safeguard the copyright of E-Book creators. This study aims to analyze and provide insights into the copyright protection of E-Book works in the form of NFTs, under the perspective of Copyright Law. Additionally, the study seeks to determine whether NFT transactions can serve as a solution for Intellectual Property protection in Indonesia. The research employs a normative legal research method, utilizing literature review and descriptive techniques. The findings reveal that NFTs can indeed offer a solution for intellectual property protection in Indonesia. By transforming works into NFTs, their copyright is protected through ownership tokens that are automatically integrated into the blockchain (digital ledger).

Abstract

Youth development has always been an important aspect in the fight against drug abuse, which includes the effort in dealing with underage drug abusers to help them reflect and get back to society. Using normative legal research method, this research dives deep into the challenges facing underage drug abusers on their way back to society and how these challenges impact their future involvement with drugs and their ability to function normally. Through statutory approach, this research finds the possible normative construction to provide a concrete framework of restorative justice. With the restorative justice approach, societal challenges facing underage drug abusers such discriminations, prejudice, and labelling can be met with solutions that provide implementation during the process of rehabilitation and after it.

Abstract

The rapid advancement of technology has transformed various aspects of life, particularly in the economic sector, with the emergence of Financial Technology (Fintech) lending providing access to funding for individuals without access to conventional financial services. However, the rise of illegal fintech lending platforms has created significant legal and social issues, including lack of transparency, misuse of personal data, and unethical collection practices. This community engagement initiative, conducted in Pulau Mubut Laut, Kelurahan Karas, Kecamatan Galang, Kota Batam, aimed to enhance public awareness regarding fintech legality, risks associated with illegal platforms, and available legal protections. Through legal education and consultations over two months, the program revealed participants’ limited understanding of digital finance, often leading to risky financial decisions. The initiative successfully improved participants' awareness of fintech risks and regulations, fostering wiser decision-making. Recommendations include intensifying fintech education in remote areas and strengthening legal frameworks to combat illegal fintech operations. Abstrak: Kemajuan teknologi yang pesat telah mengubah berbagai aspek kehidupan, terutama di sektor ekonomi, dengan hadirnya Financial Technology (Fintech) lending yang menyediakan akses pendanaan bagi individu yang tidak memiliki akses ke layanan keuangan konvensional. Namun, munculnya platform fintech lending ilegal telah menimbulkan masalah hukum dan sosial yang signifikan, termasuk kurangnya transparansi, penyalahgunaan data pribadi, dan praktik penagihan yang tidak etis. Pengabdian kepada masyarakat, yang dilakukan di Pulau Mubut Laut, Kelurahan Karas, Kecamatan Galang, Kota Batam, bertujuan untuk meningkatkan kesadaran masyarakat tentang legalitas fintech, risiko yang terkait dengan platform ilegal, serta perlindungan hukum yang tersedia. Melalui penyuluhan hukum dan konsultasi selama dua bulan, program ini mengungkapkan rendahnya pemahaman peserta terhadap keuangan digital, yang sering kali menyebabkan keputusan keuangan yang berisiko. Program ini berhasil meningkatkan kesadaran peserta tentang risiko dan regulasi fintech, sehingga mendorong pengambilan keputusan yang lebih bijak. Rekomendasi mencakup intensifikasi edukasi fintech di daerah terpencil dan penguatan kerangka hukum untuk memberantas operasi fintech ilegal.

Abstract

The proliferation of digital technology has challenged the traditional understanding of identity and subsequently brings forth its own unique legal implications. Identity theft as a crime that has existed even before this development has also brought its own unique legal implications, particularly in the realm of criminal law. Using normative legal research method, this research aims to establish the boundaries around digital identity theft, to distinguish it from the traditional identity theft, to provide a more relevant and robust understanding of its criminality within the digital age. Results of this study highlight the gaps in Indonesia's current legal framework, emphasizing the need for a revised approach that distinctly addresses the complexities of digital identity theft. The research proposes a model of normative development aimed at refining legal definitions and enhancing enforcement mechanisms to better combat this modern crime. This model seeks to provide a more relevant and robust legal framework, ensuring that the legal system is responsive and adaptive to the challenges posed by digital advancements.
