Abstract

Corporate Social Responsibility (CSR) is a corporate commitment to contribute to sustainable economic development by focusing on the balance between attention to economic, social, and environmental aspects. This paper argues that corporations are subject to criminal law, which can be subject to criminal liability if they do not carry out CSR obligations. This study aims to find out the linkage of sanctions arrangements and the urgency of regulations on criminal liability if the corporation does not carry out CSR obligations. In practice, CSR is only based on corporate awareness and commitment. In the meantime, CSR enforcement's most basic weakness is the absence of strict sanctions for corporations that deny CSR, especially in terms of criminal sanctions. Instead, the sanction is limited to administrative as set out in Act No. 25/2007 on Investment, with a lack of legislation governing criminal sanctions against CSR prevention. In so doing, there is a need to introduce sanctions against corporations that deny CSR, by taking into account adverse impacts to the environment and community. Abstract

Microfinance Institutions (MFIs) are part of non-bank financial institutions. In organizing, MFIs can be implemented with sharia principles, but not a few people who assume that this Sharia-based MFI is only a label to attract the sympathy of the Muslim community. Based on this, this study aims to determine the legal policies for the implementation of MFIs in Indonesia and to find out regulatory policies regarding sharia principles in the organization of MFIs as an effort to protect the spiritual rights of consumers. This study uses a normative juridical research method with a conceptual approach and a statutory approach. This study shows the legal basis for the organization of MFIs is Law Number 1 of 2013, POJK Number 14/POJK.05/2014, POJK Number 61/POJK.05/2015, and POJK Number 62/POJK.05/2015. The policy of regulating the application of sharia principles as an effort to protect the spiritual rights of consumers has also been regulated in the MFI Law and the implementing regulations namely POJK Number 62/POJK.05/2015 concerning Business Administration of MFIs which in the implementation of sharia-based MFIs must use mudharabah, musyarakah, murabahah, ijarah, salam, istishna, ijarah muntahiah bit tamlik or other contracts (akad) that do not conflict with sharia principles. The policy of applying sharia principles in organizing MFIs is intended to guarantee the protection of the spiritual rights of consumers from Islamic MFIs.

Abstract

The Industrial Revolution 4.0 provided advances in financial services such as financial technology (fintech) innovations. The fintech concept that adapts to technological developments is expected to facilitate a more practical, secure, and modern financial transaction process, including digital-based financial services that are currently developing around the world. The implementation of fintech in Indonesia is divided into conventional fintech and sharia fintech which provides choices for the public in accessing financial services. The problem comes from the Muslim community who still do not believe in the implementation of the Islamic financial industry especially sharia fintech. The existence of skepticism from the community is the basis of this research. This research uses normative legal research methods to describe and explaining efforts to implement sharia fintech in protecting the consumers, especially the protection of “spiritual rights”. This protection can be pursued through the spread of sharia principles in which sharia fintech financing services do not contain usury, uncertainty (ghoror), speculation (masyir), hiding damage (tadlis), harming other parties (dharar), and avoiding illegal matters (haram). Then the implementation of sharia fintech in protecting the customer's spiritual rights can also be pursued by applying financing arrangements that have been regulated by applicable regulations and by Fatwa DSN-MUI, such as contract/akad al-bai', akad ijarah, akad mudharabah, akad musyarakah, akad wakalah bi al ujrah, and akad qardh.

Abstract

Potensi anak dalam menyempurnakan tujuan dari Negara Indonesia yang tercantum dalam Pembukaan UUD 1945 yang memberikan kesempatan bagi seluruh rakyat termasuk kepada anak-anak sebagi potensi penerus cita-cita bangsa untuk mengembangkan kemampuan berinovasi dalam segi kekayaan intelektualnya. Hak kekayaan intelektual anak adalah hasil karya yang merupakan bentuk hasil pemikirannya.  Namun hasil karya dan buah pikiran tersebut kerap kali cenderung disalahgunakan oleh pihak-pihak tidak bertanggung jawab yang berdampak secara langsung kepada hak ekonomi dan hak moral dari pencipta. Maka diperlukan perlindungan terhadap anak pemilik kekayaan intelektual. Bentuk perlindungan anak secara umum yang dijamin negara terdapat dalam Undang-Undang No. 35 Tahun 2014 tentang Perlindungan Anak. Undang-undang tersebut juga mencakup perlindungan kepada anak penyandang difabel. Terkait anak yang memiliki kekayaan intelektual, bentuk perlindungannya berupa pendampingan oleh wali dalam mendaftarkan kekayaan intelektual anak. Anak yang merupakan subjek hukum yang belum cakap memiliki cara tersendiri untuk mendaftarkan ciptaannya, pendaftaran ini dapat diwakilkan oleh wali selaku orang tua maupun wali yang secara hukum telah diakui, namun jika terdapat syarat yang belum terpenuhi terhadap wali maka wajib bagi anak untuk mengajukan permohonan pengangkatan wali pada Pengadilan Negeri.

Abstract

Objective: This study aims to identify how progressive the legal protection for borrowers as a fintech lending service user is and how the business dispute resolution model for these services is applied in Indonesia.Methodology: This research utilized a normative juridical research method with legal and conceptual approaches. The data used in this research were secondary legal data analyzed using qualitative analysis techniques to draw the right conclusions.Findings: Fintech lending service is an alternative solution for the community to carry out the procedure of fund borrowing by accessing the sites and applications of lending companies without having to go through banking transactions and financing institutions. Although fintech lending contributes to various financial activities, this innovation encounters issues in protecting consumers as borrowers. The rise of personal data misuse, intimidating money collection procedures, and sexual harassment have threatened consumers' sense of security, so law enforcement is urgently needed to overcome these crimes. Regarding the borrower protection in the fintech business, OJK, under its power, has ratified “OJK Regulation Number 77/POJK.07/2016 concerning Information Technology-Based Fund Borrowing Services”. However, these regulations cannot protect borrowers, so the problems continue to rise. Furthermore, business disputes that arise in fintech lending need further guidance from independent institutions and the government to protect consumers and business actors when involved in disputes. Applying a non-litigation route, namely Alternative Dispute Resolution (ADR), is recommended with the disputing parties and third parties.Implication: This research is expected to support literacy to the public in selecting the right online financing and loan institutions. In addition, the results of these studies can be a source of reference for legal scholars.Novelty/Originality: In contrast to previous research, this research focuses on studying how important the legal protection of borrowers who use fintech services is and the steps that can be taken to resolve business disputes in the industry that have not yet been specifically identified.

Abstract

Industrial revolution 4.0 causes everyone to compete to produce work. One of the things that play an important role in this industry is a brand. The term brand is familiar in society, every day we use many products with various brands. This is where the presence of a brand is needed to differentiate the products that have been produced. Brands also make it easy for consumers to identify the products they want. With the increasing number of products on the market today, it is necessary to regulate the brand. Everyone is indeed free to work, but that freedom is also often violated. Therefore, as a part of intellectual property, the brand must get protection. So, this research aims to compare the protection of brands between Japan and Indonesia. This study uses a normative legal research method with a statutory approach and a comparative law approach. Indonesia already has a legal instrument that regulates trademark protection, namely Law no. 20 of 2016. The same is done by Japan. They have also provided protection to their citizens about trademark rights. This is stipulated in the Japan Trademark Act.

Abstract

Copyright is a part of Intellectual Property Rights whose existence must receive legal protection. The same is the case with other creations, especially those produced through digital media which are copyright works that must be protected. However, in reality there are still many people who do not understand about this protection, and many people are not responsible for using a copyrighted work without the author's permission. This of course is very detrimental to the creator as the original owner of the work by violating the exclusive rights of the creator. Some of the main issues that will be discussed in this research are copyright protection of digital works, namely digital painting as one of the works that should be protected as well as several legal remedies that can be taken against infringement of the exclusive rights of the author. This type of research is normative legal research with analytical descriptive research type and the problem approach used is a normative approach with a normative juridical approach. The results of the research and discussion conclude that legal protection for digital painting is implicitly regulated in Law Number 28 of 2014 concerning Copyright. Starting from the protection of the creator's exclusive rights to legal remedies that the creator can take.AbstrakHak cipta merupakan salah satu bagian dari Hak Kekayaan Intelektual yang keberadaannya harus mendapat perlindungan hukum. Sama hal nya dengan ciptaan-ciptaan lainnya khususnya terhadap ciptaan yang dihasilkan melalui media digital yang merupakan salah satu karya cipta yang harus dilindungi. Akan tetapi, pada kenyataannya masih banyak masyarakat yang belum paham mengenai perlindungan ini, serta banyak orang yang tidak bertanggung jawab memanfaatkan suatu karya cipta tanpa seizin pencipta. Hal tersebut tentu saja sangat merugikan pencipta sebagai pemilik asli dari ciptaan tersebut dengan dilanggarnya hak eksklusif dari si pencipta. Beberapa pokok permasalahan yang akan dibahas di dalam penelitian ini adalah tentang perlindungan hak cipta terhadap karya digital yaitu digital painting sebagai salah satu ciptaan yang seharusnya dilindungi serta beberapa upaya hukum yang dapat dilakukan terhadap pelanggaran atas hak eksklusif pencipta. Jenis penelitian ini yaitu penelitian hukum normatif dengan tipe penelitian deskriptif analitis dan pendekatan masalah yang digunakan yaitu pendekatan normatif dengan tipe pendekatan yuridis normatif. Hasil dari penelitian dan pembahasan menyimpulkan bahwa perlindungan hukum terhadap digital painting ini secara tersirat telah diatur di dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Mulai dari perlindungan terhadap hak eksklusif pencipta hingga upaya hukum yang dapat dilakukan oleh pencipta.

Abstract

The importance of the independence of the Corruption Eradication Commission (KPK) is to accelerate the performance of the KPK itself. However, the enactment of Law Number 19 of 2019 concerning the Second Amendment to Law Number 30 of 2002 concerning the Corruption Eradication Commission (a revision of KPK Law) has concretely resulted in a weakening of the KPK institution. This doctrinal research uses a normative legal research method that is based on the statutory approach and conceptual approach in analytical descriptive analysis. The result of this study shows that the KPK has lost its independence by amending the Article 3 of the KPK Law. The weakening of the KPK can be seen through the formation of a supervisory body, and also the regulation of the State Civil Apparatus as the compulsory background of KPK staff resulting the KPK has limited space to perform as it is bound by the central command.

Abstract

Kebijakan pembatasan sosial akibat dari covid-19 menyebabkan pelaku UMKM mengalami penurunan omzet. UMKM berperan penting dalam peningkatan perekonomian negara terutama dalam hal penyerapan tenaga kerja. Dengan terdampaknya UMKM, perekonomian negara juga ikut menurun. Salah satu upaya yang dapat dilakukan pelaku UMKM untuk mengembangkan usaha mereka adalah dengan melakukan pendaftaran merek. Maka, peneleitian ini bertujuan untuk mengkaji urgensi pendaftaran merek UMKM selama pandemi covid-19. Penelitian ini menggunakan metode penelitian non-doktrinal atau penelitian hukum empiris. Penelitian ini menunjukan bahwa pendaftaran merek memberikan sejumlah keuntungan bagi pelaku UMKM terutama memberikan kesempatan bersaing dengan usaha lain di marketplace dan memberikan perlindungan terhadap barang atau jasa yang diperdagangkannya. Namun banyak pelaku UMKM yang masih enggan untuk melakukan pendaftaran merek dikarenakan alasan seperti pandangan terhadap prosedur pendaftaran merek yang panjang dan memakan waktu serta biaya yang banyak. Pendaftaran merek dapat dilakukan secara online dan terdapat panduan lengkap untuk mempermudah proses pengajuan.

Abstract

Since the entry of the COVID-19 pandemic in Indonesia in early March 2020, the economy in Indonesia has experienced negative growth. Negative economic growth has resulted in mass layoffs (layoffs) in many companies. The purpose of this study is to analyze mass layoffs during the COVID-19 pandemic which is reviewed from the perspective of the Labor Law. The research method used in this reserach is the normative legal method by prioritizing secondary data. The results of this reserach indicate that termination of employment by many companies hurts workers. Especially in Article 151 paragraph 1 of Law Number 13 of 2003 concerning Manpower, it has been stated that employers, laborers/workers, the government must make every effort to prevent termination of employment. So based on this research it shows that laying off work during the COVID-19 pandemic is not a win-win solution.
