Abstract

Penelitian ini bertujuan untuk meneliti bagaimana konsep pemikiran dan hukum di zaman klasik (Yunani dan Romawi) mempengaruhi pembentukan sistem hukum Indonesia, penelitian ini juga membahas bagaimana penerapan secara konkrit konsep keadilan dan hukum di zaman klasik pada sistem hukum modern Indonesia. Penelitian ini memiliki urgensi untuk meninjau bagaimana relevansi pemikiran yang ada di zaman klasik mempengaruhi sistem hukum modern Indonesia. Penelitian meggunakan metode Yuridis normatif, bahan hukum yag digunakan adalah bahan hukum primer dan sekunder yang diperoleh melalui studi kepustakaan, penarikan kesimpulan menggunakan metode deduktif. Pengaruh pemikiran hukum dan keadilan zaman klasik terhadap pembentukan hukum positif di Indonesia sangatlah besar, hal ini ditandai dari banyaknya sistem hukum, peraturan perundang-undangan serta konsep hukum dan keadilan di Indonesia yang menggunakan pemikiran hukum dan keadilan di zaman klasik. Ini dikarenakan pengaruh jajahan negara-negara eropa yang merupakan pewaris dari peradaban Yunani-Romawi yang membawa konsep tersebut ke Indonesia di zaman kolonialisme. Implementasi konsep keadilan di zaman klasik dalam peraturan perundang-undangan di Indonesia juga telah dilakukan misalnya penerapan konsep keadilan distributif Aristoteles terhadap penerapan Nomor 7 tahun 2021 Tentang Harmonisasi Peraturan Perpajakan pada penggenaan pajak orang pribadi dan konsep keadilan plato diimplementasikan dalam Undang-Undang No.1 Tahun 2023 tentang KUHP mengenai tujuan pemidanaan.

Abstract

This study focuses on the impact of local regulations governing street vendors on corporate partners and micro, small, and medium enterprises (MSMEs) in Depok City. In this context, street vendors play an important role in the local economy and require regulation to ensure sustainability and proper management of public spaces. This study aims to analyze how the implementation of the Perda affects corporate cart partners and MSMEs, with the goal of identifying the challenges and opportunities faced by these businesses. The research method used is a normative legal approach supplemented by in-depth interviews to obtain rich and detailed data from MSMEs, PKL, corporate partners, and relevant stakeholders. This study also employs policy analysis using a legal and conceptual approach to evaluate the effectiveness of existing regulations. The results and discussion reveal that SME partners strongly agree with the on-the-ground conditions in Depok City, where frequent raids on SMEs significantly hinder their economic activities. However, on the other hand, based on interviews with the team from the Depok City Cooperative and SME Department, it was explained that SMEs that are raided need to be mentored to gain knowledge and understanding regarding Depok City Regulation No. 3 of 2024 on the Protection, Empowerment, Development of Micro Businesses, as well as the Regulation and Empowerment of Street Vendors. This will at least provide protection and meet the needs of SMEs in Depok City. Thus, the implications of this regulation have a positive impact on SMEs and street vendors in driving the economy of Depok City.

Abstract

The global energy transition has increased demand for transition minerals, particularly nickel, as a strategic component in electric vehicle battery production and low-carbon energy systems. Indonesia has positioned itself as a global nickel hub through downstream industrialization policies and the development of the Indonesia Morowali Industrial Park (IMIP). However, the rapid expansion of the nickel industry in Morowali has also triggered environmental degradation, agrarian conflict, and indigenous land dispossession. This study aims to analyze the relationship between green extractivism, spatial planning, agrarian conflict, and indigenous land rights within the Morowali nickel industrial corridor. The research employs a socio-legal approach with a political ecology perspective using qualitative analysis. Data were collected from spatial planning documents, mining regulations, scientific journals, media reports, and publicly available interviews involving indigenous communities, academics, and government institutions. The findings indicate that nickel industrial expansion has produced spatial injustice through land-use change, mining concession expansion, and industrial zoning that marginalize indigenous communities and local living spaces. Spatial planning instruments function not as neutral governance tools but as mechanisms legitimizing green extractivism and land dispossession. This study contributes to spatial planning law by integrating environmental justice, political ecology, and socio-legal studies in understanding the spatial crisis within Indonesia’s transition mineral industry.

Abstract

The The formation of community organizations (ormas) is a form of freedom of association and assembly in the life of a democratic rule of law. The Islamic Defenders Front (FPI) is an example of a community organization in Indonesia. However, FPI has been disbanded by the government through a Joint Decree (SKB) concerning the Prohibition of Activities, Use of Symbols and Attributes, and Termination of Activities of the Islamic Defenders Front which was issued on December 30, 2020. This government action created a polemic and raised several questions as to what caused it to be dissolved. FPI community organizations by the government, then what is the perspective of constitutional law regarding the disbandment of FPI Community organizations. This study aims to determine the cause of the dissolution of the FPI Community Organization by the government, then to find out how the perspective of constitutional law regarding the dissolution of the FPI Community organization is. The type of research used is normative legal research, by examining the literature. The nature of this normative type of research uses qualitative research. This research approach uses a statutory approach and a conceptual approach approaches). Sources of data in the form of primary data and secondary data. Result analysis. This research is done by criticizing or approving and giving comments, then making issues or conclusions to the research results. The results of this study concluded that several causes of the FPI Community Organization to be dissolved by the government, namely. First, FPI has been de jure disbanded by the government since June 21, 2019 because it no longer has legal standing as a mass organization. Second, FPI in enforcing the commandments for ma´ruf nahi munkar is often accompanied by acts of anarchy and violence, even to the point of violating the law. Therefore, the government issued a Joint Decree (SKB) to prohibit and stop FPI activities. Based on the perspective of constitutional law, the dissolution of the FPI Community organization was in accordance with the applicable laws and regulations. In addition, the use of a Joint Decree (SKB) to prohibit and stop FPI activities from a formal and material perspective is also considered to be in accordance with the principles of the rule of law and the principles of a democratic state.
