Abstract

Abstrak: Desa Babakankaret merupakan salah satu desa di Kabupaten Cianjur yang memiliki potensi sumber daya alam yang cukup besar. Permasalahan yang dialami mitra adalah minimnya modal warga tidak produktif untuk dapat mengelola lingkungan desa yang memiliki sumber daya alam,Tujuan penyelenggaraan pengabdian kepada Masyarakat ini agar dapat meningkatkan pemahaman legalitas dalam berkontrak bagi kelompok tani dan pemberdayaan lingkungan di Desa Babakankaret.. Metode pelaksanaan pengabdian kepada masyarakat menggunakan Community Based Participatory Research (CBPR) yaitu metode yang mengutamakan partisipasi masyarakat dalam setiap tahap penelitian dan pengabdian, lalu diturunkan dalam tiga tahapan yaitu tahap survey, tahap pelaksanaan penanaman bibit dan diakhiri dengan tahapan sosialisasi perjanjian bagi hasil. Hasil dari pelaksanaan pengabdian kepada masyarakat adalah pemberdayaan lingkungan pada Desa Babakankaret dengan ditanamnya 3000 bibit hibah dari Kementerian Lingkungan Hidup dan Kehutanan (KLHK) pada 5 lokasi Desa. Pemberdayaan hukum yang terlaksana adalah 90% dari 40 warga Desa Babakankaret dari beberapa elemen masyarakat telah memahami pentingnya hukum dan tersosialisasinya perjanjian bagi hasil yang akan digunakan warga desa apabila akan melakukan perjanjian dengan pemilik tanah yang ingin dikelola oleh kelompok tani yang ada di Desa Babakankaret.Abstract: Babakankaret Village is one of the villages in Cianjur Regency which has quite large natural resource potential. The problem experienced by partners is the lack of capital for unproductive residents to be able to manage the village environment which has natural resources, this is also reinforced by the low knowledge of legal partners to enter into production sharing agreements with landowners so they can manage productively. The method of implementing community service uses Community Based Participatory Research (CBPR), which is a method that prioritizes community participation in each stage of research and community service, then is passed down in three stages, namely the survey stage, the seed liberation stage and ends with the agreement socialization stage for results for the population village. The result of the implementation of community service is environmental empowerment in Babakankaret Village by planting 3,000 grant seeds from the Ministry of Environment and Forestry (KLHK) in 5 village locations. The legal empowerment that was carried out was that 90% of the 40 residents of Babakankaret Village from several elements of society had understood the importance of law and the socialization of Income share agreements that would be used by villagers when they were to have relations with landowners who wanted to be managed by farmer groups in Babakankaret Village.

Abstract

The amendments made to the Health Law Number 17 of 2023 represent Indonesia's commitment to enhancing the welfare of its citizens, particularly in the field of healthcare. A key aspect of this law is to provide broader and more equitable access to higher quality healthcare services for all Indonesian citizens, addressing the shortcomings of previous healthcare legislations. This study aims to analyze the controversies within the healthcare law, examining their impact on societal well-being and assessing the law's implementation within the framework of national development. Employing a juridical-normative research method using a statutory approach, the findings of this research indicate that the amendments introduced in the Health Law Number 17 of 2023, despite creating controversies within the healthcare sector, are aimed at ensuring widespread and equitable access to healthcare services and improving their quality in Indonesia. Hence, the nation's goal of providing welfare in the healthcare sector indirectly relies on the concurrent operation of existing laws, implementation of regulations, and public compliance awareness.

Abstract

Politik hukum keimigrasian di Indonesia menganut prisnip selective policy dengan menggunakan 2 (dua) pendekatan yaitu pendekatan kesejahteraan dan pendekatan keamanan. Dalam kebijakan Bebas visa ditetapkan bahwa dalam pemberiannya harus memperhatikan asas timbal balik dan asas manfaat. Penelitian ini disusun dengan tujuan untuk menjawab rumusan masalah yakni: 1) Bagaimana dinamika perkembangan dalam kebijakan Bebas visa di Indonesia? dan 2) Bagaimana penerapan kebijakan Bebas visa dalam perspektif politik hukum keimigrasian di Indonesia? Penelitian ini menggunakan pendekatan penelitian hukum normatif, dengan menganalisis data sekunder berupa peraturan perundang-undangan dan pustaka. Hasil penelitian memperoleh kesimpulan bahwa kebijakan Bebas visa di Indonesia sudah diterapkan sejak tahun 1983 hingga saat ini. Berdasarkan Peraturan Nomor 21 Tahun 2016, ditetapkan bahwa Bebas visa diberikan kepada 169 negara. Namun saat ini kebijakan tersebut dilakukan penghentian sementara untuk dilakukan evaluasi. Fasilitas Bebas visa yang diberikan kepada 169 negara dipandang tidak sejalan dengan politik hukum keimigrasian di Indonesia sehingga perlu dilakukan perubahan atas kebijakan tersebut dengan lebih mempertimbangkan asas timbal balik dan asas manfaat serta dampaknya bagi Indonesia.

Abstract

Pancasila selain sebagai dasar negara juga sebagai pedoman dalam kehidupan berbangsa dan bernegara. Nilai-nilai Pancasila merupakan norma yang memberikan akses kesamaan hak bagi seluruh warga negara tak terkecuali penyandang disabilitas. Pemenuhan hak penyandang disabilitas dalam mewujudkan inklusifitas penyandang disabilitas juga terdapat dalam indikator Pembangunan Berkelanjutan (SDGs). Tujuan dari penelitian ini adalah untuk meneliti interkonektivitas antara nilai-nilai Pancasila dan indikator SDGs yang bertujuan untuk mendukung inklusifitas penyandang disabilitas di Indonesia. Metode yang digunakan dalam penelitian ini yaitu menggunakan pendekatan kualitatif dengan metode studi literatur dan analisis konten. Hasil dari penelitian ini adalah antara nilai-nilai Pancasila dan beberapa indikator SDGs sama-sama memiliki tujuan dalam pemenuhan hak penyandang disabilitas. Hal ini sebagai wujud inklusifitas penyandang disabilitas dalam kehidupan  berbangsa dan bernegara. Dalam setiap sila-sila Pancasila semuanya memiliki nilai yang menjamin persamaan penyandang disabilitas dan kehidupan. Beberapa indikator dalam SDGs juga bertujuan untuk menjadi pedoman yang harus dicapai dalam mewujudkan inklusifitas penyandang disabilitas.

Abstract

The expansion of new provinces in Papua has been carried out, signed, and stipulated by the Indonesian Minister of Home Affairs.as many as four provinces have been added to the order administrative division of provinces in Indonesia, including: Mountainous Papua Provines, Southwest Papua, South Papua, and Central Papua. With the implementation of four new provinces in Indonesia to balance economic equality in the Papua region and provide regional autonomy freedom which is respected for Papuans who wish to form new provinces on the Papua Island where the Papua region is still so very large that it is sufficient to meet the welfare and living needs of all Papuans what is in it. Therefore the Indonesian government has established a regional autonomy policy within the Papua region to expand the island of Papua from previous two provinces to six provinces. The research method used by author is normative juridical research which includes four main theories, namely region autonomy theory, legal sovereignty theory, state sovereignty theory, theological theory. The purpose of this research is to find out the impact obtained by residents and the causes of Papuan’s desire on the expansion of new provinces in its territory and to find out the implementation of regional autonomy legal for the four new provinces in Papua. In the future, we hope that expansion of new provinces in Papua can produce a sense of justice and realize share properity in Papua.

Abstract

The legal consequence of this decision was that the Constitutional Court granted the lawmakers a two-year period to amend the Job Creation Law, following a process that adheres to a clear, standardized, and established method for creating omnibus laws. The Constitutional Court's Decision No. 91/PUU-XVIII/2020 was subsequently followed by the government issuing Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation, which contains similar content to the Job Creation Law. This has sparked controversy within the public. Therefore, the issue that will be further examined in this research is how the creation of the Job Creation Government Regulation In lieu of Law complies with the Constitutional Court's Decision No. 91/PUU-XVIII/2020, which declared the law conditionally unconstitutional, and how the harmonization between the Job Creation Government Regulation In lieu of Law and the legal reasoning in the Constitutional Court's decision is achieved. The research method used in this study is a normative juridical approach, which emphasizes library research. This study is descriptive-analytical, with the research stages focusing on secondary data analysis. Data collection techniques include library research and field research through interviews with relevant parties. The results of the study show that the lawmakers did not comply with the Constitutional Court's Decision No. 91/PUU-XVIII/2020, as they did not amend the Job Creation Law as required by the decision. Instead, they chose to issue the Job Creation Government Regulation In lieu of Law. Regarding the harmonization between the Job Creation Government Regulation In lieu of Law and the legal reasoning in the Constitutional Court's Decision No. 91/PUU-XVIII/2020, a lack of harmonization between the two was found.

Abstract

Article 43 paragraph (3) of Law Number 12 of 2021 requires that every Draft Bill (Rancangan Undang-Undang/RUU) submitted by the President, the People's Representative Council, or the Regional Representative Council must include an Academic Manuscript. This document contains a scientifically proven legal study outlining the necessity of regulating a problem and its resolution in the Draft Bill. The Academic Manuscript serves as a key reference during the legislative planning process. This study explores the role of the Academic Manuscript in law formation and analyzes the RUU on Amendments to Law Number 5 of 2014, focusing on its alignment with the Academic Manuscript. Using legal and empirical approaches, the research evaluates the application of norms under the Law on the Legislation Drafting, which mandates an Academic Manuscript for drafting laws. Law Number 20 of 2023 accommodates strategic issues highlighted in the Academic Manuscript. However, during the discussion process, the RUU underwent significant changes, with over 50% of its substance added. Despite these additions, the Academic Manuscript remained unchanged. Ultimately, the RUU led to the repeal of Law Number 5 of 2014 and its replacement with Law Number 20 of 2023, which redefines the regulations concerning the State Civil Apparatus.

Abstract

National development planning is essential for realising sustainable and inclusive development goals. However, the current planning system faces various challenges. This research aims to create a more consistent development framework by revitalising the Outline of State Policy concept. The research method used is normative juridical with statutory, historical, and comparative approaches. This article highlights the lack of effectiveness of the National Development Planning System that replaced the role of the State Policy Guidelines in ensuring long-term development sustainability, including policy inconsistencies across governments in Indonesia. Therefore, reformulation using the Garis Besar Haluan Negara concept is considered urgent. This research finds two options for reform limited amendment of Article 3 Paragraph (1) of the 1945 Constitution or strengthening regulations through revision of Law No. 25/2004 on the National Development Planning System.

Abstract

Artikel ini membahas hubungan antara politik dan hukum dalam pembentukan serta penegakan hukum di Indonesia, dari masa lalu hingga era reformasi saat ini. Ada tiga model hubungan yang menggambarkan kaitan antara politik dan hukum. Pertama, dalam perspektif Das Sein, politik dianggap sebagai penentu hukum karena hukum lahir melalui proses politik, sehingga hukum mencerminkan hasil persaingan kepentingan politik. Kedua, dalam perspektif Das Sollen, hukum menjadi penentu politik, dengan setiap agenda politik harus tunduk pada aturan hukum. Ketiga, politik dan hukum saling mempengaruhi, di mana politik tanpa hukum akan mengarah pada penindasan, sementara hukum tanpa pengawasan akan terhenti. Dalam pembentukan peraturan perundang-undangan oleh lembaga politik, peran kekuasaan politik sangat penting, karena lembaga politik memiliki kewenangan formal untuk merancang undang-undang. Lembaga politik yang tidak diberi kewenangan akan kehilangan fungsinya. Ini menunjukkan bahwa lembaga politik sering kali berfungsi sebagai alat kelompok yang memegang kekuasaan politik. Ada tiga elemen utama yang berkaitan langsung dengan upaya penegakan hukum: pertama, unsur perundang-undangan yang dihasilkan oleh lembaga legislatif; kedua, unsur penegak hukum, yaitu polisi, jaksa, dan hakim; ketiga, unsur lingkungan hidup yang melibatkan warga negara dan masyarakat.

Abstract

Munculnya keraguan akan kapasitas hukum adat sebagai sumber hukum bagi politik hukum pembentukan hukum nasional lahir disebabkan anggapan hukum adat bersifat kuno, primitif dan hanya relevan untuk wilayah tertentu sesuai asal nilai dan tradisi. Hukum adat dianggap sudah tidak sesuai untuk digunakan sebagai sumber penyusunan aturan hukum sehingga kian termarginalkan. Permasalahan yang diangkat ialah bagaimana kedudukan hukum adat sebagai sumber hukum tidak tertulis dapat menjadi sumber hukum bagi politik hukum nasional dan bagaimana peranan hukum adat sebagai sumber bagi politik hukum nasional. Tipe penelitian yuridis normatif melalui pendekatan studi perundang-undangan dan pengumpulan data berbasis studi kepustakaan. Analisis data secara kualitatif yang bersifat preskriptif. Kedudukan hukum adat diakui sejak zaman kolonial Belanda yang tertuang dalam Pasal 75 Regerigs Reglement dan Pasal 130 IS yang selanjutnya diakui Pemerintah Indonesia melalui Pasal 18B ayat (2) dan Pasal 28I ayat (3) UUD 1945 serta Pasal 5 ayat (1) UU Kekuasaan Kehakiman. Hukum adat berperan penting menentukan arah pembentukan dan pelaksanaan hukum dengan aplikasi nilai yang terkandung dalam berbagai regulasi seperti UU Perkawinan, UUPA, dan regulasi lainnya. Hukum adat dapat menjadi sumber hukum politik hukum pembentukan hukum nasional sepanjang nilai-nilainya tidak kontradiktif dengan upaya penataan kembali eksistensi dan pranata hukum adat melalui pengaturan khusus.
