Abstract

This study aims to analyze the regulation of the medical profession in Indonesia in implementing the Mutual Recognition Arrangement (MRA), as well as the legal response to violations by foreign doctors and the government's efforts to increase the competitiveness of ASEAN foreign doctors in MRA professional standards. The normative-empirical method is used by collecting data through field studies, literature studies, and qualitative analysis. The results of the study show that a number of regulations including the Medical Practice Act, the Health Law, and the Presidential Decree regarding foreign workers governs the regulation of the medical profession in Indonesia related to MRA. The government is also trying to increase the competitiveness of foreign doctors by providing quality health infrastructure and creating a conducive investment climate. Legal responsibility for foreign doctors' violations of the medical profession includes civil, criminal and administrative aspects. This research provides insight into legal protection for the medical profession in the implementation of MRA and emphasizes the importance of government steps in increasing the competence of foreign doctors to maintain professional standards in the ASEAN context.

Abstract

Punishment is a form of deviation of behavior within society. One of the criminal acts in the field of pharmacy is related to the circulation of pharmaceutical preparations without an edar license, such as drug circulation without a edar licence that can harm society. The purpose of the research is to analyze the arrangements regarding the distribution of pharmaceutical preparations without authorization, efforts to combat such crimes, as well as the punishment given to the perpetrators. This research uses a method of research jurisprudence normative law, descriptive analysis using library data through libraries, regulations-legislation related to pharmaceutical preparations without authorization. The results of the criminal investigation of distributing pharmaceutical preparations without an edar license are regulated in Article 106 paragraph 1 junto 197 of the Law No. 36 of 2009 on Health. Procurement of pharmaceutical supplies is carried out by the pharmacy in the production, distribution and distribution facilities and facilities of pharmacy services. (pasal 6 PP Nomor 51 Tahun 2009 tentang pekerjaan kefarmasian). Countermeasures for criminal acts are carried out with penal and non-penal efforts. The punishment given is 4 (four) months and a fine of IDR 1,000,000.00 (one million rupiah) subsidiary of 1 (one) month in prison

Abstract

Virtual account is an electronic application that is created to connect to a large computer network when using the internet. This is very vulnerable to the threat of online crime, virtual accounts must provide security for customers. The aim of the research is to find out what electronic system crimes are, analyze the application of data protection laws, and legal sanctions for perpetrators of account burglary crimes. The research method is normative juridical. The research results show that the electronic systems currently in force in Indonesia are Mobile Banking, SMS Banking and Internet Banking. Regarding data protection in banking, it is regulated in article 40 (1) of Law no. 10 of 1998 concerning banking, namely that banks are obliged to keep confidential information regarding depositors and their deposits. Even though the Laws and Regulations have strictly regulated the protection of customer data, the fact is that in the field there is still a lot of misuse of customer personal data by irresponsible parties. Prohibitions for perpetrators of virtual account burglary crimes are regulated in Law Number 19 of 2016 concerning Information and Electronic Transactions Article 31 Paragraphs 1, 2, 3 and 4. The conclusion is that the application of the law regarding data protection in banking is regulated in Article 40 (1) of the Law No. 10 of 1998 concerning banking, namely that "banks are obliged to keep confidential information regarding depositors and their deposits.

Abstract

Corruption is a crime that harms state finances and the people's economy. On KPK website, cases of budget misuse data based on region, from 2004 to 2021 there are as many as 402 cases. So, extraordinary enforcement and extraordinary measures are needed. The research purpose is to analyze the regulation of corruption crimes committed during natural disasters, analyze the weaknesses of regulation corruption in social assistance funds, and analyze the prevention of corruption during natural disasters. This study uses statute approach with secondary legal literature research techniques and uses prescriptive analysis. The result of this journal is regulation of Corruption Crimes during natural disasters is regulated in Law Number 24 of 2007 about Disaster Control, Law Number 31 of 1999 about Eradication of Corruption Crimes, and PERPU Number 24 of 1960 about Investigation, Prosecution and Examination of Corruption Crimes. Provisions for the death penalty are regulated in Article 2 paragraph 2 Law Number 31 of 1999, namely in event that criminal act of corruption as referred to in paragraph (1) is committed under certain circumstances, the death penalty can be imposed, and prevention of corruption during a natural disaster can be carried out by penal and non-penal.

Abstract

Digital signatures are a substitute for manual signatures that are electronic and have the same function as manual signatures. However, the development of digital signatures has not yet been realized in the world of notarial services, especially in the creation of authentic deeds by notaries. This research uses a Normative Juridical approach. Data was collected through literature research and using qualitative and descriptive analysis. Conclusions from this research, the implementation of electronic digital signatures has been implemented in a number of authentic deeds, but not all are allowed to use digital signatures, some are required to still use hanko or signatures in the form of stamps made of wood. However, in Indonesia the implementation of digital signatures is still unclear, which is why currently digital signatures have been implemented, however, their use is only in documents in the form of personal identity such as Resident Identification Cards, Driving Licenses, etc and Legal sanctions for criminal acts of misuse of digital signatures in Indonesia include forgery of documents which can be charged under Article 263 paragraph (1) of the Criminal Code. The perpetrator is threatened with imprisonment for six years. In Japan, the crime of misuse of digital signatures is regulated in the Cybercrime Law which was passed in 2011 and the Act on Electronic Signatures and Certification Business Act No. 102. However, the penalties that may be applied depend on various factors, including the severity of the offense, the harm caused. The government's efforts to prevent the misuse of criminal acts of digital signature falsification are by strengthening the digital certification security system, conducting regular audits on services that use digital signatures, implementing effective reporting and following up on cases by providing strict sanctions to provide a deterrent effect at the perpetrator.

Abstract

Thematic Cosmetics are traditional cosmetics made from natural ingredients and are identical to a region and are in demand by the community. Due to this development, some communities try to make and sell thematic cosmetics without paying attention to BPOM permits. Therefore, this study aims to determine the legal protection for consumers who use thematic cosmetics, to find out the systematic registration of thematic cosmetics to obtain BPOM permits, and to find out the supervision of thematic cosmetics that applies in Indonesia. This study uses the Normative Juridical method, this literature study is a series of activities related to the stages of collecting literature data, understanding then recording, and processing research materials. Each province in Indonesia has a Food and Drug Supervisory Agency which is tasked with supervision, law enforcement, and guidance, BPOM supervises the quality of cosmetics starting from the registration and assessment stages, with the latest regulation, namely BPOM Regulation No. 21 of 2022 concerning Procedures for Submitting Cosmetic Notifications replacing Regulation No. 12 of 2020 which is considered no longer appropriate. The Food and Drug Supervisory Agency has the authority to supervise the circulation of each productan d destruction of products that do not meet the requirements. Create standards and requirements related to product quality, safety, and benefits as well as inspection of production and distribution facilities and technical guidelines for laboratory assessment and testing.

Abstract

Penelitian ini bertujuan menemukan langkah tepat sebagai upaya mencegah peredaran Produk Hortikultura yang tidak sesuai standar mutu dan /atau keamanan pangan dipasar Trandisional maupun Modern melalui kebijakan penal maupun nonpenal. Metode dan jenis Penelitian yang digunakan yuridis empiris. Menggunakan metode Pendekatan peraturan perundang-undangan (statute approach) dan sosial masyarakat. Sumber data diperoleh dari lapangan secara langsung dengan wawancara dengan Narasumber. Sifat penelitian yaitu deskriptif, analisis evaluatif, dan perskriptif Menganalisis data bahan hukum dengan kualitatif. Kajian ini menyimpulkan bahwa perlu adanya harmoniasi kebijakan dalam bidang Hortikultura, sehingga peraturan secara khusus mengatur tentang Hortikultura Segar dan Hortikultura Olahan dapat diatur dalam regulasi khusus Undang-undang No.13 Tahun 2023 tentang Hortikultura. Mengatur tentang bentuk pengawasan pada Pre Market dan Post Market. Pemberian ijin edar dan pencabutan ijin edar jika produk tidak sesuai standar mutu dan/atau keamanan pangan. Upaya pencegahan dilakukan melalui penerapan kebijakan Kriminal yaitu Penal dan Non Penal. Pendekatan non penal melalui Pendekatan Pendidikan, moral dan Agama, selain itu melalui penyuluhan kepada Masyarakat, Pelaku Usaha. Pemberdayaan Perempuan untuk pengambilan keputusan menentukan memilih untuk mengkonsumsi buah dan sayuran bagi keluarga sesuai standar mutu dan/atau keamanan pangan. Melakukan pengujian sample produk secara rutin dan berkala, melakukan inspeksi ke Pusat pasar, pasar tradisional dan modern, sosialisasi kepada konsumen untuk Cek Klik (Cek Kemasan, Label, Izin Edar, Kadaluarsa).

Abstract

Pine tree sap is one of the benefits of forest products managed by farmer groups and the general public. The utilization of pine tree sap or in the Makkoak and Manderes areas, has a very bad impact on the sustainability of pine trees in protected forests or industrial forests in the Samosir district area. This paper explains related to management licensing, pine sap extraction, the impact of pine sap on the community's economy, adverse impacts on forest plantation and several other problems in the utilization of pine sap in Samosir district. In this paper, qualitative/quantitative descriptive analysis is used to analyze primary data obtained through interviews and observations in the field and secondary data through related institutions or agencies. The researcher in this writing found that there were violations of laws, regulations and also violations of agreements and agreements between the farmer group and KPH III Dolok Sanggul in the utilization of pine tree sap. As a result, pine tree plantations that are not good will have a very bad impact on protected forests and industrial forests.

Abstract

Corruption is a serious, organized crime that has caused serious problems and threats. The purpose of this study to analyze the regulation of corruption in Indonesia, Malaysia and Singapore, find out and analyze the comparison of the death penalty for corruption in Indonesia, Malaysia and Singapore and compare the efforts to prevent corruption in Indonesia, Malaysia and Singapore. The normative juridical research method is an approach based on the main legal material examining theories, concepts, legal principles, and regulations related to this research. This research included normative juridical research. In normative juridical research, law is conceptualized as a norm, method, principle, dogma. This type research uses a statute approach, which is analyze all laws and regulations relating legal issues that are discussed the research. In Indonesia, corruption more common in the central government from 2004 to 2021 there are many as 402 cases which are data by region, Malaysia scored 48 points out of 100 in the Corruption Perceptions Index 2021 reported by Transparency International, while Singapore the CPIB in 2018 managed to handle 80% of the cases are the majority from the private sector that 112 people were indicted the Court for criminal acts of corruption.

Abstract

The purpose of this research is to analyze the occurrence of land conversion which is increasing from year to year from agricultural land to non-agricultural land. The research uses a normative juridical method which is carried out by examining literature studies and sources of this research using primary legal sources. The problem in this research is to analyze the policy of sustainable food agriculture land protection, the weaknesses of the policy and provide recommendations to improve these weaknesses. In Law No. 41 of 2009 article 28 discusses the development of agricultural technology that has not been evenly distributed and has not been kept up with the times. Education in agriculture is also still not in accordance with article 63. This land conversion occurs because there are fewer people who work as farmers and the lack of policies that support people to work as farmers. The area of ​​non-paddy agricultural land in 2019 was around 29,353,138 hectares and the area of ​​rice fields in 2019 was around 7,463,948 hectares. Indonesia should focus more on agriculture to overcome this land conversion.
