Abstract

Each country strives to achieve what is the goal of the Nation and State which for Indonesia is stated in the 4th paragraph of the 1945 Constitution, namely to achieve public welfare, one way is to improve transportation facilities, this is very important to support the activities of the daily community. . This research is socio-juridical, looking at how an existing legal regulation is applied in society. Data collection was carried out by means of observation, interviews and questionnaires consisting of online motorcycle taxi drivers and office staff of online motorcycle taxi institutions and consumers.From the results of the research that the legal relationship between online motorcycle taxi drivers is only a partnership relationship and also as a liaison between partners and consumers, however the partnership relationship is made with a separate role and it is written that the partner frees PT Paket Global Semesta in criminal and civil lawsuits, because each agreement it must comply with Article 1320. Based on the provisions of the law that online motorcycle taxi drivers are not appropriate as partners because this is only an individual and in the standard agreement entered into by PT. Paket Global Semesta which regulates the rights and obligations of both parties, in fact it provides more benefits than the producer and as if the entrepreneur is transferring the risk to the partner, this is still a dilemma about the legal consequences that will occur in the implementation of all activities offered by producers to consumers, there are still many discrepancies.

Abstract

Mayarakat harus dilindungi dari pangan berbahaya Tujuan Penelitian untuk mengetahui dan menganalisis perlindungan hukum, penanggulangan tindak pidana pangan berbahaya saat ini. Penelitian ini bermanfaat secara teoritis dan Praktis. Jenis penelitian Yuridis Normatif, Analisis bahan hukum secara kualitatif diuraikan secara deskriptif analitis dan preskriptif. Bentuk perlindungan hukum terhadap tindak pidana peredaran pangan berbahaya di Indonesia diatur dalam Undang-Undang Perlindungan Konsumen secara umum dan Undang-Undang Pangan secara khusus. Di Tiongkok diatur dalam peraturan perundang-undangan Keamanan Pangan Republik Rakyat Tiongkok. Administrasi Makanan dan Obat-Obatan Negara China SFDA bertanggung jawab mengawasi dan mengoordinasikan lembaga kesehatan, makanan, dan obat-obatan. Tiap negara perlu memperhatikan sistem perlindungan hukum yang diterapkan dan memberi hukuman yang berat kepada pelaku sehingga memberikan efek jera. Upaya Penanggulangan Tindak Pidana Peredaran Pangan Berbahaya di Indonesia dilakukan dengan Upaya Pre-Entif, Preventif dan Represif. Ditiongkok menerapkan hukuman pidana penjara dan denda, dan adanya pengawasan oleh SFDA. Diperlukan upaya memberi pemahaman bagaimana pangan yang berbahaya kepada masyarakat agar dapat mengurangi resiko pangan berbahaya.

Abstract

The purpose of this study is to analyze the mechanism in the process of ownership of the property rights on the foundation land, as well as the factors that obstruct the process of ownership of the property rights on the foundation land, and to analyze the legal remedies available to a foundation so that land owned by the foundation but certified in the name of an individual can be changed to the foundation's name. The approach used was the juridical-empirical method, which is legal research carried out by combining a juridical legal approach with empirical elements. Literature review and interviews were employed as data collecting or processing techniques in this study. The research results obtained are based on Law 28 of 2004 concerning Amendments to Law 16 of 2001 on Foundations at ensuring greater legal certainty and order. Therefore, the Management of the Buddhist Religious Foundation in Medan City is required to continue the process of transferring for rights or applying for rights at the National Land Office in an orderly manner. Based on Government Regulation No. 18 of 2021 on Right to Manage, Land Rights, Multi-story Housing Units, and Land Registration in Article 87 Paragraph 1, "Systematic Land Registration". As a result, Buddhist Religious Foundations can conduct Land Registration in line with the applicable legislation. Based on the Decree of the Directorate General of Buddhist Community Guidance No. 323 of 2017 on Registration of Buddhist Religious Institutions so that Buddhist Religious Foundations can be independently registered to the Ministry of Religious Affairs through the Organization and Houses of Worship Information System (SIORI) on the website: https://sioribuddha.kemenag. go.id/.

Abstract

Abstrak Seorang Notaris berkewajiban untuk memastikan seluruh isi yang dituangkan kedalam akta telah dipahami dan sesuai dengan keinginan oleh para pihak. Notaris diharuskan untuk membacakan akta yang sudah dibuatnya dan membuat sebuah keterangan terhadap kondisi penghadap ketika pembacaan akta. Ketika terdapat salah paham diantara para pihak yang terlibat dengan akta yang dibuat oleh notaris, hal tersebut dapat menyebabkan timbulnya ketidakjelasan bagi akta yang telah dibuat oleh notaris. Ini mengakibatkan kekuatan dan kegunaan akta notaristersebut patut dipertanyakan dan juga termasuk tanggung jawab dari Notaris yang secara sengaja tidak membacakan akta dihadapan para pihak. Permasalahannya bagaimana keabsahan perjanjian jual beli hak atas tanah dalam perkara MA Nomor 351 PK/Pdt/2018), bagaimana pertanggungjawaban notaris atas tindakan tidak membacakan akta pengikatan jual beli berdasarkan perkara MA Nomor 351PK/Pdt/2018, bagaimana analisis pertimbangan majelis hakim dalam putusan MA No.351PK/Pdt/2018 mengenai akta PPJB hak atas tanah oleh pihak calon penjual karenaadanya akta tidak otentik. Metode penelitian digunakan adalah yuridis normatifdan peneliti menggunakan pendekatan Studi Kasus, bahan hukum berupa primer,sekunderdantersier.Tesis ini menggunakan metode kualitatif untuk analisis data.Hasilpenelitianmenunjukkan bahwa Keabsahan PPJB pada Putusan MA adalahtidak sah hal ini dapat dikatakan bahwa Notaris secara sengaja tidak membacakanakta kepada penggugat merupakan suatu pelanggaran yang berakibat kepada aktayang dibuatnya tersebut menjadi batal demi hukum dan kekuatan pembuktiannya menjadi sebuah akta dibawah tangan. Notaris bertanggungjawab secara administratif dan perdata karena secara sengaja tidak membacakan akta Perjanjian Pengikatan Jual Beli kepada penggugat. The problem is in the form of the validity of the agreement to buy and sell land rights in the Supreme Court case Number 351PK/Pdt/2018, accountability for notaries who are negligent in implementing the code of ethics and the considerations of the panel of judges in the Supreme Court case decisions. Research is to find out the validity of the agreement to buy/sell land rights, accountability for notaries who are negligent in implementing the code of ethics and the considerations of the panel of judges in the Supreme Court case decisions. Normative judicial is the research method used in this thesis and the researchers used a case study approach, legal materials in the form of primary, secondary and tertiary. Study results show that the validity of the Supreme Court's decision is invalid. The notary did not read the deed to the plaintiff, which was a violation which resulted in the deed being null and the strength of evidence became an underhanded deed. The notary is civilly responsible for intentionally not reading the deed of agreement to the plaintiff. Keywords: Land Rights, Inauthentic deed, Agreement, Negligence

Abstract

This research aims to analyze criminal law enforcement policies in combating cyber gambling offenses in Indonesia. Through a normative legal approach and qualitative research, this study refers to legal norms found in legislation and relevant literature materials. The research findings indicate that law enforcement policies in combating cyber gambling offenses require the codification and unification of legal fields, as well as the development of new legislation. These legal instruments are crucial in supporting development in various sectors, in line with the demands of development, legal awareness, and societal perspectives on behavioral assessments. The application of criminal sanctions against perpetrators of gambling offenses utilizes the general minimum and specific maximum systems. However, within this framework, judges do not have full discretion in determining the appropriate type of punishment for the offenders. Instead, they must adhere to the criminal penalty provisions established in the legislation. In conclusion, regulating cyber gambling offenses within the legal framework in Indonesia requires an improvement in the quality and quantity of investigators specializing in Information Technology and Electronics (ITE) at both the National Police Headquarters and Regional Police Offices. Investigators face challenges in identifying online gambling agents who use false identities and effectively apprehending and detaining offenders.

Abstract

The spread of promotional materials in the modern world is greatly helped by advances in technology. The wedding ran smoothly because of the actions of many people and groups, such as the wedding organizer (WO). This study aims to explain the regulation of criminal acts and criminal liability for WO business actors who advertise underage marriages through social media and websites, as well as possible criminal penalties and sanctions that can be used against those who are responsible for advertising violations. This investigation is based on methods for analyzing descriptive-analytic studies, legal-normative analysis, and qualitative data. This legal writing is largely about studying a statewide collection of literature, data, and documentation for legal instruments. The results of the discussion explained that companies that encourage underage marriages violate Article 59(2)(d) of Law No. 35 of 2014 concerning Child Protection. Law Number 16 of 2019 concerning Marriage Article 7 Paragraph 1 states that underage child marriage is invalid. This is because it is against the law because you have to be 18 years old to get married. Article 8 paragraph 1 letter an of Law Number 8 of 1999 concerning Consumer Protection states that WO business actors advertising underage child marriages is against the law. As stated in the first sentence of article 27 of Law Number 19 of 2016 concerning ITE, it is a crime to advertise in a way that is against the law and is not in accordance with statutory regulations. When the subjective and objective requirements of Article 20 jo. Article 60 paragraphs (1) and (2) of Law No. 8 of 1999 concerning Consumer Protection and Article 45 paragraph (1) of Law No. 19 of 2016 concerning Information and Electronic Transactions are fulfilled, the perpetrators can be held accountable for their actions.

Abstract

Pelecehan seksual terhadap anak meningkat setiap tahun dapat dilihat dari data Tahun 2019 dengan jumlah 216 kasus sampai Tahun 2021 sebanyak 953 kasus. Tahun 2023 jumlah anak di Medan sebanyak 76.101 jiwa sehingga perlu upaya mencegah kekerasan seksual agar jumlah anak di Medan terhindar dari kekerasan seksual. Penelitian bertujuan menganalisis pengaturan penghapusan kekerasan seksual pada anak, menganalisis upaya penanggulangan kekerasan seksual pada anak. Metode penelitian menggunakan metode Yuridis Empiris, melakukan wawancara narasumber. Kekerasan seksual pada anak merupakan kejahatan kekerasan fisik dan nonfisik, diatur pada Pasal 4 huruf a, b, Pasal 5, Pasal 6 huruf a, b Undang-Undang TPKS No.12 Tahun 2022. Upaya penanggulangan kekerasan seksual sesuai Undang-Undang Perlindungan Anak diatur dalam Pasal 76D, 76E, Pasal 81 ayat 1, Pasal 82 ayat 1 dan pada Pasal 1 ayat (3), Pasal 5 Peraturan Pemerintah No. 70 Tahun 2020 tentang Kebiri Kimia merupakan upaya penanggulangan kekerasan seksual pada anak secara penal. Upaya penanggulangan kekerasan seksual terhadap anak secara non penal di sekolah dilakukan melalui sosialisasi penyuluhan kepada murid, peran orangtua memberi edukasi seks sejak dini, mengajarkan anak bagian tubuh yang tidak boleh disentuh, mengawasi penggunaan handphone, peran KPAI untuk memberikan pengawasan dalam memeriksa, memantau, mengevaluasi pelanggaran terhadap anak.

Abstract

The background of this research is that a will is considered void if it is made under threat or fraud. Threats or fraud can be carried out by parties who want to threaten by alternatively asking the heirs to refuse inheritance or by releasing inheritance rights. The heir who refuses the inheritance is considered never to be an heir because if he dies earlier than the heir, he cannot be replaced by his children who are still alive. The legal research method used in this research is normative juridical research which is research conducted or aimed only at written regulations with the nature of analytical descriptive research which is a method that functions to describe or give an overview of the object under study through data or samples and make general conclusions. Sources of data used in this study are primary and secondary data and analysis of qualitative data which is an observation of phenomena obtained from the data obtained in the form of descriptions, verbal information stated by sources in writing or orally. The result of this research is that provisions for the release of inheritance rights based on the Civil Code (Burgerlijk Wetboek) are regulated in 1057 to 1065 Burgerlijk Wetboek. In Article 1057 Burgerlijk Wetboek states that refusal must be expressly stated in a statement made by the clerk of the District Court in the area where the inherited property is located. Article 1058 Burgerlijk Wetboek states that heirs who refuse inheritance are considered not considered heirs. Article 1059 Burgerlijk Wetboek states that the portion of the inheritance from the person who refuses the inheritance falls into the hands of the person receiving the inheritance. The provisions of the law regarding heirs who are forced to relinquish their inheritance rights are regulated in Article 1065 which states that no one can be fully recovered from refusal of an inheritance, unless the refusal occurs due to fraud or coercion. Settlement of disputes by heirs if coercion occurs can be carried out through litigation, namely through an Unlawful Act lawsuit to the District Court in the area where the inheritance is located.

Abstract

Land is seen as something very valuable and must be maintained by indigenous peoples. This can be seen in the life of the Indonesian people in each area of ​​residence and apart from the Indonesian people, land also has an impact on the government, in which case the government has the authority to control the land in use and allotment to the community. The research method used is in the form of normative juridical which is viewed from the UUPA, government regulations related to the same matter as well as literature studies and the type of data used is the Mataram District Court Decision Number 36/Pdt.G/2021/PN.Mtr, Mataram High Court Decision Number 231/PDT/2021/PT.MTR, and Court Decision Number 2884K/Pdt/2022 and reviewed based on customary law in Mataram. The results of this study are in the Cassation Decision Number 2884 K.Pdt/2022, it has been proven that PT Pertamina is the owner of the customary disputed land which was originally claimed to belong to the Plaintiff, namely the families of Ida WJ Gedok and Ida Nyoman Oka, but because the evidence they have is Proof of Garuda Pipil or Temporary Registration Certificate that is not re-registered so that it cannot be used as legal evidence because it is no longer valid.

Abstract

In carrying out their duties and authorities, notaries are given legal protection as in Article 66 paragraph 1 of Law Number 2 of 2014 (UUJN). In the Constitutional Court Decision No.16/PUU-XVIII/2020, the judge rejected the lawsuit of the plaintiff PJI (Indonesian Prosecutors Association) on the basis that the plaintiff did not have legal standing. This study aims to analyze the Constitutional Court Decision No.16/PUU-XVIII/2020 regarding the examination and summoning of Notaries by the Prosecutor. This research, normative legal research, is conducted with a statute approach using the theory of authority, namely by reviewing and analyzing regulations related to the legal issues being addressed. The results show that the decision provides special protection to the duties of Notary, but also weakens the position of the Prosecutor in summoning the Notary. Article 66 of the UUJN overlaps with Article 1 paragraph (2) of the Prosecutor's Office Law which authorizes the Prosecutor as a Civil Servant with a functional position that has the specificity to carry out its duties, functions and authorities based on the law. Efforts need to be made by Prosecutors and Investigators to prevent and eradicate criminal acts involving Notaries without violating human rights and the rights of Notaries regulated by law.
